    The states procurement process addresses such issues as ensuring fair, open, and transparentcompeon, and establishing vendor responsibility. State procurement must facilitate eachagencys mission while protecng the interests of the state and its taxpayers, and promongfairness in contracng with the business community. State agencies are required to purchasecommodies, services, and technologies in accordance with New York State Finance Law,Arcle 11. Guidance on Arcle 11 is set forth in the New York State Procurement Guidelines,issued by the New York State Procurement Council.

    State agencies purchase commodies, services and technologies to address a wide rangeof needs. To meet these varying needs, agencies are mandated to make purchases in thefollowing order:

    New York States Preferred Sources were statutorily created to advance certain social andeconomic goals. State agencies, public benet corporaons (including most public authories),municipalies, and school districts are required by law to purchase commodies and servicesfrom Preferred Sources rst if a Preferred Source oering meets the agencys form, funcon,and ulity. Commodies or services purchased from Preferred Sources are exempt from the

    compeve bid process. There are four Preferred Source organizaons in New York State:1. New York State Department Correcons and Community Supervision, Division of

    IndustriesCorcra, providing employment opportunies for inmates.

    2. NYS Preferred Source Program for People who are Blindemployment opportunies for blindand visually impaired New Yorkers.

    3. New York State Industries for the Disabled, providing employment opportunies for bothdisabled New Yorkers and veterans.

    4. New York State Oce of Mental HealthBuy OMH, providing employment opportuniesfor New Yorkers with mental illness and psychiatric disabilies.

    The New York State Oce of General Services (OGS) is responsible for the states system ofcentralized contracts. There are presently more than 1,500 centralized contracts in place,valued at over $2.5 billion. Contracts meet a broad range of commodies, services, andtechnologies that t the form, funcon, and ulity requirements of contract users. Generally,a centralized contract is established through an open, compeve-bid process among eligible

    businesses for the purchase of commodies. Service and technology contracts are procuredusing best value.

    In addion to state agencies, centralized contracts are also used by:

    State authories and public benet corporaons;

    Local governments and municipalies;

    Public and private elementary and secondary schools;

    Volunteer ambulance and re companies;

    There are three types of centralized state contracts, as follows. State agencies are required touse commodity, service and technology contracts that meet the agencys requirements withrespect to form, funcon and ulity.

    Commodity Contracts*: Examples are fuel, vehicle, oce supplies and food.

    Service Contracts*: Examples are small package delivery and elevator maintenance.

    Technology Contracts*: Examples are computers, printers, soware, andtelecommunicaons contracts.

    Third: Agency or Mul-Agency Established Contracts

    Agency or mul-agency contracts are contracts established by an agency or mulple agenciesto procure on an ongoing basis and are usually in eect for mulple years. The purchasingagency must determine if such a contract exists that meets its form, funcon, and ulityrequirements, and if the contract is structured to allow for inter-agency use.

    Fourth: Agency Conducts Its Own Procurement, Including Discreonary Spending

    When agency requirements cannot be met through a Preferred Source, centralized contract,or other exisng agency contract, agencies may conduct their own procurement. This typeof procurement may be either a formal compeve bid process or a discreonary spendingpurchase, depending on the value of the procurement.

    Discreonary purchases are procurements made below statutorily established monetary levels

    and at the discreon of the agencies. While discreonary purchases may not require a formalcompeve procurement process, agencies must document and jusfy the selecon andresponsibility of the vendor, including: reasonableness of price; compliance with the internalagency policies and procedures; and assurance that purchases meet form, funcon, and ulityrequirements.

    Important to know:

    Use of discreonary spending streamlines the procurement process;

    The discreonary purchasing authority threshold is $50,000 for most state agencies;

    Discreonary levels increase to $200,000 when state agencies are purchasing from a NewYork State Cered Minority or Women-Owned Business Enterprise or small business;

    Discreonary levels also increased to $200,000 for state agencies when purchasingcommodies or technology that are recycled or remanufactured; and

    Agency purchases esmated at $50,000 or more must be adversed on the New YorkState Contract Reporter.

    Businesses interested in learning about OGS centralized state contract bid opportunies shouldregister with the OGS Online Bidder Nocaon Service. Registraon is simple and free.The system allows businesses to create a prole with classicaon codes to match businesstypes. When bid opportunies occur related to the business classicaon, automac e-mailnocaons are sent out. To ensure e-mail and bid updates are received, businesses shouldcreate a general business e-mail account for receipt of bid nocaons, updates, and otherinformaon.

    Businesses should follow these further recommendaons to help in the bid process:

    Monitor the OGS Online Bid Calendar to view upcoming bid opportunies;

    Search for exisng contracts that oer the same goods or services that your business supplies;

    Study related contracts to learn about the typical terms and condions of contracts; and

    Start preparing for the next bid opportunity.

    Important to know:

    Term centralized contracts may be awarded for up to ve or more years;

    Certain centralized contracts may add new vendors through periodic or connuousrecruitement bid opportunies;

    A centralized contract award does not guarantee sales, but provides an opportunity for sales;

    Sales are generated when state agencies or other authorized users make purchasesfrom the centralized contract;

    Centralized contract value is based on esmated amounts of sales; and

    Businesses should market their products or services to eligible centralized contract usersin order to promote sales.

    A centralized state contract may allow vendors to parcipate as authorized resellers, dealers,distributors, or agents. This allows a manufacturer with a centralized contract award to marketand support the contract statewide, creang addional sale opportunies. In addion, the useof an authorized reseller, dealer, distributor, or agent promotes and provides opportunies forNew York States small, minority, or women-owned businesses.

    To learn more:

    Check exisng centralized contract terms to determine if the contract authorizes resellerparcipaon. Some common examples include centralized contracts for computerhardware and soware, printers and copiers, and audio/visual equipment; and

    Contact the manufacturer or contractor directly for parcipaon opportunies.

    Remember: All sales through an authorized contract reseller, dealer, distributor, or agent mustbe made in compliance with the centralized contracts terms and condions, and are limited tothe commodies and services approved under the centralized contract.

    The New York State Contract Reporter is New York States ocial publicaon of procurementacvity for all state agencies, public authories, and public benet corporaons. Municipaliesand local governments may also, but are not required to, submit ads. The Contract Reporterpublishes new ads and posts bid results every business day. All ads are searchable, archivedand retrievable.

    The Contract Reporter is free; however, businesses must register for general access. Anenhanced E Alert Bid Match service is available that noes an account holder when a bid orad is posted in the business category of interest. This enhanced service is free, but a registereduser must set up an account prole and choose the type of message and categories of interest.E Alert messages may contain the solicitaon tle with a link to the ad, the locaon of theproject, the name ohe agency solicing goods or services, and the bid due date.

    Important to know:

    It is important to note that there are many opportunies to become a subcontractor orsupplier to a prime construcon contractor.* Becoming a subcontractor is an excellent way fortrade businesses, or small, minority, or women-owned businesses to gain a foothold on doingbusiness with New York State.

    Businesses that could potenally be hired by prime contract holders as a subcontractor orsupplier should use the Contract Reporter and the Empire State Builder Newsleer to idenfyconstrucon projects in their area and nd out which companies were awarded contracts.Businesses are encouraged to market themselves directly to prime contractors.

    Cered Minority or Women-Owned Business Enterprises (MWBEs) should periodically reviewtheir business informaon in the states MWBE Directory to ensure that all contact and productinformaon is up to date. Prime contract holders use the directory to idenfy potenalsuppliers and subcontractors for fullling MWBE ulizaon goals.

    A responsible bidder is one that has the capacity to fully perform its contractual obligaons,and the integrity to jusfy the award of public dollars. State Finance Law and soundprocurement pracce dictate that state agencies take reasonable steps to ensure that publiccontracts are awarded to bidders that are responsive and responsible, including the capabilityto meet bid requirements and fully perform contractual obligaons, and possessing theintegrity to jusfy the award of public dollars. In short, businesses must demonstrate theirvendor responsibility prior to the award of the contract. Bidders must be responsive to all the

    bid requirements and must maintain responsibility throughout the term of the agreement.The responsibility determinaon is based upon the FliP review:

    Financial and organizaonal capacity;

    legal authority to do business with the state;

    integrity of the owners/ocers/principals/members and contract managers; and

    Past performance of the bidder on prior government contracts.

    The NYS VendRep System allows business enes (vendors) to enter and maintain their VendorResponsibility Quesonnaire informaon in a secure, centralized database. The system makesinformaon available to New York State agencies.

    The NYS VendRep System requires assignment of NYS Vendor ID number. The Vendor ID isneeded to:

    Enroll in the NYS VendRed System; and

    Receive payments.

    To obtain a Vendor ID, businesses should contact their contracng state agency. If you do nothave a contracng state agency, contact the OSC Help Desk.

    Preparing a Bid

    In addion to understanding how state agencies purchase and where to nd state bidopportunies, businesses should have a thorough understanding of the vocabulary ofprocurement. The most commonly used procurement words and phrases can be found in theGlossary of Terms in the New York State Procurement Guidelines. For example, within thestate bidding process, there are two main types of bids:

    Invitaon for Bid (IFB): Used in the procurement of commodies and awarded to theresponsive and responsible bidder on the basis of lowest price; and

    Request for Proposals (RFP): Used for procurements when factors in addion to cost areweighed. The contract is awarded to the responsive and responsible proposer oeringthe best value.

    Businesses should read the enre bid proposal, follow the bid instrucons, and review theirbid package for accuracy and completeness before submial. Other crical points for awardconsideraon include:

    Subming a mely bid (by law, even one minute late may result in a bid rejecon);

    Being responsive to all bid requirements;

    Subming a signed bid package complete with all the mandatory forms;

    Pricing the bid compevely;

    Demonstrang vendor responsibility; and

    Providing proper licenses, insurance, and current references where required.

    Note that during the inquiry period, businesses may submit quesons for claricaon to thedesignated contact.

    Once bids are received by the procuring agency, the award process may take several months tocomplete. The agency evaluates bids and makes a recommendaon for award to the Oce ofthe State Comptroller (OSC). OSC has up to 90 days to approve or reject a contract.

    The following resources provide contract award informaon:

    Th Oce of the State Comptroller Open Book includes state agency and localgovernment spending, including:

    -State Agency Contracts: Search acve state agency contracts and certain stateauthority contracts to see who is doing business with the stateinformaon isupdated daily.

    -Local Government Spending: View how county, city, town village, re or schooldistrict gets and spends moneyinformaon is updated daily.

    Th New York State Contract Reporter lists agency bid results, with the excepon of OGScentralized state contracts and OGS Design and Construcon contracts;

    Th OGS Procurement Services Group lists awarded centralized contracts and bidresults; and

    Th OGS website posts all OGS Design and Construcon contract awards.

    Businesses that were not successful may follow the specied process in the IFB or RFP torequest a debrieng. A debrieng will detail the shortcomings of a bid submission. During adebrieng, businesses should take notes and ask quesons.

    Markeng is a fundamental way for businesses to be recognized by the state agencies makingpurchasing decisions. Many markeng strategies for vendors trying to engage in business withNew York State have already been presented throughout this document. First and foremost, itis important to understand the buyer. As not all government enes are alikestate agencies,municipalies, and other enes operate under dierent laws and therefore have varyingpurchasing procedures and/or restricons:

    New York State agencies operate under State Finance Law (see the Order of PurchasingPriority for Agencies);

    Municipalies (e.g., counes, cies, towns) operate under General Municipal Law;

    Authories operate under Public Authority Law; and

    School districts operate under General Municipal Law and State Educaon Law.

    A New York State Small Business is dened as a company that is a resident to New York State,independently owned and operated, with 100 or fewer employees, and not dominant in itseld. There is no cercaon process to be considered a New York State Small Business. Themajority of businesses in New York State are small businesses; they supply over one-third ofthe services and commodies purchased by agencies under state centralized contracts. Whilesome small businesses may not have the capacity to bid on a centralized contract, many areable to gain experience by:

    Parcipang as authorized resellers, dealers, distributors, or agents for certaincentralized contracts;

    Becoming suppliers or subcontractors to prime contractors; or

    Idenfying discreonary purchasing opportunies.

    Minority and Women-Owned Business Enterprises (MWBEs)

    Execuve Law Arcle 15-A, signed into law in 1988, established guidelines for state agencies toestablish business and contract ulizaon goals for cered enterprises owned by minoriesand women. Arcle 15-A denes an MWBE as at least 51 percent owned and controlled byminority or women members. Contract spending thresholds establish goals for using NewYork-cered MWBEs as subcontractors or suppliers. Businesses meeng the criteria to qualifyas a New York-cered MWBE rm are strongly recommended to become cered.
