Problem of violence against doctors - the situation in Poland

Trainings for healthcare employees: development of skills aiming at preventing or reducing aggressive and violent behaviour, raising national awareness about violence against physicians, proper work organization, which contributes to limitation of aggressive and abusive behaviour;

legal protection for doctors while performing emergency medical procedures – in Poland a doctor performing emergency activities is legally protected in the same way as public officials

In 2010 the Polish Supreme Chamber of Physicians and Dentists established the Bureau of Doctors’ Rights – the role of the Bureau is to undertake actions to protect the profession of doctors and dentists. The activities of the BDR consist in helping doctors in matters regarding the exercise of the medical profession eg. by providing legal aid, especially when a doctor’s good name or reputation is violated (libel, slander) or violation of bodily integrity

The Doctor’ Rights Ombudsman defends the dignity of the medical profession as well as the collective interests of all doctors

Both the Bureau of Doctors’ Rights and the Doctor’ Rights Ombudsman have their counterparts on the level of Regional Medical Chambers.

Is a medical doctor in Poland entitled to provide medical

treatments other than within the scope of his medical specialty under the Polish national regulations?

Is it possible and how for a medical doctor to get a license for providing some medical treatments which are not covered by any specialty program, but could belong, due to their scope – to several different specialties?

In Poland, in theory, a physician holding the right to practice the

profession can in principle provide all medical treatments, except a few specifically indicated by the law (eg. administration of anestaetics)

The Polish Act on professions of doctor and dentist does not include any regulations prohibiting the exercise of any medical procedures by any medical doctor

A medical doctor is not obliged to get a medical specialty, although the majority do

According to the principles of the Polish Medical Code of Ethics a doctor should not perform medical procedures, which are beyond his actual knowledge and skills

In Poland the draft of the law on the so called professional skills in few narrower fields of medicine is under way

Unfortunately the regulations are still in the course of preparation and the project itself was already postponed several times

Physicians in Poland are required (by state law and medical ethics) to take active part in Continuing Medical Education/ Continuing Professional Development

The CME is supervised by the self-government of physicians and dentists

A credit points system is applied - 200 points have to be collected in a period of every 4 years.

The fulfillment of the CME obligation is registered in the document „The right to exercise the profession”

Medical diplomas obtained outside the European Union are not covered by the system of automatic recognition. In Poland they are subject to recognition procedure called nostrification.

Are there any treatment guidelines in Poland?

Who defines the treatment procedures/guidelines? What rules apply when writing a guideline (based on which documents)? Are they mandatory?

Are the standards and norms of medical treatment defined in Poland and based on any guidelines ( eg. the consumption of supplies)?

Are there any terms (of validity) and conditions of applying treatment guidelines?

When lack of guidelines, on what basis do you provide high-quality health care? Who/what entity is responsible for establishing standards for treatment?

There are no general and legally binding standard operating procedures for clinical practice in particular diseases in Poland

Some Polish medical societies develop clinical guidelines and adjust them from time to time, however those guidelines only indicate how a physician should treat a disease. The guidelines are not binding and thus can be not used as a clear reference in case of court proceedings and medical errors.
