Per State Dues

Dues are assessed for all states in which you perform, or advertise the ability to perform, creditor’s rights legal services related to the financial services industry.

First State Dues $3,750.00All Additional States $375.00 per state

Initiation Fee

New Attorney-Trustee members pay a one-time initiation fee upon being approved for membership and is based on the number of attorneys in your creditors rights practice.

1-5 Attorneys $3,500.006-10 Attorneys $5,250.0011+ Attorneys $7,000.00

National Practice Fee

An additional flat fee will be paid for any national default related practices for any one of the following practice areas: Bankruptcy, Eviction, REO, Litigation, Title.Flat Fee Per National Practice $1,000.00(The National Practice maximum fee is $3,000.00)

Non-Legal Support Services Fee

If the law firm/trustee or any combination of members or partners of the law firm/trustee owns 30% or more of a separate company that provides non-legal support services to the financial services industry, then an additional flat fee will be paid. This fee will be waived if the separate company is an Associate member of ALFN.Flat Fee $2,500.00

Analysis of the state:New York continues to be one of the top states where a foreclosure takes the longest time frame to get to sale in addition to one of the top states plagued by the backlog of foreclosures. The Courts continue to adopt new strategies and focus on improvements within the courts to further advance Standards and Goals. Overall, we continue to see the expansion of electronic filings, with more parts moving to a truly paperless system. There will be continued efforts to monitor the residential foreclosure matters, conducting servicer calendars, and improve movement of the files through the court. Westchester Supreme Court created a Mandatory Appearance Part for all foreclosure cases released from the settlement conference part, with the purpose to move the inventory and have the Plaintiff timely move for the Order of Reference. Similarly, Monroe County created a Master Calendar to push foreclosure cases through to disposition. Moreover the Third Judicial District implemented dedicated foreclosure parts headed by court-attorney referees, which enabled legal service providers to increase their presence at all stages of the conference process. Overall, the initiative has resulted in a report from a vast majority of counties that the backlog of foreclosure cases has reduced in volume, statistics that have not been seen in New York in years. By example, Queens County has seen a 37% drop in foreclosure cases since 2015, Nassau County has seen an 89% drop in foreclosure cases since 2015, the Sixth Judicial District has seen an 18% drop in foreclosure cases since 2015, and the Eighth Judicial District has seen a 37% drop in foreclosure cases since 2015.

Judicial

RPAPL 1304 Notices remain under scrutiny by the CourtsOver the years since the institution of the statutorily required notice (90 day notice) there has been a waterfall of challenges to the notices based on whether there is strict compliance with the statute. Initially, these challenges came in the form of questioning whether the notices were sent to all of the appropriate parties. This challenge was overcome, and best practices were established to send the notices to all persons who signed the note and mortgage. The next challenge faced was compliance with the requirement to send by certified mail. Easily overcome by presenting evidence of the post office certified green card, this challenge was quickly defeated. However, the next challenge that arose was to not only the regular mailing but the policies and procedures maintained by a lender/ser-vicer as to its business practices surrounding the mailings if the person who personally mailed the notice did not sign an affidavit. The result has been an increased focus on including additional information within what were considered standard affidavits. Additionally, this challenge is further complicated in light of the increase in servicer transfers prior to submitting a Motion for Summary Judgment as the new servicer lacks sufficient information to be able to attest in an Affidavit as to the mailing procedures of the lender/servicer that mailed the notices. More recently, strict compliance challenges have come in form of whether each borrower must receive his/her own notice, and also whether additional information required by SCRA/FDCPA/Bankruptcy is a violation of the statute. The courts, and even the judges within the same county, continue to render decisions on all ends of the spectrum as new defenses to the 1304 notices are presented by defense counsel.

In a decision rendered on March 13, 2019, the Second Department Appellate Division decided a case of first impression on the issue of Statute of Limitations in Bank of New York Mellon v. Dieudonne. While Statute of Limitations has been a significant issue over the past few years, there has been no guidance from the higher level courts as to the question of when does acceleration occur, leaving it to the Supreme Court Judges to interpret the law and mortgage instruments. This often has led to conflicting decisions among judges sitting within the same county. In Dieudonne, the Second Department was forced to confront the issue raised by the reinstatement provision of FNMA/FHLMC Mortgage Instrument that allows a borrower the option, under certain circumstances, to decelerate the maturity of the debt, and therefore the Statute of Limitations does not begin to run until such right is extinguished by the entry of the Judgment. The Second Department held that the reinstatement provision is not a condition precedent to acceleration of the mortgage and therefore the plaintiff had exercised its right to accelerate when it commenced a prior foreclosure action.

Pending in the NY Legislature currently is a bill that would amend the Real Property Actions and Proceedings Law to permit municipalities to commence judicial proceedings to compel a mortgagee to either complete a mortgage foreclosure or issue a certificate of discharge of the mortgage for any property that has been certified as abandoned. The impetus behind this bill is to allow the municipalities the ability to reclaim and redevelop properties.
