DESCRIPTION OF SITE AND APPLICATION 1.1 The proposed site is land used as a playing field associated with the

1.2 This proposal will affect the Grade I listed Ramsey Abbey. The house

lies within an associated scheduled monument and its garden is enclosed by Grade II listed walls. The site is also within a conservation area. 1.3 The Environment Agency Flood Map shows the site and surrounding

land to lie in defended Flood Zone 1. 1.4 The proposal is for the construction of an external 3G Artificial Turf

Pitch including perimeter fencing, floodlighting, associated hardstanding area and goal recess areas. The Applicant has provided details of usage and are as follows:

1.5 Monday to Friday 0900-1700 hrs it will be used by the school.

Monday to Friday 1700-2200 hrs it will be used for training sessions by a variety of sports clubs/teams, including informal groups/play groups as well as football association programmes or projects, for

example flexi football. Saturday and Sundays it will be used by the various clubs/teams for matches.

1.6 There will also be different offers during school holiday periods, again

aimed at informal groups and play groups, young and old, these offers will be advertised on the One Leisure website.

2. NATIONAL GUIDANCE 2.1 The National Planning Policy Framework (19th February 2019)

(NPPF 2019) sets out the three objectives - economic, social and environmental - of the planning system to contribute to the achievement of sustainable development. The NPPF 2019 at paragraph 10 provides as follows: 'So that sustainable development is pursued in a positive way, at the heart of the Framework is a presumption in favour of sustainable development (paragraph 11).'

2.2 The NPPF 2019 sets out the Government's planning policies for

(amongst other things): * delivering a sufficient supply of homes; * achieving well-designed places; * conserving and enhancing the natural environment; * conserving and enhancing the historic environment. 2.3 The NPPF 2019 replaces the NPPF 2012. Transitional arrangements

are in place for authorities who have submitted Local Plans on or before the 24 January 2019. To ensure consistency, the 2012 Framework policies will continue to be relevant for the purposes of examining those plans. For clarity HDC submitted their Local Plan on 29 March 2018 and the examination hearings took place in July and September 2018. This emerging Local Plan is a material consideration. The NPPF 2019 should also in the normal way be taken into account as a material consideration in dealing with applications.

3.5 The LPA consider the Local Plan to 2036 to be a sound plan and it

was submitted for examination on the 29th March 2018. Footnote 22 of NPPF 2018 states during the transitional period for emerging plans submitted for examination (set out in paragraph 214 of NPPF 2018), consistency should be tested against the previous Framework published in March 2012. The plan has therefore reached an advanced stage and is consistent with the policies set out within the NPPF 2012. Given the transitional arrangements in place it is considered that if there is any tension between emerging policies and NPPF 2018 the previous framework policies will prevail.

Ramsey Abbey College. The scheme will comprise 6 no. 10m high columns with 8 no. 720W LED lamps atop the columns, positioned around two existing tennis courts on the Abbey School site.

5. CONSULTATIONS 5.1 Ramsey Town Council – Approved by 9 votes with 1 abstention. No

objections.

Officer response: Whilst the support from The Town Council is noted, the Town Council did not give any reasons in support of the application.

5.2 Environment Agency – No comment – refer to government standing

advice.

Officer response: The site is within Flood Zone 1. Notwithstanding, outdoor sports and recreation facilities fall within water-compatible development of the Flood Risk Vulnerability Classification table of the Standing Advice.

5.3 Cambridgeshire Police, Crime Prevention Design Team - the

documents in relation to community safety, crime, disorder and the fear of crime have been considered and raise no comment or objection in relation to the application at this time.

5.4 Historic England (Ancient Monuments) - On the basis of the

information available to date, we do not wish to offer any comments. We suggest that you seek the views of your specialist conservation and archaeological advisers, as relevant. It is not necessary for us to be consulted on this application again, unless there are material changes to the proposals. However, if you would like detailed advice from us, please contact us to explain your request.

Officer response: Historic England have responded in respect of the scheduled ancient monument within the vicinity of the application site, however they have not responded in respect of the grade I listed building. Your officers have contacted Historic England to ensure that they are aware of the proximity of the proposal to the grade I listed building. If these comments are forthcoming they will be reported on or before the DMC.

5.5 CCC Archaeology - does not object to development proceeding in

this location but consider that the site should be subject to a further programme of archaeological investigation secured through the inclusion of a condition.

Officer response: A condition as requested by CCC Archaeology team should be imposed.

5.6 Wildlife Trust - the Wildlife Trust has reviewed the Preliminary

Ecological Assessment (PEA) report and are satisfied with the recommendations in table 7. Should permission be granted, these recommendations will be secured via a suitably worded planning condition(s). With regards to the lighting scheme, the Wildlife Trust advise that the revised lighting scheme will be sufficient to prevent

significant negative impacts on bats using the nearby habitat for foraging and/or commuting.

Officer response: If the recommendation is supported a condition as requested by the Wildlife Trust is recommended. HDC Conservation OBJECTS to this proposal, their full objection is included in the Green Papers.

6. REPRESENTATIONS 6.1 In addition to a site notice, there has been extensive neighbour

consultation. Of the 66 neighbours consulted there have been five representations received. Three in support, and two objectors.

6.2 Objections raised for the following:

7. ASSESSMENT AND CONSIDERATION 7.1 The principal, important and controversial issues to consider in

assessing this application are based on if this development is considered sustainable development, having considered the economic, environmental and social elements of this case, and also the duty placed upon LPA officers under Section 66 of The Planning (Listed Buildings and Conservation Areas) Act 1990, which states: In considering whether to grant planning permission for development which affects a listed building or its setting, the local planning authority shall have special regard to the desirability of preserving the building or its setting or any features. Section 72 of The Planning (Listed Buildings and Conservation Areas) Act 1990 requires special attention to be paid to the desirability of preserving or enhancing the character or appearance of the conservation area. With that in mind the following issues are assessed below:

• The principle of development • Design and visual impact, including impact on the setting of

the grade I listed building and conservation area (the heritage assets)

• Public Benefits and a balancing exercise • Residential amenity • Highway Safety and Parking • Infrastructure requirements and planning obligations; and • Other issues

Principle of development 7.2 The proposal would provide an additional facility adjacent to the

existing leisure and school complex located within the built up area of the ‘Market Town’ of Ramsey, as defined by Policy CS3 of the Core Strategy 2009. Ramsey is designated as a Spatial Planning Area in Policy LP7 of the Local Plan to 2036 Proposed Submission 2017 where a proposal for a leisure facility (class D2) will be supported where it is appropriately located within the built-up area.

7.3 The site is considered to lie in a sustainable location in terms of bus

routes, walking and cycling distances with very good access to a range of facilities including the existing leisure centre, so the proposal to provide an additional leisure facility in this sustainable location can be supported on accessibility grounds. It is therefore considered that the proposal satisfies policy S2 of the Huntingdonshire Local Plan (1995) with regards to accessibility. The proposal satisfies LP2 of the Huntingdonshire Local Plan to 2036: Proposed Submission 2017 as the proposal makes efficient use of land, within existing settlements, however officers have significant concerns with regards to the impact of the proposed development on the setting of the nearby grade I listed building Ramsey Abbey, and the impact of the proposal on the special character and appearance of the conservation area, these concerns are expanded upon in the remainder of the report.

7.4 Paragraph 193 of the NPPF advises that when considering the impact

of a proposed development on the significance of a designated heritage asset, great weight should be given to the asset’s conservation. The more important the asset, the greater the weight should be. This is irrespective of whether any potential harm amounts to substantial harm, total loss or less than substantial harm to its significance.

7.5 Paragraph 194 of the NPPF advises that any harm to, or loss of, the

significance of a designated heritage asset (from its alteration or destruction, or from development within its setting), should require clear and convincing justification.

7.6 Section 66 of The Planning (Listed Buildings and Conservation

Areas) Act 1990,- In considering whether to grant planning permission for development which affects a listed building or its setting, the local planning authority shall have special regard to the desirability of preserving the building or its setting or any features. Section 72 of The Planning (Listed Buildings and Conservation Areas) Act 1990, requires special attention to be paid to the desirability of preserving or enhancing the character or appearance of the conservation area. There is a statutory presumption and a strong one, against granting planning permission for any development which would fail to preserve the setting of a listed building or character and appearance of a conservation area. This should not be considered lightly.

7.7 Ramsey Abbey House and scheduled monument are heritage assets

of the highest significance and therefore changes within their setting must be fully justified with any harm identified and mitigated where possible. The scheduled monument protects the core of the abbey grounds where it is believed the most important abbey buildings were located. The listed building incorporates the last surviving built parts of the Ramsey Abbey inner precinct and was converted into a dwelling house by the Cromwell family at the dissolution of the monastery. Much of the building has been re-worked by the architects Soane and Blore in the Georgian period. Part of the latter’s work was to create formal gardens to the south of the building and to enclose them within the now listed walls and balustrades.

7.8 The listed building and garden structures are also an important

component of the conservation area and reflect the post-dissolution conversion of the abbey into a country house with formal gardens and parklands.

7.9 Under consideration are the potential impacts of the proposed

scheme to the setting of the Grade I listed building, the scheduled monument, the Grade II listed garden walls and the direct impact of the proposal on the character and appearance of the conservation area.

7.10 It is considered that the wider setting of the listed building is of great

importance as it allows the best appreciation of the architect’s realisation of an ‘Elizabethan Revival’ mansion presented within formal gardens bounded by matching walls and set within a soft landscaped parkland setting. Although the pristine quality of the planned setting has been compromised by modern school buildings and their associated paraphernalia this setting has not been undermined to an irretrievable degree. It is against this background that the proposal is assessed.

7.11 This application is for the construction of an external 3G Artificial Turf

Pitch (ATP) including perimeter fencing, floodlighting (15 metre high columns), maintenance store and associated hardstanding areas located on a games pitch adjacent to Ramsey Abbey House, a Grade I listed building. The house lies within an associated scheduled monument and its garden is enclosed by Grade II listed walls. The proposed ATP would be located to the east of Ramsey Abbey House and gardens within an area of grassed playing fields which currently provides an attractive open setting to the historic buildings. The area is enhanced by the addition of various specimen trees. There has already been some loss of the quality of the setting to the heritage assets through the piecemeal introduction of various 20th Century school buildings and adjacent tennis courts with associated fencing and flood lights.

7.12 The applicant (HDC) considers that due to the position of the existing

tennis courts (with floodlights on 2 of the 3 courts) adjacent to the grade I listed building, these are much closer to the abbey house building than the proposed artificial pitch. As such the Applicant considers that an additional artificial pitch will not be out of keeping with the current paraphernalia which exists on the school site and the existing sports facilities, and therefore would not be out of keeping

with the current setting of the grade I listed building. Furthermore the Applicant also considers that the proposed siting of the artificial pitch is in the far corner of the playing fields, such that it is as far as possible from the abbey building whilst remaining within the playing fields. The Applicant further considers that the views from this area are of the corner of the abbey house building and do not obstruct frontal views of the building and formal gardens.

7.13 The proposed ATP would be located approximately 200m to the east

of Ramsey Abbey House and would occupy a large area in views in that direction from the house and its formal gardens. The proposed floodlights, and surrounding green heras fencing will have an adverse impact upon the setting of the building. This is also HDC Conservation Officers view and HDC Planning Officers fully agree with this. It is recognised that the applicant proposes porous fencing which they argue will allow one to appreciate the wider sense of the green space of the playing fields beyond. Notwithstanding your officers, including HDC Conservation consider that the proposed ATP would negate this sense of space by adding further cumulative layers of fencing, floodlights and a maintenance store into this space. A significant part of the setting of the Grade I listed building and its scheduled formal gardens would be eliminated to the east. Glimpsed views to Ramsey Abbey House across the playing fields from footpaths to the west of the abbey and its grounds would also be degraded through the introduction of additional layers of fencing and floodlights.

7.14 It is the author of this report’s view that the best views of Ramsey

Abbey House is from Abbey Road, immediately after the Hollow Lane junction, looking north. It is at this point where the full grandeur of Ramsey Abbey House is revealed by an observer. Views of Ramsey Abbey House become less prominent along the windy section of Abbey Road due to the mature trees and tennis courts in between, an observer is still able to catch glimpsed views of Ramsey Abbey House all the way to the One Leisure Car Park. The thinner, eastern side elevation of Ramsey Abbey House is clearly visible from the playing field to the north of the One Leisure Centre. The proposal will undoubtedly impact on this view.

7.15 It is also considered that the proposal will be harmful to the setting of

the listed building and scheduled monument; the visual impact of the lighting columns and fencing will be beyond the area of highest sensitivity, but as explained above, the proposal will not impact on the best available views of the Grade I Listed building, and therefore the harm will be less than substantial. However, because the heritage assets are of the highest significance, great weight must be given to their conservation and any justification of the scheme through public benefit must be considerable, as per para 196 of the NPPF, which confirms that less than substantial harm to the significance of a designated heritage asset should be weighed against the public benefit of the proposal.

Impact on the conservation area

7.16 Ramsey Abbey House, its formal gardens and associated buildings

are an important part of the conservation area, and as mentioned, within the school grounds views towards the house are good where

the modern buildings are screened by trees. From some directions the visual quality of the conservation area has been reduced by the piecemeal development of the school prior to the designation of the area in 1975. The addition of visual clutter from the fencing and floodlights of the ATP to the green space of the playing fields will not preserve or enhance the character or appearance of the conservation area.

7.17 In the wider context of the Ramsey Conservation Area the proposal

will fail to preserve or enhance the character or appearance of the conservation area, this harm can also be said to be less than substantial.

7.18 In accordance with NPPF para.196, the scheme would be harmful to

the setting of designated heritage assets and directly to the significance of the conservation area and should therefore not be supported unless it can be demonstrated that the proposals would have considerable public benefit that would clearly outweigh the identified harm to all the heritage assets affected.

Public Benefits 7.19 A grade 1 listed building and a scheduled monument carry the

highest weight, therefore the public benefit should be sufficient to outweigh this extremely high threshold. The assessment should apply to each heritage asset. In addition, great weight is required to be attached to the preservation of all heritage assets, the more important the asset the greater the weight.

7.20 In accordance with Paragraph 196 of the NPPF, less than substantial

harm to the significance of a designated heritage asset should be weighed against the public benefits of the proposal, including securing its optimum viable use. In this instance, the harm is identified to 3 groups of heritage assets therefore the public benefits accrued by the development needs to clearly outweigh all of these aspects of harm not just one. It is therefore not an equal balance.

7.21 The Applicant has advised that the addition of a 3G pitch will benefit

the school in a number of ways: *It will enhance the provision of Physical Education within Abbey College and allow all year team outdoor activity over and above the current small Astro Turf capabilities; due to its larger and more divisible nature. *It will improve the physical wellbeing of students from having greater outdoor activity use and encourage more students to take up sport activities and studies. *It will improve the abilities of students from having predictable bounce and roll characteristics akin to good quality natural turf, which the existing hard court facilities cannot offer; and will lead to greater student enjoyment of sports. *It will reduce the risk of sports injury from the natural turf facilities and will provide an all-weather use capability to the school. *It will encourage sports oriented students to come to Abbey College and will add to both the Admissions and the reputation of Abbey College within the local community. *It will further enhance the reputation of Abbey College as a Good school and support the development into an Outstanding school.

7.22 The 3G pitch will support the local community and clubs outside of the schools weekday daytime use. Huntingdonshire Football Association has strategically identified the site and area as a location in need of a 3G facility and fully support the scheme. The facility will promote the sport of football with the associated health and social benefits it brings and will be available year round providing a safe space for children and adults to actively take part in sports.

7.23 The proposed facility will be used by the following users;

*Ramsey Colts and Warboys Colts junior team will be main users of the proposed facility and are in need of an artificial grass pitch to increase participation and enjoyment *Ramsey Town and Warboys Town senior teams will use the facility for training use *Norwich City FC and Peterborough Town FC have expressed interest and demonstrated a need for a facility within the area to undertake outreach programmes and to use the facility as a player development centre *Other clubs/teams/events will also hire the facility throughout the year The public benefits outlined in paragraphs 7.20, 7.21, 7.22 are given limited weight because these same benefits will also come forward if the pitch were to be located in a different location on the site or somewhere else in Ramsey.

In a wider context, the proposal will also bring the following benefits: 7.24 There are areas in Ramsey with extremely high rates of reception

school children with excess weight (36%) compared to the average for Huntingdonshire (19.6%) and this is the same trend for children in year 6. Some areas in Ramsey also rank low to very low (compared to Huntingdonshire as a whole) in the rank of general health deprivation. The proposed facility, which will be accessible to all residents, will assist in helping to alleviate this crippling problem – this is a public benefit of moderate weight because the delivery of facility, if planning permission is approved, is fully in the control of the applicant.

7.25 To add to the above, issues such excessively high childhood obesity

levels put additional pressure on publically funded health services, and can impact on other social services, the proposal will make it easier for residents to access a high quality fitness facilities, and could in turn indirectly alleviate pressures on health care facilities due to the clear links between excessively high obesity levels and additional strains of health services. This is a public benefit which, due to its indirect nature, could be afforded moderate weight.

7.26 The 3G facility will be located on the eastern perimeter of the built up

area of the market town of Ramsey. The vast majority of the residential areas of Ramsey, including the town centre, are located to the west of the site. The centre of Ramsey Town Centre is located a 15 minute walk from the site. The proposal, if approved, will undoubtedly result in a significant increase in usage and footfall to the Ramsey One Leisure centre. Not only will this be beneficial for Ramsey One Leisure, which is a facility run on a proceeds model, where any surpluses are invested back into the organisation for the

benefit of the District Council and its residents, but also, due to the increase in usage there is a strong possibility that footfall through the town centre could increase due to proximity of the site in relation to the town centre and residential areas. Town centres in the UK are struggling, and Ramsey town centre also shows some symptoms of decline with vacant shops etc. The likely increase in footfall through the town centre, from people going to, or coming from the proposed facility, will help to boost the vitality and viability of the town centre through additional spending. It will help to establish One Leisure Ramsey as a destination and there will be positive know on effects for the nearby town centre. This public benefit is weighs moderately in favour of the proposal.

7.27 Other similar 3G facilities in HDC are extremely popular with local

people. It is very likely that a high proportion of people will use this facility, this will include people who do not normally, or very infrequently, visit One Leisure Ramsey. This increase in footfall will result in more members of the public being exposed to these beautiful heritage assets. The facility will also provide an opportunity for users, young and old, able, or disable, to play sports in a highly inspirational and aesthetically pleasing environment, which in turn can improve the will to go there in the first place, it can also improve performance and well-being for a wider proportion of the public vs the current number of people who visit this area/facility. This is a public benefit of considerable weight.

7.28 Notwithstanding the above benefits, it is acknowledged that enhanced

leisure facilities could be provided in other locations within Ramsey, however the Applicant (HDC) has advised that the 3G pitch has to be linked to the One Leisure Centre in Ramsey to enable efficient management of the facility and to be of most benefit so that the secondary college can use it daily to enhance physical activity for the pupils. Officers have explored additional less harmful locations with the Applicant, there attempts were unsuccessful for the reasons given below.

7.29 The Applicant (HDC) has also advised that the land to the east of the

existing leisure / school complex is part of the Schools plan for future development, and therefore cannot be considered as an alternative location for the 3G artificial pitch. The land in question was chosen because the land is owned by Ramsey Abbey Foundation trust and leased to the school for only Education purposes, therefore no other developments could go on that land. It is considered by the Applicant that it will enhance the existing hub of sports facilities in close proximity to the changing facilities for the school and Leisure Centres use. In light of this, officers have to consider this application in front of them, and have to make a recommendation on this application.

7.30 Having fully explored other locations, and firmly pushed the applicant

to look into providing the facility in a different location, the facility is therefore only deliverable in this location. There is a very high likelihood that that facility will be constructed if planning permission is granted by members, as such, the author of this report is satisfied that the public benefits can be delivered in this manner and could not be delivered if the pitch were to be located in a different location on the site – because the development will not come forward then.

7.31 In addition to the above mentioned benefits, other public benefits includes employment during and after construction).

7.32 Whilst it is a difficult task to weigh the harm caused to the heritage

assets, i.e. the listed building, setting of other listed buildings and the conservation area compared to the above list of public benefits discussed above, senior planning officers at HDC carefully considered the harm and weighed the public benefits against the harm. Senior officers consider that the list of public benefits that will come forward as a result of this proposal will be significant and considerable, especially in the context of this market town and the unique challenges it faces. Taking all of the above into account, it is considered the public benefits that will be forthcoming would outweigh the harm identified to all the heritage assets and it is for this reason that the proposal is considered that the proposal is in accordance with S66 and S72 of The Planning (Listed Building and Conservation Areas) Act 1990; NPPF paragraphs 193, 194 and 196; policies En2, En5, En6, En9 and R2 of the Huntingdonshire Local Plan 1995; policy CS1 of the Core Strategy 2009; and LP36 of the Huntingdonshire Local Plan to 2036 Proposed Submission 2017 (as amended for submission March 2018).

Residential Amenity 7.33 As this is a town centre location moderate increases in traffic are

expected in an urban environment. 7.34 Due to the size of the development, it is considered reasonable and

necessary to add a condition such as restricting hours of work during construction in order to protect the amenity of nearby residents. Due to the concerns of traffic and the densely populated area within this location it is also considered reasonable to add a traffic management plan condition to the decision notice to ensure any disruption to neighbouring residents and the public Highway is sufficiently mitigated during construction.

Highway Safety and Parking 7.35 The proposal does not create a new access onto the public highway.

However the site is within a sustainable location within the town of Ramsey, where there are Public Car Parks and sustainable transport alternatives such as cycling and public transport available.

7.36 The proposal is therefore considered to accord with the NPPF,

policies T18 of the Huntingdonshire Local Plan 1995 and LP17 and LP18 of the Huntingdonshire Local Plan to 2036 Proposed Submission 2017.

Ecology 7.37 A phase 1 Ecology Report has been submitted. The Wildlife Trust has

reviewed the PEA report and is satisfied with the recommendations in table 7 of the Phase 1 Ecology Report. Should permission be granted contrary to the advice of your Officers, the recommendation in table 7

of the Phase 1 Ecology Report should be required by way of a suitably worded planning condition(s).

7.38 With regards to the lighting scheme, the revised lighting scheme

should be sufficient to prevent significant negative impacts on bats using the nearby habitat for foraging and/or commuting.

7.39 The proposal is therefore considered to accord with the NPPF,

policies En22 of the Huntingdonshire Local Plan 1995 and LP17 and LP18 of the Huntingdonshire Local Plan to 2036 Proposed Submission 2017.

Community Infrastructure Levy (CIL): 7.40 As this planning application is for a minor development, the

development will be CIL liable in accordance with the Council's adopted charging schedule; CIL payments will cover footpaths and access, health, community facilities, libraries and lifelong learning and education.

Conclusion and Planning Balance 7.41 The NPPF has at its heart the presumption in favour of sustainable

development. To be sustainable, development must, as noted in paragraph 6 of the NPPF, strike a satisfactory balance between the economic, environmental and social considerations.

7.42 In terms of the economic dimension of sustainable development, the

proposal would contribute towards economic growth, including job creation, not only additional jobs within the leisure sector itself but also during the construction phase and in the longer term through the additional population assisting the local economy through spending on local services / facilities through combined trips into the town centre.

7.43 In terms of the environmental dimension of sustainable development,

as clearly outlined in this report there will be harm to the heritage assets as identified. Due to the above, decision maker must therefore weigh the harm against the public benefits of the scheme. The weight afforded to a particular material consideration is a matter for the ultimate decision maker (DMC members). This can be challenged if the exercise of judgement is found to be irrational or perverse. An application can only be approved if the public benefits outweigh the harm caused to all the heritage constraints identified.

7.44 In terms of the social dimension, the proposal would increase level of

leisure services available to the general public of Ramsey, to the adjacent school as well as the wider area of Cambridgeshire, with this the proposal will bring significant health benefits as well as other benefits (clearly outlined in main body of report).

7.45 Having assessed all three dimensions of sustainable development;

economic, environmental and social within this report it is concluded that the development of this site will: -

- Cause harm to three heritage assets, the harm is considered to amount to less than substantial harm, however senior officers consider that the combined public benefits of the scheme will

outweigh the less than substantial harm to the three heritage assets as identified in this report.

- Not cause significant detrimental impact to residential amenity

- Maximise opportunities for use of public transport, walking and cycling

- Have no significant adverse impacts on features of landscape or ecological value

7.46 All the material considerations have been fully considered and, on

balance, the application is therefore recommended for approval. 8. RECOMMENDATION - APPROVAL subject to

conditions to include the following

• Development to be implemented strictly in accordance with the approved plan

• Details of seasonal use and timings of floodlighting • Hours of use
