Thank God for Governor Charlie Crist! During the last weekof the Florida legislative session, and down to the last min-

utes, Republicans added an amendment to HB 5607 which wouldhave reduced the interest rate paid to DROP participants from6.5% to 3%. I want to thank all the PBA members who took thisseriously and flooded Governor Crist’s office with e-mails andphone calls asking Charlie not to forget the working classFloridians. Well, we know what the results were; the Governorcame through once again by VETOING this bill.

Next session will probably be the same. Let’s see what else wecan take and cut from Florida’s employees. I cannot expressenough to all our members: WE HAVE TO GET INVOLVED INTHIS YEAR’S ELECTIONS. If you are not already aware, the PBAhas endorsed Alex Sink for Governor. The people of the State ofFlorida cannot afford to have the Senate, the House and theGovernor’s mansion controlled by Republicans. It is not that I donot like the Republicans, far from it. But if they get their way andget to push their agenda through, the working people are going tobe taking it on the chin! A Republican governor will rubber stampany bills that diminish our pensions. Did you notice that all thepension bills proposed in the House and Senate last session didnot include elected officials; your typical politicians? I would notexpect anything less. GET INVOLVED AND GET YOUR FRIENDSAND FAMILY INVOLVED. WE CAN MAKE A DIFFERENCE!

I am also requesting all our members get involved, if andwhen the time comes, if Lois Frankel gets her way and tries toextend her terms, from two to three. If there is a referendum onthis year’s ballot, the PBA will need to get involved to help defeatthe extension of term limits in order to send Frankel packing. Wehave to help our brothers and sisters out at West Palm Beach PD.The City continues to take and take. This year, the Mayor and herhenchmen want the police to take five (5) unpaid furlough daysand also freeze the Salary Plan for another year. Just the police; theMayor forgot to send the firefighters a notice as to what articlesneed to be negotiated, so the firefighters got a free pass this year.

On a good note, I would like to recognize Ernie George asthe first Labor person to chair the Criminal Justice Standards andTraining Commission. The PBA has come a long way from thetimes when Ernie was the only Labor member on theCommission. Presently, there are seven Labor members out of 19Commissioners. So, next time you see Ernie, extend your hand,and congratulate him on his new appointment.

Last but not least, once again we were able to give over$130,000 in scholarships to our PBA members’ children. Theyoung adults going through the scholarship screenings were sim-ply outstanding. The parents of these children need to be proudof yourselves because your children are a reflection of your val-ues, which are passed down in the law enforcement community.

On 3/12/2010, a home invasion occurred where the sus-pect killed the victim. Corporal Nick Barbera advised he wasen route after Sgt. Mike Tranchant advised he had a vehiclematching the description from the radio. Two suspects werethen seen running to an apartment complex, where Barbera

and Tranchant formeda shield team andmoved up the firstfloor of the complex.Corporal Barbera andhis K-9 apprehendedthe suspects who werepositively identified,along with recoveringthe firearm used tomurder the victim.

On March 23, 2010 Deputy Sheriff’s Ron Bouiso andKrystal Johnston went to serve a VOP warrant. The arresteeresisted and stated: “I’m not going. You’re going to have to killme!” A struggle ensuedwhereby D/S Johnstondeployed her TASERas the arrested grabbedD/S Bouiso’s baton andbegan striking him.Fearing for their safety,D/S Bouiso fired hissidearm, killing thearrestee, and stoppingthe threat.

searched the area as the suspects ran from the K-9. Deputy Mike Joseph and DeputyLeslie Beath confronted the suspects and all three deputies and the Lieutenant arrest-ed them. Their guns were recovered and they are being investigated for a series of rob-beries in Palm Beach County.

This installment will spare you my tutorials regardingstatutes, rights, case law and/or authorities impacting you,

and appropriately subject of these articles. So, relax. Hard-pressedas I am to find anything celebratory these days, there’s somethinggood to report that escaped my attention because of the modestmen involved. It happened a couple of years ago; which is furtherevidence of how hard-pressed I am to find anything celebratorythese days.

Most of you have been in an investigative interview at somepoint in your career, so most of you have been advised that yourAgency “has a policy regarding untruthfulness” and/or that yourtestimony is being taken under “the penalties of perjury,” etc.Whether as a “witness” or “subject” in an investigation, you’vebeen on the receiving end of such ominous warnings. And ifyou’ve been a “subject,” you’ve listened to the recordings of yourinvestigator reading such warnings to the witnesses against you,among others, at the outset of those “complainant” and “identifi-able witness” statements. The warnings are part of a templateevery policy investigator at every agency reads from so automati-cally and quickly as to sound like those rapid-fire and nearlyunintelligible disclaimers concluding advertisements for law firmsand pharmaceuticals. Until now, I would have told you thosewarnings to the complainants and witnesses against you were asobscure as the side-effects spoken about at the end of most drugcommercials.

My experience in investigations has caused me to consider theperjury warnings given to complainants/witnesses a pretense; noteven an effective investigative technique. It’s not only because I’vebecome somewhat cynical. It’s because I’ve been involved in“investigations” crediting demonstrably incredible accounts ofconduct in order to contrive charges of “untruthfulness” againstour members. And when I say demonstrably incredible, I’m talk-ing about accounts of conduct inconsistent with video or even lab-oratory evidence that would be conclusive to all but those unwill-ing, or unable, to see or to read.

A little north of this office a member was dismissed fromemployment based upon the accounts of drug use the officerdenied, a laboratory could not detect (from urine, blood, andextensive hair-testing by a forensic toxicologist); which accountsthe informant recanted in a second sworn statement to the same“investigator” to whom he had given the first “sworn” statement.Warned both times (the first time was at DEA headquarters) that“[a]ny person making a false statement under oath may be guilty ofperjury and subject to the penalties of law,” the informant in thatcase ended his second “sworn” statement (not at the DEA) by char-acterizing his career-destroying first “sworn” statement as follows:

“99.9 percent of that was all nonsense just for me toget people to stop questioning me....”

Question: Do you think there were any “penalties of law” inconsequence?

Answer: _____________ You can put your pencils down. A little south of this office a member was dismissed from

employment for “untruthfulness” regarding an account by a “wit-ness” of some considerable and substantive “conversation” withthat officer during an encounter that was videotaped. The “wit-ness” swore there was a conversation. The officer swore there wasno conversation.

From the “investigator” all the way up to the City Manager(with the exception of a certain Major), people with no apparentvisual impairments concluded from their purported review of thevideo that there was a conversation consuming between 11 to 15seconds. The video shows the officer walking right past the “wit-ness” in two seconds, with absolutely nothing to indicate any con-versation at all; e.g., no pausing, no hand movements, etc. Shownat the hearing, an enhanced video (enhanced by the PBA, not bythe employer of course) shows that as the officer walks past the“witness” and the “witness” steps aside, the two of them nevereven look at each other!

Question: Do you think there were any “penalties of law” inconsequence?

Answer: _____________ Pencils down.But now the “news.” Out of the West Palm Beach Police

Department, there’s a different answer to the questions. After anindividual made certain allegations against a West Palm Beach offi-cer, Internal Affairs personnel there did all of the things the “inves-tigators” did in my previous examples: they took sworn statements(after those warnings); and they searched for and gathered evi-dence. They did things I often find troubling, but which arguablyare part of their job: they went out actively looking for witnessesagainst their officers, soliciting testimony, and they used photoline-ups, etc. They didn’t have an informant who admitted he lied.They didn’t have a video. They used good old shoe leather, and atthe end of the day they weighed what they had without theirthumb on the scale.

The West Palm IA personnel involved didn’t exhaust them-selves trying to resuscitate and breathe life into the allegations, andthey didn’t affix blinders with regard to (or omit in the report)exculpatory evidence. They didn’t go through gymnastics to cred-it demonstrably incredible accounts. But most importantly: havinggenerating public records memorializing scandalously career-com-promising conduct, West Palm IA didn’t just walk away after writ-ing “unsustained,” and leaving that turd in their officer’s jacket.

The Palm Beach County PBA is proud to announce that Palm Beach County Sheriff’s Office Lt. Marcos Martinez, Cpl.Christopher Wolf and D/S Peter Tapia have been selected as finalists for the National Association of Police Organizations

(NAPO) 17th Annual TOP COPS Award.Since NAPO launched the awards program in 1994, the TOP COPS Awards have paid tribute to outstanding law enforcement

officers across the country for actions above and beyond the call of duty. TOP COPS awardees are nominated by their fellow offi-cers for outstanding service during the preceding calendar year.

The TOP COPS are selected by an Awards Selection Committee comprised of national law enforcement representatives whochoose one TOP COPS case from each state and U.S. territory. The cases are then ranked and the top ten case winners are flownto Washington, DC for the awards ceremony.

The awards show features a three-minute videotape of each TOP COP and his or her story.Lt. Martinez, Cpl. Wolf and D/S Tapia traveled to Washington, D.C. for the official ceremony which took place at the Warner

Theatre in D.C. on May 14, 2010.On behalf of the PBA Executive Board and the entire PBA Brotherhood congratulations Lt. Martinez, Cpl. Wolf and D/S Tapia!

fulness in violation of a Florida State Statute (for “Perjury”). The“witness” was arrested, prosecuted, and incarcerated. Alsoinvolved in the case at the time were then-Sergeants Coppin andKalil. It’s the only example I know about, of internal affairs inves-tigators using the badges on their belts to enforce the words in

their warnings. Thank you Greg, Kevin and Tony. Maybe I shouldbe a little less cynical.

Juno Beach NewsAs I write this article, the morale at this Department is at

an all-time low. We have been given inferior medical benefits,we have not received a decent raise in a number of years, we arenot allowed to accrue overtime, and now the final blow is theymight take away our only remaining perk—our take-homevehicles. We are also transitioning to a new computer softwareprogram that requires us to complete a report for everythingthat is called out over the radio, including traffic stops.

Like the majority of our members, I have been stressed justthinking about these issues. I do understand that we are “luckyto have a job right now,” but at what point are we no longerconsidered “lucky?” At what point are we considered humans,just like everyone else? We have spouses, we have children, wehave mortgages, and we have bills. We have the same responsi-bilities as everyone else, except we sacrifice more. We workovernights and holidays, while the majority of the public is athome sleeping or relaxing with their families and friends.

Unfortunately, 120 officers died in the line of duty in theUnited States in 2009. Eighty-two officers have died in theline of duty this year so far, which is up 19% from last year.To date, there have been 20,180 officers who have lost theirlives in the line of duty in the United States. We go to worknot knowing whether or not we will see our loved ones again.We do understand that this is the profession we chose, but isit selfish to want to feel like we are appreciated, and to becompensated for the sacrifices we make on a daily basis?”

I have been assured that things will get better; we just allneed to be patient.

On a lighter note, I recently backed up a couple of FWCofficers on a 76, under the Donald Ross Bridge. I stood bywhile these two officers issued a few tickets to five males froma nearby city. As I was speaking to these males, one of themasked me what department I worked for. I advised him that Iworked for Juno. This male then stated “Y’all don’t play herein Juno; we don’t come through Juno.”

I know we don’t always get the recognition that wedeserve, but this gentleman’s statement is a prime example ofthe great service that we provide to this community. Due toour officers’ pro-active police work for the past several years,our residents enjoy a low crime rate, even though we have afew crime ridden cities to our south. I am proud to servealongside each and every one of you.

Once again, everything will get better. We just have to havepatience. Please, everyone be safe out there, and let’s all go homeat the end of our shifts. I recently read a quote which immedi-ately struck me and made me think of our current situation.

School Police NewsWelcome back everyone. I hope you all had an enjoyable

and restful vacation and are ready for another school year. Bythe time you read this, the contract will have been ratified bythe members on July 22nd, 2010. Thanks to all of those whotook the time to vote.

This year’s negotiation sessions were extremely frustrat-ing due to the amount of time it took to get it done but in theend we worked out an agreement that both sides could agreeupon and work with. I will tell you that although it may havebeen painfully long, this round went rather peacefully andprofessionally, in comparison to past negotiation sessions.Negotiations did get heated because a member of theDistrict’s negotiation team tried comparing us to custodians,bus drivers and other employees. That got ugly because wewill not tolerate that. The PBA will always defend its mem-bers. We are not custodians, bus drivers, teachers or any ofthe other positions in the District. We put our lives on theline everyday to defend the students and teachers of PalmBeach County.

In the end an agreement was completed that both sidescould live with in these tough economic times. Kudos andthanks to Larry Fagan, Kevin O’Sullivan and Harry Rawlingsfor a job well done. Additional thanks to Van Ludy, JamesHayes, Jr. and Chief Kelly on the District side for working withus on the contract.

As I write this newsletter in late July I am thinking aboutour losses the past six months. We lost Gerry Gallagher andEd Brewer within a few months of each other. Both were life-long law enforcement officers and PBA members. I think oftheir widows and family members left behind and it’s heart-breaking. Make sure to kiss your spouse and hug your kidsevery morning. Tell them that you love them. Do everythingyou can to stay safe this year. Make officer safety your numberone priority this year.

It’s extremely doubtful that Dr. Johnson and the Board aregoing to do anything about our dangerously low manpowerlevels this school year. Regardless, please do everything youcan to keep yourselves safe this year. Make your number onepriority this year getting home safely to your family at the endof your shift. Everything else is secondary.

By the way, get involved in the electoral process this yearand vote for PBA endorsed candidates for the School Board.With the exception of Dr. Debra Robinson, we have not got-ten any support from the incumbents running for reelection.Keep that in mind in the primaries and November election.Contact the PBA office for a list of PBA endorsed school boardcandidates.

School District Police NewsHello all,The Contract re-openers are finally concluded. What we

have is:Workers’ Compensation - If you are injured in the line of

duty, through a fight at school, saving a life, ie. (car wreck)you could be entitled to up to six months Workers’ Compen-sation, not just the ten days. But restrictions do apply.

Comp time - You can accumulate up to 24 hours now.The wording was changed in our favor to get a full day off, notjust three hours.

Bereavement Leave - If a family member passes away youare entitled to three Bereavement days.

Attendance Stipend - If you do not go out sick for sixmonths (July 1 through Dec 31), you will get a $700 stipend,and for every six months thereafter. Again, restrictions apply.

Negotiations are very time consuming and a lot goes backand forth across the table. Although we did not get any moneythis time around, I believe that the district was fair to us andwe further increased our benefits package. We are going to tryand get a meeting set for the membership before the schoolyear starts so stay tuned.

Palm Beach Shores NewsThe officers are having their second meeting to work on

issues for the contract. Our major issue, as with all others,annual raise. We have asked the PBA for the comparisonsalaries so we can get a look at other agencies, but the num-bers are a little slow to surface so we are still waiting. Callshave been made to comparable departments in an effort tosupply the town with those numbers needed to justify ourargument in light of the fact we are going on three years with-out a raise of any kind.

It is our understanding that budget cuts are necessary, butwe also understand the need for compensation for those pro-viding services to the community.

Chief Kniffin has been working hard with the members ofthe Town Council, Town Administrator, and the Mayor tokeep our efforts and performance in the forefront. As statedbefore, this exposure should work in our favor as a show ofgood faith on the part of the police to continue to providesuperior services under these economic hard times. Again,these efforts should be rewarded, and that reward should notbe limited to: “You should be thankful you have a job.” We arethankful—no question about that—but that should not be thefinal reward for what has been sacrificed by the members ofthe Police Department.

system is being updated to improve the quality of transmis-sions/reception. Mobile radios are being updated to makeimprovements.

The reorganization that this department is going throughis more than anyone bargained for. We will be operating withtwo bureaus, two assistant chiefs (one appointed-one not-com-petitive process), a colonel (appointed), four new commanders(competitive process), and new sergeants will be promoted.

The only problem is the abolishment of the rank of lieu-tenant. As of September 30, the services of 25 year veteranswill no longer be needed. All in an effort to save the citymoney. Union officials and the officers support these men thathelped make this agency what is and don’t agree with the gra-cious offer they received to be terminated, retire, or participatein a process that to all, has little credibility.

These dedicated employees worked hard for the city foryears before this administration was formed. Has the lawenforcement family changed that much that if you are dislikedyou are shown the door. It would appear the “good old boysystem” is alive and well. This sounds eerily like the way theHonda Classic detail is run. Special jobs for certain people.The goal is to make it fair/equitable for all.

This reorganization has done one thing—effectively dis-mantled an entire agency in record time, removing opportuni-ties for growth and advancement. Morale is at an all time low.This is unheard of anywhere, and other agencies, veteran torecruit, take heed. This will set law enforcement back decadesand we are all in jeopardy.

This fight will be a long, arduous, and expensive one, somuch for the savings to the city, not to mention the potentialcivil suits that follow.

The lieutenants want to thank everyone who supportsthem and their cause. You must look ahead at what this willdo to your future.

We will not let the shortsighted, self-serving, and myopicview of a few, spoil it for the many. Their frail grasp on the bigpicture will have little effect on the rest of us. Years of educa-tion are of no use to a fool.

I’ve been through 25 classes in my years at the Sheriff’s Office.This year was the best ever. The DT’s portion was the best we

ever had. Ground fighting was unbelievable. True shooting isimportant but we do more hands-on than shooting. North Palm Beach NewsNot much going on in the Village of North Palm Beach,

but as we get into hurricane season make sure you make yourplans now, so if a storm does enter the area you are ready.Make sure you have a plan for your family in case the needarrives, and you are ordered to work. Do not depend on youremployer to take care of things for you. With the budget cuts,I am sure you will have to supply all your needs yourself.

We will begin the contract negotiations soon, and as itlooks we will not be making any gains with the new contract.If we can keep the same contract as we have now, and not loseanything, we will be doing well. With the economy doing aspoorly as it is, if we all keep our jobs as police officers we arewell enough. We must remember that this is your contract wewill be negotiating, and without the help from the memberswe will not be successful. MissionAs we all know, the killer earthquake that ravaged the

island of Haiti caused its government to suffer major set-backsand in particular, severe dislodgment of their police force.Consequently, District 14, which serves a very large Haitiancommunity in Lake Worth, initiated a plan to assist the HaitianNational Police and their families in one of the most impactedtowns known as “Croix-Des-Bouquets.”

Strategic plan overview:1. Assessment of the area and their needs: After speaking

with our government liaisons in Haiti, the town ‘Croix DesBouquets’ was selected. Why? Well, the town currently doesnot have an operating police station! Upon our arrival, wewill be meeting with a “Commissar” (district commander’srank equivalent) regarding their needs, which includerebuilding a run-down prison in the area. In addition to theinfrastructure problems, officers in the area lack “modestcommodities” such as boots, belts, flash lights, etc. One ofour goals, therefore, will be to collect extra pairs of boots,belts, cargo pants, batteries and flashlights, for the Haitianofficers.*

2. To provide a report to our official liaisons in Haiti oncurrent logistics and identify the required steps that willbring immediate benefits to the area: We have so far heldmeetings here in Florida with an organization known as“Solid Seed Ministries,” which has already established astrong foundation there. We will be flying down on May13th and return on May 15th with this partner.

3. Facilitate the delivery of 182 children’s sleeping cots. Wealready have acquired 182 children’s sleeping cots from alocal organization, for children who are currently sleepingon the ground in the streets of the town. We will identifywho will receive these cots, and solicit the assistance of anairline to deliver them.

4. Collection of relief items. District 14 will acquire a ship-ping container to be housed at the District 14 parking lot.We will collect donations to benefit the “Croix-Des-Bouquets” officers and their families. We anticipate contribu-tions from local LEO’s and/or citizens willing to spare theirused equipment, clothing, and extra food cans for Haiti.

Mission logistics and supportSpirit Airlines will fly the District 14 team members to

Haiti; this airline currently offers the cheapest available fare of $1095.00 for the four passengers. PBA President John Kazanjianhas pledged $1000.00 on behalf of the PBA to support this proj-ect. The difference and other related expenses (lodging, food,etc) will be paid for by the District 14 team members: CaptainSilva, Sgt. Ponce, D/S Desir and D/S Rouzeau. PBSO or the Cityof Lake Worth will have no financial obligation.

Project’s Timeline:1) Depart for Haiti May 13th and return May 15th .2) Facilitate delivery of the children’s sleeping cots before June

30th.3) Procure a shipment container to be housed at District 14

from Monarch Shipping by July 30th.4) Fill and send the container by September 1st.

On May 20, 2010, Ernie Georgewas elected Chairman of the

Criminal Justice Standards and Training Commission (CJSTC).CJSTC, for the uninitiated, is the 19 member commission whichsets up the training for all law enforcement and correctional offi-cers, decides if you get certified (meaning, you can work as an offi-cer), and decides whether or not to take away your certification(meaning, you can’t work as an officer).

It is an extraordinary honor and triumph for Ernie, FloridaPBA, and working stiffs throughout the law enforcement and cor-rections community.

My, my, how times have changed. Not so long ago,representatives of rank and file officers had to sit in theback of the bus—no, they weren’t even allowed onthe bus. Officers coming before the Commissionwere routinely decertified and humiliated in theprocess—even on the most trivial of charges. TheCommission of old had the attitude: “Let’s hangthe guilty bastard, then give him a fair trial.”Thankfully, due to the many years of persistentlegislative lobbying by PBA (led by Ernie andJohn Rivera), two most sympathetic governors(Bush and Crist), and a new cadre of progressive,fair-minded sheriffs (e.g. Sheriff Bradshaw), chiefs(e.g. Chief Romine), and other administrators (whosit on the Commission as well), the “hang ’em high,”kangaroo court mentality has now been replaced witha Commission that treats rank and file officers withrespect and fairness. This change didn’t just fall out ofthe sky or materialize overnight.

Allow me to digress and give a blow by blow account of howthis remarkable change came into being. I was there with Erniefrom beginning to end, so I have had a unique, inside view of howall of this happened.

Around 1990 when Ernie was President of Palm BeachCounty PBA, and I served as Florida PBA’s Chief Lobbyist, Inoticed Ernie start grumbling about how unfair CJSTC had beento some of his members, summarily running them off when theyshouldn’t have been. One day at the Capitol in 1992, the grum-bling got even more pronounced, and he gathered me up to gowith him to meet and discuss the problem with then SenatorRobert Wexler (later Congressman and Florida PBA HonoraryMember for many good reasons, including this story). SenatorWexler was Chairman of the Senate Criminal Justice Committee.We met with Senator Wexler and his staff director, and Ernie laidit all out about the unfairness of CJSTC and that a good startwould be to pass legislation which required rank and file officersto sit on the Commission, with the belief that rank and file officerswould be more sympathetic and understanding. Wexler listenedintently and then told the staff director: “Do what these guyswant.” And “do” he did. We worked hard with Senator Wexler,

and out of that came legislation requiring that at least one lawenforcement officer and one correctional officer serving on theCommission must be of the rank of sergeant or below. That wasthe beginning of many changes through the years.

Next year, Ernie noticed that these positions were not beingfilled by “sergeant or below” officers and that the old crowd wasbeing allowed to fill out their terms, which was FDLE’s misguidedinterpretation of the law. Back to the drawing board and more leg-islation. Legislation passed booting off the interlopers, mandatingthat the Governor comply with the law mandating “sergeant and

below” representation. As an added bonus, the legislation alsorequired an additional two rank and file officers be put on

the Commission.In 1994, when Jeb Bush ran for Governor and

narrowly lost, Ernie made a project of educatingJeb about the need to reform membership of theCJSTC. When Governor Bush won election in1998 (again with PBA’s backing), Ernie contin-ued that education with Governor Bush. In allthe meetings where we met with the Governor,and there were many, it seemed like the topic ofCJSTC came up just about every time. We found

a sympathetic and most helpful ear. By then,Ernie had become President of Florida PBA and

was honored by the Governor by being appointed asone of the commissioners with the rank of sergeant or

below. Unfortunately, his appointment was not wellreceived by the other 18 commissioners, and whenhe spoke up in support of deserving officers appear-

ing before the commission, the votes were mostly 18-1 against theofficer—with Ernie being on the short end of that stick. It got sohostile that he told John Rivera (now President of both Dade andFlorida PBA’s) and Dick Brickman (Senior Vice President of FloridaPBA) that they would have to attend the meetings with him andgive him moral support while he was taking his beatings on behalfof the officers. They did so. (John is now an appointed commis-sioner, and Dick still attends all the meetings.)

Next, Ernie, John and Dick noticed that accused officerswould often not have their cases resolved for two or three years—which meant that many officers could not work and support theirfamilies while the respective case went dragging on. Back to thedrawing board and more legislation. We got legislation passedwhich mandated that all investigations by the Commission had tobe resolved within 180 days after receiving the complaint.

Next, Ernie and his two compadres decided that more rankand file officers should be on the Commission. Back to the draw-ing board and more legislation. Another rank and file law enforce-ment officer was added to the Commission. Then another rank andfile officer was added in a subsequent legislative session. Thenanother rank and file officer was added shortly thereafter, bringingthe total to four law enforcement and one correctional officer.

Eighteen Years Of Fighting For FairnessPays Off

Next, the trio noticed that even though a total of five rank andfile officers were to be on the Commission, most of those whofinally got appointed seemed to be management wannabes andwere hardly supportive of deserving officerscoming before the Commission. It turned outthat FDLE and other management types hadgreat influence on which rank and file officersactually got on the Commission. Back to thedrawing board and more legislation. We cameup with the bright idea that a committee oughtto be set up, so that a list of six names would besubmitted by the committee, and the governorwould have to select one from that list. Whilewe were at it, we also added a provision addingyet another rank and file law enforcement offi-cer to the Commission (which meant five lawenforcement and one correctional officer of thesergeant or below rank). This was a most contentious piece of leg-islation. It passed and Governor Bush signed it into law—eventhough it cut into some of his powers as governor.

Today, PBA and FOP (PBA has four votes and FOP two) sitdown and come up with a list jointly agreed upon. This hasworked exceedingly well. Ernie George, John Rivera (President of

both Dade and Florida PBA’s), Pat Hanrahan(Broward County PBA President), Mick McHale(Southwest Florida PBA President), and NelsonCuba (Jacksonville FOP President) all serve ascommissioners appointed by Governors Bush andCrist. These appointees plus three other like-mind-ed commissioners add to the clout for rank and fileofficers (one law enforcement, one correctionalofficer below the rank of sergeant, plus AttorneyGeneral McCollum’s designee who is a former stateFOP president). The end result? Ernie no longerhas to endure being there by himself as in thoseearly day 18-1 votes against deserving officers.

After nine years of being a commissioner andmany more years of fighting the fight for justice, Ernie’s time hasfinally come. Officers coming before the Commission now get afair shake. Congratulations on your election, Ernie!

Most people think about sports when theyhear increased performance and

endurance; but if you’re not concerned aboutimproving your athletic abilities, what aboutimproving performance in life? Athletic perform-ance or ability was measured in a study as agili-

ty, balance, propioception, power, and speed reaction.(Studydone by Dr. Anthony Lauro and Brian Mouch) The reality isstrength and endurance are important factors in our daily lives.These things can help us complete our routine, mundane tasksmore efficiently, such as, housework and yard work. Many pro-fessions, including law enforcement, require physical strengthand high physical endurance at times. For example, someonemore agile, powerful, and with a good speed reaction is less like-ly to get injured on the job and it increases their safety.

Exercise is an obvious factor in improving strength andendurance; but even exercise may be limited by a person’s phys-ical alignment. If a person has had an injury that caused mis-alignments in the spine or other joints, certain movements andactivities may be less than optimal, no matter how hard youexercise.

What about chiropractic care? Many sports fanatics mayknow top athletes, such as Tiger Woods and Joe Montana, cred-

it their performance to chiropractic. When they sustain aninjury, like Joe Montana did, he received chiropractic care toimprove the alignment and function of his spine and extremities(ex: shoulders and knees). If they keep their foundation (theirspine) straight and keep their joints agile and moving properly,they improve their performance overall. This philosophy appliesto nonathletes as well. Everybody may not be an athlete, buteverybody has a job, chore, or physical activity that usuallyneeds to be done on a regular basis.

Seek out chiropractic so you can perform to your greatestability in athletics… and in life. “Pain is a very poor yardstick tomeasure health!” Don’t wait until it’s too late. Take care of youbody now and you will enjoy a lifetime of better and improvedhealth.

Law Enforcement Torch Run For Special Olympics 2010Submitted By Capt. Sarah J. Mooney, WPBPD

On Thursday, April 15th, the Law Enforcement Torch Runfor Special Olympics traveled through Palm Beach County.

Over one hundred officers participated in this multi-agency event,which covered 5.5 miles from Lantana Public Beach to the RoyalPalm School. At the conclusion of the run, the participants metwith the special needs students at the school and then had a con-tinental breakfast reception, made possible through a donationfrom the PBA. In addition to sponsoring the breakfast, the dona-tion from the PBA was added to the total amount raised for SpecialOlympics in Palm Beach County. Participating agencies sold hatsand shirts in addition to doing other fundraising events, with allproceeds going toward the support of Special Olympics. PalmBeach County law enforcement agencies consistently raise abouttwenty thousand dollars each year, which enables SpecialOlympics athletes to travel and participate in events throughoutthe state at no cost to their families.

This year, there was a great turnout by runners and supportpersonnel. Several agencies brought their command posts, SWATvehicles, bicycles, motors, and/or marked patrol cars. The partici-pation of all of the officers involved was a tribute to local lawenforcement’s commitment to serve the community. The agenciesactively involved in the fundraising efforts or the run itself includ-

ed Palm Beach County SO, Atlantis PD, Boynton Beach PD,Delray Beach PD, Department of Corrections, FederalProbation and Parole, Palm Beach Gardens PD, Jupiter PD,West Palm Beach PD, Lantana PD, Boca Raton PD, the FBI andPBSC- CJI staff members.

The beneficiaries of the event, the Special Olympic athletes,were very appreciative of the efforts of the officers. They cheeredas the caravan of runners and support personnel arrived at theschool, and were absolutely thrilled with their interaction with theparticipants; whether it was giving “high fives” or receiving “hon-orary badges” and goodie bags from the officers. It was an honorto participate in this event, which is made more special by the factthat so many fellow officers from different agencies participatesimply because it is a great cause. The Law Enforcement TorchRun is held every year, usually in April. There are many officerswho have participated in this event every year of their law enforce-ment careers. In addition, there are several retired officers whocontinue to participate; the feeling of goodwill and camaraderieduring this event is contagious. There is always room for morerunners, so I invite you to join us next year. Thanks to everyonewho supported and participated this year; I look forward to seeingyou again next year!

A Question Of RemembranceRespectfully Submitted By Lt. Michael Antonopoulos, SRB/WACOM, PBA Rep

Over the last several years, I have had the honor and privi-lege to sit on the Scholarship Committee for the

PBA/Kaitlin Kazanjian Scholarship Fund. I am always amazed atthe accomplishments and aspirations of the children of our PBAmembers as they get ready to start their college careers. Some ofthem are focused on what they want to do with the rest of theirlives and some are undecided, but all of them appear to be look-ing forward to their new challenges and adventures.

For most of these young adults, the opportunity to interviewfor this scholarship money is the first time that they will presentthemselves to other adults in a business-like way. It is an opportu-nity to dress appropriately and be knowledgeable enough toanswer simple questions, such as their grade point averages(GPAs) and interests. Also, you would imagine that since one ofthe scholarships is named the Kaitlin Kazanjian Scholarship, theywould have some knowledge about Kaitlin, and the scholarshipnamed in her honor.

Unfortunately, it was abundantly clear that ninety-five per-cent, or more, of the new candidates who applied and interviewedfor the scholarships had no knowledge of Kaitlin, and the circum-stances surrounding her tragic death. At first I was embarrassed atthe answers given by the kids as they were asked, “Do you knowabout the Kaitlin Kazanjian Scholarship and why we are heretoday?”, or “Do you know about Kaitlin Kazanjian?” But after theninth or tenth person came through and had no idea about whathappened to her, I realized that I shouldn’t be upset with these

kids for not knowing; it wasn’t their fault. Sadly, I realized that theparents of these young adults hadn’t prepared them for the inter-views. They hadn’t taken the time to ensure that their sons anddaughters were given the knowledge they needed to answer themost basic question of the Committee.

Kaz would then explain to everyone who didn’t know aboutKaitlin that she had been killed in a car crash years before, andthat this scholarship was created in her honor. That was theanswer that any one of the new candidates might have given, yetmost didn’t know. And Kaz always told them that answer, in justabout the same way every time. They weren’t made to feel badlyfor not knowing, we just felt that they should know about whathappened to Kaitlin.

This scholarship is John and Joanne Kazanjian’s way to honor,respect and keep the legacy and love of their daughter alive intheir thoughts and hearts. They want to share that love and thosethoughts with everyone who knew Kaitlin and those who didn’thave the privilege to know her. Telling the kids who interview forthe scholarship about Kaitlin is, I believe, John’s catharsis. It helpshim cope.

So, in the future, when our children fill out that scholarshipapplication for the PBA/Kaitlin Kazanjian Scholarship, honor herand her parents by telling your children about Kaitlin. Let themknow that the money they will be receiving is to help them andtheir parents with paying for college and that most of it is becauseof Kaitlin, and in her memory.

2010 Scholarship AwardsThe Palm Beach County PBA Charity Fund (which is comprised of Scholarship Awards from the Palm Beach County PBA, the

Kaitlin Kazanjian Scholarship Fund, the Brian Chappell Memorial Scholarship Fund, the Babbitt Johnson Osborne and LeClainche, P.A. Awards, the Matt Weiner Award for Computer Science and the Robert Preston Scholarship Awards) is pleased toannounce that there were 156 applicants interviewed on Saturday, June 19, 2010 with a total of over $130,000 in scholarshipmonies being awarded to the children of PBA members. PBA President and Charity Fund Chairman John Kazanjian would like tothank the following Committee members for their participation in the interview process: Charlie Nicastro, Bob Brown, RickMcAfee, Mike Antonopoulos, Ray Griffith, Pete Tartaglione, Jeff Jackson, Joe Berkery, Lou Penque, Chris Roaf, and Bill Lammie.

(1) (817.311 SS)From and after May 9, 1949, any person who shallwear or display a badge, button, insignia or other emblem, or shalluse the name of or claim to be a member of any benevolent, frater-nal, social, humane, or charitable organization, which organization isentitled to the exclusive use of such name and such badge, button,insignia or emblem either in the identical form or in such near resem-blance thereto as to be a colorable imitation thereof, unless such per-son is entitled so to do under the laws, rules and regulations of suchorganization, shall be guilty of a misdemeanor of the first degree,punishable as provided in S. 775.082 or S. 775.083.(2) This section shall be cumulative to any and all laws now in forcein the state.Florida Statutes (1987).
