    ThisconstitutionofByeLaws,RulesandRegulationsshallbefollowedbytheHeadQuartersandCentersofAssociationofConsultingCivilEngineers(India).

    1. NameoftheAssociation: AssociationofConsultingCivilEngineers(India).2. RegisteredOffice: No.2,UVCEAlumniAssociationBuilding,KRCircle, BANGALORE560001.

    3. Purpose:

    3.1. ToencourageandfostertheidealsofprofessionalismintheCivilEngineeringfieldand

    topromotefellowshipandethicalconductamongstpracticingCivilEngineers.

    3.2. To promote and enhance the common interest of the Association and to act as aliaison between members and various statutory or nonstatutory authorities andmembers.

    3.3. Torepresenttotheauthoritiesandseekredressofthegrievancesofmembers.

    3.4. To interact, cooperate and work with other Associations, Institutions or bodies in

    Indiaandabroad,havingsimilarobjectivesandgenerallytotakeanyactionoractionswhichareincidentalandconducivetofurthertheobjectivesoftheAssociation.

    3.5. TocreateCentersoftheAssociationinotherplacesalloverthecountry,inaccordance

    withthenormsasspecifiedandstipulated,andtoworkatdifferentplacesandprovidecommon platform to act in the interest of the profession in general and society atlarge.

    3.6. Tomakerulesandregulationsandtake incidentalactionstogiveaffiliationstoother

    likemindedAssociations.

    3.7. To hold conferences, meetings or seminars and gatherings at Local, National orInternationalvenues;toconduct,manage,encourageorsponsortours inthecountryor abroadon the subjects related to theprofessionor the society in generaleither

    solelyor inassociationwithotherInstitutions,Associations,Societiesorbodies ortoparticipate in suchMeetings, Seminars,Conferences,Gatherings, Tours,Debates,orDiscussions, etc. held by other Associations, Institutions, Societies, Bodies orAuthorities.

    3.8. Topromoteandbringaboutawarenessamong thegeneralmembersof the society

    about the role of Civil Engineers as a necessity in contributing to the two mainattributesnamely,safetyandeconomy.

    3.9. Toensure implementationofstringent lawbytheconcernedGovernmentauthorities

    totakeupCivilEngineeringasaprofession,onlybyqualifiedCivilEngineers.

    3.10. TotakestepstorepresenttotheCentralGovernment,StateGovernments,andotherbodies,torecognizeandbringanactdefiningaProfessionalEngineer.

    3.11. Toresolvedisputesbetweenmembersonprofessionalmatters, ifrequestedtodoso

    bythepartiestothedispute,andtakeactionstofulfillthesame.

    3.12. To arrange for the publication and sale of Technical monographs on various CivilEngineering disciplines as also any other special publications like Proceedings ofSeminars,CommemorativeLecturesetc.,

    3.13. Toadvance,createnewandspecializedtechniquesinCivilEngineeringactivities;toset

    up, Operate, promote Research and develop Laboratories, Experimentalmanufacturing plants, and Test houses to carry out Research and developmentassignments;develop,buyoracquireand licenseorallowtheuseoftechnicalknowhow, Rights, Patents, Licenses, either as Owners or as Concessionaires and collectroyaltyontheuseofsuchspecializedtechniques,Rights,Patents,Licenses,etc.

    4. Authority:

    ThePresidentand/ortheSecretaryGeneraloftheAssociationisauthorizedtocorrespondwiththe Registrar of Societies and other Associations, Institutions, or other bodies in India andabroadasperdefinitioninCl.3.4.

    5. Funds:

    Any fundsgenerated throughactivitiesof theAssociation shallbeapplied to theobjectivesmentionedinthisMemorandumofAssociationandthesameshallbeusedforfurtheranceofobjectivesoftheAssociation.

    The Association shall achieve these objectives through the formation of Regions, Centers,Divisions and Special Interest Groups, holding of lectures, educational and instructionalprograms,Discussions,MeetingsandConferences forpresentinganddiscussingProfessionalpapers,PublicationofJournals,PeriodicalsandWorksofScience,Technology,LiteratureandArtpertainingthereto,givingofAwardsandPrizestorecognizeIndividualsandOrganizationsforachievementsofexceptionalmeritandanyotheractivitiesnecessary,suitableandproperforthefulfillmentoftheseobjectives.

    The territory inwhich theAssociationsactivitiesare tobeconducted shallprimarilybe theterritoryof theRepublicof India. Inorder topromote Internationalbrotherhood among itsmembersandtoensurethefulfilmentofitsobjectivescoveringprofessionalsspreadovertheglobalvillage,theAssociationmayextenditsactivitiesbeyondtheTerritoryofIndia.

    7. Regions:

    7.1. EastRegion:

    StatesofArunachalPradesh,Assam,Bihar,Jharkhand,Manipur,Meghalaya,Mizoram,Nagaland,Orissa,Sikkim,TripuraandWestBengalconstitutetheEasternRegion.

    7.2. NorthRegion:

    States ofDelhi,Haryana,Himachal Pradesh, Jammu& Kashmir, Punjab,UttarkhandandUttarPradeshconstitutetheNorthernRegion.

    7.3. SouthRegion:

    StatesofAndaman&Nicobar islands,Telangana,AndhraPradesh,Karnataka,Kerala,Lakshadweep,Pondicherry,TamilNaduandTelanganaconstitutetheSouthernRegion.

    7.4. WestRegion:

    States of Chhattisgarh, Maharashtra, Madhya Pradesh, Rajasthan, Gujarat and GoaconstitutetheWesternRegion.

    7.5. UnionTerritories:

    Union Territories as defined by the Constitution of India, will be affiliated to therespectivegeographicalregioninwhichsuchUnionTerritoriesaresituated.

    NOTE:Newer States/Union Territories as andwhen formed in future,will belong to the same region towhichtheoriginalstate(fromwhichthisnewState/UnionTerritoryiscarvedoutof).ThisshallbenotifiedbytheGCandratifiedinthesucceedingAGM.

    8. MembershipTerritory:

    8.1. Eligibility:

    AnypersonorInstitution/OrganizationsubscribingtothepurposesoftheAssociationshallbeeligibleformembershipinaccordancewiththisConstitutionandByelaws.

    8.2. Grades:TheAssociationshallhavegradesofmembership.Thequalifications,privilegesandtherequirementsforadmission,transferandseverancepertainingtoeachgradeshallbeasstatedintheByelaws.

    8.3. Duesandfees:

    The dues and fees shall be as specified in the Byelaws. Under exceptionalcircumstances,thepaymentofduesandfeesmaybedeferredorwaivedinwholeorinpartbytheGoverningCouncil,hereinafterreferredtobrieflyastheGC.

    8.4. Accounts:Income,gains,fundsandassetsoftheAssociationshallbespentonlyonthepurposesoftheAssociationasatCl.5andnopartofitshallbedistributedtoanyorallmembersoftheAssociation.TheAssociationdoesnotexistforthepurposeofprofit.

    9. GroupsofMembers: The establishment of groups of members given below, for promoting the objectives andinterestsoftheAssociation,theoperatingrulesandtheterminationoftheirexistenceshallbeasprovidedintheByelaws.

    9.1. Regions:

    The geographical areas in the territoryofACCE (I) shallbe grouped intoRegions asgiven intheByelaws.TheVotingMembersofeachRegionshallelectaRegionalVicePresident,asspecified intheByelaws.However, ifaRegionhas lessthan100voters,noRegionalVicePresidentwillbeelectedforthisRegion; insteadthePresidentshalltakeupthisrolepersonally,unlessotherwisetheGoverningCouncilnominatesaVicePresident for theRegion,keeping inview theneed forgrowthof theAssociation inthatRegion.

    9.2. DivisionsandSpecialInterestGroups(SIG):ThetechnicalareasandinterestscoveredbyACCE(I)shallbegroupedintoDivisions.Division:ADivision isadomainofGeneralspecialityunderthebranchofCivilEngineering.ForexampleGeotechnicalDivision shallbeGeneral SpecialityDivision,underwhichallotherareasof interestofSuperSpecialization,pertainingtoGeotechnicalEngineeringshallbegrouped.SpecialInterestGroup(SIG):A Special InterestGroup (SIG) is a subunit ofDivision described earlier, formedbymembersof theAssociation,withdueapproval from theGoverningCounciland theGeneralBody, withthedesiretopursuesignificant longtermactivity inanemergingareaoraspecialityofACCE (I) interests.AssociationmayhaveasmanySIGUnitsasdecidedbytheGoverningCouncil.

    9.3. Centres:In theRegions there shallbeestablishedCentres comprisingof groupsofmembersresiding in specified geographical areas. TheVotingMembers of Centres shall electChairman,Secretary,TreasurerandManagingCommitteeMembers,asspecifiedintheByelaws.

    9.4. DivisionandSIGunits:

    IntheCentresthereshallbeestablishedDivisionandSIGUnits,hereinafterreferredinbrief asUnits, consisting of the Centrememberswho aremembers of a particularDivision,exceptwhereexplicitlyprovidedotherwiseintheByelaws.

    9.5. StudentCenters:In the Region there shall be established Student Centers comprising of groups ofStudentMembersandothers residing inspecifiedgeographicalareas,asspecified intheByelaws.

    9.6. Dissolution:Intheeventanyoftheabovegroupsaredissolved,allAssetsandFundsheldbythemshall become the property of the Association, by transferring the same to theHeadquartersaccount.

    10. Management:

    ThemainbodiesoftheAssociationshallbethefollowing:10.1. GeneralBody10.2. TheGoverningCouncilatHeadquarters.10.3. TheManagingCommitteeatCenters.10.4. TheExecutiveCommittee.10.5. TheCorporateOfficers,alsoreferredtoastheOfficeBearers,and10.6. TheThinkTank

    The General Body, the Governing Council, the Managing Committee and the ExecutiveCommitteemaydesignateorappointCommitteesforSubCommitteesunderthemandconfersuchpowersthatnormallycomeundertheircompetence,astheydeemnecessarytofulfilthefunctionsassignedtothem.

    10.1. GeneralBody(Headquarters):

    10.1.1. CompositionandVotingRights:

    TheGeneralBodyoftheAssociationshallconsistofallVotingMembers,asdefinedintheByelaws,whoshallhaveonevoteeach.

    10.1.2. Authority:

    TheGeneralBodyshallbethesupremeauthorityoftheAssociation. Itshall legislate,guideanddirecttheAssociationinallitsactivities.Inparticular,butnotrestrictedto

    a. Receive,reviewandaccepttheannualreportandtheauditedaccountsandshall

    appointtheauditorb. Ratifytheestablishmentandterminationof IndividualMemberand/orGroup/s

    ofMembers.

    c. Electmemberstotheoffices,asspecifiedintheByelawsd. Decide the venue/s of all the Annual Conventions along with the name the

    Chairman of the Organizing Committee and the Program Committee of theAnnualConvention/shereinafterreferredtoasOCandPC

    e. Name the inheritingbodywithsimilarpurposesasACCE (I) in theeventof thewindingupoftheAssociation.

    10.1.3. QuorumandMajority:

    a. FifteenpercentofEligiblevotersoronehundredofthetotalVotingMembers,asrecorded intheofficialACCE(I)membershiprecordsattheendofthepreviousyear,whicheverisless,shallconstituteaquorum.Howeverwhenthemeetingiscalledtoorderatthestipulatedtime,andifnumberofmemberspresentdonotfulfilltherequirementofthequorum,theChairmanofthemeetingshalladjournthemeetingbyhalfanhour.Afterthelapseoftheadjournedtime,whateverbethenumberofpresent for themeeting, it shall constitute thequorum for theproposedmeeting.

    b. DecisionsoftheGeneralBodyshallbetakenbyasimplemajorityofthosevotingunlessotherwiseprovidedintheConstitutionandByelaws.

    10.1.4. Meetings:

    a. TheGeneralBodyoftheAssociationshallordinarilymeetonceinthefiscalyear,brieflyreferredtoastheYear,normallyattheAnnualConventionthisMeetingbeingreferredtobrieflyastheAGM.

    10.2. GeneralBody(Centers):

    10.2.1. CompositionandVotingRights:

    TheGeneral Body of the Association at a Center shall consist of all eligible VotingMembersaffiliatedtotheCenter,asdefined intheByelaws,whoshallhaveonevoteeach.

    10.2.2. Authority:

    TheGeneralBodyshallbethesupremeauthorityoftheAssociationattheCenter. Itshall legislate, guide and direct the Center in all its activities. In particular, but notrestrictedto

    a. Receive,reviewandaccepttheannualreportandtheauditedaccountsandshall

    appointtheauditorb. Recommend the establishment and termination of IndividualMember and/or

    Group/sofMemberstotheHeadquartersGeneralBodyafterratificationattheGoverningCouncil.

    c. Electmemberstotheoffices,asspecifiedintheByelaws

    d. Decide the venue/s of all the Annual Conventions along with the name theChairman of the Organizing Committee and the Program Committee of theAnnualConvention/shereinafterreferredtoasOCandPC

    10.2.3. QuorumandMajority:

    c. Fifteen percent of Eligible voters or one hundred of the total eligible VotingMembersaffiliatedtotheCenter,asrecordedintheofficialACCE(I)membershiprecords at the end of the previous year, whichever is less, shall constitute aquorum.Howeverwhen themeeting is called toorder at the stipulated time,andifnumberofmemberspresentdonotfulfilltherequirementofthequorum,theChairmanofthemeetingshalladjournthemeetingbyhalfanhour.Afterthelapse of the adjourned time, whatever be the number of present for themeeting,itshallconstitutethequorumfortheproposedmeeting.

    d. DecisionsoftheGeneralBodyshallbetakenbyasimplemajorityofthosevotingunlessotherwiseprovidedintheConstitutionandByelaws.

    10.2.4. Meetings:

TheImmediatePastPresidentshallbeexofficioandvotingmemberoftheCouncil,butarenottobeconsideredasOfficeBearers. InadditionthereshallbeCooptedMemberson the Governing Council as per byelaws, who are also eligible to vote on allresolutionstakenupforconsideration.

    10.3.2. Authority:

    TheGoverningCouncil shalladminister theAssociation through thepreparationandmaintenance of various operational manuals and make all decisions except thosespecially reserved for the General Body and shall advise the General Body on allmatterscomingupfordecision.

    10.3.3. QuorumandMajority:

    TheGoverning Council shall be able to conduct business if at least one third of itsmembers arepresent for anymeeting convened,which shallbe termed as the GCMeeting.DecisionsoftheGoverningCouncilshallbetakenbyasimplemajorityofthememberspresent.

    10.3.4. Meetings:

    The Governing Council shall meet every calendar Quarter, and compulsorily at theAnnualConvention,prior to the AGM. Itmayhoweverbeconvenedatany timebythePresident,whenhe/shedeems itnecessary. It shall alsobe convenedupon therequestofamorethanonethirdofthemembersontheGoverningCouncil.Noticeofsuchmeetingshallbedispatchedwithintendaysofreceiptofsuchvalidrequest,andthemeetingconvenedandheldwithinfortydaysofreceiptofsuchvalidrequest.ThismeetingshallbecalledastheExtraOrdinaryGoverningCouncilMeeting.

    10.4.2. Authority:

    TheManaging Committee shall administer the Center through the preparation andmaintenance of various operational manuals and make all decisions except thosespecially reserved for theGeneral Body of the Center and shall advise theGeneralBodyoftheCenteronallmatterscomingupfordecision.

    10.4.3. QuorumandMajority:

    The EC shall be composed of the Office Bearers of the Headquarters and VicePresidents.Everymemberof theEC shall continue toholdoffice anddischarge theduties until a successor takes his place after the Elections are held in the year ofelections.

    10.5.2. Authority:

    TheECasawholeorthroughtheofficers,shallconductthedaytodayoperationsoftheAssociation.TheECshallapproveascheduledbanktodepositthefundsreceivedbytheAssociationnotinconsistentwiththedecisionsoftheGCandtheAGM.TheECshall also designate the Officer(s) authorized to execute withdrawals thereon notinconsistent with the decisions of the GC and the AGM. The interpretation of thisConstitutionandByelawsdoesnotrestswiththeEC.

    10.5.3. QuorumandMajority:

    TheECshallbeabletoconductbusinessifatleastonethirdofthemembersoftheECarepresent.Decisionsof theECshallbe takenbyasimplemajorityofthememberspresent.

    10.5.4. Meetings:

    TheECshallmeetregularlyduringtheyearondatesandplacesdecidedby it.Itshallalsobe convened,within tendays,upon the requestofmore thanonethirdof theMembersoftheEC.

    10.5.5. NominatedMembers:

    ToensurethatEChasrepresentationfromallareasoftechnologyandallsectionsofAssociation,thePresidentinconsultationwiththeSecretaryGeneral,willnominateupto twoECmembers foraoneyear term.Thesenomineescouldbe reappointed foranotheroneyear term.However, thesenominatedmemberswouldnothavevotingrights.

    All EC Members will communicate plans for their respective areas to the EC andpublishontheACCE(I)website/ACCE(I)Communications,onregularbasisduringtheyear.

    10.6. OfficeBearers:

    10.6.1. Composition:

    TheOfficebearersoftheACCE(I)shallbethePresident,theVicePresidents,SecretaryGeneral, and the Treasurer (HQ). The Secretary General will act as Secretary ofGoverningCouncil.

    10.6.2. Authority

    TheOfficeBearersshallperformthesefunctions:

    a. The President shall be the principal officer responsible in taking further the

    ObjectivesoftheAssociationinamannerbefittingthestatusoftheAssociationandshallpresidethatthemeetingsoftheGeneralBody,theGoverningCouncil,theEC and themeetingsof anyotherbodiesas specified in theByelaws.ThePresidentshallhavenovotetomoveanyresolution.However ifthevotescastare equally divided on any resolution, then the President shall exercise thedeciding vote. The President may visit groups of members and promote theobjectivesofACCE(I).

    b. The VicePresident in their respective Region, shall assist the President incarrying out the organizational duties and in the absence or incapacity of thePresidentassumethedutiesofthePresident.

    c. TheSecretaryshallmaintaintherecordsofactivities,membershipandanyotheraspects of the Association as required by the law. The Secretary shall beresponsible for the arrangements of all meetings of the General Body, theCouncilandtheECandsuchotherspecifiedintheByelaws.

    d. The Treasurer shall conduct the fiscal affairs of the Association and maintainrecordsthereof.

    e. In theeventof the absenceor incapacityofboth thePresident and theVicePresident,theECshallelect fromamongstthemselvesan interimPresident forthe period not longer than the unexpired term of the President. The InterimPresidentshallperformallthedutiesofthePresidentandVicePresidentduringtheperiod.

    10.7. TheThinkTank:

    10.7.1. Composition:

    TheACCE (I)ThinkTankconsistsofall thePastPresidents,ECmembers,andspecialinviteesbythePresident.

    10.7.2. Authority

    TheACCE(I)ThinkTankisanadvisoryforum,whichshallmeetatleastonceeveryyearpriortotheAGMandonanyotherdateasdecidedandfixedbytheExecutiveCouncil.

    11. Recall:

    AnyelectedmemberoftheAssociationmayberecalledbyavoteofthemembership.AtwothirdsvoteoftheGoverningCouncilorapetitiontotheGoverningCouncilbythreepercentofthetotalmembershipoftheconstituencythatelectedthemembertotheGoverningCouncilshall cause a specialballot tobedirected and scheduledby theGoverningCouncil.A twothirdsmajorityofthevotescast,providedat leastonethirdofthemembershiphascasttheballots, shall be required for the immediate removal of the member from the GoverningCouncil.Theprocedureforthedeclarationoftheresultshallbethesameasfortheelections.

    12. Vacancies:

    Theexistenceof a vacancy in theGoverningCouncil shallbedeterminedby theGoverningCouncilwhichshallfillsuchavacancyforaperiodnotexceedingtheunexpiredtermofthatoffice.

    13. Dissolution:

    a. TheAssociationshallnotbedissolvedunlessthreefourthsoftheVotingMembers,aspertheofficialrecordsoftheACCE(I)attheendofthepreviousyearataspecialballotheldforthatpurpose,voteforitsdissolution.

    b. TheAssociationshallbedissolvedvoluntarily,wheneveraSpecialResolutioninthatbehalf

    is passed by an Extra Ordinary General Body Meeting convened specifically for thatpurpose.

    c. Amalgamation/dissolutionof theAssociation shallbeasper the relevantSectionsof the

    KarnatakaSocietiesRegistrationActinforce.

    d. The assets shallbe inheritedby abodyhaving similarobjects as thoseofACCE (I)dulydecidedbytheGeneralBody.

    e. Uponamalgamation/dissolutionoftheAssociationtheassetsandmoniesremainingwith

    the Association, after the satisfaction of its Debts and Liabilities, shall not be paid ordistributed among themembersof theAssociationbut shallbegivenor transferred toInstitution(s)withsimilarAimsandObjectiveswhich Institution(s)shallbedeterminedbythemajorityof votes castbymemberspresent inpersonorby validproxyduringExtraOrdinaryGeneralBodyMeeting,or indefaultthereofbytheCompetentcourtofOriginalJurisdiction,BangaloreDistrict,Bangalore.

    14. ASSOCIATIONSEAL:

    a. TheGoverningCouncilshallforthwithprovideacommonSealoftheAssociationforusebytheAssociationandshallhavepowerfromtimetotimetodestroythesameandsubstituteanewseal in lieuthereof.TheGCshallprovide forthesafecustodyofthesealwiththeSecretaryGeneralanditshallnotbeusedexceptbythewrittenauthorityoftheGCandinthepresenceofthePresidentand/orVicePresidentoftheAssociation.

    b. Deeds,Bondsandother legaldocumentsandcontractsunderSealmadeonbehalfoftheAssociation and signed by the President and Vice President and countersigned by theSecretaryGeneralorthepersonactingasSecretaryGeneral,shallbedeemedtobedulyexecutedandlegallybindingontheAssociation.

    15. Law:

    Anythingnotprovidedfor inthisConstitutionandByelawsshallbe inaccordancewithIndianLawonthesubject.

    16. Jurisdiction:

    Any legal petition concerning the Association and its business shall be filed only in courtshavingjurisdictionoverBangalorewheretheHeadquartersatpresentissituated.ForfilinganysuchpetitionpriorsanctionoftheGoverningCouncilshallhavetobeobtained.

    17. NominationsandElections:

    17.1. TheReturningOfficer,appointed inaccordancewith theByelawsshallsubmit to theMembersalistofnomineesforsuchofficesasmaybespecifiedintheByelaws,tobe

    elected byVotingMembers or groups of them. The ReturningOfficer shall submit,along with this list, the biodata and the statement of each nominee on how thenomineeintendstoservetheAssociation.

    17.2. The ReturningOfficer shall submit to all VotingMembers the names, biodata and

    statementsofallthenomineesforelectioninaccordancewiththeByelaws.

    17.3. Elections:

    TheReturningOfficershallsupervisetheconductoftheElections,thecountingoftheballots and communicate the results to the Governing Council and the AGM fordeclaringtheresults,actingwithintheframeworkofthesetofRulesandRegulationsasgivenintheByelaws.

    18. QuestionsofImportance:

    18.1. Questions of Importance briefly referred to asQuestionsmay include any questionrelating to the policies or public position of the Association, affiliation with otherSocietiesorholdingofbusinessmeetings.

    18.2. TheCouncilorpetitionbyonehundredVotingMembers, indicating clearly the lead

    petitionerforcorrespondence,canraiseaQuestion.

    18.3. ThecommunicationoftheQuestiontotheVotingMembersthroughapublicationthatisdistributedtotheentiremembership,orbyanoticemailedseparately,ifurgencysorequiresaskingthemspecifically fortheirviewswithinthirtydaysofthemailingandtheirpresentationtotheCouncilforinspectionisconsideredadequate.

    18.4. For aQuestion tobe submitted specifically for thepurposeof taking a voteon the

    Question,One thirds of theGoverning Council or petition by onethird of the totaleligibleVotingMembersshallbenecessary.Thescheduleofballotinganddeclarationof resultshall follow thereafter theschedule for theelection. Ifurgencyso requires,theGCmaydirectaspecialballot tobeheld todecideonQuestionsof Importance,independentlyoftheschedulefortheannualelections.

    18.5. Thevoteofamajorityofthemembersballoting,providedthetotalnumberofballots

    castisinfavorofaresolutionisnotlessthanseventypercentoftheeligiblevotescastduringthemotionoftheresolution,shallbebinding.

    19. Amendments:

    19.1. NoproposalforchangeofByeLaws,RulesandRegulationsshallbedeliberatedatanymeetingoftheGoverningCouncil/AnnualGeneralbodyMeeting,unlesstheproposedchanges/alterationhasbeencirculatedtoalltheMembersforopinionandunlessduenotice of it has been given in the agenda of the meeting of the GoverningCouncil/AnnualGeneralbodyMeeting.

    19.2. Any amendment to the ByeLaws, Rules and Regulations will be valid only whenapprovedbythreefourthmajorityofthememberspresentandvotingattheAnnualGeneralbodyMeetingorExtraOrdinaryGeneralbodyMeetingoftheAssociationandshall come into effect immediately after it is passed, unless otherwise specified forreasons, based on the conditions considered, deliberated and imposed during the

    Annual General body Meeting, or Extra Ordinary General body Meeting of theAssociation.

    19.3. AnychangewithregardtotheByeLaws,RulesandRegulationsshallbe informedto

    theRegistrarofSocietiesforapproval.NoresolutionforamendmenttotheByeLaws,RulesandRegulationsbe forwarded to theRegistrarofSocietiesunlessapprovedatthe Annual General body Meeting or Extra Ordinary General body Meeting of theAssociation. Any resolution or amendment to the ByeLaws, Rules and Regulationshaving special reference to any of the Centre/s, may be forwarded by the HeadQuarterstotheconcernedCentre/sonlywiththepriorapprovaloftheAnnualGeneralbody.

    19.4. Whenever there is a dispute in interpretation of Articles and Byelaws of this

    constitution,thedecisionoftheGoverningCouncilandtheAnnualGeneralBodyshallbefinalandbindingonalltheMembersandCenters.

    19.5. Whenever there is a dispute in interpretation of Articles and Byelaws of this

    constitutionwithregardtoElections,aftertheElectionprocesshasbeensetinmotion,thedecisionoftheReturningOfficershallbefinalandbindingonalltheMembersandCenters.

    19.6. AfterthenotificationoftheElectionsinanelectionyear,thethensetofcurrentOfficebearers, shall not interfere in the electoral process and shall position themselvesneutral.

    19.7. Amendments shall take effect thirty days after adoption. However, the status of a

    member of the EC already in office, shall not be effected by an amendment. Themembershallcontinuetoserveinthatcapacitytillthetermofofficeexpires.

    4.1.2. Allmemberswill be required to give an undertaking to the effect that they

    wouldabidebytheACCE(I)CodeofEthics.TheCodeofEthicswillalsospecifytheprocedure fortheactiontobetakenagainstconcernedmembersforanybreachofthisCode.

    4.1.3. FollowingistheCodeofEthicspreparedbytheGCandadoptedafterapproval

    4.1.5. AsregardstheirOrganization,ACCE(I)membershould:

    A. Act with integrity in carrying out the lawful policy and instructions of theirorganizationandupholditsimageandreputation.

    B. Plan, establish and review objectives and tasks for themselves and theirsubordinates which are compatible with the Codes of Practice of otherprofessionals in the enterprise, and direct all available effort towards thesuccessoftheenterpriseratherthanofthemselves.

    4.3.6. HONORARYFELLOWMEMBER:

    Thefollowingcriteria,istobefollowedforconferringHonoraryFellowmembershipoftheAssociation,oneminentCivilEngineeringPractitioners.

    A. AsandwhenitdeemsfittheGoverningCouncilatitsdiscretionmayadmitbynomination, anHonorary FellowMember,who is a qualified Practicing CivilEngineer of repute,with at least 25 years ofprofessional practice, having abasic Diploma or Bachelors Degree or equivalent inCivil/Transportation/Environmental Engineering or Construction TechnologyfromaUniversity/Institution/Board,recognizedbyAICTEand/oranequivalent

    authority,asperanActofGovernmentofIndiaand/orState.

    AND

    B. Nomination for an Honorary FellowMember shall be proposed by not lessthanfiveFellowmembersoftheassociation.

    D. Those who are already admitted as members earlier than the adoption ofthese Bye Laws, shall continue to be Honorary Fellow Members of theAssociation.

    4.3.7. ORGANISATIONMEMBER:

    Any Firm/Organization/Institutions, interested in theobjectsof theAssociation fromamongthefollowingmaybeadmittedasOrganizationmember:

    A. Organizations offering Consultancy services in various disciplines of Civil

    Engineering.B. Organizations involved in publication of Books, Journals, Proceedings,

    Monograms,etc.invariousdisciplinespertainingtoCivilEngineering.C. InstitutionsimpartingeducationinthebranchofCivilEngineeringatalllevels.D. OrganizationsinvolvedinCivilEngineeringConstructionandManagement.E. Government,Public,SemiPublic,NGOsAutonomousandPrivateOrganizations

    engagedinactivitiespertainingtotheartofCivilEngineeringF. Organizations/Institutions, which, in the opinion of the GC will further the

    objectivesof theAssociationandbeof relevance to theneedsof theSocietyandtheProfessionofCivilEngineering.

    G. Organizations/InstitutionswhoaremembersoftheAssociation,shallhavetheprivilegetonominatethreeoftheirfulltimeemployeestobemembersoftheAssociationastheirrepresentatives.

    H. Nominated member/s of an Institution/Organization shall cease to be amember of the ACCE(I) on severance of their employment with theInstitution/Organization,orifthemembershipoftheInstitution/Organizationisterminated.

    Inadditiontotheabove,Organizations/InstitutionsseekingmembershiptotheAssociationshallhaveto:

    I. Agree to abide by the Rules and Regulations of theAssociation in force andagreetofurthertheobjectsoftheAssociationtothebestofonesability.

    J. SubmitasignedcopyoftheprevalentCodeofEthicsatthetimeofadmissionandthereafterasandwhenmodifiedduringthetenureoftheMembership.

    Organizations/InstitutionswhoseMembership applicationhasbeen approvedby theGCandhavepaidtherequisitefeesasapplicableuponadmissionandarenotinarrearsofanysubscription to the Association on the date of reckoning are to be considered asOrganizationalMembersoftheAssociation.

    4.4. SpecialCases:

    The Governing Council of the ACCE(I) may, in special cases, take into account theparticular experience of a person in a relevant field and modify or waive therequirementof the time factoror references foradmissionor transfer toonegradehigherthanthegradeforwhichtheapplicantwouldhavebeeneligibleinthenormalcourse.

    4.5. Upgradationand/orTransferofmembership:

    ApplicationsforadmissionortransferfromoneCentertoanotherorfromonegradetoanother,orboth, shallbemadeon the formsavailable for thispurpose from theOfficeoftheACCE(I)anduponpayingthespecifiedMembershipfees.

    4.6. Validation:

    Thepersonsnamedasreferencesshallcertifythecorrectnessofthestatementsmadeintheapplication,frompersonalknowledgeoronexaminationofevidenceproducedby the candidates. In addition they shall mail direct to the Office of the ACCE (I)reports,inconfidence,onformssuppliedtothembytheapplicant.

    4.7. Reapplication:

    AcandidatewhoseapplicationforAdmissionasanewmemberorforUpgradationofMembershipstatusorfortransferfromoneCentertoanotherCenter,hasbeenputonhold or has been rejected for any specific reason attributable for such action,mayreapplyaftertheexpiryofoneyearfromthedateofrejection.

    4.8. DiscountedMembershipFee:

    If the applicant is over 65 years of age, and upon their seeking admission formembership of the Association under the Fellow Category, GC may consider adiscountedmembership fee for applicants eligible under this category, as a specialgesture.HoweverthisisnotapplicableforupgradationofstatusofMembershipofanexistingMemberoftheAssociation.

    4.9. REGISTEROFMEMBERS:

    4.9.1. Headquarters and Centers shall compulsorily maintain a separate register ofmembersforallcategoriesofmembershipoftheAssociationincorporating:

    i. MembershipNumber,ii. DateofAdmission,iii. Name,iv. Qualification,v. LandlineTelephonenumber,vi. MobileTelephonenumber,vii. Emailid,viii. Addressforcorrespondence,

Officebearerpostsheldtermanddesignation,xiv. Anyspecialrecognition,awardsorachievementsconferred,xv. RecordofanyspecialcontributiontothegrowthoftheAssociation,xvi. UpgradationofmembershipDateandCategorytowhichupgraded,xvii. DetailsofparticipationineventsconductedbytheAssociation,etc.,xviii. Nature,designationandplaceofwork,xix. Domainexpertise,xx. DetailsofmembershipofotherProfessionalbodies.

    4.9.2. The Association shall maintain the roll of membership for different annual

    subscription based membership subcategories, and also prepare the list ofmembers,whosemembershipsubscriptionisfullypaidandcurrent,toparticipatein the General Body Meeting of the Association and Elections as and whenconductedaspernorms.

    4.9.3. Theseregistersshallbeupdatedregularlyincorporatingallthechangesinthedata

    asandwhenrequiredbasedontheneed,seekingadditional information/dataasandwhennecessary.

    4.9.4. These registers shallbeupdatedconcurrentlybothat theHeadquartersand the

    Centrequarterly.

    4.10. FORMOFAPPLICATION:

    4.10.1. ForallcategoriesofmembershipexceptHonoraryFellowMembership,dulyfilledandsignedapplicationform,tosignifyacceptanceoftheseByeLawsandtheRulesand Regulations of the Association in force at that time, along with necessarysupportingdocumentsasrequired,havetobesubmittedtotheOfficeoftheHQ.

    4.10.2. The applicant shall be introduced by a Current Member of the Association

    correspondingcategoryoraboveoftheapplicant.

    4.10.3. Applicable admission fees shall be paid in advance by Demand Draft/Multicitycheque/eTransfer,drawn in favourof AssociationofConsultingCivilEngineers(India)payableatBangaloreonly.

    4.10.4. The application forms will be processed by the Administrative staff of theAssociation,andplacedbeforetheGCforconsiderationandnecessaryapproval.

    4.11. DuesandFees

    4.11.1. Subscription to be charged shall be as per resolutions passed in the AGM andprintedinthecurrentapplicationforms/website.

    4.11.2. Onexpiryofthe financialyeartillthedateofthenextAGMthesubscription for

    therenewalshallbeacceptedbytheGoverningCouncil.

    4.11.3. The Members, Associate Members, Organization Members will cease to haveprivileges given to them till the subscription in advance is paid for the currentfinancialyear.

    4.11.4. The Governing Council shall have right to alter the rate of subscription or

    admission fee for members with the concurrence of the General Body or byreferendumasprovidedinCl.8.5.

    4.11.5. TheMembershipDuesshallbedecidedandapprovedbytheGoverningCouncil.

    4.11.6. TheEntranceFeeshallbedecidedandapprovedbytheGoverningCouncil.

    4.11.7. Theentrancefee,theannualduesandotherassessments,ifany,shallbepayablewiththeapplicationforadmission.Anoticethathehasbeenelectedshallbesenttoeverynewlyadmittedmemberandheshallenjoyalltherightsandprivilegesofhisgrade from the firstdayof thecalendarmonthafterelection,exceptwhereexplicitlystatedotherwise.

    4.11.8. Shouldthecandidatefailforadmissiontothemembership,heshallbeadvisedto

    seek admission to a suitable grade or reapply as per theByelaws and the sumremittedwiththeapplicationshallberefunded.

    4.11.9. AretiredCivilEngineeringProfessional,asperdefinitionofCivilEngineerCl:4,not

    gainfully employed, and over the age of sixtyfive years, may apply formembershipatareducedfees/dues,whichshallbefixedbytheGoverningCouncilinconsultationwiththeGeneralBody.

    4.11.10. TheGoverningCouncilmay, under exceptional circumstances,waivedues for a

    period and declare that during the period of such waiver, the member hasmaintainedcontinuousmembership.

    4.11.11. ForupgradationofMembershipforexistingmembers,fullfeesaspernotification

    prevalentatthattimeshallbepaid.

    4.12. Billing,terminationandReinstatement:

    4.12.1. Billing:

    4.12.1.1. TheannualSubscriptionperiodisApril1sttoMarch31stnextCalendaryear.Abillcoveringtheseduesandotherassessmentsshallbemailedtoeverymember not later than February 28th, and shall be paid not later thanMarch 31st of the Calendar Year. Student Members, however, will havemembership from July1st to June30thnext.Abillingcovering theseduesandotherassessmentsshallbemailedtoeverystudentmembernot laterthanMay15th,andshallbepaidnotlaterthanJune30th.

    4.12.1.2. The mailing of bills or statements to the address of a member on therecords of the Association shall be considered as a valid notice ofindebtedness.

    4.12.2. Termination:

    4.12.2.1. Failure topay thesubscriptionamount in fullonorbefore thestipulatedduedateshallresultintheterminationofmembership.

    4.12.2.2. Amemberwhosesubscription is inarrears fortwomonthsshallnotvote

    foranypurposewhatsoeveruntilsucharrearshavebeenclearedandifhecastshisvote, itshallnotbecounted.Amemberwhosesubscription is inarrears for more than three months shall lose all the privileges ofmembershipuntilhissubscriptionhasbeenpaidandtheGoverningCouncilmay at their discretion, order the removal of the defaulting membersnamefromtheRegisterofmembers

    4.12.2.3. Anymemberwhoceasestobeamembershallneverthelessremain liable

    forand shallpay to theAssociationallmonieswhichat the timeof suchmemberceasingtobeduefromhim/hertotheAssociation.TheGoverningCouncilshallhavethepowertowaiveeitherfullyorpartlythesubscriptioninarrearsintheeventofsuchamemberseekingreadmission.

    4.12.2.4. TheGCshallhavetherighttoexpelfromtheAssociationanymemberwho,intheopinionoftheGC,willfullyacted incontraventionoftheByeLaws,Rules andRegulations from time to time in forceunder theByelaws,orwho, in the opinion of theGC, shall have been guilty of violation of theCodeofEthicsasperclause4.1and itssubclauses,asframed/modifiedby theGC from time to timeorsuchconductasshallrenderhimunfit toremainamemberoftheAssociation,providedthat:

    a) The meeting of the GC at which the resolution is passed shall be

    specially convened for the purpose, and the person concerned shallhavebeengiven thirtydaysnotice thathisconduct is tobeenquiredinto,andisgivenanopportunity,ofstatinghiscasetotheGC,inperson.

    b) Upontheresolutionofexpulsionbeingpassed,thenameoftheperson

    concernedshallberemovedfromtherollandheshallceasetohaveanyconnectionwiththeAssociation.NeithertheGCcollectivelynoranyofitsmembers individually,shallbemade liable foranythingdoneunderthisByelaw. Every candidateapplying forelection to theAssociationshallbedeemedinsoapplyingtoagreetoacceptasfinalanydecisionoftheGCunderthisByelaw.

    c) TheexpelledpersonwhohasceasedtobelongtotheAssociationshall

    be called upon by the Secretary General to return immediately hismembership certificate to theSecretaryGeneral,andhe/she shallnotbe entitled any longer tomake use of any designation implying pastconnectionwiththeAssociation.

    d) Majorityoftwothirdsormoreofthetotalnumberofmembersvoting

    inpersonmay,by resolutionpassed at an annualor anextraordinarygeneral meeting expel any member who in their opinion is guilty ofconduct contrary to the interests of the Association and any suchmembershallceasetobeamemberoftheAssociationfromthedateof

    passingthisresolutionbutmaybeproposedagainformembershipaftertheexpiryoftwelvecalendarmonthsfromthatdate.

    4.12.2.5. TheGCshallalsohavetherighttotakeanydisciplinaryactionagainstany

    memberwhoshallhave, intheopinionoftheGC,acted insuchamanneras towarrant disciplinary action, but not expulsion. The procedure laiddownintheByelawCl:4.12.3shallbefollowedinsuchcasesalsoandthedecisionoftheGCshallbefinalandbindinguponthememberconcerned.

    4.12.3. PROCEDUREFORACTIONAGAINSTANACCE(I)MEMBERFORAVIOLATION:

    ThisprocedureaimsatsettingoutastrategyfordealingwithviolationsbymembersoftheCodeofEthicsoftheACCE(I).ThetermmembersincludesInstitutionalmembersindividually,aswellascollectively.4.12.3.1. Complaints:

    Allcomplaintsshallbemadeinwritingwithinthirtydaysoftheviolationbeingnoticed.These may be addressed to any Office Bearer at a Center or a member of theGoverningCouncil.Thecomplaintshouldincludethefollowinginformation:

    a. Dateofevent;person/personinvolved.b. Placeofeventandcircumstances.c. NatureofViolation.d. Witnesses

    4.12.3.2. SequenceofAction:

    a. ThePresidentwillsendthecomplainttotheDisciplinaryCommitteeoftheACCE(I)

    appointedbytheGoverningCouncil.

    b. TheDisciplinaryCommitteewouldmeetandtakethefollowingactions:

    c. Ifthecaseisclearcut,getwrittenexplanationsfromvariouspartiesandsetadateforhearing.

    d. Carryoutinvestigation,byvisittothelocation,ifnecessary.

    e. Fixadateforaformalhearing.

    f. Thehearingwouldgointoevidencesofferedandallowwitnessestobesummoned

    andexamined.

    4.12.3.3. Findings:

    Findings of the committee would depend on merit of each case and theirrecommendationtotheGoverningCouncilmaybe:

    a. Honorableacquittal,b. Removalfrommembership,c. Anyother.

    ThereshallbeNoappealonthedecisionoftheGoverningCouncil.ThedecisionwillbepromulgatedthroughtheACCE(I)Communications.

    4.12.4. Reinstatement:

    4.12.4.1. MembershipsoterminatedunderCl:4.12.2exceptunder4.12.2.4,canbe

    resumedwithno lossof continuity,uponpaymentof alldues andotherassessments, ifany, inarrears.Membershipmayalsobe resumedafteralapse,without continuity ofmembership upon payment of current duesandassessments,ifany.Ifthelapseofmembershipequalsorexceedstwoyearsanewentrancefeeshallbepaiduponrenewingmembership.

    4.12.4.2. On the resumptionofmembership, the rights andprivilegesofhis gradeshall be restored from the first day of the next calendarmonth, exceptwherestatedexplicitlyotherwise.Publicationsthathewouldhavenormallyreceivedduring the interimperiod,hadhismembershipbeencontinuousshallbeconsideredforfeited.However,uponwrittenrequestthesewillbesupplied,ifavailableatcosttobedulyfixedbytheGC.

    4.13. Resignation:

    4.13.1. A member in good standing may resign from membership of ACCE(I), by

    submittingawrittenresignationlettertoSecretaryGeneralofhis/herintentiontodoso,butsuchnoticemustreachhimat leastonecalendarmonthbeforethe31stofMarch ineachyear,failingwhichthememberwillalsobe liabletotheAssociationforsubscriptionforthefollowingoneyear.

    4.13.2. A resignedmembermay resumehismembership, subject to theapprovalof

    the GC, upon payment of current dues and other assessments, if any. Noentrancefeeshallbeleviedonsuchmembers.

    4.14. DeathofMember:

    a. Amemberingoodstandingupondeath,ceasesfrommembershipofACCE(I).

    b. No heirs of the deceased shall claim either continuity ofmembership or any other

    privilegesenjoyedbythememberwhenalive,butshallbe liabletofulfillall liabilitiesowedbythedeceasedmembertotheAssociation.

    c. HowevertheGoverningCouncilmaylookintotheissueoffulfillingtheliabilityandcan

    considertakingalenientviewdependingthepresumedlosstotheAssociationbecauseofthenonfulfillmentoftheliabilities,onhumanitariangrounds.

    4.15. Severance:

    Ifanapplicanthassecuredadmissionortransferonwillfulmisrepresentation,theGCshallcallforan explanation from themember. If thereafter theGC concludes that themember is guilty ofmisrepresentationthemembershipshallbeterminatedandthememberintimatedaccordingly.

    4.16. PrivilegesofMembers:

    4.16.1. AllmembersoftheAssociationareentitledtothefollowing,exceptthoselistedunderCl:4.3.1and4.3.2.

    a. Fellows, Honorary Fellow, Life Members, Members and Organizational

    Members,shallbereferredtoasVotingMembersoftheACCE(I).

    b. ParticipateintheactivitiesoftheAssociation,payingstipulatedeventbasedfees,ifany.

    c. Bepresentandvoteat theGeneralBodyMeetingof theMembersof the

    Associationonanymatter,whichmaybesubmittedforitsconsideration.

    d. Toaccessandutilize the library facilities inACCE (I)premises,asperrulesandregulationsinforceatthetimeforitsusage.

    e. TocontestforthepostofanyOfficeoftheAssociation inaccordancewith

    andsubjecttotheregulationsgoverningsuchelectionsintheseByelaws.

    f. Toutilize the facilitiesprovidedby theAssociation inaccordancewith thedecisionoftheGoverningCouncil.

    g. To inspectandhavereasonableaccesstotherecordsoftheAssociationby

    givingpriornoticeofonemonthtotheSecretaryGeneraloftheintentiontodo so, specifying the particulars of the records to be sought, and havingreceivedanwrittenauthorizationtodosofromtheSecretaryGeneral.TheSecretary General shall take the concurrence of the Governing Councilbeforeactingontherequest.

    h. Organization/Institutions other than education institutions may nominate

    three full time employees in their organizations whereas Educationalinstitutionsmaynominate two full timeemployees in their institutionsastheirrepresentativemembersofACCE(I).

    i. Institutions shall indicate their officer(s) authorized to nominate andcorrespondontheirbehalf.

    4.16.2. StudentsshallbeentitledtoallrightsandprivilegesoftheACCE (I)membersexcluding Clause 4.16.1. (a), 4.16.1. (c), 4.16.1. (e), and 4.16.1. (g), of thisSection,exceptwherespecificallyindicatedotherwise.

    4.16.3. RepresentativesofOrganizationalmembers shallbeentitled toall rightsand

    privilegesoftheACCE(I)membersexcludingClause4.16.1.(e)and4.16.1.(g),exceptwherespecificallyindicatedotherwise.

    4.16.4. Assertion:

Mem. ACCE (I) and SM ACCE (I),dependingonthecategorytowhichtheybelongto.Misrepresentationof factsshall lead to disqualification and termination from Membership of theAssociation.

    4.16.5. Publications:

    EveryMemberoftheACCE(I)shallreceivesuchPublicationsoftheAssociationasdeterminedbytheGoverningCouncil,fromtimetotime.Thesepublicationscould either be a complimentary copy or as a subscription based copy to beboughtatacostuponpayment to theAssociation. Informationwith regard tothesepublicationsshallbecommunicatedtoallthemembersoftheAssociationinadvance.

    5. ADMINSTRATIVEHIERARCHYOFTHEASSOCIATION:All posts of Office in the Association are Honorary in nature, and the Office bearers are notentitledtoanycompensationeitherinkindorcash.

    5.1. HEADQUARTERS:

    GOVERENINGCOUNCILATHEADQUARTERSSHALLCONSISTOF:

    5.1.1. OFFICEBEARERS:

    Office bearers of theHeadquarters of theAssociation shall consist of the current President, Vice Presidents of all the defined regions where the Association has itsCenters situated,SecretaryGeneraland theTreasurer, soelected fromamongst theeligible candidates of the Association by the electorate of the Association. Theeligibilitycriteriafordifferentpostsbeingasdefinedunderrelevanteligibilityclausesinthisdocument.

    5.1.2. EXOFFICIOMEMBERS:

    Immediate Past President will be the exofficio members at the Headquarters andhe/sheshallNOTbeconsideredasOfficebearerattheHeadquarters.

    5.1.3. CHAIRMANSOFCENTERS:

    CurrentChairmansofallrecognizedCentersoftheAssociationwillbecomemembersoftheGoverningCounciloftheHeadquartersforthetermunderconsideration,unlesstheywillinglyoptouttomakewayforothersfromtheirrespectiveCenterandtheyareNOTtobeconsideredasOfficebearersattheHeadquarters.

    5.1.4. COOPTEDGOVERNINGCOUNCILMEMBERS:

    a) Theupper limitonthenumberofmembers intheGoverningCouncilshallbe

    sixtyallinclusive.

    b) TheOfficeBearersof theHeadquartersconsistingof thePresident,Secretary

    GeneralandtheTreasurer,inconsultation,maycooptmembersfromamongsteligiblemembersoftheAssociationtobeontheGoverningCouncilascooptedmembers.ThecooptedmembersareNOTtobeconsideredasOfficebearersattheHeadquarters.

    c) Such coopted members for the Governing Council shall be based on the

    principleofproportional representation in termsof thenumberofmemberseach Center of the Association has, in addition to the Chairman, with theoverallnumberspecifiedaboveassixtyremainingrelevant.

    d) The President shall be vested with a discretionary quota of four members,

    whomhecanappointasmembersof theGoverningCouncil,with theoverallnumberspecifiedaboveassixtyremainingrelevant.

    e) ThenewlyconstitutedGoverningCouncilinitsfirstmeeting,shallcooptthree

    representatives fromamongst theOrganizationalmembersof theAssociationtotheGC.Thiscouldbeoverandabovethe limitingnumberofsixtyspecifiedabove.

    f) The duties, rights and privileges of all theGoverning Councilmembers shall

    remainthesame.

    5.1.5. STRENGTHOFGOVERNINGCOUNCIL:

    The overall strength of the Governing Council shall be limited to Sixty (60). Thisnumber is inclusiveofall categoriesofmembersof theGoverningCouncil,more sodescribedabove.

    5.2. LOCALCENTERS:

    MANAGINGCOMMITTEEOFTHELOCALCENTERSHALLCONSISTOF:

    5.2.1. OFFICEBEARERS:

    OfficebearersoftheCentersoftheAssociationshallconsistofthecurrentChairman,Secretaryand theTreasurer, soelected fromamongst theeligiblecandidatesof theCenter under consideration. The eligibility criteria being as defined under relevanteligibilityclausesinthisdocument.

    5.2.2. EXOFFICIOMEMBER:

    ImmediatePastChairmanistheexofficiomemberattheCenterandhe/sheshallNOTbeconsideredasOfficebearerattheCenter.

    5.2.3. ELECTEDMANAGINGCOMMITTEEMEMBERS:

    ThereshallbeonlythreeelectedManagingcommitteemembers foreachCenter,soelectedfromamongsttheeligiblecandidatesoftheCenterunderconsideration. The

    5.2.4. OTHERS:

    Vice President of the Region in which the Center is situated for the term underconsideration, will be a permanent invitee for all the meetings of the ManagingCommitteeoftheCenter/sintheRegionwithequalvotingrights.

    5.2.5. COOPTEDMANAGINGCOMMITTEEMEMBERS:

    The duly constituted Managing Committee in its first meeting, shall coopt fromamongst the eligible members of the Center, additional Managing CommitteeMembersOneforeveryfiftyeligiblemembersonMembershipregisteroftheCenter.Eligibilitycriteriaforcooption,beingmoresodescribedundereligibilityclausesinthisdocument.

    6. ELECTIONS:

    6.1. ELECTORATE:

    6.1.1. ELECTORATEFORLOCALCENTERELECTIONS:

    AllmembersoftheAssociationregisteredundertheCenter,exceptStudentMembersand Honorary Fellow Members, who are in the eligible membership list of theAssociationason31stMarchoftheyearinwhichtheelectionsarebeingheldandarenot inarrearsof subscription, shallconstitute theelectorate for theelection for theOfficebearersoftheCenter.

    6.1.2. ELECTORATEFORHEADQUARTERSELECTIONSFORTHEPOSTOF:

    6.1.2.1. PRESIDENT:

    AllmembersoftheAssociation,exceptStudentMembersandAssociateMembers,whoareintheactivelistofmembershipoftheAssociationason1stApriloftheyearinwhich theelectionsarebeingheldandarenot inarrearsof subscription, shallconstitute the electorate for the election for the post of President of theAssociation.

    6.1.2.2. VICEPRESIDENT:

    AllmembersoftheAssociation,exceptStudentMembersandAssociateMembers,whoareintheactivelistofmembershipoftheAssociationcumulativelyfromalltheCenters of the Association coming under the domain of the region underconsideration,ason1stApriloftheyear inwhichtheelectionsarebeingheldandarenotinarrearsofsubscription,shallconstitutetheelectoratefortheelectionforthepostofVicePresident/softheAssociationfromthatRegion.

    6.1.2.3. SECRETARYGENERAL:

    AllmembersoftheAssociation,exceptStudentMembersandAssociateMembers,whoareintheactivelistofmembershipoftheAssociationason1stApriloftheyearinwhich theelectionsarebeingheldandarenot inarrearsof subscription, shallconstitute theelectorate for theelection for thepostofSecretaryGeneralof theAssociation.

    6.1.2.4. TREASURER:

    AllmembersoftheAssociation,exceptStudentMembersandAssociateMembers,whoareintheactivelistofmembershipoftheAssociationason1stApriloftheyearinwhich theelectionsarebeingheldandarenot inarrearsof subscription, shallconstitute the electorate for the election for the post of Treasurer of theAssociation.

    6.2. ELECTIONPROCEDURE:

    a) ElectionofOfficebearersfortheHeadquartersandCentersshallbeheldconcurrently

    onceeverytwoyearsinthemonthofApril.ThetermofofficeforallpostsshallbetwoyearsbothattheHeadquartersandtheCenters.

    b) AnnualGeneralBodymeetingof theAssociation for theCenters shallbe conductedwithinthemonthofMayeveryyearunlessunderforcedemajeure.

    c) Annual General Body meeting of the Association for the Headquarters shall beconductedontheSecondSaturdayinthemonthofJulyeveryyearunlessunderforcedemajeure.

    d) InstallationofnewofficebearersshallbeduringtheAGMonthesaiddateintheyear

    duringwhichelectionsareconductedforbothHeadquartersandtheCenters.

    e) TheGoverningCouncilmeetingsshallbeheldinthemonthsofApril,July,October,andJanuaryeveryyear.Thedurationbetween twoconsecutiveGCmeetingsshallnotbemorethan90days.

    f) TheGoverningCouncilinitsmeetingheldinthemonthofJanuary,intheyearinwhich

    electionshavetobeconducted,appointaReturningOfficerforconductingelectionstotheHeadquartersandtheCenters.

    g) There shallbeoneReturningOfficer for theelectionsof theAssociationbothat the

    HeadquartersandtheCenters.HowevertheManagingCommitteeoftheCentersinitsmeeting held in the month of January, in the year in which elections have to beconducted,appointajurisdictionalReturningOfficertocoordinatewiththeReturningOfficeroftheAssociation,tohelpinconductingtheelectionsatthelocalCenterlevel.

    h) Upon the election process being set in motion, the interpretation of the rules and

    regulations,Byelawsof theAssociation,with regard to the conductof theelectionsshall be the sole responsibility of the Returning Officer and binding on all othermembersconcerned.TheGCanditsmembers,shallceasetoexertanyinfluenceontheprocess of elections, till the declaration of the results by the Returning Officer. Allissues related to the electoral process shall be represented only in writing to theReturningOfficer,whoshalllookintotherepresentationraisedandinitiateappropriate

    action if warranted. The Returning Officer shall abide by the Byelaws, Rules andRegulations in vogue at the time of elections, and ensure a smooth, fair andtransparentelectiontakingintoconfidenceallconcerned.

    i) The entire election process shall be completed by 10th May in that year in which

    electionsarebeingheld.

    j) ThemembershipRegistersshallbeupdatedfourtimesduringtheyearinthemonthsofApril,July,October,andJanuary.

    k) All changes, additions and deletions in the membership status, intimated up to

    February28thintheyearinwhichelectionsarebeingconductedshallbeincorporatedandtheMembershipRegisterstreatedasclosedforallofficialpurposes,exceptwhereexplicitly stated otherwise for elections. Changes here explicitly mean, changes inmailingaddress, telephonenumbers,email idandCentreofaffiliationof theexistingmembers,whichshallbesubmittedinwritingtoSecretaryGeneraloftheAssociation.All requests for change received after the above specified date shall be kept inabeyancetillthecompletionoftheelectoralprocess.

    l) AllthosememberswhoareontheofficialMembershipRegisteroftheAssociationas
