ABSTRACTThis document contains a summary table of the
statutes, amendments, and constitutional provisions in the 50 statesforming the legal bases for the establishment of educationalcorporations and private postsecondary institutions. The majorportion of the legal bases concern 2- and 4-year degree-grantinginstitutions and nonprofit corporations. The summary' table includes12 areas of concern and, because of the number and lengths of theseareas, has been divided into 2 parts as follows: Part 1 contains (1)provisions for the incorporation or chartering of corporations and/orinstitutions; (2) provisions concerning licensure, accreditation,certification, or permission at the state level; (3) descriptions ofthe types of postsecondary institutions included in the statutoryprovisions; vo provisions for restricting or prohibiting certaintitles such as college or university; (5) regulation or authorizationfor the granting of degrees; and 04 provisions for the developmentand maintenance of standards, rules and regulations; Part 2contains: (7) provisions for certain financial requirements before acorporation or institution is chartered, established, or operated;(8) provisions for evaluations, review, investigations, etc.; (9)provisions covering out-of-state schools for operation in anotherstate or correspondence courses; (10) any penalties or descriptionsof offenses or violations of statutes; (11) institutions or areasexcepted from the statute cited; and (12) miscellaneous areas ofcoficern. fIn 1970, the North Central Association of Collegesand Secondary Schools published an article in itsQuarterly (Vol. XLIV, No. 3, Winter 1970) by Dr.Robert L. Williams, Administrative Dean of theUniversity of Michigan. In his article, "Legal Basesfor Establishment of Private Institutions of HigherEducation", Dr. Williams analyzed the statutesfrom each of the 50 states providing the conditionsto be met before a charter or articles of incorpora-tion could be issued. At the present time, theEducation Commission of the States is consideringforming a task force or advisory committee tostudy this area and possibly develop sample legisla-tion for approving new postsecondary institutionsand authorizing the granting of degrees. We aregrateful to Dr. Williams for his generosity inlending us the legislative statutes used for hisreport. These statutes were very helpful in prepar-ing the summary table on the following pages. Thetable will provide initial background material forthe proposed task force, together with any legisla-tion not included which we are hopeful will bebrought to our attention, particularly in the area ofproprietary and correspondence types of institu-tions.

This issue of Higher Education in the States contains a summary table of thestatutes, amendments, and constitutional provisions in the 50 states formingthe legal bases for the establishment of educational corporations and privatepostsecondary institutions. The major portion of the legal bases concerntwo- and four-year degree-granting institutions and nonprofit corporations.For the convenience of the reader and user, the table has been divided intotwo parts, as described below. Part One begins on page 66 and Part Two onpage 98.
The summary table includes twelve areas of con-cern and, because of the number and lengths ofthese areas, has been divided into two parts asfollows:
PART ONE (pages 66-97): Cited below each state'sname are the statutes from which the informationis derived. The six areas in this part are: (1)provisions for the incorporation or chartering ofWrporations and/or institutions, (2) provisionsconcerning licensure, accreditation, certification,or permission at the state level; (3) descriptions ofthe types of postsecondary institutions included inthe statutory provisions; (4) provisions for restrict-ing or prohibiting certain titles such as "college" or"university"; (5) regulation or authorization forthe granting of degrees; and (6) provisions for thedevelopment and maintenance of standards, rules,and regulations.
