    Subject: Frank Depascali BailFrom: time21arry Date: Tue, 17 Nov 2009 09:20: 12 -0600To: [email protected] Judge Sullivan,I was so pleased when you read Mr. Depascali my e-mail at his bail hearing and then denied him bail lastmonth. I thought maybe the entire justice system had not let me down. Then today on CNBC I heard thatyou then let him out last week without hearing from the victims once again. To lJe honest I got nauseousand could not believe what i heard.On December 11th i had no bail hearing or no chance to "get out on bail". My life sentence was given to mewithout any justice. The entire system had failed to protect from "Evil" in the form of Mr Madoff and Mr.Depascalli. Why should he have a chance for anything.I do not understand the following:1) Why was his sentencing put off for almost one year? Mine and all the Madoff clients was an INSTANTlife sentence without bail.2) There is nothing he can say or do to restore my life and the life's of the other victims.3) Anything he wanted to tell the prosecutors he had plenty of time to do so. Can't they do their job withoutthe help of a admitted criminal? This case is such a easy one. Just look at the Madoff check book ... that willtell it all.4) Why did I not get another chance to speak again before your decision was made? Publicly you deniedbail and the privately it was granted?5) Did you not think of the emotional impact this would have on the victims? To be honest Judge we don'twant Mr. Depascalli information. Let him take it to jail with him and die there with it.On December 10th I Had my life's work ( 8 million dollars including my retirement) with Mr Depascali andon December 11th it was all gone. The"System" totally let me and the others down. Why is the justicesystem doing the same thing.I now ask you fo r myself and the other victims that you revoke bail. Just as easy as you granted bailyou can revoke it. That is your p ower to help all of us. The prosecutors are doing a horrible job inbringing the guilty parties to justice. It has been almost one year and only a few people "That turnedthemselves in" are being prosecuted.

    I would be happy to fly to New York (even though It would be financially hard for me) and talk with you andthe prosecutors in your chambers about this. Trust me my case would be strong and hard to turndown.

    PLEASE do the morally right thing.
