Code of Practice for the Pastoral Care of International Students

Liston College has agreed to observe and be bound by the Code of Practice for the Pastoral Care of International Students published by the New Zealand Minister of Education. Copies of the Code are available on request from this institution or from the New Zealand Ministry of Education website at: www.minedu.govt.nz/goto/international

Immigration:Full details of visa and permit requirements, advice on rights to employment in New Zealand while studying, and reporting requirements are available through the New Zealand Immigration Service, and can be viewed on their website at www.immigration.govt.nz

Eligibility for Health Services:Most International Students are not entitled to publicly funded health services while in New Zealand. If you receive medical treatment during your visit, you may be liable for the full costs of that treatment. Full details on entitlements to publicly-funded health services are available through the Ministry of Health, and can be viewed on their website at www.moh.govt.nz

Accident Insurance:The Accident Compensation Corporation provides accident insurance for all New Zealand citizens, residents and temporary visitors to New Zealand, but students may still be liable for all other medical and related costs. Further information can be viewed on the ACC website at www.acc.co.nz

Medical and Travel Insurance:International students must have appropriate and current medical and travel insurance while studying in New Zealand. Students can either have a cover arranged by Liston College or produce evidence at the time of enrolment that they have insurance cover from another company that meets the Code requirement.

About Liston College Liston College is a small friendly Boy’s College of 800 Year 7 to 13 students (10 -18 years), conveniently located in the heart of Waitakere City only 15 minutes from downtown Auckland City.

Waitakere City is well known for its surf beaches, bush walks, rural character and recreational facilities and mild climate, while having a number of large shopping centres throughout its suburbs.

The College is set in spacious grounds and well resourced with up to date teaching and English Language support facilities as well as specialist rooms, including art and computer rooms, science laboratories, music suites, technology workshops and gymnasium.

Liston College has much experience in offering education to International Students and preparing them for university study. It offers an excellent opportunity and facilities for International Students to come and study at a New Zealand school.

Liston College has both a long term, full time, International Student programme, as well as short term Study Tour programmes. These can be tailored to suit individual needs and circumstances. Homestays can also be arranged.

Liston College has a close relationship with St Dominic’s College, a Year 7 -13 Catholic Girls School, a three minute walk away, and St Paul’s School, a Catholic Primary school, five minute car trip away. Many of our families have children in both Colleges and have had their sons go to St Paul’s School.

IntroductionWithdrawals and Refunds of FeesAll refunds of tuition fees to International Students withdrawing from Liston College are at the discretion of the Board of Trustees. Application for refund must be made in writing to the Board of Trustees setting out the special circumstances of the claim.

Refund of Tuition fees If a student decides against coming to Liston College, tuition fees will be refunded minus a NZ$500 administration fee.

Once an International Student has arrived in New Zealand, refunds (less a NZ$500 administration fee) will be made only in the most exceptional circumstances (i.e. return home because of serious illness or death of a close family member) and then only partial refund may be made as the School will have incurred costs on the student’s behalf for the whole year.

The refund policy of the Liston College Board of Trustees is set out below, based on Section 4B(7) of the New Zealand Education Amendment (No.4) Act 1991. In arriving at their decision, the Board of Trustees will take into consideration the special circumstances of the withdrawing student and; • CostsalreadyincurredbytheBoard.• Thesalariesoftheteachersandsupportstaffandanyothercomponents

of the fee committed for the duration of the course.• Anamountwhichcoverstheuseoffacilitiesandresourcestothedateof

the withdrawal. • The proportion of the Government or the Catholic School Levies the

school is required to pay.• Anyothercostsalreadyincurred.

Please note:• Norefundwillbemadetoastudentwhoisexcludedfromtheschoolby

the Board of Trustees¹. • International Students who gain permanent residence or parents who

gain work visas after the course has commenced will not be eligible for a refund.

¹ Where a student is excluded from Liston College, the costs associated with the return journey home will be the responsibility of the parent or guardian, not Liston College.

Homestay Fees Outstanding homestay fees will be refunded if the contract for tuition at Liston College or its contracted homestay agency, is terminated. Two weeks notice, or payment of two weeks fees in lieu of notice, must be given. The placement fee is not refundable.

How to apply for RefundsAll refunds of tuition fees to withdrawing International Students are at the discretion of the Liston College Board of Trustees.

Applications for refund must be made in writing to the Board of Trustees, setting out the special circumstances of the claim, such as return home because of serious illness or death of a close family member. This application should include any supporting documents (eg. medical certificates, tickets for return journey etc.)

At Liston College we provide a range of comprehensive guidance and support services throughout their stay at Liston College. This ensures that the College meets the various personal, academic and future vocational needs that may be of a concern to International Students and their parents. The services that we offer provide the help and support needed by our students.

Student WelfareThe Dean of International Students oversees the general welfare of all International Students. The services provided include:

• Parents receiving regular communication and progressreports from the College.

• Regular interviews with students to ensure that they arehappy, well cared for and making good progress.

Pastoral SupportWe provide an extensive network of personnel to support International Students while they are at Liston College. These include:

International DeanInternational Students have access to an International Dean as well as a Level Dean. The International Dean is available to specifically assist International Students with day to day issues that they may have as well as courses study, visa requirements, homestay questions, health issues, account queries and parental enquiries. The International Dean interviews each International Student on a regular basis to monitor academic performance and general welfare.

Form TeacherEach student is assigned to a Form Class, with whom they will stay with during their time at Liston College. They are the first link in the College’s Guidance network. The Form Teacher has special responsibility for the welfare and progress of all students in their Form Class.

Guidance CounsellorThe Guidance Counsellor is available to all International Students enrolled at Liston College. The Guidance Councellor maybeaccesseddirectlybystudentstodiscussanymatter–academic, personal, careers, health etc.

Careers and Tertiary GuidanceInternational Students can access Tertiary studies information as well Careers information from the College’s Career’s Advisor.

Health NurseA Health nurse visits the College on a regular basis and is available free to International Students.

School ActivitiesInternational Students are encouraged to take part in the life of the College. This includes being involved in numerous activities offered at the College:

• Sports teamssuchassoccer,basketball,volleyball, rugbyetc.

• Dramaand Performing Arts.

• Music performance and groups – individual tuition isavailable in some circumstances.

Pastoral SupportWe provide an extensive network of personnel to support International Students while they are at Liston College. These include:

International DeanInternational Students have access to an International Dean as well as a Level Dean. The International Dean is available to specifically assist International Students with day to day issues that they may have as well as courses study, visa requirements, homestay questions, health issues, account queries and parental enquiries. The International Dean interviews each International Student on a regular basis to monitor academic performance and general welfare.

Form TeacherEach student is assigned to a Form Class, with whom they will stay with during their time at Liston College. They are the first link in the College’s Guidance network. The Form Teacher has special responsibility for the welfare and progress of all students in their Form Class.

Guidance CounsellorThe Guidance Counsellor is available to all International Students enrolled at Liston College. The Guidance Councellor maybeaccesseddirectlybystudentstodiscussanymatter–academic, personal, careers, health etc.

Careers and Tertiary GuidanceInternational Students can access Tertiary studies information as well Careers information from the College’s Career’s Advisor.

Health NurseA Health nurse visits the College on a regular basis and is available free to International Students.

Liston College has agreed to observe and be bound by the Code of Practice for the Pastoral Care of International Students published by the New Zealand Minister of Education. Immigration:Full details of visa and permit requirements, advice on rights to employment in New Zealand while studying, and reporting requirements are available through the New Zealand Immigration Service, and can be viewed on their website at www.immigration.govt.nz

Eligibility for Health Services:Most International Students are not entitled to publicly funded health services while in New Zealand. If you receive medical treatment during your visit, you may be liable for the full costs of that treatment. Full details on entitlements to publicly-funded health services are available through the Ministry of Health, and can be viewed on their website at www.moh.govt.nz

Accident Insurance:The Accident Compensation Corporation provides accident insurance for all New Zealand citizens, residents and temporary visitors to New Zealand, but students may still be liable for all other medical and related costs. Medical and Travel Insurance:International students must have appropriate and current medical and travel insurance while studying in New Zealand. About Liston College Liston College is a small friendly Boy’s College of 800 Year 7 to 13 students (10 -18 years), conveniently located in the heart of Waitakere City only 15 minutes from downtown Auckland City.

Waitakere City is well known for its surf beaches, bush walks, rural character and recreational facilities and mild climate, while having a number of large shopping centres throughout its suburbs.

The College is set in spacious grounds and well resourced with up to date teaching and English Language support facilities as well as specialist rooms, including art and computer rooms, science laboratories, music suites, technology workshops and gymnasium.

Liston College has much experience in offering education to International Students and preparing them for university study. It offers an excellent opportunity and facilities for International Students to come and study at a New Zealand school.

Liston College has both a long term, full time, International Student programme, as well as short term Study Tour programmes. These can be tailored to suit individual needs and circumstances. Homestays can also be arranged.

Liston College has a close relationship with St Dominic’s College, a Year 7 -13 Catholic Girls School, a three minute walk away, and St Paul’s School, a Catholic Primary school, five minute car trip away. Many of our families have children in both Colleges and have had their sons go to St Paul’s School.

IntroductionWithdrawals and Refunds of FeesAll refunds of tuition fees to International Students withdrawing from Liston College are at the discretion of the Board of Trustees. Application for refund must be made in writing to the Board of Trustees setting out the special circumstances of the claim.

Refund of Tuition fees If a student decides against coming to Liston College, tuition fees will be refunded minus a NZ$500 administration fee.

Once an International Student has arrived in New Zealand, refunds (less a NZ$500 administration fee) will be made only in the most exceptional circumstances (i.e. return home because of serious illness or death of a close family member) and then only partial refund may be made as the School will have incurred costs on the student’s behalf for the whole year.

The refund policy of the Liston College Board of Trustees is set out below, based on Section 4B(7) of the New Zealand Education Amendment (No.4) Act 1991. In arriving at their decision, the Board of Trustees will take into consideration the special circumstances of the withdrawing student and; • CostsalreadyincurredbytheBoard.• Thesalariesoftheteachersandsupportstaffandanyothercomponents

of the fee committed for the duration of the course.• Anamountwhichcoverstheuseoffacilitiesandresourcestothedateof

the withdrawal. • The proportion of the Government or the Catholic School Levies the

school is required to pay.• Anyothercostsalreadyincurred.

Please note:• Norefundwillbemadetoastudentwhoisexcludedfromtheschoolby

the Board of Trustees¹. • International Students who gain permanent residence or parents who

gain work visas after the course has commenced will not be eligible for a refund.

¹ Where a student is excluded from Liston College, the costs associated with the return journey home will be the responsibility of the parent or guardian, not Liston College.

Homestay Fees Outstanding homestay fees will be refunded if the contract for tuition at Liston College or its contracted homestay agency, is terminated. Two weeks notice, or payment of two weeks fees in lieu of notice, must be given. The placement fee is not refundable.

How to apply for RefundsAll refunds of tuition fees to withdrawing International Students are at the discretion of the Liston College Board of Trustees.

Agreement WordingIf LISTON COLLEGE(“School”)acceptstheStudentnamed(“Student”)intheApplicationformfortuitioninNewZealand,the following terms and conditions shall apply:

1. TheSchool shallprovide tuition inaccordancewith theNewZealandMinistryofEducationCodeofPractice forPastoral Care of International Students.

2. TheSchoolshallapproveandmonitorhomestayordesignatedcareinaccordancewiththerequirementsoftheNewZealandMinistryofEducationCodeofPractice.

3. The Parents or legal guardians of the Student who have signed the application for tuition on behalf of the Student (“Parents”) irrevocably appoint and authorise the Principal of the School (or other such person as may be appointed by the School to carry out the Principal’s duties) to:

3.1 Receiveinformationfromanyperson,authorityorcorporatebodyconcerningthestudent,butnotlimitedto,medical education or welfare information;

3.2 Provide consents in respect of any activity carried out and authorised by the School; 3.3 Receivefinancialinformationrelatingtothestudent,includingbankaccountsorincomeoftheStudentwhilein

NewZealand; 3.4ProvideconsentsthatmaybenecessarytobegivenontheStudent’sbehalfintheeventofamedicalemergency

where it is not reasonably practicable to contact the Parents.

4. TheParentsirrevocablyauthorisethePrincipaloftheschooltoadvisethestudent’shomestayhosts(whetherornotarranged through the School) of all matters and information required to be provided to parents of any student under theEducationAct1989andagreetoappointthehomestayhostsastheiragentsinNewZealandtoreceivesuchinformation in substitution for the Parents.

5. The Parents agree to provide the School with academic, medical or other information relating to the wellbeing of the student as may be requested from time to time by the School.

6. The School shall use its best endeavours to ensure the safety, health and wellbeing of the student but shall not be liable for:

• Anydamageorharmcausedto theStudentor theStudent’spropertyarisingoutof theStudent’shomestay(whether or not such homestay was arranged by or through the School).

• AnydamageorharmcausedtotheStudentortheStudent’spropertywhileattendingtheSchoolunlesstheharmwas a result of gross negligence on the part of the School.

• Anydamageorharmcausedtothestudentorthestudent’spropertyoutsideofnormalschoolhoursandinthecase of Student’s property, shall not be responsible for any damage to such property that may occur outside the School’s premises.

7. Withoutrestrictingclause6,butsubjecttoclause8,theSchool’sliabilityinrelationtothesupplyofservicestotheParent is limited to the amount of fees paid by the Parent for provision of the services in respect of which liability arises.

8. NothinginthisAgreementlimitsanyrightstheParent’sand/orstudentmayhaveundertheConsumerGuaranteesAct1993.

9. EitherpartymayterminatethisAgreementuponthreeweekswrittennotice.IftheAgreementisterminated,theRefundsPolicyforInternationalStudentsshallapply.

10. Itisacknowledgedthatthesuspension,expulsionandexclusionofstudentprovisionsassetoutintheEducationAct1989shallapplytotheStudentinNewZealand.AnydecisionundertheseprovisionstoexpelorexcludetheStudentshall terminate this Agreement and the refunds policy shall apply. The Parent shall have no claim in damages or for any compensation if this Agreement is terminated in these circumstances.

11. Neither party shall be in default or in breach of their obligations under this Agreement to the extent that theperformance of those obligations is prevented by an event of force majeur. Force majeur means an event beyond thereasonablecontrolofthepartyseekingtorelyonforcemajeur.

12. ThisAgreementshallbeconstruedandtakeeffectinaccordancewiththedomesticlawsofNewZealand.Inrelationto any legal action or proceedings arising out of or in connection with this Agreement, the Parents irrevocably submit tothejurisdictionoftheCourtsofNewZealand,agreethatproceedingsmaybebroughtbeforeanyCourt,includinganyforumconstitutedundertheArbitrationAct1908withinNewZealand,andwaiveanyobjectiontoproceedingsin any such court or forum on the grounds of venue or on the grounds that the proceedings have been brought in an inconvenient forum.

16. This Agreement shall consist of the Application for Tuition and this Tuition Agreement including the attached Schedules 1 and 2. This Agreement contains the entire understanding of the parties and overrides any prior promises, representations, understandings or agreements. The Terms of the Agreement may be changed by the School in writing to the Parents and shall continue in force while the Student is enrolled within the School.

17. TheParentsacknowledgethat: a) PersonalinformationofParentsand/orstudentcollectedorheldbytheSchoolisprovidedandmaybeheld,

used and disclosed to enable the School to process the Application for Tuition, provide tuition and homestay servicestotheStudent,providetotheStudentand/orParentsadviceorinformationconcerningproductsandservicestheSchoolbelievesmaybeof interesttotheStudentand/orParentsandtoenabletheSchooltocommunicatewiththeStudentand/orParentsforanypurpose.

b)AllpersonalinformationprovidedtotheSchooliscollectedandwillbeheldbytheSchoolat69RathgarRoad,Henderson,Auckland,Phone:098389350orFax098379809.

c) IftheStudent/ParentsfailtoprovideanyinformationrequestedintheApplicationforTuition,theSchoolmaybe unable to process the application.

18. TheconditionsinthisTuitionAgreementapplyforthewholeofthetimethatthestudentisenrolledatListonCollege.

Liston College has agreed to observe and be bound by the Code of Practice for the Pastoral Care of International StudentspublishedbytheMinisterofEducation.CopiesoftheCodeareavailableonrequestfromthisinstitution

This may also be his Parents, Aunt, Uncle, or family friends or a homestay family that the school has chosen. 1. IguaranteethegoodbehaviourofmysoninNewZealand.Iunderstandthatunacceptablebehaviouronthepartofmy son in the homestay may lead to the termination of my son’s enrolment at Liston College.

2. IundertakethatmysonwillnotleavethehomestaytoliveatanotheraddresswithoutthepermissionoftheDirector/DeanofInternationalStudents.

3. IundertaketogivewrittennoticetoListonCollegeofatleasttwoweekswhenIwishmysontochangefromonehomestay to another category of accommodation, such as living with a parent or designated care.

4. IunderstandtheSchool’spolicyonWithdrawalsandRefundofFees.

5. IundertaketocommunicateinatimelyandpromptmanneraboutanymatterwhichmayaffecttheSchool’sabilityto carry out its responsibilities effectively, including any changes of address or phone numbers for either ourselves or our son.

Current practice:

All homestays in which we place students have been approved following a process set out in the Guidelines to the Code of Practice for the Pastoral Care of International Students.

This includes but is not limited to:

• providingtheprospectivecaregiveracopyoftheSummary of the Code of Practice for the Pastoral Care of International Studentstoinformhim/themoftheresponsibilitieslaiddownbytheNewZealandGovernment

• thecompletionbytheprospectivecaregiverofawrittenquestionnairetodeterminetheirsuitability

• an interview of the prospective caregiver in their home and inspection of that home and its facilities by the Liston College Dean of International Students

• photosmaybetakenofthehomeanditsenvironsandmadeavailabletothestudentandhisparents

• adiscussionwithtworefereesnamedbythecaregivertoattesttotheirsuitabilitytotheroleandwrittenrecordsofthose discussions made

• policevettingofallpeoplelivinginthehomeaged18andover,excludingotherinternationalstudents

• entryonourdatabaseofrelevantinformation,whichiscopiedforthestudentandhisparents

Liston CollegeInternational Students’ Homestay General Information

Current practice:

All homestays in which we place students have been approved following a process set out in the Guidelines to the Code of Practice for the Pastoral Care of International Students.

This includes but is not limited to:

• providingtheprospectivecaregiveracopyoftheSummary of the Code of Practice for the Pastoral Care of International Studentstoinformhim/themoftheresponsibilitieslaiddownbytheNewZealandGovernment

• thecompletionbytheprospectivecaregiverofawrittenquestionnairetodeterminetheirsuitability

• an interview of the prospective caregiver in their home and inspection of that home and its facilities by the Liston College Dean of International Students

• photosmaybetakenofthehomeanditsenvironsandmadeavailabletothestudentandhisparents

• adiscussionwithtworefereesnamedbythecaregivertoattesttotheirsuitabilitytotheroleandwrittenrecordsofthose discussions made

• policevettingofallpeoplelivinginthehomeaged18andover,excludingotherinternationalstudents

• entryonourdatabaseofrelevantinformation,whichiscopiedforthestudentandhisparents

• thehomewillbevisitedaminimumofthreetimesyearlywhileyoursonlivesthere,andhewillbeinterviewedeachtermatschooltocheckhissafetyandwellbeinginit

Broadly, we hope to place students in homes:

• whichmatchthestatedneedsofthestudents,asfaraspossible

• withinareasonabledistanceoftheschool,thoughitmaynecessitateabusortraintriptoreachListonCollege,ratherthanwalking

• whereEnglishisthefirstlanguage,ifthisisrequested

• wherethestudentwillhavehisownbedroomwithinthehome

• wherethefamily(whichmaybeasingleparent)willprovideconvivialcompanyandenjoywelcomingnewcomers

• where thecaregiversareable tomeet theneedsofan international student facingnewchallengesand requiringsupport and encouragement
