Your complaint has been forwarded to our Invtstigations UDit for further review. I have been a.uigned to investigate your complaint and will contact you if any additional information is needed.

Pursuant to Florida law. (AGUILAR. NOE) will be provided with a copy of your complaint and given an opportunity to submit a written response to your complaint. Once the investigation is complete. the investigative file will be forwarded to our legal division and assigned to a Prosecutor.

With a few exceptions, such as investigations of unlicensed activity, Department Investigations and the evidence obtained during the investigation is confidential and remains confidential unless there is a finding of "probable cause." A finding of probable cause is appropriate where there is enough evidence to believe that the subject under investigation has committed a violation of the applicable laws or mies.

1n complaints against licensed Professional Surveyors and Mappers, a probable cause panel is delegated the responsibility to make decisions regarding probable cause. The probable cause panel meets regularly to review the investigative findings of the Department. The prosecutor presents the complaints to the panel and represents the Department during the panel meetings. If the panel closes a complaint without fmding probable cause. the entire file remains confidential. If the panel makes a finding of probable cause, the file becomes public ten days later. Whether probable cause is found or not. you will be notified of the outcome of the panel meeting.

The subject property and all parcels within 1,000 feet of this site have a future land use classification of Single-Family/Multi-Family by PDP (SM) and a zoning designation of Single-Family Residential (R-1B). The surrounding properties primarily consist of vacant lots with properties developed with single-family homes scattered throughout the area. The home was constructed in 2004 by the previous owner of the property. The applicants purchased the property in 2011. The Timperleys requested a survey of the property in June of 2011, which revealed that the home was constructed with a side setback 3.79 feet from the side property line, in violation of the

minimum side setback requirement of 7.5 feet. The initial survey of the subject property was prepared in 2003 by Caribbean Inspections and Surveys for the development of a single-family house, and showed property boundaries that later were discovered to be inaccurate. Based upon that survey, building plans were prepared and submitted by the developer to the City that showed that the house would be located 15 feet from the south property line and 20 feet from the north property line. Building permits for the construction of the house were approved and issued by the City based on information provided on this survey. However, this structure was later discovered to be located about 11 feet further south on the property. In addition to encroaching into the south side setback area, the house also penetrates the six-foot wide public utility easement by ±2.3 feet. However, Staff has verified that utilities are not located within the easement. While granting this variance would address the setback infringement, the location of this structure partially within a public utility and drainage easement would remain. As a result, staff recommends that the property owners provide the City with a hold harmless agreement that would indemnify the City from any costs borne by the owners related to utility installation and maintenance within this easement. Analysis: According to LUDR, Section 8.10.2, a variance is defined as “a modification of the requirements of the City’s ordinance when such modification will not be contrary to the public interest where, because of conditions peculiar to the property involved and not the result of the actions of the applicant which occurred after the effective date of the ordinance, a literal interpretation of the ordinance would result in unnecessary and undue hardship.” The Planning Division has reviewed this application based on the five (5) standards outlined within LUDR, Section 8.10.3a-e and offers the following analysis below for consideration.

1. Special Conditions: The special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other land, structure or buildings in the same zoning district; that the special conditions and circumstances do not result from the actions of the applicant.

Staff determination and analysis: Standard MET by the applicant.

Staff finds that special conditions and circumstances exist that are not the result of the applicants. A building permit for the single-family home was approved by the City in 2004. The applicants did not own the subject property when the home was developed, nor did the applicants have knowledge that the house violated City setback requirements at the time the property was acquired. As a result, Staff finds that these circumstances represent a special or unique situation that occurred through no fault of the applicants.

2. No Special Privilege: The granting of the variance requested will not confer on the applicant any

special privilege that is denied by this ordinance to other lands, buildings or structures in the same zoning district.

Staff finds that the granting of the requested variance will not confer on the applicants any special privilege, as the City approved a building permit for the construction of the single-family home. Therefore, it is reasonable that the owner at the time as well as subsequent owners of this property would have the expectation that the home was constructed in compliance with the City’s dimensional regulations for the R-1B District. As a result, Staff finds that no special privilege exists.

3. Hardship: That literal interpretation of the provisions of this ordinance would deprive the

applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this ordinance and would work unnecessary and undue hardships on the applicant.

Staff determination and analysis: Standard MET by the applicant.

The literal interpretation of this ordinance would deprive the applicants of rights commonly enjoyed by other property owners in the same zoning district and would work unnecessary or undue hardships on the applicant. Without the variance, the applicants may encounter difficulties in selling this property as prospective purchasers would likely be made aware of this setback infringement. In an effort to avoid a variance, the alteration of this structure to achieve compliance with the City’s setback requirements could disrupt the integrity of the structure.

4. Minimum Variance: That the variance granted is the minimum variance that will make possible

the reasonable use of the land, building or structure. Staff determination and analysis: Standard MET by the applicant. The variance requested by the applicants are the minimum variance to allow the home to remain as constructed.

5. Purpose and Intent; Public Interest: That the granting of the variance will be in harmony with the general intent and purpose of this ordinance, and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare.

Staff determination and analysis: Standard MET by the applicant.

The City’s setback regulations help to ensure that the use of a property does not infringe on the rights of neighboring property owners. Although the house was constructed within the side setback area, a minimum separation of at least 10 feet will still be maintained between the subject house and any house constructed in the future on the adjacent lot to the south. As a result, Staff finds that the variance requested is consistent with the intent of the City’s side setback requirement and the future development of the adjacent lot or surrounding area is not likely to be adversely affected by the requested variance.

Recommendation:

For a variance to be granted, the Board of Zoning Adjustment and Appeals must find that all five standards outlined above can be met or are satisfied by the applicant. Given that the variance requested meets all five (5) standards outlined within LUDR, Section 8.10.3a-e discussed above, the Planning Division recommends approval of the requested variance with conditions:

1. The property owners shall provide a Hold Harmless Agreement to the City within 30 days from the date of adoption of the Resolution. The resolution approving this variance shall not be recorded by the City until the Hold Harmless Agreement has been provided by the owners to the City.

2. This variance shall only apply to the existing house. This house shall not be expanded any further into the south side setback area nor shall any new structure be located within this side setback area.

3. This resolution shall be recorded with the Office of the Lee County Clerk of Circuit Court by the City of Cape Coral. The Developer shall be responsible for reimbursing the Department of Community Development for all recording fees associated with this resolution.

Public Notification This case will be publicly noticed as required by LUDR, Section 8.3.2 as further described below. Publication: A legal ad will be prepared and sent to the New Press announcing the intent of the applicant to request a variance as described within this report.
