    III.REGULACINREGULACINREGULACINREGULACINEl Consejo de Estado de la Repblica Popular de China encarg al AQSIQ la elaboracin dela regulacin CCC. El AQSIQ y la Administracin para la Acreditacin y Certificacin (CNCA)desarrollaron conjuntamente la regulacin.

    La normativa reguladora vigente de la certificacin obligatoria de productos fue aprobada el26 de Mayo del 2009 por la Administracin General de Supervisin de la Calidad, Inspecciny Cuarentena (en adelante AQSIQ) y entr en vigor el 1 de Septiembre del 2009. Dicha normaclasifica el contenido y los mtodos de la certificacin obligatoria de productos y adems es-tipula el formato y el contenido de la certificacin.

    Los principales cambios introducidos por la legislacin vigente son:(i) Validez de 5 aos del Certificado obligatorio chino (CCC);

    (ii) Inspecciones regulares del CNCA (anualmente);

    (iii) Mejor definicin de las actividades de seguimiento de inspeccin de los produc-tos;

    (iv) Posibilidad de establecer un criterio para clasificar la frecuencia de las inspeccio-nes a las fabricas segn la trayectoria del fabricante;

    (v) Penalizaciones ms severas, pasando de 5 a 11 previsiones;

    (vi) Los fabricantes son los responsables de llevar a cabo la retirada de aquellos pro-ductos que no sean seguros. En caso de que el fabricante no lleve a cabo, el AQ-SIQ ser quien tenga la potestad para hacerlo; y

    (vii) Nuevas previsiones reforzando la obligacin de los rganos certificadores a man-tener la confidencialidad respecto al know-how y la propiedad intelectual.

    Actualmente los organismos certificadores autorizados que pueden llevar a cabo las inspec-ciones son once (ANEXO 1). El China Quality Certification Centre de Pekn (en adelante CQC)es uno de los organismos que dispone de informacin en ingls2, el resto de instituciones de

    certificacin presentan un perfil mucho menos internacional, y por lo tanto dejan al CQC co-

    mo la institucin de referencia para las empresas extranjeras.El sistema est constituido por tres regulaciones:

    1.1. Regulacin de la certificacin obligatoria de productos. (Anexo 2.1);

    1.2. Regulacin de la marca de la certificacin obligatoria de los productos. (MarcaCCC). (Anexo 2.2); y

    1.3. El catlogo de productos sujetos a certificacin obligatoria (actualizado en marzodel 2010). La lista puede sufrir modificaciones.

    Adems de las regulaciones arriba mencionadas se debe tener en cuenta los Avisos publica-dos por las autoridades competentes a travs de los cuales se llevan a cabo cambios en las

    regulaciones y en el catlogo. El AQSIQ, el CNCA y los departamentos del Consejo de Esta-do de la Republica Popular China son los responsables de redactar las enmiendas al catlo-go.

    Para determinar si los productos a exportar requieren el certificado CCC, el primer paso essu verificacin consultando el Catlogo de Productos Sujetos a Certificacin Obligatoria3. Silas descripciones que se dan en el catlogo no son suficientes, se puede consultar el listadode productos sujetos a CCC, catalogados por cdigo arancelario (Anexo 3) o como ltimorecurso recurrir directamente a la CNCA, organismo que tiene la ltima palabra.

    Los componentes de los productos acabados, piezas de repuesto y piezas de recambio,puede, en algunos casos, exigir la certificacin CCC.

    Una vez de que el producto a exportar est obligado a superar la certificacin CCC convieneasegurarse de que cumple los Estndares Nacionales.

    El sistema de certificacin CCC se basa en estndares nacionales chinos, conocidos por lassiglas GB y por ganar tiempo y ahorrar dinero es aconsejable que se haga una auto-evaluacin del producto para verificar si cumple los estndares exigidos. Estos estndarespueden estar basados en otras normas internacionales(por ejemplo los estndares EC), sineximir posibles diferencias.

    Cuando se determine que los productos estn sujetos a dichos estndares, hay que exami-nar si estn cualificados para optar a la exencin de la certificacin CCC.

    La exencin de ciertos productos ha de basarse en las normas propuestas en el anuncio N8 (2002) de CNCA sobre productos no sujetos a la certificacin CCC (Anexo 2.4) y en los ar-tculo 41 y 42 de Regulacin de la Certificacin Obligatoria de los Productos. (Anexo 2.1). Lasolicitud de esta exencin se presenta en el CNCA, aportando los siguientes documentos:

    Prueba de conformidad con las condiciones citadas para la exencin;

    Carta de garanta; y

    Declaracin de conformidad del producto (incluyendo informe de resultados de ensa-yo).

    1.1.1.1.ORGANISMO CERTIFICADOR

    En primer lugar habr que determinar cual es el organismo certificador pertinente para elproducto en cuestin. El CNCA ha designado, hasta el momento, 11 organismos certificado-res (Anexo 1). Cada uno de ellos se encarga de llevar a cabo la gestin del certificado de unaparte del catlogo de productos sujetos a certificacin.

    Segn establece el articulo 6 de la Regulacin de la certificacin obligatoria de productos(Anexo 2.1), los organismos y el personal responsables de la tramitacin de certificacin obli-gatoria de productos estn obligados a guardar secreto respecto de las confidencialidades

    tcnicas y comerciales as como de la tecnologa obtenida durante el proceso de certifica-cin.

    2.2.2.2.TRAMITACIN DE DOCUMENTOS

    Debido a que en la gran mayora de los organismos certificadores y laboratorios utilizan elchino como idioma de trabajo y los empleados no poseen conocimientos suficientes de in-gls, la barrera lingstica es importante. Por lo tanto, los fabricantes debern elegir la va pa-ra gestionar la certificacin:

    (i) A travs de terceras personas (distribuidor, agente, representante local), el cual

    gestionar a travs del organismo certificador la obtencin de la marca; o(ii) A travs de los organismos certificadores directamente, que se encarguen de la

    gestin del proceso. Cuando la va elegida sea esta, la barrera del idioma tambinpuede complicar la gestin de la documentacin a menos que se cuente con per-sonal que hable chino.

    3.3.3.3.SOLICITUD

    La solicitud de la certificacin obligatoria China (CCC), se presentar ante un organismo decertificacin autorizado, por el propio fabricante o por su asesor o agente autorizado. Segn

    establece la Regulacin de la certificacin obligatoria de productos (Anexo 2.1), en su artcu-lo 11, el solicitante deber proporcionar en determinados supuestos informacin tcnica adi-cional segn los requerimientos.

    El organismo certificador llevar a cabo una revisin inicial y un estudio de la solicitud.

    Si la solicitud no se ajusta a los requisitos mnimos, el organismo certificador rechazar lasolicitud y devolver la documentacin al solicitante, quien, en determinados supuestos po-dr subsanar los errores y volver a presentar la documentacin. Si la solicitud se ajusta a losrequisitos mnimos, el organismo certificador emitir una notificacin de aceptacin y la en-viar al solicitante, quin deber seguir con los siguientes pasos de la tramitacin.

    A excepcin del China Quality Certification Centre (CQC), los organismos certificadores nosuelen utilizar documentacin en ingls. Sin embargo, cuando los solicitantes extranjerosproporcionan la informacin de sus productos slo en ingls, el certificado se les expide eningls. Se recomienda que los solicitantes cumplimenten el formulario en ambos idiomas de-

    bido a que las empresas locales necesitan un certificado en chino para poder vender sus

    productos en China. La informacin especfica a aportar es: (i) nombre y direccin del solici-tante; (ii) marca registrada; (iii) nombre y direccin del fabricante; (iv) nombre y direccin dela fbrica; (v) nombre, modelo y especificaciones del producto; y (vi) estndares y requisitostcnicos para el producto.

    Parte del proceso de solicitud exige a los solicitantes la presentacin de pruebas del registrode la marca4porque el certificado CCC incluye la marca del producto. Muchos solicitantesextranjeros no aportan este material, por lo que el elemento marca de su certificado CCC es-t vaco. Esto puede causar dificultades al propietario de la marca en el futuro.

    4.4.4.4.OBTENCIN DE LA CERTIFICACIN

    Una vez aprobada la solicitud y enviada la notificacin de aceptacin por parte del organis-mo certificador, el solicitante deber pagar la cuota de la certificacin. Una vez pagada lacuota, el ente certificador asignar a uno de los laboratorios autorizados la tarea de ensayodel producto y enviar la notificacin al solicitante informndole cual es el laboratorio quellevar a cabo la evaluacin del producto.

    Actualmente existen 156 laboratorios con autorizacin para llevar a cabo pruebas basadasen los estndares GB que puede emitir informes al respecto. Cada uno de ellos evala unadeterminada lnea de productos dentro de las categoras sujetas a certificacin.

    El solicitante deber enviar las muestras al laboratorio asignado, quin notificar al ente cer-

    tificador la recepcin de las muestras e iniciar el proceso de ensayo de las mismas y lascomparar con muestras extradas del mercado local. Una vez realizados los ensayos, el la-boratorio deber enviar informe al ente certificador.

    Segn establece la Regulacin de la certificacin obligatoria de productos. (Anexo 2.1) en suartculo 14, el laboratorio responsable de los ensayos deber asegurar la autenticidad y laprecisin de los resultados de los ensayos, adems de guardar en un archivo todo el proce-dimiento utilizado.

    Del informe emitido por el laboratorio pueden darse dos resultados:

    Que el producto no este conforme con los requisitos de la certificacin. En este su-

    puesto, el ente certificador deber notificar al solicitante mediante escrito, explicandolas razones de la denegacin de la certificacin.

    Dispone el artculo 47 de la Regulacin de la certificacin obligatoria de productos(Anexo 2.1), si el solicitante no est de acuerdo con la decisin del ente de certifica-cin, deber apelar ante el mismo ente y si sigue en desacuerdo, una vez haya ape-lado, deber apelar nuevamente pero ahora ante el CNCA.

    Que el producto sea conforme a los requisitos de la certificacin y por lo tanto segui-ra el proceso regulado para la adquisicin de la certificacin, es decir, se pasara a lafase de inspeccin de la fbrica y sus instalaciones (se debe tener en cuenta que la

    inspeccin se lleva a cabo en todas las instalaciones que participan en el proceso de

    elaboracin del producto final para el cual se solicita la certificacin). Ser el ente cer-tificador quin asignar un inspector nacional certificador registrado para llevar a ca-bo la inspeccin de las fbricas.

    Dispone el artculo 16 del mismo reglamento, una vez el ente certificador haya termi-nado con esta parte del procedimiento y tanto el producto como las instalaciones delsolicitante estn conforme a los requisitos exigidos por la certificacin, bajo circuns-tancias normales, a los 90 das despus de iniciar la solicitud, se deber expedir elcertificado y notificar al solicitante la aceptacin.

    Ser el CNCA el responsable de especificar el contenido y el formato del certificado, ademsdel tipo de marcas CCC explicadas en el siguiente apartado. Como dispone el artculo 22 del

    reglamento, el certificado tendr un plazo de validez de 5 aos y para su ampliacin, cuandodicho plazo est cerca de expirar, el solicitante deber cursar la solicitud antes de los 90 d-as antes de la fecha de caducidad, al ente certificador correspondiente.

    5.5.5.5.LA MARCA CCC

    La marca CCC est regulada en el Announcement No I [2001] by the Certification and Ac-creditation Administration of the People's Republic of China (CNCA), (Anexo 2.2). Establecedicho reglamento en su artculo 3 que CNCA ser la autoridad responsable de la aprobacindel diseo, el anuncio de los cambios en la implementacin y la supervisin.

    La marca CCC est compuesta por dos partes, un diseo patrn y una letra de referenciaque indica el tipo de producto, segn establece el artculo 7 del reglamento. Dispone el art-culo 11 que la marca CCC se colocar en el producto segn la naturaleza del mismo.

    El fabricante podr comprar las etiquetas a travs de imprentas designadas por el CNCA obien podr solicitar al CNCA que le autorice la produccin de sus propias etiquetas previosometimiento del diseo a una agencia designada por el CNCA, todo ello segn lo dispuestopor los artculo 14 y 15 del reglamento.

    Para solicitar el etiquetado al CNCA el fabricante, adems de presentar la solicitud al entedesignado por el CNCA, tambin deber presentar copia del certificado.

    6.6.6.6.TIEMPO Y COSTES

    Segn lo establecido por la Regulacin de la certificacin obligatoria de productos (Anexo2.1), lo normal es que el proceso de solicitud de la marca CCC tarde 90 das, aunque puedealargarse por los requerimientos de obtencin de visados y otros factores.

    En cuanto a los costes que pueda suponer, variarn dependiendo del producto. Sin embar-go, el coste aproximado se puede calcular partiendo de los costes bsicos:

    7.7.7.7.SEGUIMIENTO

    El seguimiento de los productos se realiza a travs de inspecciones peridicas de productosy fbricas, por lo menos una vez al ao.

    Dispone el artculo 34 de la regulacin de la certificacin obligatoria de productos (Anexo2.1), el CNCA ser el responsable de llevar a cabo la inspeccin anual e inspecciones peri-dicas de los productos y de las instalaciones del poseedor de la certificacin, pudiendo can-celar o suspender las certificaciones segn los resultados de dichas inspecciones.

    Segn establece el artculo 36 del reglamento, el poseedor del certificado no podr impedir

    que la inspeccin se lleve a cabo.

    Durante las inspecciones de seguimiento, los inspectores revisarn la capacidad de las ins-

    talaciones para asegurar la calidad de los productos y la coherencia de los mismos con lasnormas.

    La duracin de las inspecciones depender del nmero de productos certificados y el nme-ro y tamao de las fbricas a ser inspeccionadas. Si es necesario, los inspectores podrncoger muestras aleatorias de productos para su posterior anlisis. Si la inspeccin resultafavorable, el producto retendr la certificacin. Si no es as, el CNCA podr cancelar o sus-pender el certificado y como dispone el artculo 29 del reglamento, todo aquel producto queno est de acuerdo con los requisitos exigidos para la certificacin no podrn salir de la f-brica, ser importados o ser usados con propsito comercial.

    Segn el Aviso N 7/2008 de CNCA (Administracin China de Certificacin y Acreditacin)publicado el da 28 de enero de 2008, algunos productos de seguridad informtica iban a re-querir el certificado del CCC despus del 1 de mayo de 2009 (Anexo 4), pero la entrada envigor de dicho aviso se ha pospuesto hasta el 1 de mayo de 2010. Segn el gobierno chino,la marca CCC para los productos de seguridad informtica slo ser necesaria para los su-puestos de adquisiciones pblicas.

    Como consecuencia de las intenciones de China de exigir la marca CCC para productos de

    El objetivo del Background Paper es hacer ver a China que no es necesario establecer unsistema de certificacin propio para los productos de seguridad informtica, sino que debe-ran adoptar el criterio comn aceptado por los dems pases, convirtindose as en un pasmiembro del CCRA.

    a algunos detalles que pueden dificultar la obtencin de ese certificado.5Las principales l-

    neas a seguir segn el grupo de trabajo creado por la UE para estudiar el tema son:9999.1.1.1.1....     Segn los estudios realizados por grupos de trabajo de la UE durante el proceso de certifi-cacin:

    (i) el producto puede ser testado de diferentes formas y en diferentes laboratorios lo que difi-culta la obtencin del certificado;

    (ii) debido a la gran variedad de categoras, la certificacin de los productos es cada vezms complicada y detallada, lo que ralentiza el proceso;

    (iii) al ser ms lento el proceso, ms tiempo tarda hasta que el producto entra en el mercado;

    (iv) muchas veces se requieren informaciones que no son necesarias; y

    (v) se solicitan informacin confidencial que muchas veces no son necesarias para el proce-so y que puede terminar transfirindose a la competencia.

    Segn publica la Cmara Europea en el European Business in China Position Paper2009/2010, para evitar que eso tenga lugar, China debera, entre otras cosas, fusionar algu-nas categoras de productos para que un certificado abarque un mayor nmero de produc-tos, disminuir la frecuencia de la inspecciones de fbricas, permitir entes certificadores ex-tranjeros llevar a cabo las inspecciones internacionales y permitir que laboratorios extranje-ros analicen los productos.

    Segn el estudio, las empresas extranjeras tienen mayor dificultad para participar en los co-mits tcnicos (TCs, technical commites) y grupos de trabajo (WGs, working groups) y unavez dentro, no tienen los mismos derechos que las empresas chinas. Adems, segn la pu-blicacin las autoridades chinas deberan autorizar publicaciones traducidas al ingls sobrelos nuevos estndares para as disminuir las incertidumbres que puedan surgir durante elproceso.

    Segn determina el estudio, existe una falta de transparencia dentro del proceso de estanda-

    rizacin chino, la diversidad de entes certificadores genera confusin y el gobierno chino uti-liza dichos estndares como una condicin necesaria para entrar en el mercado.

    Para la UE, la creacin de un mercado prspero pasa por permitir acceso libre y justo a la in-formacin de los estndares a todos los que participan en dicho mercado.

    La vigilancia del mercado es una buena forma de monitorear y contribuir el crecimiento delmercado. En China, las autoridades responsables de la vigilancia de los mercados son elAQSIQ y el Ministerio de Industria y Comercio (SAIC, por su sigla en ingls). Pero segn elestudio, no est claro cules son las funciones exactas de cada uno de esas instituciones.

    Article 2Article 2Article 2Article 2 In order to protect state safety, prevent deceptive practices, protect human life orsafety, animal or plant life or health, and the environment, the state specifies that productsrelating to the above issues be subject to compulsory certification (hereinafter uniformly re-ferred to as Compulsory Product Certification). Only after being certified and when displaying

    certification marks may such products leave the factory and be placed on the market, im-ported or used for any commercial purposes.

    Article 3Article 3Article 3Article 3 The General Administration of Quality Supervision, Inspection and Quarantine of thePeople's Republic of China (hereinafter referred to as State General

    Administration of Quality Supervision, Inspection and Quarantine (AQSIQ)) is in charge ofcompulsory state product certification.

    The Certification and Accreditation Administration of the People's Republic of China (herein-after referred to as State Certification and Accreditation Administration) (CNCA) is responsi-ble for the organisation and practice, supervision and management, and comprehensive co-

    ordination of the certification operation.The local level Bureau of Quality and Technical Supervision and the local Entry-Exit Inspec-tion and Quarantine Bureau (hereinafter uniformly referred to as Local Certification Supervi-sion and Administration Department) shall, according to their respective obligations and inkeeping within the law, within the district under their jurisdiction, be responsible for the su-pervision and inspection of compulsory product certification.

    Article 4Article 4Article 4Article 4 With regard to products which are subject to compulsory certification, the stateshall unify the Product Catalogue (hereinafter referred to as the Catalogue), shall unify themandatory requirement of technical standards, standards and conformity assessment proce-dures, as well as unify certification marks and standard fees.

    Catalogue, which is promulgated by the State General Administration of Quality Supervision,Inspection and Quarantine and the State Certification and Accreditation Administration, aswell as any related authorities which helped implement the Catalogue.

The mutual recognition exer-cise should be carried out within the framework of the International Mutual RecognitionAgreement signed by the State Certification and Accreditation Administration or the relateddepartments authorised by the State Certification and Accreditation Administration.

    ArticleArticleArticleArticle 7777 The primary standard on compulsory product certification shall be formulated andpromulgate by the State General Administration of Quality Supervision, Inspection and Quar-antine and the State Certification and Accreditation Administration, the regulations for thecertification of the compulsory product (hereinafter referred to as Certification Regulations)shall be formulated and promulgated by the State Certification and Accreditation Administra-tion.

    Article 8Article 8Article 8Article 8 Certification of the compulsory product should be applicable to one certificationmodel or a combination of multiple certification models, as listed below:

    (1) Design appraisal;

    (2) Type test;

    (3) Test or inspection samples taken from the factory;

    (4) Test or inspection samples taken from the market;

    (5) Inspection of manufacturer quality assurance system and product consistency;

    (6) Follow-up inspection on certified products.

    In accordance with the principles of science and convenience, the choice of product certifi-

    cation model should be made on the basis of comprehensive factors such as product per-formance, the degree of possible detriment to national security, human health, the environ-ment, the product life cycle and production, and any risks associated with the importedproduct.

    Article 9Article 9Article 9Article 9 (Implementation Rules) The implementation rules should include the followingguidelines:

    (1) Scope of applicable product;

    (2) Mandatory requirements of national standards, occupation standards and the nationaltechnical regulations which correspond to the applicable products;

    (3) Certification model;(4) Application of the principles and rules for product unit division;

    (6) Requirements for the confirmation of key parts and components or the raw materials(when necessary);

    (7) Requirements for testing standards and rules (where applicable);

    (8) Requirements for factory inspection;

    (9) Requirements for follow-up inspection after obtaining a certificate;

    (10) Requirements for the validity period of the certification certificate;

    (11) Requirements for applying certification marks to certified products;

    (12) Other requirements.

    Article 10Article 10Article 10Article 10 The manufacturer, seller, or importer (hereinafter uniformly referred to as the Ap-plicant) of the Catalogue covered product shall entrust a certification body designated by theState Certification and Accreditation Administration (hereinafter referred to as CertificationBody) to carry out certification regarding product manufacturing, selling or importing.

    In the event of entrusting other enterprises to manufacture the Catalogue covered product,either the entrustor or the entrusted enterprise may apply to the Certification Body for Certifi-cation Entrusting.

    Article 11Article 11Article 11Article 11 The Applicant shall, according to the implementation rules on the specific product,submit relevant technical information to the Certification Body.

    When the seller or importer of the product acts as the Applicant, they should also submit acorresponding copy of the contract signed by the seller and the manufacturer or the importerand the manufacturer to the Certification Body.

    In the event of entrusting other enterprises to manufacture the Catalogue covered product,the Applicant should also submit a corresponding copy of the contract signed by the entrus-tor and entrusted enterprise to the Certification Body.

    Article 12Article 12Article 12Article 12 After the Certification Entrusting is accepted the Certification Body shall arrangeproduct type testing and factory inspection in accordance with the certification rules on thespecific product.

    Article 13Article 13Article 13Article 13 The Applicant shall ensure that the samples and actual product produced andsupplied by it are identical; the Certification Body should carry out an authenticity investiga-tion of samples provided by the Applicant.

    The Certification Body shall, according to the requirements of the implementation rules andon the basis of the unique features of the product and actual situation, adopt a sample mode.For example, taking a sample from the factory or after the sample is sealed up on-site, theApplicant then delivers the sample and a laboratory is entrusted to carry out sample typetest, as designated by the State Certification and Accreditation Administration (hereinafter re-ferred to as the Laboratory).

    ensure the authenticity and accuracy of the test results, and shall make a complete record ofthe entire test process, keeping it on file so as to ensure that the test process and result re-

    out follow-up inspections of the certified product.The Laboratory and concerned personnel shall be responsible for the content of the test re-port and the test results drawn up by them; if there is any doubt surrounding the authenticityof the sample, the situation should be explained to the Certification Body, and correspondingpenalties should be imposed.

    Article 15Article 15Article 15Article 15 When factory inspection is required, the Certification Body shall appoint a nationalregistered certification inspector to carry out inspections of the compulsory product by fol-lowing the implementation rules for each specified product, with regard to manufacturerquality assurance ability and the consistency of the actual product and the type-tested sam-ple, for example.

    The Certification Body and the certification inspectors of the compulsory product shall be re-sponsible for the inspection results.

    ArticleArticleArticleArticle 16161616 With regard to products that conform to the certification requirements, after theCertification Body has completed the product type test and factory inspection it shall, underusual circumstances, issue the certificate and notify the Applicant within 90 days of the dateof the receipt of acceptance.

    With regard to products that do not conform to certification requirements, the CertificationBody shall notify the Applicant in writing, and explain the reason for the rejection of the prod-uct.

    The Certification Body and personnel concerned shall be responsible for the certification re-sults they issue.

    Article 17Article 17Article 17Article 17 (Follow-up Inspection after Certification) With regard to certified products andmanufacturers of said products, the Certification Body shall adopt methods for testing andinspecting samples taken from the factory, testing and inspecting samples taken from themarket, testing for quality assurance ability; carry out classified administration and effectivefollow-up inspections; control and verify the consistency of the certified product and typetested sample, and the quality assurance ability of the manufacturer to continuously conformto the certification requirements.

    Article 18Article 18Article 18Article 18 The Certification Body shall make a complete record of the whole follow-up in-spection process, keeping it on file so as to ensure that the inspection process and resultscan be traced.

    With regard to products that no longer conform to the certification requirements, the Certifi-cation Body shall, according to the corresponding situation, publicly suspend or cancel theproduct certification.

    Article 19Article 19Article 19Article 19 The Certification Body shall, according to the implementation rules of the certifica-tion regulation and on the basis of different factors such as safety grade, production technol-ogy, production batches, model type, product upgrade level, and product quality stability of

    the certified product, carry out classified follow-up inspection administration on certifiedproducts and related manufacturers so as to determine reasonable follow-up inspection fre-quencies.

    Article 20Article 20Article 20Article 20 The State Certification and Accreditation Administration uniformly specifies theformat, content of the certification certificate (hereinafter referred to as the Certificate) andthe style and type of the certification marks (hereinafter referred to as Certification Mark) forcompulsory products.

    Article 21Article 21Article 21Article 21 The Certificate shall contain the following basic information:

    (1) Name and address of the Applicant;

    (2) Name and address of the product producer (manufacturer);

    (3) Name and address of the entrusted manufacturer (where applicable);

    (4) Product name, series, specification and type;(5) Certification argument;

    (6) Certification model (where applicable);

    (7) Date on which Certificate granted and validity period;

    (8) Name of Certification Body that granted the Certificate;

    (9) Serial number of the Certificate;

    (10) Other information that needs to be displayed.

    ArticArticArticArticle 22le 22le 22le 22 The validity period of the Certificate is 5 years.

    On the basis of the follow-up inspection results of the certified product and its manufacturer,the Certification Body should display a valid web address and a hotline phone number for theannual inspection on the Certificate.

    When the validity period of the Certificate is near expiry, the Applicant should submit an ex-tension application within 90 days before the certificate expiration date to continue to use itcorrectly.

    Article 23Article 23Article 23Article 23 The content of the certificate displayed on the certified product and its sales pack-aging should be identical to the content of the Certificate itself, and should conform to rele-vant national administration rules for product symbols.

    Article 24Article 24Article 24Article 24 Under any of the following circumstances, the Applicant should submit an applica-tion to the Certification Body to apply for the modification of the Certificate, and the Certifica-tion Body shall make corresponding amendments according to the circumstances.

    (1) Changes to how a certified product is named; the product name or type is changed lead-ing to the manufacturer of the certified product, manufacturer name, and address beingchanged, after verification by the Certification Body modify the Certificate.

    (2) Changes to the certified product type, which are not related to safety property and elec-tromagnetic compatibility; or reduction of the same product model of the certified product af-ter verification by the Certification Body modify the Certificate.

    (3) Changes to key components and parts, specification and type of the certified product, aswell as its design, structure, technology and material or manufacturer for raw materials,

    which is related to the whole safety unit or electromagnetic compatibility, after verification by

    the Certification Body modify the Certificate.(4) The changes of the manufacturer location, production condition or the manufacturer qual-ity control system of the certified product, after verification by the Certification Body modifythe Certificate.

    (5) Other circumstances modify the Certificate.

    Article 25Article 25Article 25Article 25 (Prolonging the Certificate) Applicants requiring that the certification of a productbe prolonged shall apply to the Certification Body for the prolongation of the Certificate. TheCertification Body shall check the consistency of the product with the original certified prod-uct and confirm the authentication of the original certification results applicable to the prod-uct. After quality confirmation, the Certification Body may agree with the request of the Ap-

    plicant to issue an independent certificate or re-issue the Certificate.

    In accordance with the requirements of the implementation rules, the Certification Body maycarry out additional product type testing or factory inspection based on variation.

    Article 26Article 26Article 26Article 26 The Certification Body should publicly write off the certification under any of thefollowing circumstances:

    (1) When the validity period of the Certificate is over and the Applicant has not applied for theCertificate to be prolonged;

    (2) Production of the certified product has ceased;

    (3) The type of the certified product is listed in the product catalogue with a national explicitorder to eliminate or ban production of the said product;

    (4) The Applicant applied for the cancellation of the Certificate.

    (5) Other circumstances, according to the law, under which the Certificate should be writtenoff.

    Article 27Article 27Article 27Article 27 Under any of the following situations, the Certification Body should, according tothe time limit specified in the implementation rules, publicly suspend a Certificate:

    (1) Changes to the Certification Argument or implementation rules applicable to the productthat cause products produced within the specified time limit to not conform to the new re-

    quirements;(2) If it is discovered during the follow-up inspection that the Applicant acts against the im-plementation rules;

    (3) If for no legitimate reason the Applicant refuses to accept follow-up inspection or if thefollow-up inspection reveals that the product no longer conforms to the certification require-ments;

    (4) The Applicant applied to suspend the Certificate;

    (5) Other circumstances, according to the law, under which the Certificate should be sus-pended.

    Article 28Article 28Article 28Article 28 Under any of the following conditions, the Certification Body shall publicly cancelthe Certificate:

    (1) If the certified product is faulty, or the product has caused an accident;

    (2) If the follow-up inspection reveals that the certified product is not identical to the sampleproduct provided by the Applicant;

    (3) If, during the Certificate suspension period, the Applicant did not adopt measures for ref-ormation and consolidation, or after reformation and consolidation the product is still notqualified.

    (4) If the Applicant obtained the Certificate through an improper method such as cheating orbribery.

    (6) Other circumstances, according to the law, under which the Certificate should be can-celled.

    Article 29Article 29Article 29Article 29 (Rules for Certificate being written-off, suspended or cancelled) With regard to cer-tified products which have had their Certificate written-off, suspended or cancelled, the Cer-tification Body shall determine the product type and product range which does not conformto the certification requirements.

    From the date of writing-off or cancelling the Certificate or during the Certificate suspensionperiod, a product which is not in line with the certification requirements must not leave thefactory, be marketed, imported or used for any other commercial purposes.

    Article 30Article 30Article 30Article 30 (Style of the Certification Mark) The Certification Mark is composed of a basic pat-tern and displays the certification type; the basic pattern is as below:

    The CCC in the basic pattern is the English abbreviation China Compulsory Certification.

    Article 31Article 31Article 31Article 31 (Display Rules for Mark Type) The certification type should be displayed on theright-hand side of the basic pattern of the certification mark. It is composed of first letters forthe English name representing the certification type of the product.

    In accordance with the requirements of compulsory product certification, the State Certifica-tion and Accreditation Administration shall draw up specific requests concerning the display-ing of certification types.

    Article 32Article 32Article 32Article 32 The Applicant should set up management rules for the use of the CertificationMark, accurately record and file the actual applied situations of the certification mark and,

    according to the implementation rules, correctly use and display the Certification Mark on theproduct and its packaging, publicity material such as advertisements, and product informa-tion.

    Article 34Article 34Article 34Article 34 The State Certification and Accreditation Administration carries out annual super-visory inspection and non-regular special item supervisory inspections of the CertificationBody, Inspection Institution and the certification, inspection and testing activities of theLaboratory.

    Article 35Article 35Article 35Article 35 The Certification Body shall report information such as that about the Applicant ofthe certified product, certified product and its manufacturer, as well as the writing off, sus-pension or cancelling of the Certificate to the State Certification and Accreditation Admini-stration and Local Province Certification Supervision and Administration Department.

    Article 36Article 36Article 36Article 36 Planed by State General Administration of Quality Supervision, Inspection andQuarantine, the State Certification and Accreditation Administration and the Local Certifica-tion Supervision and Administration Department shall adopt the method of regular and non-regular supervisory inspection of the certified product.

    The manufacturer, seller, importer and commercial user of the certified product is not permit-ted to refuse the supervisory inspection.

    The State Certification and Accreditation Administration shall set up a publication system forcertified products and their manufacturers, and shall publicly publish the supervisory inspec-tion results.

    Article 37Article 37Article 37Article 37 The Local Certification Supervision and Administration Department shall, accord-ing to related law and on the basis of its own obligations, within the district under its admini-stration, carry out supervisory inspections of the compulsory product certification, investigateinto and deal with unlawful practice accordingly.

    With regard to Catalogue covered products that have not left the factory or been sold, theLocal Certification Supervision and Administration Department shall urge the manufacturer ofthe products to carry out certification procedures promptly.

    Article 38Article 38Article 38Article 38 When the Local Certification Supervision and Administration Department carriesout supervisory inspection of compulsory product certification, they may legally enter the

    production operating site and carry out on-site inspection, consult, reproduce, close down,distrain any contract concerned, receipt, account book or other information, close down, dis-train any product which is not certified or which does not conform to the certification re-quirements.

    Article 39Article 39Article 39Article 39 When the manufacturer or seller of the Catalogue covered product discovers theproduct they are producing or selling may be dangerous to human safety, may be damagingto human health, human life or human safety, then this information should be made public,and measures such as product recall should be adopted and the product should be reportedto the quality inspection department according to related regulations.

    In the event that the manufacturer or seller of the Catalogue covered product does not fulfil

    the obligations specified above, the State General Administration of Quality Supervision, In-spection and Quarantine shall start the product recall process, order the manufacturer to re-call its product and the seller to stop selling the product.

    of the imported products listed in the Catalogue, must check testimonial documents such asthe Certificate and Certification Mark, and must check that the goods conform to the Certifi-cate. Products that do not qualify after verification shall be dealt with according to relevantlaw.

    Article 41Article 41Article 41Article 41 Under any of the following circumstances, products are not required to go throughthe procedure of compulsory product certification upon entry:

    (1) The articles are for foreign diplomatic and consular missions in China and international or-ganisations in China, and the personal belongings of diplomatic personnel;

    (2) The articles are for the official organisation of Hong Kong, or Macao Special Administra-tive Region government offices in mainland China and the personal belongings of its staff

    member;

    (3) The personal belongings are carried into China from outside China in person by entry per-sonnel.

    (4) The articles are gifts between governments;

    (5) Other situations when, according to law, compulsory product certification procedure isnot required.

    Article 42Article 42Article 42Article 42 Under any of the following conditions, the producer, importer, seller or agent ofthe Catalogue covered product may request exemption certification from their local Entry-Exit Inspection and Quarantine Bureau, and submit information such as concerned testimo-nial, letter of guarantee for liabilities, product conformity declaration (including type test re-port), after the approval and obtaining the CCC Exemption Certification, after which they maythen import, according to the declared purpose for use:

    (1) The product is for the purpose of scientific research or tests;

    (2) The imported parts and components are required by the production line for the purpose ofassessing technical equipment;

    (3) The product is directly used for reasons of maintenance by the end consumer;

    (4) The equipment/parts are for the purpose of forming a complete set of production line/ fac-tory production line (office supplies are not included);

    (5) The product is only for the purpose of commercial display, and is not for sale;

    (6) The product only needs to be temporarily imported, and shall need to be returned at alater date (exhibit included);

    (7) The target is to export all complete units while importing parts/components by using ordi-nary trade methods;

    (8) The target is to export all complete units while processing imported materials or materialssupplied by clients;

    (9) Other circumstances under which, according to the law, compulsory products may be ex-

    empt from certification.

    Article 43Article 43Article 43Article 43 In the event that the Certification Body, the inspection institution, or the Labora-

    tory is in one of the following situations, the State Certification and Accreditation Administra-tion must order the institution to make improvements and consolidate within a certain timelimit; while these improvements and consolidation are being made, the institution may notengage in compulsory product certification, inspection, or test activities within a designatedrange:

    (1) If the primary regulations of certification and the procedures specified in the implementa-tion rules are increased, reduced, omitted or changed;

    (2) If effective follow-up inspection of the product certified by the institution was not carriedout, or if it is revealed that the product certified by the institution is not able to continuouslyconform to the certification requirements, but did not suspend or publicly cancel the Certifi-

    cate promptly;(3) If the certification process, inspection, and test were not recorded and filed completely,under serious circumstances;

    (4) If unqualified personnel were employed to deal with certification, inspection, test activities,under serious circumstances;

    (5) If no investigation was carried out with regard to the authenticity of the samples providedby the Applicants;

    (6) If the certification or law enforced inspection carried out by the Local Certification

    Supervision and Administration Department is obstructed or disturbed;

    (7) If compulsory certification is carried out on a product which is not listed in the Catalogue;

    (8) Other circumstances which act contrary to laws and regulations.

    Article 44Article 44Article 44Article 44 At the request of interested parties or according to its authority, the State Certifi-cation and Accreditation Administration may dissolve the assignment of the CertificationBody, the inspection institution and the Laboratory under any of the following situations:

    (1) Staff members abuse their power, or neglect their duty to make designated decisions;

    (2) If a person acts beyond their own authority when making designated decisions;

    (3) If a person acts contrary to the law when making designation decisions;

    (4) If any assignment is given to the Certification Institution, inspection institution and

    Laboratory which are without assignment qualification;

    (5) Under any other circumstances according to law for which the designation decisions canbe dissolved.

    Article 4Article 4Article 4Article 45555 If the Certification Body, inspection institution or Laboratory obtains its assignmentby an improper method such as cheating or bribery, its assignment shall be publicly dis-solved by the State Certification and Accreditation Administration.

    The Certification Body, the inspection institution or the Laboratory whose assignment is dis-

    solved, is not permitted to apply for any assignment within 3 years from the date of dissolu-tion.

    certification issue false conclusions or fabricate false documents or records, its audit qualifi-cation shall be cancelled and the auditor registration department of China Certification andAccreditation Association shall not accept any applications registered by it within 5 yearsfrom the date of qualification cancellation.

    Article 47Article 47Article 47Article 47 If an Applicant disagrees with the certification decision of the Certification Body, itmay appeal to the Certification Body; if an Applicant continues to disagree with the result ofthe Certification Body, they may appeal to the State Certification and Accreditation Admini-stration.

    Article 48Article 48Article 48Article 48 With regard to any unlawful act committed during compulsory product certifica-tion, any unit or individual has the right to report such an act to the State Certification and

    Accreditation Administration or the Local Certification Supervision and Administration De-partment, which must investigate and deal with the concern promptly, without disclosing theidentity of the reporter.

    Article 49Article 49Article 49Article 49 If any product listed in the Catalogue has not been through the certification proc-ess and, without authorisation, leaves the factory, is sold, imported or used for any commer-cial purposes, according to the rules specified in the Regulations on Certification and Ac-creditation of China punishment must be enforced by the Local Certification Supervision andAdministration Department.

    Article 50Article 50Article 50Article 50 Products listed in the Catalogue after obtaining the Certificate, if not in accor-dance with legal factors, legal requirements to deal with any production operation activitiesor producing, and selling illegal products, according to rule 2 set out in Article 3 of The Spe-cial Rules of the State Council On Strengthening the Supervision and Management of theSafety of Food and Other Products to carry out punishment by the Local Certification Super-vision and Administration Department.

    Article 51Article 51Article 51Article 51 Act against rule 2 of Article 29 of this regulation, during the writing-off, cancellingor suspending of the Certificate, if any product does not conform to the certification require-ments and continues to leave the factory, is sold, imported or is used for any commercialpurposes, according to the rules specified in Article 67 of the Regulations on Certificationand Accreditation of China penalties must be enforced by the Local Certification Supervisionand Administration Department.

    Article 52Article 52Article 52Article 52 Fabricating false information to obtain a Certificate for Exemption from ChinaCompulsory Certification by cheating, or after obtaining a Certificate for Exemption fromChina Compulsory Certification but not according to the original declared purpose for use,will result in the Certificate for Exemption from China Compulsory Certification being can-celled by the Entry-Exit Inspection and Quarantine

    Bureau; if the product was used for selling or used for any commercial purpose, a penaltyfine of between RMB 50,000 to RMB 100,000 shall be imposed by the Local Certification Su-pervision and Administration Department, and any illegal income shall be seized.

    Article 53Article 53Article 53Article 53 Counterfeiting or fraudulently purchasing or selling, transferring or tampering withthe Certificate shall be ordered to be corrected by the Local Certification Supervision andAdministration Department, and a penalty fine of RMB 30,000 shall be imposed.

    In the event that the Certification Mark is transferred, the Local Certification Supervision and

    (1) Act against rule 1 specified in Article 13 of this regulation - the samples provided by theApplicant and the actual products are not identical;

    (2) Act against the rules specified in Article 24 of this regulation an application to the

    Certification Institution for a Certification modification was made against the rules, then anact without authentication meant the Catalogue listed products left the factory, were sold,

    imported or used for any other commercial purpose;(3) Act against the rules specified in Article 25 of this regulation - an application to the

    Certification Institution for a Certification expansion was made against the rules, then an actwithout authentication meant the Catalogue listed products left the factory, were sold, im-ported or used for any other commercial purpose;

    ArticArticArticArticle 55le 55le 55le 55 Under any of the following circumstances, corrections shall be ordered to be madewithin a time limit set by the Local Certification Supervision and Administration Department; ifthe time limit expires and respective corrections have not been made, a penalty fine of underRMB 20,000 shall be imposed.

    (1) Act against the rules specified in Article 23 of this regulation - the content of the Certifi-cate which is displayed on the certified product and its sales packaging are not identical withthe content of the Certificate itself;

    (2) Act against the rules specified in Article 32 - rules for use of the Certification Mark werenot adhered to.

    Article 56Article 56Article 56Article 56 In the event that the Certification Body, the inspection institution, or the Labora-tory issues a false conclusion, the State Certification and Accreditation Administration mustcancel the designation; and also cancel the correspondent qualification of the person incharge or the culpable personnel; if an offence has been committed, criminal responsibilityshall be ascertained according to law. It is necessary to undertake the responsibility of com-

    pensation in case of damages or losses.Article 57Article 57Article 57Article 57 In the event that the Certification Body, the inspection institution, or the Labora-tory is in one of the following situations, the State Certification and Accreditation Administra-tion must order the institution to make improvements; under serious circumstances, theState Certification and Accreditation Administration may cancel its designation or retire theauthorization documents of the Certification Body.

    1). Realize the certification, test or inspection of the products listed in the catalogue whichare not designated to the institution;

    2). Transfer the designated certification services;

    3). during the improvements and consolidation period, the institution engages in compulsoryproduct certification, inspection, or test activities within a designated range;

    The specifications of the Certification Mark

    The certification marks fall into two categories, standard-size and irregular size certificationmarks.

    The color of the Certification Mark

    (1) The standard-size certification marks printed only by CNCA are of blackdesign on a white background,

    (2) If the certification mark is printed, pressed, molded, screen-printed,painted, etched, carved, stamped or sealed on the product(s) or thenameplate(s) of the product(s), the color of the background and that of the design can bereasonably altered so as to match the appearance of the product(s) or the nameplate(s) ofthe product(s).

    The manner in which the certification mark is applied to the certified products may be se-

    lected based on the nature of the product(s),(1) The standard-size certification marks printed only by CNCA shall be affixed to the speci-fied place on the outer body of the certified product(s),

    (2) If the certification mark is printed, pressed, molded, screen-printed, painted, etched,carved, stamped or sealed on the product(s) or the nameplate(s) of the product(s), it shall beapplied on an exposed location on the outer body of the product(s) or the nameplate(s) of theproduct(s),

    (3) If it is not appropriate to apply the certification mark to the body of the product(s), the cer-tification mark must be applied to the smallest packing of the product(s) and indicated in theattached document(s),

    (4) For certified products of a special nature that would not be appropriate for certificationmarks to be applied, the special derivation of the "China Compulsory Certification (CCC)"must be printed, pressed, molded, screen- printed, painted, etched, carved, stamped orsealed on the product(s) or the nameplate(s)other product(s),

    For compulsory products that have been certified, the Certification Mark may be applied tothe packing of the products.

    Products produced overseas must apply the certification mark after being certified beforethey are imported, while products produced domestically must apply certification mark afterbeing certified before they are allowed out of the factory.

    The printing of the standard-size certification marks will be specifically undertaken by a print-ing house(s) designated by CNCA,

    If the certification mark is printed, pressed, molded, screen-printed, painted, etched, carved,stamped or sealed on the product(s) or on the nameplate(s) of the product(s) as referred to inArticle 11 (2) and (4), the applicant must submit the design to a CNCA-designated agencyand can only produce the mark with the final approval of CNCA.

    The application for the use of the Certification Mark

    (1) If the applicant applies in person for the use of certification mark, they need submit to aCNCA-designated agency the application form and copy of the certificate.

    (2) If the applicant applies through another party or parties for the use of the certificationmark, the party or parties entrusted need submit to a CNCA- designated agency the trustdeed, application form and copy of the certificate ,

    (3) If the applicant applies through correspondence or any other communication means, they

    The applicant should pay the cost of the standard-size certification marks printed only byCNCA, or pay the administrative charge if the certification mark is printed, pressed, molded,screen-printed, painted, etched, carved, stamped or sealed on the product(s) or the name-plate(s) of the product(s),

    The standard-size certification marks printed only by CNCA will be granted by the CNCA-designated agencies.

    CNCA is the sole authority to supervise and admit the production, grant and use of the certi-fication mark. Local branches of the State General Administration for Quality Supervision andinspection and Quarantine of the People's Republic of China (AQSIQ) will be responsible forthe supervision and check in the use of the certification mark within their respective adminis-trative jurisdiction,

    DCBs will be responsible for the supervision and check in the use of the certification markrelative to their respective certified products. The entrusted overseas inspection agencies will

    be responsible for the supervision and check in the use of the certification mark relative tothe certified products within their respective entrustment scope.

    The DCBs and CNCA-designated agencies are under obligation to inform the applicants ofthese regulations and guide the applicants in the use of the certification mark as required.

    The applicant shall abide by the following requirements.

    (1) To set up a management system in the use of the certification mark, and to keep a true and completefile in the use of the certification mark.

    (2) To ensure that products with the certification marks meet certification criteria

    (3) No certification marks are permitted for products when the certificate has expired,

    (4) To ensure a correct use of the certification mark in promotional materials, such as any ad-vertising or leaflet of the products, so that the consumers are not misguided or cheated,

    (5) To accept the supervision and check in the use of the certification marks by CNCA, AQSIQlocal branches and the DCBs.

    Certification, testing or inspection bodies designated by CNCA should ensure the correct use

    of the Certification Mark in their business operations and advertisements, and they are not al-lowed to misguide or cheat consumers by using the Certification Mark.

    The printing house(s) undertaking the printing of the standard-size certification marks withthe sole authorization of CNCA shall keep confidential the printing technology and counter-feit-proof technology. Without the authorization of CNCA, such printing house(s) are notpermitted to provide any other organization or individual with the standard-size certificationmarks or the printing equipment,

    Should the certified products fail to meet certification criteria within the validity period of thecertification, the DCBs shall request the applicant to take corrective action within a pre-scribed time period, and no certification mark is allowed for use during this time period.

    Article 25Article 25Article 25Article 25Administrative penalties will be imposed for any of the following irregular practices. If viola-tion of Criminal Law is involved, legal action wl be taken accordingly.

    (1) Falsification, modification, trading or transfer of the certification marks.

    (2) To seize and hold in possession the certification mark without approval.

    (3) To use the certification mark under another party name, or

    (4) Other illegal practices contrary to these regulations.
