the chief minister. But, the commissionwas bundled up following the Rajasthanhigh court's order on January 4, 2010 ona petition filed by Kashi Purohit andKM L Asthan, who challenged the con-stitution of the Commission.

The Gehlot government had said thatthe panel was set up on demand of thecommon man and on receipt of "a largenumber of complaints" from the pub-lic at large. However, the petitionerscould not get copies of these complaintseven after moving the information com-mission under the Right to InformationAct.

Petitioners clarified that the Com-mission was based only on an officialnoting moved by the chief minister,Ashok Gehlot, and there were no com-plaints on record against Raje. "TheCommission has not been constitutedunder the Commission of Inquiry Act,"Abhinav Sharma, counsel for petition-er Kashi Purohit argued before thecourt.

In its orders, the high court had di-rected the government to wind up Math-

ur commission and transfer all casespending with it to the Lokayukta.

The government then moved a spe-cial leave petition (SLP) against the HCorder in the Supreme Court. After hear-ing out the government counsel, theApex court dismissed the SLP ongrounds that there existed nothing onrecord to prove any prima facie chargesor to have an inquiry by way of a com-mission. The bench of Justice DK Jainand Justice HL Dattu took a seriousnote of the state government's appealagainst the fair order of the high court.

Anti-graft fight...the ACB does not even get a list of offi-cials with suspected integrity fromchief vigilance officers in governmentdepartments as no one is willing to actagainst their colleagues.

On Sunday, chief minister AshokGehlot emphasised that a strong polit-ical will was necessary to act againstcorrupt officials and public represen-tatives. The question is: who stopspoliticians?

The chief minister also rued the factthat the Lokayukta, another agency to

deal with corruption, has not been ableto get a single bureaucrat or public rep-

resentative convicted. In Rajasthan, abook on completion of 30 years ofLokayukta institution revealed that thegovernment, despite Lokayuktas rec-ommendation, did not take any actionagainst some senior bureaucrats, in-cluding MD Kaurani, PN Bhandari andTR Verma.

Kandahar hijack...documents for the five hijackers werearranged. A crucial meeting betweenthe gang members took place in theKathmandu Zoo on December 13,where Latif was told he would not beon the hijacked plane but should re-main as the gangs point man in Mum-bai. Thereafter, the hijackers movedto their base in Kathmandu but kept intouch with Abdul Latif, who relayedthe messages to Abdul Rauf inKarachi. The arrests in the Kandaharhijacking were made after interceptingAbdul Raufs telephone call to AbdulLatif asking him to call up the BBC of-fices in London to give details of the hi-

    jacking.

    DMRC rejectsquery on enggsqualification

    DNA Correspondent

The Delhi Metro Rail Corporation Ltd (DMRC),involved in the execution of the Jaipur Metroproject, has rejected an RTI plea seeking quali-fication details of its key engineers.

The qualifications of key DMRC personnel, their past experience, name of their engineer-ing university, number of attempts they in whichthey passed the course are very personal det ailsand cannot be disclosed. The information soughthas no relevance to any public activity or inter-est, Atul Gadgil, GM (Civil) and Public Infor-mation Officer of the DMRC, said in his reply tothe RTI plea.

    However, RTI ac-tivist Manoj Kamra

said its peoplesright to knowwhether the engi-neers involved in theproject are qualifiedenough.

DMRCs un-willingness to dis-close informationregarding qualifi-cations of its engi-neers involved in

such an important and expensive project inwhich crores of rupees is being spent and anyengineering fault may cause severe damage tolife and p roperty, is suspicious, Kamra sai d.According to the rules laid down by the All In-dia Council for Technical Education (AICTE),one can complete bachelor of engineering (BE)in seven years.

People have the right to know whether or notthe Metro engineers have enough prior experi-ence to handle such a high-profile project. Sev-eral engineers complete their course in sevenyears and their qualification track record maybe questionable. We must also know in whosehands we are entrusting our money and future,

    Kamra said.
