Whereas, Smt. Santosh Kumari has filed CWP No. 16913 of 2012 with a prayer toquash her transfer order dated 06.07.2012 vide which she was transferred from GSSSDhurala to GSSS Thaska Miranji (Kurukshetra). This case came up for hearing on

31.08.2012 and Hon'ble High Court has please to pass the following order :-

"Without going into the merits or commenting thereon, this petition isdf3posed of with a direction to the Financial Commisisoner es PrincipalSecretary to Govt. Haryana, School Education Department-respondent No. 2

1 consider, and decide the representation dated 11.07.2012 (Annexure P-5)within a period of 3 weeks from the date of receipt of a certified copy of thisorder. The decision, so taken be conveyed to the petitioner forthwith.

In case, the aforesaid representation of the petitioner is not to beaccepted, then a speaking and well reasoned order be passed by respondentNo. 2 and the same be conveyed to the petitioner forthwith."

The representation of the petitioner has been examined and it is found that thepetitioner had not completed 5 years service at the time of her transfer. As per departmentaltransfer policy, normal tenure of employee at any place of posting shall be a minimum of 5years. Therefore, after reconsideration of the matter, the transfer orders of Smt. HardeepKaur, Principal from GSSS Thaska Mlranji (Kurukshetra) to GSSS Dhurala (Kurukshetra)vice Smt. Santosh Kumari, Principal and vice-versa issued vide order No. 4/6-2010 HRG-I (2)dated 06.07.2012 are hereby cancelled. It is made clear that Smt. Sr. Lecturer (Principal), DIET Shahpur (Karnal) was charge sheeted under Rule-8 ofPunishment & Appeals rules, 1987 vide order No. 5/126-2009 HRG-I (1) Dated,13.05.2011, wherein following charges were leveled against her:-

She replied to the charge sheet on 12.07.2011 and denied all the chargesleveled against her. She further requested for an opportunity of personal hearingbefore deciding the matter. Finally, she was offered an opportunity for personalhearing on 19.11.2012.

During the course of hearing on 19.11.2012, the delinquent officer told that :-

Smt. Sukhvinder Walia, DPE was relieved from the school on 05.11.2010 to16.11.2010 for attending camp at SCERT, Gurgaon and than 26.11.2010 to16.01.2011 to Tara Devi Shimla, but she did not produce the attendancereports for the above said period.

On 17.01.2011 she was absent from school and on 18.01.2011 she was on dutyin the Directorate.

Vide Order No. 1995 dated 20.01.2011, she was directed which was duly notedby her that she will not be permitted to relieve until she will not produce herpervious attendance reports and not complete the work of school allotted to her.

Thereafter, she again produced duty letter from 21.02.2011 to 02.03.2011 videletter No. AE0/1021 dated 22.02.2011 but she was not relieved due to thereasons mentioned in my letter dated 24.01.2011.

I have gone through the relevant record of the case and contentionsmade by the delinquent officer during personal hearing, it has been observed thatSmt. Sukhvinder Walia is not obeying the orders of Principal and not taking interest inthe studies of students rather she managed herself in the duties of SSA and otherworks, thus, the delinquent can not be held responsible.

In view of the above, the reply of Smt. Sween Malik is satisfactory, hencecharge sheet issued to her vide order No. 5/126-2009 HRG-I (1) dated 13.05.2011 isdropped.
