Strict Interpretation vs. Implied Powers

Democratic-Republicans We believed in

interpreting the Constitution word for word. If it wasn’t written, you could not do it!

Federalists We believed in interpreting

the Constitution by “reading between the lines”. Just because the Constitution, doesn’t mean you can’t do it! It allows us to make laws based on the “Necessary and Proper Clause” (Elastic Clause) to carry out what is needed.

Federalists vs. D-Rs

Democratic-Republicans Economy is focused on

agriculture. States should have more

power left to them because they know what’s best for their own state.

Federalists Economy focused on

industry. A strong central

government should have the power because it unites our country.

Election of 1800

Democratic-Republicans T J and Aaron Burr tied and the DR’s wanted TJ The DRs are happy

because they’re getting power.

Federalists Feds wanted Burr to be

president. Hami worked behind the scenes to help get TJ elected which upsets the Fed. Party.

This set the precedent for a peaceful transition to power. The 12th Amendment was created to prevent future ties.

Midnight Judges

Democratic-Republicans We felt the appointment

of the judges at the last minute was a “sneaky” move by Mr. Adams.

Federalists We felt that it was not

unconstitutional to appoint these judges so it was done legally:J

State’s Rights vs. Federal Power

Democratic-Republicans We thought that states

should have the power so that they would always have a say and that not all power would be in the federal government.

Federalists

We think that by having the power in the federal government because we need a strong unified country.

Judicial Review

Democratic-Republicans We like judicial review

because it is fair and based on the Constitution.

As long as the rulings are impartial, we are in favor of it.

Federalists We like judicial review

because it’s a fair way to interpret the Constitution.

It keeps everything fair/bad laws from becoming laws.

Spoils System

Democratic-Republicans

Jeffersonian Democrats didn’t like Jackson because he was too much like a dictator and disregarded the Constitution.

Jacksonian Democrats liked the idea of a new style of government.

Federalists Feds thought the Spoils

System was unfair and not everyone would be qualified.
