Your quoted rates shall be inclusive of all applicable taxes and duties exceptGST, which shall be quoted separately in attached Form-A. The applicability of GSTas a percentage rate of total quoted price shall be clearly mentioned in theForm-A. If the information is not provided, it will be assumed that GST is notapplicable. Any statutory variation in GST within the contractual completion period shallbe to BPCL account, against submission of documentary evidence forsubstantiating the variation by way of relevant notification. However in caseof delay in completion period beyond the contractual date, for reasonsattributable to contractor, any increase in these rates shall be borne by thecontractor, whereas any decrease in rates shall be passed on to the owner.

"The vendor shall take steps viz uploading invoice in GSTR 1 , payment of thetax liability on the said invoices and filing of Returns etc. and complywith all the requirements of applicable laws including GST laws for the timebeing in force to enable the OWNER to avail tax credit/s including input taxcredit. Clause regarding purchase preference to Micro and Small Enterprises

Owner reserves its right to allow Micro and Small Enterprises (MSEs) and MSEsowned by Scheduled Caste (SC) or the Scheduled tribe (ST) entrepreneurs,purchase preference as admissible/ applicable from time to time under theexisting Government policy. Clause regarding ISO Certification and adherence:

BPCL Mumbai Refinery is an ISO:50001:2011 certified Refinery and is focused onenergy efficiency. In line with the same, all contractors providing servicesfor BPCL Mumbai Refinery should preferably deploy energy efficient equipmentssuch as energy efficient welding machines, LED / CFL temporary lighting andtemporary window AC of BEE 4-star rating and above for execution of the work.

Please submit folowing details in the E-Tender attachment titled "reply ofpoint no.13 of special safety conditions" along with techno-commercial bid:-

a) Complete work injury records per year for the last three years.b) Total man-hours worked per year for the last three years.c) Safety assurance plan.d) No. of supervisors

In case, reply to Point No.13 is not submitted, bids are likely to berejected/ bids may not be considered for technical evaluation.

ABNORMAL RATES: The Contractor is expected to quote rate for each item aftercareful analysis of the cost involved for the completion of item, consideringall specifications and conditions of contract. This will avoid loss of profitor gain, in case of curtailment or change of specification for any item. Incase it is noticed that the rates for any item quoted by the tendererunusually are high or unusually low it will be sufficient cause for therejection of tender unless the owner is convinced about the reasonableness ofthe rates on scrutiny of the analysis for such rate to be furnished by thetenderer on demand. In the rate contract where the quoted rates for the itemsexceed 25 % of the owner's estimated rates, such items will be considered asabnormally high rates items(AHRs) and payments of AHR items beyond the SORstipulated quantities shall be made at the least of the following rates:

1. Rates as per SOR , quoted by the contractor2. rates of the items , which shall be derived as follows:

a. Based on the rates of machines and labour as available from the contract(which includes contractor's supervision, profit, overheads and otherexpenses)

b. In case rates are not available in the contract , rates will be calculatedbased on prevailing market rates of machine, material and labour plusreasonable escalation to cover contractor's supervision profit,Transportation, overhead and other expenses.

In the event of award of contract, bidders to note that the executedquantities of the SOR items may vary +/- any percentage. In case of change inL-1 status based on concluded executed quantities, the L1 bidder shall offernecessary discount to BPCL to ensure their L1 status.

Minimum two numbers of portable H2S detectors per work location shall beensured by contractors while working in refinery plant areas. The portable H2Sgas detectors should be with valid calibration certificate. The portable H2Sgas detectors should be from reputed make such as Honeywell, Drager, MSA.

Existing penalty for "Violation of permit conditions" as per Sr No 3 ofexisting "financial deterrents" shall be applicable for the non-compliancewith respect to the point no 1.

Supply and installation of porta cabin(10' x 10' x 8'6"). The porta cabinsshall be provided with window all necessary electrical and plumbingfittings,as detailed under technical specification.

Final layout before supply is to be approved by EIC.

All windows / doors shall be provided with monsoon protection made out of MSsheet and all the window glasses shall be provided with sun films. Also,sliding curtains to be provided from inside for all the windows in all thecabins.

The scope also includes all transportation / placement services / unloading /loading at BPCL refinery site.

For loading / unloading at BPCL premises, the required crane shall be providedby Contractor. Contractor shall arrange sufficient nos. of Slings, D shackles& manpower for making rigging arrangement and loading / unloading of the portacabins including placement at designated place.

For any problem related to the electrical fitting / equipment, contractorshall arrange to rectify the defective equipment within 12 hrs and same shallbe made good without any cost to BPCL.

The porta cabin shall be supplied with complete internal wiring facilities.The porta cabin shall be in ready to use condition with all electricalaccessories as listed below once the incoming supply is provided by BPCL.

4 nos. 5 x 15 Amps plug point and 4 nos. spike guards with all wiring from themain incoming board. Please ensure availability of spike guards in all thecabins.

Suitable capacity power points are to be provided in the office cabins forwindow air conditioners.

Two additional spare power points to be provided near the doors as spare totake care of any additional requirements.

1) INTRODUCTION :

We are required to facilitate project activities by carrying out miscellaneousworks at various locations inside the refinery time to time.

Contractor should apprise himself of all the conditions prevailing in suchlocation and the restrictions placed on movement of personnel and equipment,types of equipment and tools permitted, working method allowed etc.in thelight of security and safety regulations operative in the area.

3) SPECIAL CONDITIONS OF CONTRACT :

Please note that "Scope of Work" will be read along with the 'SpecialConditions' of this contract. Contractor shall be required to abide by theconditions stated in General terms & conditions attached.

3.1. Prior to quoting for the job, the bidder will be required to visit thesite & clarify all the doubts (if any) from Engineer- in-charge. Otherwise itwill be presumed that the party has understood the work in all respect.

3.2 FIRE & SAFETY REGULATIONS

3.2.1 The work shall be carried out in a safe manner as per Refinery Fire &Safety Rules & Regulations. Work permit condition shall be scrupulouslyfollowed.

3.2.2 BPCL conducts an intensive training programme on various aspects of Fire& Safety, on regular basis, at Refinery-Fire Station. It is the responsibilityof the Contractor to nominate all the supervisors/labours (likely to beemployed for this job) for training through BPCL site engineer. The successfulcompletion of training is mandatory requirement (in addition to otherqualifications/experiences mentioned earlier) for any supervisor/labour to beeligible for working at Refinery work site. Failing which no supervisor/labourwill be deputed for working at Refinery work site. Contractor shall also sendall the other workmen deployed at Refinery for this training.

3.2.3 Contractor shall arrange all required safety gadgets like safety helmet,safety Belt, safety shoes, Boiler suit, Gloves, Goggles etc. for theirworkmen.

3.2.4 Contractor shall submit detail safety action plan & quality assuranceplan before start of work within7 days from the date of award of contract &get it approved from BPCL.

Scaffolding will be as per BPCL standards. As far as practicable the danger

3.3 MOBILIZATION & TIME SCHEDULE OF WORK.

3.3.1 Within 7 days of issue of contract letter the contractor shall mobiliseall necessary manpower & equipment & start the job at site as directed.

3.3.2 The contractual completion period shall be Elevan months from the dateof award of job. The mobilization & detailed schedule of activities forcompletion of the specified works shall be submitted by contractor shall gotit approved from BPCL. Prices quoted shall be valid considering all above.

3.4 SCOPE OF SUPPLY :

3.4.1 BY BPCL (free issue) : NIL

3.4.2 BY BPCL (Chargeable) : NIL

3.4.3 BY CONTRACTOR: All the material, Equipmets To complete the work as perscope of work & as specified in SOR.

3.5 TECHNICAL PERSON AT SITE/DEPLOYMENT OF ENGINEER

The contractor shall depute experienced/qualified (Degree/diploma Holder)Civil Engineers with safety trained supervisors for site job.Contractor shall sufficient manpower during agreed working period to ensureeffective output to meet the agreed schedule/ bar chart.

3.6 DRAWING & DOCUMENTS:

Detailed construction drawings & other related documents on the basis of whichactual execution of the work shall be carried out will be made available tothe contractor progressively, in line with progress achieved/timeschedule/programme after the award of the work. After issuance of constructiondrawing, contractor shall take actual site measurements, sort out discrepancyif any between drawing & actual site condition. After sorting out thediscrepancy if any, contractor shall execute the work.

3.7.1 Cement:-

Cement required for all construction shall be provided by contractor only.Cement used for ready mix concrete shall be Portland Slag Cement (PSC)conforming to IS 455 or Portland Pozzolana Cement (PPC) Fly Ash basedconforming to IS 1489 Part-I as indicated in IS 456:2000. This shall be ofapproved make viz ACC, L&T, Gujrat Ambuja or equivalent conforming to IS:455or IS: 1489 part-I.

A) Water:

The CONTRACTOR shall at his own costarrange for tapping, storage tank & distribution required for his workincluding supply, installation & calibration of water meters.The present charge for Water is Rs. 81.35 / CUM which may change in accordancewith change of rate by Muncipal authorities. Non availability of water throughBPCL should not be a case for extra claim or time extension. Therefore, theCONTRACTOR shall, within the quoted price, make alternate arrangement to copewith such eventuality. Additional water, if required, to meet the contractualrequirements, shall be arranged by the CONTRACTOR at his own cost.

B) Power:

Construction power shall be provided to the CONTRACTOR at one point, subjectto availability, on chargeable basis. The charge for Electricity will be Rs.9.5 / kWh. All the works related tolaying of cable / distribution panel etc. for construction power shall bearranged by CONTRACTOR at his own cost including supply, installation &calibration of energy meters. Thecost of power supply shall be recovered by the BPCL every month (withoutprejudice to any other mode of recovery available to the BPCL) by deductionfrom the CONTRACTOR'S bills.The energy meter to be installed by the CONTRACTOR shall be tested andcertified by State Electricity Board or any other agency approved by the BPCL.The construction power shall bemade available to the CONTRACTOR subject to grid disturbance, and no extensionof time or compensation shall be payable on this account. Therefore, theCONTRACTOR shall, within thequoted price, make alternate arrangement to cope with such eventuality.Additional power, if required, to meet the contractual requirements, shall bearranged by the CONTRACTOR at his own cost.

3.7.3

3.7.4 WORK TIMINGS :

Normal working hours for carrying out this job will be morning 07.45 am toevening 03.45pm. Contractor may have to work in extended hours and on holidaysif required to meet the project schedule as instructed by Engineer-in-chargeafter taking all necessary permissions from BPCL.

For execution of this job, contractor shall be required to get clearances fromBPCL.The work shall be carried out in a safe manner as per Refinery norms & workpermit condition shall be scrupulously followed. The work should be plannedand undertaken only under the Supervision of a competent person.No idle time wages or compensation for temporary stoppages of work orrestrictions would be paid and the rate quoted for various items of workshould cover the cost of all such contingencies and eventualities. Substantialstructures and utilities exist both above ground and underground, adjacent tothe work site, Special care is necessary in transportation, storage, workingon equipments and other construction activities to protect the existingfeatures and prevent damage to any facility. Necessary protective structures,barricades etc. have to be erected at various places as directed by Engineerin charge. No extra payment of such protective work will be made. All roadsand open areas adjacent to the work site shall either be closed or suitablyprotected as per the job requirement.

3.8 INSPECTION OF CONSTRUCTION MATERIAL & WORKS :

All civil works i.e. earthwork, concrete works, finishing works, etc. shall beoffered for BPCL inspection. All material procured by the contractor shall beoffered for inspection & supported with the test certificates of the tests

3.8.1. Structural steel works

All structural steel works shall be carried out at contractor workshop insiderefinery. All structural steel used for structural steel works shall beconfirmed to IS226, IS 2062 & relevant IS specification. This shall beapproved make like TISCO, SAIL, IISCO or equivalent. Developing Fabricationdrawings and built up drawings is in the scope of contractor and quoted ratefor structural works is inclusive of the same.

3.8.2 Civil Construction Materials

All construction works & material brought by the contractor shall be as perthe relevant latest IS specifications. The Engineer-in-charge/Inspectiondepartment shall have full authority to inspect the works at any time wheneverin progress either on the site or at contractors workshop wherever situated.All the test for e.g. Cube test, test for silt content of sand (as per IS 383,for Zone II & Zone III, as approved by Engineer- in-charge), etc. necessary inconnection with the execution of the works or material or workmanship suppliedby the contractor shall be carried out promptly by the contractor at his owncost from any other approved testing laboratory or at site as per theinstructions of the Engineer-in-charge/Inspection department.

Contractor may use the crushed stone aggregate / stone dust in place of sandby taking necessary approval from Engineer in charge after conductingprerequisite tests, with out any extra cost.

3.9 HOUSE KEEPING :

The contractor shall maintain good house keeping on day to day basis at thesite/fabrication yard. All construction material brought by the contractor(like sand, coarse aggregate, shuttering material, scaffolding pipes etc.),steel scrap (like structural steel, reinforcement steel etc.) & other debris(like earth, shrubs, rubbish etc.) generated at site shall be stacked neatlyin well defined spaces at no extra cost. Additional manpower as & whenrequired for housekeeping shall be arranged by contractor immediately as perdirection of Engineer-in- charge.Cart away all the debries generated from the work outside the Refinery at hisown cost and dispose it off without giving rise to any complaints from local,municipal and government authorities. Metal scrap or any other scrap including woodenmaterial shall be disposed categorywise at his own cost as indicated by theEngineer in Charge.All moveable, salvagable, servicable material shall be dismantled carefullyand transported/ stored as directed by Engineer in charge.

The financial implication of above, if any should be taken care in the quotedrate and no seperate claim shall be entertained on this account.The final bill of the contractor shall be linked with the area cleaning in allrespects including disposal of debries/scrap etc. to the entire satisfactionof Engineer in charge.

3.10 MEASUREMENT OF WORKS FOR PAYMENT: -

3.10.1 EARTH WORK:

i) Measurement for earthwork in excavation shall be calculated as volume ofpit/trench of excavation with working space as per IS : 1200.

ii) Measurement for earthwork in backfilling/plinth filling shall becalculated as finished compacted volume of filling.

iii) Measurement for earthwork in transportation shall be calculated asdifference of measurements of the volume of the excavated pits & themeasurement of backfilling. However, if at site, truck/dumper load measurementis required as directed by engineer in charge, 30% voids shall be deducted forvoids from total filled up volume to arrive at net payable volume. Truck loadmeasurement has to be done only as per direction of Engineer-in charge.

3.10.2 OTHER WORKS:

Measurements of works shall be as per IS:1200 if nothing is mentioned in theschedule of rates/quantities.

3.11 VARIATION IN SOR QUANTITIES:

The quantities indicated in the SOR/SOQ are indicative & payment shall bebased on actual/jointly certified measurements for the work done.

As the the jobs are of miscellaneous nature and drawings are not releasedcompletely, item quantities are estimated considering past experiencesincluding assumptions for misc works which may required to be carried outduring contract execution period. During execution jobs are required to becarried out as per site requirement which may result in variation of executedquantities with respect to order quantities and there is no minimum guaranteefor quantity of any of the SOR items. The contractor is required to note thesame and quote accordingly.




3.12 BILLING :

3.12.1 Contractor shall be paid against R.A. bills for the work done on thebasis of item rates as agreed in the contract.

3.12.2 Contractors bill for executed works shall be accepted only when jointlycertified (contractor & EIC) & signed measurements for the said works areenclosed.

3.12.3 Final bill shall be submitted along with jointly certified & signedmeasurements within 2 months from the date of completion of total work.

3.13 DEFECT LIABILITY PERIOD: Defect liability period shall be 12 months fromthe date of successful completion of all the jobs covered under this contract.

4. PAYMENT TERMS :

4.1. For all items: As per the agreed item rates for completed & certifiedquantities of work for respective item against RA bills.

Awarded contractor must submit bank guarantee of 10% of contract value, validfor defects liability period of twelve months, before submission of 1st RAbill. Further, the Bank Guarantee shall have a claim period of six monthsbeyond the date of expiry, and the same shall be mentioned clearly in the BankGuarantee. Failing to do so, the invoices will not be processed.

5. COMPLETION PERIOD :

The contractual completion period shall be 12 months from the date of LOA /Work order, whichever is earlier.

Liquidated Damages: In case of delay, 0.5%/week of delay or part thereof up toa maximum 5% of the individual purchase order value shall be recovered.
