Studies in Space LawGeneral Editor: Frans G. von der Dunk, University of Nebraska-Lincoln

‘Space law’, as the law relevant to outer space and space activities, is a relatively young area of law, which moreover is expanding rapidly in scope. Practical, down-to-earth applications of space activities abound, more and more of a commercial nature. Also the number and variety of actors is growing. As a consequence, the traditional field of research of space law is widening so as to include or interfere with such other fields as telecommunications law, intellectual property rights, trade and commercial law, EC law, transport law and so on. This series aims to present a platform for qualified authors to shed light on relevant developments from this perspective, whilst keeping in mind the longer-term perspectives of space activities and the concurrent interest of space law to remain a reasonably coherent body of law.

The Asia-Pacific Journal of Ocean Law and Policy explores ocean law and policy issues in the most economically dynamic region in the world: the Asia-Pacific. These ocean spaces are crucial to international trade and are becoming increasingly important in terms of marine resources and services. Hotly contested, the region is subject to enhanced threats such as pollution, conflicting activities, over-exploitation and environmental degradation. Escalating ocean governance challenges coupled with mounting tensions in the region have made studies focusing on this area an especially pertinent topic for scholarly research and consideration in securing and maintaining peace in the Asia-Pacific region and beyond.

Brill Research Perspectives in International Investment Law and ArbitrationEditors-in-Chief: Ian A. Laird, Crowell & Moring; Columbia Law School; Georgetown University Law Center; International Law Institute and Borzu Sabahi, Curtis, Mallet-Prevost, Colt & Mosle LLP; Georgetown University Law Center; International Law Institute

This journal provides a systematic review of key topics in this increasingly important area of international law and practice. Foreign investment (particularly FDI) continues to be a catalyst for development. To promote and protect the flow of such investments, countries worldwide have entered into thousands of investment treaties and domestic investment laws, which requires them to protect foreign investment in their territories. These treaties also allow foreign investors to directly sue governments before international arbitration tribunals for treaty violations ranging from old-fashioned “expropriation without compensation” to violations of more modern protections such as the so-called “fair and equitable” standard of treatment. The claims raise a mix of public international law, private and public law, and public policy issues requiring an examination of the legitimacy of a government’s exercise of its core functions including regulatory (involving taxation, health, and environment), administrative, and police powers and the balance of those against foreign investors’ rights under the treaties. This journal addresses these issues and aims to provide an authoritative reference guide for scholars and practitioners.

Brill Research Perspectives in International Legal Theory and Practice is a journal that offers a series of short monographs conceptualizing recent developments and fundamental trends in the field and discipline of international law. It encourages cutting-edge scholarship from leading scholars. In an undertaking that bridges international legal theory, the discipline’s culture, and international legal history, the journal critically examines the emergence and evolution of international legal practices, as well as the intellectual legal projects and theories that have shaped and continue to shape international law and its discipline. Brill Research Perspectives in International Legal Theory and Practice allows us to understand the dynamics that are at play in international law and to reclaim its history whilst, most importantly, encouraging international lawyers to reimagine and rethink its possibilities. Although the journal is intended primarily for researchers, lecturers, practitioners, and graduate students, its wide-ranging and critical engagement with international law makes it a highly interesting read for a broader audience as well.

Brill Research Perspectives in International Water LawEditor-in-Chief: Salman M.A. Salman, the International Water Resources Association

Brill Research Perspectives in International Water Law is a hybrid journal and reference publication for research output on shared freshwater resources. Population growth, economic activities, environmental degradation, and climate change have exacerbated competition and ignited disputes over water resources (both surface water and groundwater) shared by two or more states. The entry into force of the United Nations Watercourses Convention has refocused the attention of the world community on shared water resources and underscored the pressing need for their equitable and sustainable sharing, inclusive and proper management, and environmental protection.

Each issue comprises a single, uniquely focused monograph that explores these aspects and addresses international, regional, and bilateral agreements and arrangements as well as thematic matters related to shared water resources. The journal’s target contributors and readers include international water law professors, researchers, practitioners, and graduate and undergraduate students.

Brill Research Perspectives in Law and ReligionEditor-in-Chief: Norman Doe, Centre for Law and Religion, Cardiff University, UK

Legal issues concerning religion increasingly make the news headlines these days. As a result, the intersection of law and religion is today an established but growing field of scholarship worldwide. Just as the bourgeoning field whose name it shares, Brill Research Perspectives in Law and Religion seeks to better understand how the phenomena of law and religion interact and to stimulate practical debate on the diverse range of issues involved. The place of religion in society, religious pluralism, the fear of religious extremism, and the terms and limits of religious freedom generate a host of important questions on the interface of law and religion.

Brill Research Perspectives in Law and Religion encourages the publication of studies of the highest quality, for scholarly analysis and for public debate, associated with the regulation of religion in society and the regulation of the internal life of religious traditions. Its primary readership includes academics, researchers, practitioners, policy makers, educators, and graduate and undergraduate students. Brill Research Perspectives in Law and Religion is published in close cooperation with the Cardiff University Centre for Law and Religion.

European Journal of Crime, Criminal Law and Criminal JusticeEditor-in-Chief: Jannemieke Ouwerkerk, Institute of Criminal Law and Criminology, Leiden Law School, The Netherlands

Crime, criminal law and criminal justice are no longer purely national issues in today’s Europe. Criminal conduct is becoming increasingly denationalised because offenders can easily cross borders and through the emergence of the Internet and cyberspace. It is also increasingly common for individuals either to face criminal proceedings or to become victims of crime in countries other than their own. Nevertheless, efforts to combat crime, and to safeguard the rights of victims, are still organised on a, by and large, national basis. The European Journal of Crime, Criminal Law and Criminal Justice provides a forum for public debate on these European issues. It seeks not only to bridge the gap between European players and European states, but also to afford space for a non-European view on developments in these fields. Our aim, in other words, is to offer a multi-dimensional international and comparative perspective on crime, criminal law and criminal justice in Europe.

Discussions about ethical questions with legal implications are welcome. National legislation, court decisions and other relevant national material with international implications are also dealt with.

The European Convention on Human Rights Law ReviewEditors-in-Chief: Kanstantsin Dzehtsiarou, University of Liverpool and Vassilis P Tzevelekos, University of Liverpool.

The first scholarly journal devoted exclusively to the legal regime of the European Convention on Human Rights (ECHR). The Review offers peer-reviewed, legal scholarship on the protection of fundamental human rights within the ECHR framework and on its implications for other regional human rights regimes. It is a forum for inter alia comparative law, human rights law, international law and philosophy of law analysis of the practice and procedures of the ECHR regime.

While favouring legal (doctrinal, theoretical and philosophical) analysis, the Review also publishes multi-disciplinary works at the crossroads of law, history, political science and economics. It is open to all methods and schools of thought, including, comparative, doctrinal, quantitative and economic analysis of (case) law. It offers scholarship and information of interest to scholars and practitioners, both in the member states and other regions, as well as to all those working in the field of human rights law.

European Journal of Migration and LawManaging Editors: Paul Minderhoud and Sandra Mantu

A quarterly journal on migration law and policy with specific emphasis on the European Union, the Council of Europe and migration activities within the Organisation for Security and Cooperation in Europe. This journal differs from other migration journals by focusing on both the law and policy within the field of migration, as opposed to examining immigration and migration policies from a wholly sociological perspective. The Journal is the initiative of the Centre for Migration Law of the University of Nijmegen, in co-operation with the Brussels-based Migration Policy Group. It provides an invaluable source of information and a platform for discussion for government and public officials, academics, lawyers and NGOs interested in migration issues in the European context. Devoted exclusively to migration law and policy, the original research and analysis the Journal presents will emphasize the development of migration policies across Europe.

Global Journal of Comparative LawEditor-in-Chief: Francis Botchway, Sir William Blair Chair in Alternative Dispute Resolution at Qatar University

The Global Journal of Comparative Law is a peer reviewed periodical that provides a dynamic platform for the dissemination of ideas on comparative law and reports on developments in the field of comparative law from all parts of the world. In our contemporary globalized world, it is almost impossible to isolate developments in the law in one jurisdiction or society from another. At the same time, what is traditionally called comparative law is increasingly subsumed under aspects of International Law. The Global Journal of Comparative Law therefore aims to maintain the discipline of comparative legal studies as vigorous and dynamic by deepening the space for comparative work in its transnational context.

International Community Law ReviewEditor-in-Chief: Malgosia Fitzmaurice, Queen Mary University of London

International Community Law Review aims to explore the implications of various traditions of international law, as well as more current perceived hegemonic trends for the idea of an international community. The Journal will also look at the ways and means in which the international community uses and adapts international law to deal with new and emerging challenges. Non-state actors , intergovernmental and non-governmental organisations, individuals, peoples, transnational corporations and civil society as a whole - have changed our outlook on contemporary international law. In addition to States and intergovernmental organizations, they now play an important role. Rather than regional, the focus of ICLR will be multicultural, including alternative and/or critical approaches, with contributions written by scholars from all parts of the globe. The International Community Law Review, published four times a year, consists of articles, shorter articles/comments, case notes and book reviews.

International Criminal Law ReviewEditor-in-Chief: Caroline Fournet, Faculty of Law, Criminal Law - Criminal Law and Criminology, University of Groningen, The Netherlands

The practice at the different international criminal tribunals has shown that there is no real international criminal (customary) law, but only extrapolations from international public law, general principles of law and humanitarian law. The divide between the so-called common law and civil law systems and their differences in approach to solving legal problems make it necessary to establish an international forum for discussion and development of a common ground on which the work of the international courts can build. This is especially true with regard to the so-called “General Part” of the substantive criminal law, like forms of participation, actus reus and mens rea categories, defences and excuses, offence types, sentencing, enforcement etc. The International Criminal Law Review publishes in-depth analytical research that deals with these issues.

International Human Rights Law ReviewEditors-in-Chief: Ilias Bantekas and Manisuli Ssenyonjo

The International Human Rights Law Review is a bi-annual peer-reviewed journal. It aims to stimulate research and thinking on contemporary human rights issues, problems, challenges and policies. It is particularly interested in soliciting papers, whether in the legal domain or other social sciences, that are unique in their approach and which seek to address poignant concerns of our times. One of the principal aims of the journal is to provide an outlet to human rights scholars, practitioners and activists in the developing world who have something tangible to say about their experiences on the ground, or in order to discuss cases and practices that are generally inaccessible to European and North-American audiences. The Editorial Board and the publisher are keen to work hands-on with such contributors and to help find solutions where necessary to facilitate translation or language editing in respect of accepted articles. The journal is aimed at academics, students, government officials, human rights practitioners, and lawyers working in the area, as well as individuals and organisations interested in the areas of human rights law.

International Journal on Minority and Group RightsEditor-in-Chief: Gudmundur Alfredsson

The International Journal on Minority and Group Rights is devoted to interdisciplinary studies of the legal, political, economic and social problems which minorities and indigenous peoples face in all countries of the world. For the purposes of the Journal, groups are seen as clearly recognizable segments of society, defined by such relatively constant factors, as national or ethnic origin, religion, culture or language. Current developments, not least the spread of violent ethnic and religious conflicts, underline the need for a periodical publication dealing with the rights of persons belonging to minorities and indigenous peoples and of the groups themselves. The Journal pays special attention to the contribution which human rights standards and good governance guidelines can make to a better world for all. The Journal aims to become the primary forum for the discussion of the vitally important field of studies which it covers.

International Organizations Law ReviewEditors-in-Chief: Niels M. Blokker and Ramses A. Wessel Managing Editor: Cale Davis

The International Organizations Law Review is a peer-reviewed journal that only publishes articles that have passed through an anonymous review process. After the Second World War, the law of international organizations developed as a separate, but not separable, discipline within the sphere of public international law. The International Organizations Law Review functions as a discussion forum for both academics and practitioners active in this discpline. The Review offers two foci: one based in the world of scholarship and the other in the world of practice. Academic scholarship offered in the Review will focus on general and theoretical developments in international institutional law, while practitioner views offer a forum to identify and discuss legal developments within existing international organizations.

The Legal History Review, inspired by E.M. Meijers, is a peer-reviewed journal and was founded in 1918 by a number of Dutch jurists, who set out to stimulate scholarly interest in legal history in their own country and also to provide a centre for international cooperation in the subject. This has gradually been achieved through the years. Much attention is paid not only to the common foundations of the western legal tradition but also to the special, frequently divergent development of national law in the various countries belonging to, or influenced by it. Modern and contemporary, as well as ancient and medieval history is considered. Roman law and its later development, as well as canon law, have always been particularly important; in addition the history of the English Common Law has been extensively studied.

Religion & Human RightsAn International JournalEditor-in-Chief: Jeroen Temperman, Professor of International Law & Religion, Erasmus University Rotterdam, The Netherlands

Religion & Human Rights provides a unique academic forum for the discussion of issues which are of crucial importance and which have global reach. The Journal covers the interactions, conflicts and reconciliations between religions or beliefs on the one hand; and systems for the promotion and protection of human rights, international, regional and national, on the other. The Journal tackles these issues fearlessly, and draws its materials from all relevant disciplines - theology, anthropology, history, international relations, human rights, religious studies, and many others - but with special emphasis on legal frameworks. It is an indispensable source for all those concerned with monitoring, studying, teaching, analysing or developing policies on the relationship between religion and human rights today.

Security and Human RightsEditor-in-Chief: Christophe Paulussen Executive Editor: Jennifer Pampolina

It looks at the challenge of building security through cooperation across the northern hemisphere, from Vancouver to Vladivostok, as well as how this experience can be applied to other parts of the world. It aims to stimulate thinking on the question of protecting and promoting human rights in a world faced with serious threats to security. It brings to light current developments affecting human rights, peace and security across North America, and wider Europe including Central Asia. Major themes include: Conflict prevention; Human rights; Minorities; Democracy building; and Cooperative security.

United Nations Convention on the Law of the Sea OnlineEdited by Myron H. Nordquist, Satya Nandan, and Shabtai Rosenne†

These Commentaries are based almost entirely on the formal and informal documentation of the Third United Nations Conference on the Law of the Sea (UNCLOS III, 1973-1982), coupled, where necessary, with the personal knowledge of editors, contributors, or reviewers, many of whom were principal negotiators or UN personnel who participated in the Conference. The scope and duration of the “Virginia Commentary” project is without precedent as an academic undertaking in the field of international law. The project was conceived by its editors to meet the need - particularly essential in the absence of an official legislative history for the Convention - for an objective and comprehensive analysis of the articles in the Convention and in the Agreement relating to the Implementation of Part XI of the Convention that entered into force in 1996. Throughout its nearly 5000 pages, the Commentary presents the text of each article and thereafter cites its documentary sources. The line-by-line development for each article is discussed chronologically for each session of the Conference. Over 100 international law scholars or Conference diplomats, reflecting a wide diversity of views, contributed to drafting or reviewing the Commentaries.

Now firmly established as the most authoritative reference work in the field of international law about the 1982 Convention.
