DONATION INTER VIVOS

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF DONATION, made and executed by and among:

LUDOVICO J. SALINAS, of legal age, married to Remedios Salinas, formerly Filipino citizens now Naturalized American Citizens, with residence and postal address at 1706 North Russel Ave. Sta. Maria California USA 93458; And

ROMULO J.SALINAS, of legal age, married to Thelma Salinas, formerly Filipino citizens now Naturalized American Citizens, with residence and postal address at 1142 Plaza Miraleste Chula Vista California 91910-8107 USA, herein referred to as DONORS,

-IN FAVOR OF-

BENJAMIN J. SALINAS, of legal age, married to Susana F. Salinas, Filipinos, with residence and postal address at Pao, Manaoag, Pangasinan, hereinafter called DONEE,

WITNESSETH:

That the above-named parties are the co-owners of a parcel of land, more particularly described as follows:

TAX DECLARATION NO. 25606

A parcel of Unregistered Land, situated at Pao Manaoag, Pangasinan, containing an area of 1,545, more or less. Bounded on the North, by Angalacan River; on the East, by Julian Vinluan & lot 7 Saturnina Salinas Remillo; on the South, by Liborio Lazaro; and on West, by Lot 5, Felicidad Salinas Pecadiso. Boundaries are visible by means of natural objects and/or monuments, with a Fair Market Value of Php 17,360.00. The same is assessed in the amount of Php 5,940.00 issued by the Provincial Assessor of Pangasinan.

That, for and in consideration of the love and affection of the DONORS have for the DONEE, the said DONORS by these presents cedes, transfers, and conveys, by way of donation inter vivos, unto the said DONEE the real property above described, together with all the improvements existing thereon, free and clear of all liens and encumbrances;

That the DONORS does hereby state, for the purposes of giving full effect to this donation, that they have reserved for themselves in full ownership other property sufficient to support themselves in a manner appropriate to their needs.

ACCEPTANCE

That the DONEE does hereby accept the foregoing donation of the above-described property for which he expresses his sincerest appreciation and gratitude for the kindness and liberality shown by the DONORS.

That the above-described property is not tenanted and or being rented and not devoted to the production of rice and corn in whole and in p-art as of October 21, 1972 and/or on the date of registration.

That the above-described property not having been registered under the Spanish Mortgage Law nor under Act No. 496, the parties hereto agreed to register this instrument under the provisions of Section 194 of the Revised Administrative Code as amended by Act No. 3344.

That the provisions of Article 1623 of the New Civil Code and the Land Reform Code a amended had been complied with.

I, BENJAMIN J. SALINAS, of legal age, married to Susana F. Salinas, Filipinos, with residence and postal address at Pao, Manaoag, Pangasinan, after having been sworn according to law, hereby depose and say:

1. That I own a total aggregate landholding, including the area of 1545 square meters, more or less, that I am acquiring from Ludovico J. Salinas and Romulo J. Salinas by way of Donation Inter Vivos under ______________________________________________________________________________________________________________________________ , which does not exceed five (5) hectares;

2. That this affidavit is executed in compliance with DAR Administrative Order No. 1, series of 1989 as well as to show proof that my total aggregate landholdings inclusive of the land subject of the above-mentioned transaction does not exceed five (5) hectares.

1. That we waived to our brother, BENJAMIN J. SALINAS, our landholdings under Tax Declaration NO. 20421 located at Pao, Manaaoag, Pangasinan with an area of 3,324 square meters by way of Extrajudicial Settlement of Estate with Waiver of Rights under _____________________________________________________________________________which forms part of our retention area of not more than five (5) hectares;

2. That this affidavit is executed in compliance with DAR Administrative Order No. 1, series of 1989 as well as to show proof that the land subject of the above-mentioned transaction is a retention or portion of our retention area.
