TheDraftRectt./PromotionRule,proposingTimeboundfunctionalpromotionuptoAGMgradeforallcadres/streamsareasunder:-.
1. General:
1.1 Theserulesmaybecalledthe‘BSNLExecutivepromotionPolicyAmendment&RecruitmentRules,2017;
1.2 Themodifiedpolicyshallbeimplementedw.e.f.01.01.2017.
1.3 Onapprovalofthepolicy,allexistingRRinthegradeofSDE/equivalentwillbetreatedasscrappedandMSRR2009willbemodifiedtotheextentthatpromotionofAGM/DEGradeinalltheschedule-IA,IB,IC&IDshallbetreatedtobedeleted.RemainingportionofMSRRshallbecontinuedtobefollowedaspertheexistingprovision.MTrecruitmentwillcontinueaspertheexistingprovisionofRecruitmentRuleofMT.
1.4 Powersforrelaxation/modification/amendmenttotheseruleswillvestwiththeManagementcommitteeofBSNLBoard.
2. DEFINITION:Intheserulesunlessthecontextotherwiserequires,
2.1 ManagementCommitteeofBoard:MeanstheBoardofDirectorsoftheCompanyandincludesinrelationtotheexerciseofpowerbyanycommitteeoftheBoardoranyOfficerofthecompanytowhomtheBoarddelegatesanyofitspowers.
2.2 Company:MeansBharatSancharNigam Limited(BSNL,aGovernmentofIndiaEnterprise)havingitsregisteredofficeatNewDelhi.
2.3 CorporatePromotionCommittee(CPC)–Adulyformedcommitteetoassessthesuitabilityofthecandidateforpromotion,inanobjectiveandimpartialmanner.
2.4 Department:MeansDepartmentofTelecom.
2.5 FunctionalStream:MeansthedisciplinetowhichtheExecutivehasbeenrecruited,viz.Operations,Finance,Civil,Electrical,Architect,TelecomFactory,CSSetc..
2.6 Government:MeansGovernmentofIndia.
2.7 Modeofpromotion:Timeboundfunctionalpromotion
2.8 Service:MeansServicerenderedinthegradeinthesubstantivecapacity.
2.9 YearofExamination:InrespectofManagementTrainees,itwillbetheyearforwhichthevacanciesaredeclared.

5 Promotion&Seniority:
A. PROMOTIONS;
5.1 MethodofRecruitment,FieldofPromotion&Minimumqualifyingserviceinthelowergrade,forappointmentofExecutivesonpromotiontoHigherGradefor various constituents of the BSNL Executive promotion PolicyAmendment&RecruitmentRules,2017shallbeaspertheschedules.
5.2 AlltheexistingExecutivesuptoAGM/DGM(Adhoc)shallcontinuetobeconsideredforfinancialup-gradationtothenexthigherscaleuptoE-6scaleoncompletionof5yearsofservicefromthedateofplacementinlowerscalethroughconductionofCPC.Thebenchmarksconsideredforfinancialup-gradationshallbeaspertheprescribedprovisionsintheschedule.ThenewBenchmarksshallbeappliedto thoseexecutiveswhosefinancialup-gradationsareduew.e.f.01.01.2018.
5.3i.Alltheexecutiveseligibleforpromotionforavacancyyeari.e.promotion
underSCF,forwhichthepromotionintheLDCE(otherchannelofpromotion)hasbeenissuedshallbeconsidereddeemedtohavebeenpromotedbefore1.1.2017andtheyshallbetreateden-blocseniortotheexecutivespromotedasperthisRule.
ii.Alltheexecutiveseligibleforpromotionforavacancyyeari.e.promotionunderSCF,forwhichtheresultoftheLDCE(otherchannelofpromotion)hasbeenissuedandpromotionorderispending,thepromotionofexecutivesofboththechannelshallbeconsidereddeemedtohavebeenpromotedbefore1.1.2017andtheyshallbetreateden-blocseniortotheexecutivespromotedasperthisRule.

5.4 IfthepayscaleoftheexecutiveishigherthanthescaleofthegradeinwhichtheExecutiveispresentlyworking,he/sheshallbeimmediatelyplacedinthehighergrade,up to AGM equivalentgradeaspereligibilityconditionprescribed in the schedule as on 01.01.17 withoutconducting CPC.Subsequentfunctionalpromotionsto theseexecutivesup to AGM orequivalentgradeshallbedoneaspertheeligibilityandprescribedconditionsfortheexistingExecutivesmentionedintheschedulewithoutconductingfreshCPCinviewofpara5.2above.Subsequentreviewshallcommencefrom1stJanuary,2018onwardsinaccordancewiththisruleandthereafteritwillbedoneeverysixmonthsi.e.1stJuly/1stJanuaryoftheyearandthereon.
5.5 AlltheTimeBoundfinancialup-gradationsduetotheexecutiveuptothedateofapprovalofthispolicyshallbedoneasperexistingEPP2007.
5.6 Incaseofnonavailabilityofsufficientregularandeligibleexecutives,withrequisite number of years of qualifying service for promotion toAGM/equivalentgradeasperthispolicy,relaxationineligibilityservice(residencyperiodinthelowergrade)maybeconsideredfortheExecutivesworkinginE4andhigherscaleinthatparticularstream/cadreforgivingAdhocpromotiontoAGM /equivalentgrade,subjecttotheapprovalofManagementCommittee.
B. SENIORITY:
5.7 TheSeniorityshallbemaintainedatJTOlevel(beingrecruitmentlevelforexecutive)andatAGMlevel(beyondAGMthepromotionisvacancybased).
SeniorityinJTO/equivalentgradeshallbeasunder:
I. RecruitmentYear/vacancyYearII. TheSeniorityoftheexecutiveshallbeaspertheexistingprovisionin
theRecruitmentRuleoftheJTO/equivalentgradeoranyspecialrulefollowedinDoT/BSNL.
SeniorityinAGM/equivalentgradeshallbeasunder:-
I. RecruitmentYear/ vacancy Year(Since the promotions areconsideredtwiceayeari.e.panelfor1stJanuaryand1stJulyinaYear,theexecutivespromotedinthepanelfor1stJanuaryshallbeen-blockseniortotheexecutivespromotedforthepanelof1stJuly).
II. AlltheAGMspromotedaspertheexistingRRsandworkingonthedateofeffectofthisRecruitmentRulesasAGM/CAO/equivalentgradeonregularbasisshallbeen-blockseniortotheexecutivespromotedbasedonthisRRs.
III. Theinter-se-seniorityoftheexecutivespromotedtoAGM/equivalentGrade in a particularpanelfrom the existing executives inSDE/equivalentgradeshallbeintheorderasunder:
1.VacancyYearofSDE/equivalentgrade
2.WithinthesameVacancyYear,aspertheexistingprovisionintheRR(theexecutivesalreadypromotedfrom differentchannelofpromotioninaGradei.e.SDE/equivalent,shallbeaspertheQuotaandRotaspecifiedintheRR)
3.IfnoprovisionexistsintheearlierRR,dateofapprovalofpanelofpromotionbythecompetentauthorityinSDE/equivalentGrade.

6. Vacancy:ThevacancyinJTO/equivalentcadreswillbetheassessedasperthevacancyintheclusterfromJTOtoAGMequivalentgrades.
7. Reservation:
7.1 ReservationinRecruitment:Thepercentageofreservationwillbeapplicableonlyincaseofdirectrecruitment/promotionintheentrycadreofJTOequivalentandforMTGradeindirectrecruitment.ThereservationrosterwillbeapplicableatJTOequivalentlevelandfordirectrecruitmentatMTGradeonly.ThenumberofSC/STExecutiveswhichisdeficitoftherequiredpercentageprescribedintheclusterofJTOtoAGMequivalentgradesshallbefilledatJTOequivalentlevel.AspertheguidelinesofGovt.ofIndia,thereservationasapplicableis15%forSC,7.5%forST,27%forOBC&3%forPWDcategoryorasdecidedbymanagementcommitteeofBSNLBoard,inrecruitment.
7.2 Reservationinpromotion: AsthepromotionistimebounduptoAGM /equivalentGradeinE-4Scale,andthecombinedstrengthisconsideredfrom JTOtoAGM equivalentindifferentstreams/grade,therewillnotbeanypostbasedrosterforpromotiontoSDE,Sr.SDEand AGM equivalentGrades. Therelaxation in bench markforpromotiontoSDE,Sr.SDE&AGMequivalentgradehasbeenprovidedforSC/STexecutive.
8. Benchmark,eligibilityetc.:BenchmarkandeligibilityforpromotionstovariousGrade(s)/Level(s)shallbeasperschedule.
9. ConstitutionofCPC:Constitutionofscreeningcommitteeatcircleandcorporateoffice,NDlevelshallbeissued.

10. ConveningofCPC:
10.1 CPCwillbeconvenedtwiceayear,oneon1stJanuaryandanotheron1stJuly.CPCswillbeconductedatCirclelevelinrespectofpromotiontoSDE/Sr.SDE/AGM/equivalentGradesandfinancialupgradationstoallexecutivesuptoE-6Scales.Theexecutivestobeconsideredforfunctionalpromotionon1stJanuaryshallbethoseexecutiveswhoarecompletingthequalifyingservicefrom 1stJulyto31stDecemberoftheprecedingyearandsimilarly,on1stJulythoseexecutiveswhoarecompletingthequalifyingservicefrom1stJanuaryto30thJuneoftheYear.
InrespectoffinancialupgradationuptoE-6scale,theexecutiveswhoarecompletingthequalifyingservicefrom 1stJanuaryto30th Juneshallbeconsidered on 1st Januaryand those executives who are completingqualifyingservicefrom 1stJulyto31stDecemberofthesameYearshallbeconsideredon1stJuly.
10.2 TherecommendationsoftheCPCsforfunctionalpromotionshallbeforwardtoBSNLCOforconsiderationoftheAppointingAuthorityandforissuingpromotionorders.TheFinancialupgradationshallcontinuetobeapprovedbyconcernedCGMtille-DPCisimplemented.Onimplementationofe-DPC,allpromotion(postbased/financialupgradation)shallbeconductedatBSNLCO.

effecttothepromotionintime.TheCPCshallbeconvenedbetween1stDecemberto15thDecember/01stJuneto15thJune,byallcirclestomaintainuniformity.
10.3 TheAPARtobeconsideredforthetimeboundfinancialupgradationandfunctionalPromotion,shallbethelast5yearsAPARavailableason30thNovemberoftheprecedingYear.Inotherwords,fortheyear1stJanuary/1st
Julyof2018,APARsuptotheyear2016-17arerequiredtobeconsideredirrespectiveofthedateofconveningCPCs.
10.4 DateofeffectoftimeboundfunctionalpromotionuptoAGM equivalentgradeshallbe1stJanuary/1stJulyoftheyearinwhichexecutiveiseligibleforpromotionirrespectiveofconductionofCPC.
10.5 SealedcoverprocedureshallbefollowedunderfollowingconditionorasdecidedbyBSNLBoardbyCorporatePromotionCommittee(CPC).
a) WhenachargesheetunderRule35orRule36hasbeenissuedunderBSNLCDARule
b) Whenaprosecutionsanctionhasbeenissuedagainsttheexecutive,
c) Whentheexecutiveisundersuspension.
10.6 TheSealedcovercasesshouldbereviewedafterevery6monthsorwhenthecaseisdecided,whicheverisearlierandincasetheexecutiveisexonerated,theexecutiveshallbepromotedfromthedatehisjuniorispromoted.
10.7 IfbeforethenextCPCisconvened,apenaltyisissuedunderRule33ofBSNLCDARule-2006inrespectofsealedcovercases,theexecutiveshallbeconsideredinthenextCPC.Insuchcasetheseniorityoftheexecutiveshallbeasperthenewpanelapprovedbythecompetentauthority.
10.8 WhenatthetimeofCPC,anexecutiveisundergoingofanypenalty,theCPCmemberswhileassessingthesuitabilityoftheexecutiveshouldconsiderthepenaltyimposedontheemployeeandarecordtotheeffectshallberecordedinthenotesofCPC.Evenafterassessingthesuitabilityoftheexecutiveandthegroundsofpenalty,ifCPCfindstheexecutiveFITforpromotion,thepromotionoftheexecutivecanbegiveneffectafterthecurrencyofpenaltyisover.
10.9 Incasetheexecutiveispromotedafterthecurrency,hewillcontinuetoretainthesameseniorityasperthepanelbutthelengthofserviceshallbecountedfromthedateofpromotion,fornextpromotion.
10.10 Incaseofanyfurtherclarification,guidelines/instructionissuedbyBSNLfromtimetotimeafterpublicationofthisrecruitmentrulemaybereferred.IntheabsenceofBSNLguidelines,DOP&Tguidelinesmaybereferred.
11. Considerationofpromotionofexecutivewithlessqualifyingservice:
IncasewhereExecutiveappointedforsamevacancyyear/recruitmentyearinthesamegrade,whohavecompletedtheirqualifying/eligibilityservicearebeingconsideredforpromotionstohighergrade,comparablelessqualifyingserviceexecutivesappointedforsamevacancyyear/recruitmentyearwouldalsobeconsideredforpromotiontoSDE/uptoAGMandequivalentgradesaspertherelaxationdefinedinschedule.
12. Theexecutiveshalljointheplaceofpostingonpromotionwithin40daysoftheissueoftheorderofpromotionbyBSNLCO.Theperiodof40daysmaybeextendedinexceptionalanddeservingcase,intheinterestofservice,wheretheAdministrativerequirementsodemandswiththeapprovalofappointingauthority. IncasetheExecutiveswhoaregrantedfunctionalpromotionbutfailstojointhepromotedgradewithinthetimeordeclinepromotion,thenManagementreservestherighttoforfeithispromotionandexecutiveshallnotbeconsideredforfunctionalpromotionorfinancialup-

gradationtohigherscalefornextoneYearornextCPCwhicheverislater,fromthedateofdeemedrefusal(after40days)orfromdateofapplicationofrefusal.
13. FitmentMethod:
13.1 OnbeingfoundfitforIDApayscaleupgradation,fixationofpayshallbemadeasperFR-221(a)(i)orasperthecompanyequivalentrulesinforcefromtimetotime.
13.2 Consequenttograntofanytimeboundfunctionalpromotionfrom thepayscalecorrespondingtolowergradetopayscalecorrespondingtohighergrade;theexecutive’spaywillbefixedasperFR-221(a)(i).
13.3 Incaseofexecutivealreadygrantedthehigherscaleundertimeboundpromotionorequivalentscaleofthepromotedgrade,theExecutiveshallnotbegivenanyfixationunderFR-22(1)(a)whenheisbeingconsideredforplacementinthehighergrade.
14. PassingofExam onpromotionfrom lowerscaletohigherscale:EveryExecutivewhosepayisupgradedtonexthigherIDA Payscale(underfinancialup-gradation)orgrantedpromotioninthehighergradethroughtimeboundfunctionalpromotionwillhavetopasstheonlineexamasperexistingpolicy,forbeingeligibleforSECOND andsubsequentincrementintheupgradedIDAScale,i.e.theexecutivehastocleartheexamwithinaperiodoftwoyearsfrom thedateoforderoftheupgradationtothehigherscaleorpromotedtothenextfunctionalGrade.TheExecutivewhofailstopasstheexaminationwillnotbeeligibleforconsiderationofnextIDApayscaleup-gradation/functionalpromotioneveniftheexecutiveisdueforfinancialup-gradationorfunctionalpromotion.
15. Training:TheexistingTrainingmodule/policymandatorilyrequiredinanycadre/grade/scaleshallcontinuetobefollowed.
16. NewdesignationsforExecutives:
InthePolicynewDesignationhasbeenincorporatedandshallhereafterbefollowedatalllevelsatH.Q./Circle/SSAetc.TheseDesignationmodifieduptoAGMGradeareasunder:

Liabilityfortransfer:AllExecutivesinthestrengthofBSNLshallbeliablefortransferanywhereinIndiaoratanyplacefallingintheoperationalareaofBSNLinaccordancewiththetransferpolicyinforceoranymodificationissuedfromtimetotime.CombinedstrengthofJTO/SDE/SrSDEequivalentgradesshallbetakentogetherforthepurposeofdecidingthestrength/shortageforthepurposeoftransfer.ExecutivesinAGM gradeshallbeseparatelyconsideredforthepurposeoftransfer.
18. TheRoleofJTO,SDEandSr.SDEcanbeusedinterchangeablyandwillreportdirectlytoAGMorasdecidedbymanagementcommitteeofBSNLBoard.TheJobdetailsanddescriptionoftheexecutivesuptoAGMlevelshallbeissuedseparatelybyrestructuringunitofBSNLCO.
19. Disqualification:-Noperson-

shallbeeligibleforappointment,ProvidedthattheGovernmentmay,ifsatisfiedthatsuchmarriageispermissibleunderthepersonallawapplicabletosuchpersonandtheotherpartytothemarriageandthereareothergroundsforsodoingexemptanypersonfromtheoperationofthisrule.
20. Saving:NothingintheserulesshallaffectrelaxationofagelimitandotherconcessionsrequiredtobeprovidedfortheScheduledCastes,ScheduledTribesetcinaccordancewiththeordersissuedbytheGovernmentfromtimetotime.
21. Residuarymatters:Inregardtomattersnotspecificallycoveredbyorundertheserules,thepersonsappointedwillbegovernedbytherules,regulationsandordersdecideduponbytheCompany.
