    EPISODE 1

    As Bernie Banton jokes withhis workmates on the JamesHardie BI actory oor in the1970s, he and his colleagues arecovered head-to-toe in dust.Asbestos dust. Managementsays the dust is harmless, andwhy would anyone doubt them?

    A phone rings in the ABC RadioScience Unit, and journalistMatt Peacock answers. A PRrm representing James Hardie

    wants to use his recent story onasbestos, despite there being nomention o Hardie in the piece.He immediately smells a rat.

    For every journalist huntinga story, theres a spin doctorprotecting a brand. AdamBourke is working in advertisingbut sees public relations as theuture. Hardie Chairman John

    Reid likes his understanding obrand awareness, and gives hima job.

    Bernies brother Ted, a Hardieactory supervisor, asks theworkers to clean the actorybecause a site inspection isimminent. NSW Departmento Health inspector EvaFrancis queries why workersarent wearing regulatory dustmasks a comment that grabs

    Bernies attention. Why woulda health inspector worry whenworkers get regular x-rays bythe company doctor? Yet noneo the workers actually knowwhat the results o the x-raysare, and the Health Departmentdoesnt keep them Bernie issuspicious. He and his mateJock prank call Eva, tellingher to do a snap inspection.

    Meanwhile, Matt interviews anAmerican asbestos expert whosays they have been unableto identiy any sae level oexposure to asbestos dust.

    Eva turns up or her surpriseinspection and is shocked tosee asbestos dust spewingonto workers. As the union rep,Bernie calls a strike. But Adamproves his worth and convincesthe union state secretary to

    call it of. Bernie is incensedthat a pay-rise prevails overdangerous working conditionsand quits bad timing or hisamily, considering he has ababy on the way.

    With little work, Bernie allsinto a pit o despair and hiswie leaves him. Matt continuesto le asbestos stories and

    on a visit to the mining townBaryulgil, he discovers noneo the locals know about thedangers o the dust. Matt eelshe may have missed his chanceto hold Hardie accountable andaccepts a job with the ABC inLondon. Bernies lie changeswhen he meets a wonderulwoman called Karen.Ten years later Bernie is nowa uneral director and aces

    one o the toughest days o hislie when he nds the dust hasclaimed his riend Jocks lie.Matt returns rom London andpicks up the asbestos story.

    Adam is still protecting Hardiebut something has changed inhim; hes developed a certaincynicism. Hes told Hardiewants to separate itsel rom its

    asbestos liabilities by movingits headquarters ofshore andsetting up the Medical ResearchCompensation Fund (MRCF) inAustralia. Hes assured thereis enough money to cover alluture compensation claimsagainst Hardie.

    At the unds announcement,Matt makes eye contact withhis nemesis Adam. Both menknow this story is ar rom over.

    Meanwhile, more asbestos victimsthan ever are sufering. Bernieis diagnosed with asbestosisand, as his brother Ted dies rommesothelioma, he calls his oldcolleagues rom the Hardie years.But nothing can prepare him orjust what that dust has done tohis mates so many are alreadydead. That dust. Asbestos dust.That damned devils dust.

    Bernie sits in a meeting at theAsbestos Diseases Foundationo Australia with Karen by hisside. He cant listen to what heregards as platitudes any longerand lets rip at the oundationspresident Barry Robson. Howcan people all these dyingsouls around him be so naveand believe anything Hardietells them?

    Hardie has applied to the

    Supreme Court to move itsheadquarters to the Netherlands.Matt tries to convince his oldABC colleague Bob Debus now the NSW Attorney General to do something, but the courtgives Hardie the go-ahead tomove overseas.

    Bernie channels his anger byvisiting dying asbestos victims

    in hospital. But his newoundpurpose cant stave of his owndeteriorating health and hisspecialist tells him hell need touse oxygen ull time.

    In the Hardie boardroom, thingsare heating up. Hostilities emergebetween Hardie management andthe compensation und (MRCF)it set up. Adam orchestrates ameeting between Hardie andthe MRCF, but any semblance

    o goodwill is quickly dashed.The und reveals it is closeto running out o money andneeds $700 million. Hardie bossPeter MacDonald atly reusesand says the company is nowunder Dutch law. Even hardenedcompany man Adam is shocked.When the unding shortallbecomes public, Hardie acesa ormidable weapon as Matt

    meets Bernie or the rsttime. Matt sees the passionin Bernies eyes and likes hisno-nonsense turn o phrase.Interviewing Bernie or The 7.30Report, Matt kick-starts the riseo a local hero.

    Bernies emotional interviewstrikes a chord with talkbackradio listeners, and NSWPremier Bob Carr announcesa commission into the set-up

    o the MRCF. Matt tells Berniethat his inuence and straight-talking could make him theperect spokesperson or thecause.

    The Jackson Special Commissiono Inquiry begins and thingsdo not look good or Hardie,especially or CEO PeterMacDonald. As a less than

    Adam nds work weighing onhis conscience and asks his wieRebecca what kind o a man he

    is. He doesnt get the answer heis searching or: Youre a PRman Adam, thats what you do.

    At the Hardie AGM, Bernieand others rally noisily outsideand cause chaos or MeredithHellicar on stage. Berniesspeech also inspires Bob Carrto call him, asking to meet othervictims. Prooundly moved,

    Carr holds a press conerencedemanding that James Hardiepay up. He asks the PrimeMinister to use the ull orceo Federal law to ensure theHardie board is held to account.

    Bernies last roll o the diceis the Dust Diseases Tribunal,which agrees to accept Berniescase or exemplary damages.As his death approaches, hislawyer Tanya Segelov nds

    the last piece o the puzzle ina stray le. Hardie settles justbeore Bernie dies, and he isawarded a state uneral.

    intuitive, stubborn and sometimesbelligerent, but also a lovable,knockabout bloke with a sot side.

    I would describe Bernie asan ordinary Australian who iselevated to an extraordinaryolk hero, says Anthony Hayes.

    When Bernie starts workingat James Hardies Camellia

    actory (then known as HardieBI) in 1968 as a lathe operator,he and his colleagues look likesnowmen, always covered romhead to toe in white asbestosdust. Its this exposure thateventually leads to Bernie beingdiagnosed with asbestosis in1998 and to an early death rommesothelioma in 2007, aged 61.

    A man oten tortured by theinjustices o his predicament,

    Bernie has a burning desire toseize the opportunity o takingon James Hardie to seek justiceor all asbestos victims and toalso make up or a waywardpast which he seeminglyconsiders wasted.

    When youre acing your ownmortality you start lookingat your lie and want to be

    someone, says Anthony. Asmuch as Bernie ghts or thecause, it seems he also wantsto be someone that leaves alasting legacy.

    Bernies sense o airness andability to orate passionatelyor the cause is born romhis church upbringing, andwitnessing the illness and deatho not only his brother Ted butalso his best mate and so many

    o his colleagues.

    Driven, determined and unwaveringin his passion to help make theplight o James Hardie workerslead the news agenda, MattPeacock is on the scent o whatwill eventually become one oAustralias most prominent newsstories when we rst meet him inthe late 1970s.

    A smart, pugnacious journalistor ABC radio and television, Mattrst reports on James Hardie

    and the hazards o asbestos inthe workplace in 1977 in a radioprogram Work as a HealthHazard or ABC Radio National.

    Its something he believes in verymuch and he is very driven, saysEwen Leslie. In some ways andI dont know whether this is trueto lie this is about someonewho was chasing a story and

    wanting to get it out there, and isthen thrown into a very human,personal element o it. He ndshimsel in scenarios where hehas to break the news to peoplewho have worked with asbestosthat it can cause death.

    As he works rom a desk piledhigh with papers, stationeryand dirty cups, the story piqueshis interest, and Matt stays thepath, operating under the maxim

    without ear or avour.

    Ater interviewing Bernie Bantonor The 7.30 Report, Matt anointsBernie as the ace o asbestoscompensation. Matt orms aclose bond with Bernie, speakingto him almost daily and advisinghim how he can keep the heat onHardie in the media.

    What starts as just an interviewturns into an extraordinaryriendship, says Ewen. Theybecome good mates and Matt iswith Bernie right until the end.

    Theres almost a mutual respectin a strange way, with both othem having a desire to sharethe story, says Don Hany.Adam believes he can work

    with Matt to make it a win-winoutcome or what they are bothater.

    Adams strength is his brilliance atturning a negative into a positive,allowing James Hardie tocontinue to promote their branddespite their strong associationwith deadly asbestos.

    I dont think Adam sleepscomortably at night, says Don.

    Hes a product o a certain typeo corporate culture o the time,and during the course o thestory he becomes the vehicleor showing how widespread thecost o such a culture can be.

    But he becomes conictedabout what he believes and itgives him plenty o sleeplessnights.

    Away rom the boardroomand courtroom, Adam drawsstrength rom his marriage toRebecca, who stands by herhusband through the rough andtumble decades o one o themost testing corporate jobs inthe country.

    Karen is incredibly loving to

    Bernie, says Alexandra Schepisi.She loves him unconditionallyand is extremely supportive andher strength builds throughouther time with Bernie as she ghtsbeside him and or him.

    A ervently religious woman,Karen seems more conciliatorythan her husband and seeks toshow Bernie another viewpoint,

    but she doesnt always succeed.She is, however, unwavering inher love and support or Bernieand, despite him becomingconsumed with bringing JamesHardie to justice, Karensdetermination to help him in hisbattle becomes more resolute asthe years go on.

    Shes a very supportive, strong,kind and calm person, explainsAlexandra. She took on the

    bigger picture mainly to supporthim, more so about raisingawareness o the health side othings as opposed to the legalbattle. Karen is very staunch; aquiet achiever and where Bernieis celebrated very prominently,Karen is right next to himsupporting him all the way.
