PBS (Dep) Guidance (version 07/2014) - page 1 PBS (DEPENDANT) POLICY GUIDANCE Addendum - PBS Dependant Applications for leave to remain under the Points Based System will fall for refusal if you have overstayed for more than 28 days on the date of application, unless there were exceptional circumstances which prevented you from applying within the 28 day period. The 28 day period of overstaying is calculated from the latest of: • the end of the last period of leave to enter or remain granted, • the end of any extension of leave under sections 3C or 3D of the Immigration Act 1971, or • the point a written notice of invalidity is deemed to have been received, in accordance with paragraph 34C or 34CA of the Immigration Rules, in relation to an in-time application for further leave to remain. If there are exceptional circumstances which prevented you from applying in time you must submit evidence of the exceptional circumstances with your application. The threshold for what constitutes ‘exceptional circumstances’ is high and will depend on the individual circumstances of the case, but for example may include delays resulting from unexpected or unforeseeable circumstances such as the following: • serious illness which meant that you or your representative were unable to submit the application in time (where supported by appropriate medical documentation). • travel or postal delays which meant that you or your representative were unable to submit the application in time. • inability to provide necessary documents. This would only apply to exceptional or unavoidable circumstances beyond your control, such as the Home Office being at fault in the loss of, or delay in returning, travel documents, or delay in obtaining replacement documents following loss as a result of theft, fire or flood (where supported by evidence of the date of loss and the date replacement documents were sought).

Introduction

1. ThisdocumentprovidespolicyguidanceforfamilymembersofaPBSmigrant.Itreflectspolicyatthedateofpublicationandwemaychangeit.Itshouldbereadtogetherwithparagraphs319Ato319KoftheImmigrationRules.Forthepurposeoftheseguidancenotes,theterms‘we’,‘us’and‘our’refertotheHomeOffice.Whenwereferto’you‘or’your‘,thismeansthePBSdependant.

2. YoucanapplyasaPBSDependantifyoumeetthecriteriasetoutinthisguidanceandtheImmigrationRules,andyouare:•thefamilymemberofapersonwith,orapplyingfor,leaveunderTier1,2,4or5ofthePointsBased System; or

•thespouseorpartnerofapersonwithindefiniteleavetoremainorBritishCitizenshipwholastheldleaveinTier1,2,or5ofthePointsBasedSystemandyoudonotyetqualifyforindefiniteleave to remain; or

•thechildofapersonwithindefiniteleavetoremainorBritishCitizenshipwholastheldleaveinTier1,2,or5ofthePointsBasedSystemand:

○ yourotherparentdoesnotyetqualifyforindefiniteleavetoremain;and

○ youlastheldleaveasPBSDependantgrantedonorafter9July2012.

3.WherewerefertothedependantofaTier1,2or5migrant,allofthesereferenceswillalsoinclude those applicants who are applying for further leave to remain in the PBS dependant categorywhentheirsponsor(theTier1,2or5migrant)hasgoneontoacquireindefiniteleavetoremain.Ifyouareapplyingasthedependantofapersonwhohasindefiniteleavetoremain,orBritishCitizenship,youshouldreadthisguidanceasiftheywerestillintheirlastPBSimmigrationcategory.ForexampleifthepersonwithindefiniteleavetoremainlastheldPBSleaveinTier1,you should read the guidance as if you are applying as the dependant of a Tier 1 migrant.

4.AfamilymemberofaTier2andTier5PBSmigrantapplyingintheUnitedKingdomcanmaketheirPBS(Dependants)applicationonlineorusingtheequivalentpaperapplicationform.FamilymembersofaTier1PBSmigrantapplyingintheUnitedKingdommustmaketheirPBS(Dependants)applicationusingthepaperapplicationform.

5.Thisapplicationformandmoregeneralinformationareonourwebsiteat:www.gov.ukDocuments we require

6. You must ensure that you provide all of the necessary supporting documents at the time yousendsusyourapplication.WewillonlyacceptthesupportingdocumentsspecifiedintheImmigrationRules.

7. Ifyouhavesubmitted:•Asequenceofdocuments,andsomeofthedocumentsinthesequencehavebeenomitted(forexample,ifonebankstatementfromaseriesismissing);

•A document in the wrong format;

•A document that is a copy and not an original document.

wemaycontactyouoryourrepresentativeinwriting,andrequestthecorrectdocuments.Wemustreceivetherequesteddocumentsattheaddressspecifiedintherequestwithin7workingdaysofthedateoftherequest.Wewillnotaskforfurtherinformationwherewedonotanticipatethatacorrection of minor errors or omissions will lead to an approval.

Ifyouhavesubmittedaspecifieddocumentthatis:

•in the wrong format, or

•a copy and not an original document,

wemayapproveyourapplicationexceptionallyifwearesatisfiedthatthespecifieddocumentsaregenuineandthatyoumeetalltheotherrequirements.Wereservetherighttorequesttheoriginaldocumentsinthecorrectformatandtorefuseapplicationsifthespecifieddocumentsarenotprovided.8. Anydocumentaryevidencethatyouprovidemustbetheoriginal(notacopy)unlesswesay

otherwise.9. WhereadocumentisnotinEnglishorWelsh,theoriginalmustbeaccompaniedbyafullycertifiedtranslationbyaprofessionaltranslator.Thistranslationmustincludedetailsofthetranslator’scredentialsandconfirmationthatitisanaccuratetranslationoftheoriginaldocument.Itmustalsobedatedandincludetheoriginalsignatureofthetranslator.

10. Weonlyneedevidencethatisdirectlyrelevanttotheapplication,assetoutintheImmigrationRulesandthisguidance.Wewillnotconsiderunrelatedevidence.

11. IfyouarethedependantofaTier4Studentswhoqualifiesforourdifferentiationarrangementsbecauseyouareconsideredtobe“lowrisk”,youwillberequiredtoprovidefewerevidentialdocumentswhensubmittingyourapplication.Whereyouareexemptedfromhavingtoprovidea document - or a group of documents - under our differentiation arrangements, this will bespecificallystatedinthisguidance.TheHomeOfficereservestherighttorequestthesedocuments from you in all cases.

12. Youqualifyforourdifferentiationarrangementsif:•TheTier4studentissponsoredbyaHighlyTrustedSponsor;and

•YouareapplyingforleaveatthesametimeastheTier4student;and

•You are applying for entry clearance in your country of nationality or for leave to remain in the UK;and

•YouholdthesamenationalityastheTier4studentandbothofyouarenationalsofoneofthecountrieslistedatAppendixHoftheImmigrationRules.Youcancheckthisat:www.gov.uk/government/collections/immigration-rules

Verification and other checks

13.Weaimtoconsiderapplicationsquickly.However,wemustalsobeconfidentthatapplicationsmeettherequirementsoftheImmigrationRules,andthattheinformationyouprovideisatruereflectionofyourbackground.

14.Wewillaskforavarietyofverifiabledocumentstoenableustoconsideryourapplication.15.Wemaywanttocheckthesupportingdocumentsyousendwithyourapplication.Therefore,youmustensurethatalltheevidencecomesfromasourcethatcanbeclearlyidentifiedandthatitcanbeindependentlyconfirmedasbeinggenuine.

16. Therearetwosituationsinwhichwewillundertakeacheck:• Verification checks–wherewehavereasonabledoubtsthatthedocumentsaregenuine;or

• Other checks–wherewecarryoutfurtherchecks,forexample,wherewehavedoubtsaboutanapplication,orthedocumentssentwiththeapplication,butthedoubtsarenotseriousenoughforustomakeaverificationcheck.

Verification checks17. Wherewehavereasonabledoubtsthataspecifieddocumentisgenuinewemaywanttoverify

the document with an independent person or government agency.18. Thepurposeofthesechecksistoensurethatthedocumentprovidedisgenuineandaccuratelyreflectsstatementsmadeinyourapplication.Ifthedocumentisbeingusedasevidencetosupportyourapplication,wealsowanttoensurethatitmeetstherequirementsoftheRules.

19. Verificationmaydelayourdecisiononyourapplicationsowewillonlydoitwhenthereareclear reasons for it.

Reasonable doubt20. Therearemanyreasonswhywemaydoubtthataspecifieddocumentisgenuineandwhatweconsidertobeareasonabledoubtwilldependonanindividualapplication.However,ourjudgmentswillbebasedonthefactswehave.

Outcome of verification check21. Therearethreepossibleoutcomesofaverificationcheck:

• Document confirmed as genuine.Ifwecanconcludethatthedocumentisgenuine,wewillconsider your application as normal.

• Document confirmed as false.Ifwecanconcludethatthedocumentisfalse,wewillrefusetheapplication,whetherornotthedocumentisessentialtotheapplication.Ifadocumentisconfirmedasfalsewewillnormallyrefusetheapplicationformorethanonereason.Forexample,ifyousendusabankstatementtoshowthatyouhaveenoughfundsavailable,andwehaveevidencethatthestatementisfalse,wewillrefuseyourapplicationbecauseyoudonotmeetthefundsrequirementandbecauseyouhavesentafalsedocument.

• Verification check inconclusive.Ifwecannotverifythatthedocumentiseithergenuineorfalsethenwewillignoreitasevidence.IfyouhavesentotherspecifieddocumentsasevidencethatyoumeettherequirementsoftheRules,wewillconsidertheseasnormal.Ifyouhavenotsentanyotherdocuments,youwillnotmeettherequirementsoftheRules.

Refusing applications without making verification checks22. Wemayrefuseanapplicationwithoutmakingverificationchecksintwocircumstances:•Whereweareconcernedaboutapieceofevidencebutwouldinanyeventrefusetheapplicationforotherreasons,thosereasonswillformthebasisoftherefusal.Wewillnotmakeverificationchecksinthesecircumstances.However,wewillalwaysverifypassportsifwedoubtthey are genuine.

•Wherethereisevidencethatprovesaparticulardocumentisfalse.Ifwecanconfirmthatadocument is false we will normally refuse the application for more than one reason. For example, ifyousendusabankstatementtoshowthatyouhaveenoughfundsavailable,andwehaveevidencethatthestatementisfalse,wewillrefusetheapplicationbecauseyoudonotmeetthefundsrequirementandbecauseyouhavesentafalsedocument.

Other checks23.Wewillmakeothercheckswhere,forexamplewehavedoubtsaboutanapplication,orthedocumentssentwiththeapplication,butthesearenotseriousenoughforustomakeaverificationcheck.

24.Thesechecksmaydelayourdecisiononanapplicationsowewillonlymakethemwhenwehave clear reasons to do so.

extra checks25.Sometimeswewillhavesuspicionsaboutadocument,buttheywillnotbeenoughtomakeusdoubtthatitisgenuine.Forexample,thismaybebecausepreviousverificationcheckshavefound that some supporting evidence is invalid and some is genuine, or where evidence provided contradictsinformationwealreadyhave.Inthesecases,wemaycarryoutmorechecks.

Outcome of other checks26. Therearefourpossibleoutcomesofthesechecks:

• Document confirmed as genuine.Ifwecanconcludethatthedocumentisgenuine,wewillconsider the application as normal.

• Document confirmed as false.Ifwecanconcludethatthedocumentisfalse,wewillrefusetheapplication,whetherornotthedocumentisessentialtotheapplication.Ifadocumentisconfirmedasfalsewewillnormallyrefusetheapplicationformorethanonereason.Forexample,ifyousendusabankstatementtoshowthatyouhaveenoughfundsavailable,andwehaveevidencethatthestatementisfalse,wewillrefuseyourapplicationbecauseyoudonotmeetthefundsrequirementandbecauseyouhavesentafalsedocument.

• Check inconclusive.Ifwecannotverifythatthedocumentiseithergenuineorfalsethenwewill consider the application as if the document is genuine.

• Check gives us cause to have reasonable doubt about the genuineness of a specified document. Ifwecannotverifythatthedocumentiseithergenuineorfalsebutasaresultofthecheckswefindotherreasonstodoubtthegenuinenessofaparticularspecifieddocument,wemaydecidetomakeaverificationcheck.

Procedure for verification and other checks27. Theproceduresforbothverificationchecksandothercheckswillusuallybesimilarandwillvaryfromcasetocase,buttheymayinvolve:•checkingthedetailsorgenuinenessofdocumentswithemployers,therelevantembassyorhighcommission,othergovernmentdepartments(intheUnitedKingdomandoverseas);and

•checkingtheaccuracyandauthenticityofdocumentswithbanks,universitiesandprofessionalbodies.

Date of application28. Thedateofyourapplicationwillbetakentobethefollowing:

For applications made in the united Kingdom:•wheretheapplicationformissentbypost,thedateofposting;or

•wheretheapplicationformissentbycourier,thedateonwhichitisdeliveredtotheHomeOffice;

•wheretheapplicationformissubmittedonline,thedatewhenyousubmityourapplicationformand pay your application fee online.

For applications made outside the united Kingdom:•the date that the fee associated with the application is paid. This means the date shown on your payment receipt, which depends on how you paid for your visa application, for example, at a BritishDiplomaticPost,visaapplicationcentreoronline.

OVeRVIeW OF tHe teRMS anD COnDItIOnS FOR aPPLICatIOnS BY PBS MIGRantS

29. YoushouldreadtheImmigrationRulesthatapplyatthetimethatyoumakeyourapplication.

Periods of grant

30.WewillgrantleaveinlinewiththeexpirydateofthePBSmigrant’s(ormainapplicant’s)leave,exceptwherethePBSmigranthasbeengrantedindefiniteleavetoremain.Inthesecases,wewillgrantyouaperiodofthreeyearsleave.Anapplicationforfurtherleavemaythenbemadeifrequiredtotakeyouuptotheapplicablequalifyingperiodforindefiniteleavetoremain.

applying as the Family Member of a tier 1, 2 or 5 migrant in the UK

31.IfyouarethefamilymemberofaTier1,2,or5migrant,youcannotapplyintheUKifyou:

•werelastgrantedleavetoenterorremainasavisitor,unlesstherelevantpoints-basedsystemmigrant,whoyouareapplyingtobedependantofhas,orisbeinggrantedleavetoremainasaTier5(TemporaryWork)migrantinthecreativeandsportingsubcategory;or

•are on temporary admission or temporary release.

32.IfyouarethefamilymemberofaTier4(General)applicant,whetherornotyoucanapplyforthePBSDependantcategoryintheUKdependsonthetypeofpermissiontostaythatyouhaveandtypeofcoursetheTier4(General)studentisstudying,orwillbestudying.

33.YoucanbethefamilymemberofaTier4(General)applicantwheretheyareapplyingfor,orhavebeengranted,entryclearance,leavetoenter,orleavetoremainintheUnitedKingdomasaTier4(General)Studentif:

(i) theTier4(General)applicantisagovernmentsponsoredstudentwhoisapplyingfor, orwhohasbeengranted,entryclearanceorleavetoremaintoundertakeacourseof study longer than six months; or

(ii) theTier4(General)applicantis:

a) applyingfor,orhasbeengrantedentryclearanceorleavetoremaininorderto undertakeacourseofstudyatpost-graduatelevelfor12monthsorlonger; and

b) issponsoredbyasponsorwhoisaRecognisedBodyorabodyinreceiptof funding as a higher education institution from either:

I. theDepartmentforEmploymentandLearninginNorthernIreland; II. theHigherEducationFundingCouncilforEngland; III. theHigherEducationFundingCouncilforWales;or IV. theScottishFundingCouncil; or

(iii) theTier4(General)applicantisapplyingfor,orhasbeengrantedleavetoremainas aTier4(General)Studentonthedoctorateextensionscheme;or

(iv) thefollowingconditionsaremet:

a) theTier4(General)applicantisapplyingforentryclearance,leavetoenter,or leavetoremain,toundertakeacourseofstudythatislongerthansixmonths and either:

(1) hasentryclearance,leavetoenter,orleavetoremainasaTier4 (General)Studentorasastudenttoundertakeacourseofstudylonger than six months ; or

(2) lasthadentryclearance,leavetoenter,orleavetoremainwithinthe threemonthsprecedingtheapplicationasaTier4(General)Studentor asastudenttoundertakeacourseofstudylongerthansixmonths;and

b) You(thefamilymember)musteither-

(1) haveentryclearance,leavetoenter,orleavetoremainasafamily memberofaTier4(General)Studentorastudentwithentryclearance, leavetoenter,orleavetoremain,toundertakeacourseofstudylonger than six months; or

(2) havelasthadentryclearance,leavetoenter,orleavetoremainwithin thethreemonthsprecedingtheapplicationasthefamilymemberofa Tier4(General)Studentorasastudenttoundertakeacourseofstudy longer than six months; and

c) theTier4(General)applicantMigrantandyou(thefamilymember)mustbe applying at the same time.

34.ToapplyintheUKyoumustnothavelastbeengranted:

•leave to enter or remain as a visitor; or

•temporary admission or temporary release.

35.Tier4(General)studentswhowillbestudyingintheUKforsixmonthsorlesscannotbringtheirpartnersand/orchildren(alsoknownasdependants)totheUnitedKingdomwiththem.

additional evidential requirement for dependants of PBS migrants whose last grant of leave was not in this capacity.

36.IfyouareapplyingasafamilymemberofaPBSmigrantandyourlastgrantofleavewasnotastheirdependantoryouareachildbornintheUK,youwillneedtodemonstrateyourrelationship. WhereyouaremarriedorinacivilpartnershiptoaPBSmigrant,youmustprovideyourmarriageorcivilpartnershipcertificatetosupportyourapplicationWhereyouareapplyingasthepartnerofaPBSmigrantbutarenotmarriedorinacivilpartnershipwiththemyouwillneedtoprovidedocumentstoshowthatyouhavebeenlivinginarelationshipakintomarriage/civilpartnershipforaperiodofatleasttwoyears-documentsshouldthereforecoverthewholeofthisperiod.DocumentswillonlybeacceptedwheretheyarefromofficialsourcessuchasutilitybillsorNHSregistration:Suggested Documents

Partners (including spouses and civil partners)marriageorcivilpartnershipcertificatesbankstatementsCounciltax/billsmedical registrationutilitybills

ChildrenFullbirthcertificateshowingbothparentsnamesIfyouareachilddependantovertheageof16youwillalsoneedtoincludethedocumentslistedin paragraph 111.

Conditions of Stay

37.You will have the following conditions attached to any leave:

•Norecoursetopublicfunds,

•Registrationwiththepolice,ifthisisrequiredbyparagraph326oftheImmigrationRules,

•Noemploymentasaprofessionalsportsperson(includingasasportscoach)

•NoEmploymentasaDoctororDentistinTraining,unlessyou:

○ haveobtainedaprimarydegreeinmedicineordentistryfromaUKinstitutionthatisaUKrecognisedorlistedbody,orwhichholdsasponsorlicenceunderTier4ofthePointsBasedSystem; or

○ areapplyingforleavetoremainandhave,orhavelastbeengranted,entryclearance,leavetoenterorleavetoremainthatwasnotsubjecttoaconditionrestrictingyouremployment,whetherthatisemploymentasaDoctororDentistinTrainingorotherwise,andhavebeenemployedduringthatleaveasaDoctororDentistinTraining.

38.IfyouarethefamilymemberofaTier4(General)Student,ifthemainapplicant’sgrantofleaveisforlessthan12monthsyouwillnotbeallowedtoworkwhilstintheUK,unlessthemainapplicant is a Government Sponsored Student.

How many months money does a family member of a tier 4 (general) Student need?

67. IfyouareafamilymemberofaTier4(General)student,youmustshowthatyouhaveenoughmoneytocoveryourmonthlylivingcostswhilstthestudentisstudyingintheUnitedKingdom.

68. The amount of money you have to show will depend on whether the student already has anestablishedpresencestudyingintheUnitedKingdom.WhereastudenthasanestablishedpresencestudyingintheUnitedKingdom,youwillneedtoshowlessmoneyforlivingcosts.

69. ATier4(General)student(includingDoctorateextensionscheme,Post-graduateDoctorsandSabbaticalOfficers)hasanestablishedpresencestudyingintheUKiftheyhavecurrententryclearance,leavetoenterorleavetoremainasaTier4migrant,asastudent,orasaPost-graduateDoctororDentistwhenapplyingforfurtherleaveandonthedateofapplicationthey:

iv)LetterfromafinancialinstitutionregulatedbyeithertheFinancialConductAuthority,thePrudentialRegulatoryAuthorityor,inthecaseofoverseasaccounts,thehomeregulator(officialregulatorybodyforthecountryinwhichtheinstitutionoperatesandthefundsarelocated)forthepurposeofpersonalsavingsaccountsconfirmingfunds.Thislettershouldshow:

•thenameofthemainapplicantand/oryourname,or(forchildrenonly)thenameofyourotherparentwhoisalsolegallypresentintheUnitedKingdom;

•theaccountnumber;

•the date of the letter;

•thefinancialinstitution’snameandlogo;

•the funds held in the account; and

•theamountofmoneyavailable.

Official financial sponsorship or government sponsor

100. IftheTier4(General)Studenthasofficialfinancialsponsorship(i.e.isbeinggivenmoneytocovertheircoursefeesandlivingcosts),thissponsorshipmayalsobeintendedtocovercostsofyouandanyotherfamilymember(s).

101. Wherethisisthecase,youmustprovidealetterofconfirmationfromtheTier4(General)Student’sofficialfinancialsponsor.

102. ThismaybeHerMajesty’sGovernment,theirhomegovernment,theBritishCounciloranyinternational organisation, international company or university.

103.Thelettermustbeonofficialletter-headedpaperorstationeryoftheorganisationoftheofficialfinancialsponsorandhavetheofficialstampofthatorganisationonit.Itmustshow:

•boththeTier4(General)student’snameandyourname;

•thenameandcontactdetailsoftheofficialfinancialsponsor;

•the date of the letter

•the length of the sponsorship and

•the amount of money they are providing or a statement that they will cover the your full maintenance.

104.Iftheofficialfinancialsponsorshiponlycoverspartofyourlivingcosts,documentationmustbeprovided to show the remaining maintenance, as detailed earlier in this guidance.

105.IfyouareapplyingatthesametimeastheTier4(General)Student,thefundsthatyouprovideevidenceofmustbeinadditiontothefundsfortheTier4(General)student.Thesamemoneycannotbecountedtwice.Forexample,iftheTier4(General)studentprovidesaletterconfirmingthathe/sheisinreceiptofofficialfinancialsponsorshipandyouprovidebankstatementstocoveryourownlivingcosts,themoneyheldinthebankaccountmustbeinadditiontothemoneythathasbeenprovidedbytheofficialfinancialsponsortocovertheTier4(General)Student.

Children of PBS Migrants

106. InordertoapplyforleavetoremainasthechildofaPBSmigrant,youmustbeundertheageof18onthedateofapplication.Ifyouareaged18orover,youmusthave,orhavelastbeengranted,leaveasthefamilymemberofaPBSmigrantorsomeoneapplyingatthesametimeforleave as a PBS migrant.

107. YouwillnotbeconsideredtobeachildfamilymemberofaPBSmigrantwhereitisconsideredthat you:

•are married or in a civil partnership

•have formed an independent family unit; or

•are living an independent life.

108. Childrenaged18oroverwhohavenotpreviouslybeengrantedleaveasthefamilymemberofthePBSmigrantcannotbegrantedbeleaveasthefamilymemberofaPBSmigrant.

111. Ifyouareovertheageof16,youshouldsubmitthefollowingdocumentationinsupportofyourapplication.Twoitemsfromthelistbelowconfirmingyourresidentialaddress:•bankstatements;and/or

•creditcardbills;and/or

•drivinglicence;and/or

•NHSRegistrationdocument;and/or

•letterfromyourcurrentschool,collegeoruniversityconfirmingyouraddress.Thismustbeonofficialheadedpaperandbearingtheofficialstampofthatorganisation.Itmusthavebeenissuedbyanauthorisedofficialofthatorganisation.

112. Thedocumentssubmittedshouldbefromtwoseparatesourcesanddatednomorethanamonth prior to the date of application.

113.Ifyoupayrentorboardtowardsyourkeep,youshouldalsoprovidedetailsofhowmuchthisamounts to each calendar month.

114.Whereyouareresidingseparatelyfromthoseonwhichyouareclaimingtobeafamilymember,thefollowinginformationordocumentationshouldbesubmitted:•reasonsforresidingawayfromthefamilyhome.Wherethisisduetoacademicendeavoursyoushouldsubmitconfirmationfromyouruniversity/collegeconfirmingyourenrolmentandattendanceofthespecificcourse.Thisshouldbeonofficialheadedpaperandbearingtheofficialstampofthatorganisation.Itmusthavebeenissuedbyanauthorisedofficialofthatorganisation.

•youshouldalsoincludeevidencethatyouhavebeensupportedfinanciallybyyourparentswhilstresidingawayfromthefamilyhome.Thefollowingdocumentationshouldbeincludedwiththe application:

○ bankstatementsforyoucoveringthethreemonthspriortotheapplicationclearlyshowingthe origin of the deposits; and

○ bankstatementsforyourparentcoveringthethreemonthspriortotheapplicationalsoshowingcorroboratingpaymentsoutoftheiraccount.

1.IfyouwerelastgrantedleavewhichwasnotsubjecttoaconditionrestrictingyouremploymentandyouhavebeenonaNHSfoundationprogrammeorworkingasa‘DoctororDentistinTraining’duringyourmostrecentperiodofleave,youcanapplytobeexemptedfromtheconditionprohibitingthistypeofemployment.

2.Inordertoqualifyforthisexemptionyoushouldprovidethefollowingevidence:

a)ToprovethatyouareontheFoundationProgramme,aletterfromyourPostgraduateDeanthatsatisfiestherequirementsoftheImmigrationDirectorateInstruction(IDI)onPostgraduateDoctorsandDentists(seeinparticularpage17ofthatIDI)confirming:

•That you have a place on a Foundation Programme; and

•TheFoundationProgrammeisrecognisedbythemedicalcommunity;and

•The place on the Foundation Programme is full time.

or;

b)ToprovethatyouhavebeenworkingasaDoctororDentistinTraining,youmustprovidealetterfromtheNHSTrustemployingyouconfirmingthatyouhavebeenworkinginapost/programmethathasbeenapprovedbythePostgraduateMedicalEducationandTrainingBoardasatrainingprogrammeorpost.Whereyoudonotincludealloftherequestedinformation,anygrantofleavewillbesubjecttothe‘DoctororDentistinTraining’restriction.

or;

c)EvidenceofaprimarydegreeinmedicineordentistryfromaUKinstitutionthatisaUKrecognisedorlistedbody,orwhichholdsasponsorlicenceunderTier4ofthePointsBasedSystem.
