Legal System

According to Raymond Wacks ( 2008), legal system lies in the heart of any society protecting RIGHTS, imposing DUTIES and establishing a framework for the conduct of almost every social, political, and economic activity.

It endeavors to achieve JUSTICE, promote freedom and uphold the rule of law and protect security.

Law and Ethics

• According to Merriam Webster Dictionary law is the whole system or set of rules made by the government of a town, state, country, etc.

• According to Montequie Laws, in their most general signification, are the necessary relations arising from the nature of things.

• According to Lozare, (1986) Laws are the quintessential manifestations of policy.

• Marxists explain that law and human rights arise from the interactions of human beings within social structures that contain economic class distinctions.

• Class divisions within societies create conflict and disorder and therefore law (and the state) comes into existence to deal with this conflict.

Thus, Law

Consists of a set of universal principles in accordance with nature

A collection of valid rules, commands, or norms that may lack any moral content

A vehicle for the protection of individual rights, the attainment of justice or economics, political equality

ETHICS

• the study of what is good and bad

• philosophical ethics concerns itself with discovering a system one may use to determine who or what is good, or with evaluating systems that others have proposed.

• The pursuit of moral judgment in philosophical array it means that a premium is placed upon defining "the good".

• Different approaches to defining the good, the nature of moral properties, the source of moral knowledge, and the status of moral facts have played an important role in shaping various branches of moral theory.

• The (3) three major divisions of ethical philosophy may be called Virtue Ethics, Deontology, and Consequentialism.
