1. Your Legal Rights UnderThese Limited Warranties

The warranties contained in this booklet are the onlyexpress warranties that DaimlerChrysler Motors CompanyLLC ("DaimlerChrysler") makes for your vehicle. Thesewarranties give you specific legal rights. You may alsohave other rights that vary from state to state. Forexample, you may have some implied warranties, depend-ing on the state where your vehicle is registered:

• An “implied warranty of merchantability” means thatyour vehicle is reasonably fit for the general purposefor which it was sold.

• An “implied warranty of fitness for a particular purpose”means that your vehicle is suitable for your special

purposes if those special purposes were specificallydisclosed to DaimlerChrysler itself — not merely to thedealer — before your purchase, and DaimlerChrysler —not just the dealer — told you the vehicle would besuitable for that purpose.

These implied warranties are limited, to the extent allowedby law, to the time periods covered by the express writtenwarranties contained in this booklet.

If you use your vehicle primarily for business or com-mercial purposes, then these implied warranties do notapply and DaimlerChrysler completely disclaims them tothe extent allowed by law. And the implied warranty offitness for a particular purpose does not apply if yourvehicle is used for racing, even if the vehicle is equippedfor racing.

Some states do not allow limitations on how long animplied warranty lasts, so the above limitations maynot apply to you.

2. What's Covered UnderDaimlerChrysler's Warranties

2.1 Basic Limited Warranty

A. Who Is Covered?You are covered by the Basic Limited Warranty ifyou are a purchaser for use of the vehicle.

B. What’s CoveredThe Basic Limited Warranty covers the cost of allparts and labor needed to repair any defective itemon your vehicle supplied by DaimlerChryslerCorporation that is defective in material, work-manship or factory preparation. There is no list ofcovered parts since the only exception is tires.

WHAT'S COVERED UNDERDAIMLERCHRYSLER'S WARRANTIES

You pay nothing for these repairs. These warrantyrepairs or adjustments — including all parts and laborconnected with them — will be made by your dealer atno charge, using new or remanufactured parts.

C. Items Covered by Other WarrantiesThe following are covered by separate warrantiesoffered by their makers. They are not covered by theBasic Limited Warranty:

• tires;• Koss headphones; or• items added or changed after the vehicle left

DaimlerChrysler Corporation's manufacturing plant,such as accessories or protection products, or itemschanged because of customization or van conver-sion.

D. Towing Costs Are Covered Under CertainCircumstancesThe Basic Limited Warranty covers the cost of towingyour vehicle to the nearest Chrysler, Dodge or Jeepdealer if your vehicle can’t be driven because acovered part has failed.

E. When It BeginsThe Basic Limited Warranty begins on either of thefollowing dates, whichever is earlier:

• the date you take delivery of the vehicle; or

• the date when the vehicle was first put into service —for example, as a dealer “demo” or as aDaimlerChrysler Corporation company vehicle.

F. When It EndsThe Basic Limited Warranty lasts for 36 months from thedate it begins or for 36,000 miles on the odometer,whichever occurs first. But the following items arecovered only for 12 months or for 12,000 miles on theodometer, whichever occurs first:

• brakes (rotors, pads, linings, and drums);• wiper blades;• clutch discs;• windshield and rear window; and• wheel alignment and wheel balancing

G. Registration and Operation RequirementsThe Basic Limited Warranty covers your vehicleonly if:

• it was built for sale in the U.S.;• it’s registered in the U.S.;• it’s driven mainly in the U.S. or Canada; and• it’s operated and maintained in the manner

described in your Owner’s Manual.

H. If Your Vehicle Leaves the United States(We Include U.S. Possessions and Territoriesas Part of the United States for WarrantyPurposes):EXCEPT WHERE SPECIFICALLY REQUIREDBY LAW, THERE IS NO WARRANTY COVER-AGE ON THIS VEHICLE IF IT IS SOLD IN ORREGISTERED IN COUNTRIES OTHERTHAN THE UNITED STATES.

This policy does not apply to vehicles that havereceived authorization for export fromDaimlerChrysler. Dealers may not give authoriza-tion for export. You should consult an authorizeddealer to determine this vehicle's warrantycoverage if you have any questions.

This policy does not apply to vehicles registeredto U.S. government officials or military personnelon assignment outside of the United States.

2.2 Powertrain Limited Warranty

A. Who is Covered?You are covered by the Powertrain LimitedWarranty if you are the first purchaser for use ofthe vehicle. You are also covered if you are thesecond purchaser for use of the vehicle, and havepaid the $150 transfer fee within 30 days ofpurchase. See Section 2.2.F for more informationabout transfer of coverage.

D. When It BeginsThe Powertrain Warranty begins at the end of the BasicLimited Warranty, on either of the following dates,whichever is earlier:

• the date your vehicle has been in service formore than 36 months; or

• the date you've put more than 36, 000 miles onthe odometer.

E. When It EndsThe Powertrain Warranty lasts for 7 years from the dateyour vehicle has been in-service or 70,000 miles on theodometer, whichever occurs first, to the first owner.

B. What’s CoveredThe Powertrain Warranty covers the cost of allparts and labor needed (less a $100 deductible perrepair visit at the end of the 3 Year/36,000 MileBasic Limited Warranty) to repair a defectivepowertrain component on your vehicle listed insection 2.2.I below supplied by DaimlerChryslerCorporation that is defective in material, workman-ship or factory preparation.

C. Towing Costs Are CoveredThe Powertrain Warranty covers the cost oftowing your vehicle to the nearest Chrysler, Dodgeor Jeep dealer if your vehicle can’t be drivenbecause a covered part has failed.

F. Transfer of Powertrain WarrantyTo transfer the Powertrain Warranty, you must have anauthorized Chrysler, Dodge or Jeep dealer process a"Transfer of Coverage Application" for you. The costfor this service is $150. You pay this fee directly to thedealer. You must apply for a coverage transfer within 30days from the date you buy the vehicle.

G. No Coverage to Second Purchaser ifTransfer Fee is Not PaidIf you do not transfer the remainder of the 7 year/70,000mile Powertrain Limited Warranty coverage and pay thetransfer fee, or if you are the third (or subsequent) ownerof the vehicle, the Powertrain Limited Warranty de-scribed in this Section 2.2 does not apply to you.

H. Some Commercial Vehicles Are ExcludedVehicles used as a police vehicle, taxi, limousine,postal delivery vehicle, ambulance or rental vehicleare not covered by the 7 Year/70,000 MilePowertrain Limited Warranty.

I. Parts CoveredThe Powertrain Warranty covers these parts andcomponents of your vehicle's powertrain:

Gasoline Engine: cylinder block and all internalparts; cylinder head assemblies; timing case, timingchain, timing belt, gears and sprockets; vibrationdamper; oil pump; water pump and housing; intakeand exhaust manifolds; flywheel with starter ringgear; core plugs; valve covers; oil pan; turbo-charger housing and internal parts; turbochargerwastegate actuator; supercharger; serpentine belttensioner; seals and gaskets for listed componentsonly.

2.3 Corrosion Warranty

A. Who is Covered?You are covered if you are a purchaser for use ofthe vehicle.

B. What's CoveredThis warranty covers the cost of all parts andlabor needed to repair or replace any sheet metalpanels that get holes from rust or other corrosion.If a hole occurs because of something other thancorrosion, this warranty does not apply. Cosmeticor surface corrosion — resulting, for example,from stone chips or scratches in the paint — isnot covered. For more details on what isn’tcovered by this warranty, see 3.6.

C. How Long It LastsThis warranty starts when your Basic LimitedWarranty begins under 2.1(E).

This warranty has two time-and-mileage limits:

• For sheet metal panels, the limit is 36 months,with no mileage limit.

• For an outer-body sheet metal panel — onethat is finish-painted and that someone cansee when walking around the vehicle — thelimits are 5 years or 100,000 miles on theodometer, whichever occurs first.

But your warranties don’t cover any part thatDaimlerChrysler didn’t supply or is not certified for useon your vehicle. Nor do they cover the costs of anyrepairs or adjustments that might be caused or neededbecause of the installation or use of non-DaimlerChryslerparts, components, equipment, materials, or additives.

Performance or racing parts are considered to benon-DaimlerChrysler parts. Repairs or adjustmentscaused by their use are not covered under your warran-ties.

Examples of the types of alterations not covered are:• installing accessories — except for genuine

DaimlerChrysler / MOPAR accessories installed by anauthorizedChrysler, Dodge or Jeep dealer;

• applying rustproofing or other protectionproducts; or

A. Some Modifications Don’t Void theWarranties But Aren’t CoveredCertain changes that you might make to yourvehicle do not, by themselves, void the warrantiesdescribed in this booklet. Examples of some ofthese changes are:

• installing non-DaimlerChrysler MotorsCompany LLC ("DaimlerChrysler") parts,components, or equipment (such as a non-DaimlerChrysler radio or speed control); and

• using special non-DaimlerChrysler materials oradditives.

• using any refrigerant that DaimlerChrysler orDaimlerChrysler Corporation has not approved.

B. Modifications That WILL Void YourWarrantiesThese actions will void your warranties:• disconnecting, tampering with, or altering the

odometer will void your warranties, unless yourrepairing technician follows the legal require-ments for repairing or replacing odometers; or

• attaching any device that disconnects theodometer will also void your warranties.

3.2 Environmental Factors Not CoveredYour warranties don’t cover damage caused byenvironmental factors such as airborne fallout,chemicals, tree sap, salt, ocean spray, acid rain, androad hazards. Nor do your warranties cover damagecaused by hailstorms, windstorms, tornadoes, sand-storms, lightning, floods, and earthquakes.

Your warranties do not cover conditions resultingfrom anything impacting the vehicle. This includescracks and chips in glass, scratches and chips inpainted surfaces, or damage from collision.

WHAT'S NOT COVERED

3.3 Maintenance Costs Not CoveredYour warranties don’t cover the costs of repairingdamage caused by poor or improper maintenance.Nor do they cover damage caused by the use ofcontaminated fuels, or by the use of fuels, oils,lubricants, cleaners or fluids other than thoserecommended in your Owner’s Manual.

The warranties don’t cover the costs of yourvehicle’s normal or scheduled maintenance — theparts and services that all vehicles routinely need.Some of these parts and services, which yourwarranties don’t cover, include:

• lubrication;• engine tune-ups;• replacing filters, coolant, spark plugs, bulbs, or

fuses (unless those costs result from a coveredrepair);

• cleaning and polishing; and• replacing worn wiper blades, worn brake pads

and linings, or clutch linings.

WHAT'S NOT COVERED

3.4 Incidental and ConsequentialDamages Not CoveredYour warranties don’t cover any incidental or conse-quential damages connected with your vehicle’sfailure, either while under warranty or afterward.

Examples of such damages include:

• lost time;• inconvenience;• the loss of the use of your vehicle;• the cost of rental vehicles, gasoline, telephone,

travel, or lodging;• the loss of personal or commercial property; and• the loss of revenue.

Some states don’t allow incidental or consequentialdamages to be excluded or limited, so this exclusionmay not apply to you.

3.5 Racing Not CoveredYour warranties don’t cover the costs of repairingdamage or conditions caused by racing, nor do theycover the repair of any defects that are found as theresult of participating in a racing event.

3.6 Certain Kinds of Corrosion NotCoveredYour warranties don’t cover the following:

• corrosion caused by accident, damage, abuse,or vehicle alteration;

• surface corrosion caused by such things asindustrial fallout, sand, salt, hail, and stones;

• corrosion caused by the extensive or abnormaltransport of caustic materials like chemicals,acids, and fertilizers; and

• corrosion of special bodies, body conversions,or equipment not made or supplied byDaimlerChrysler Corporation or DaimlerChrysler.

3.7 When Powertrain Limited WarrantyDoes Not ApplyYou are not covered by the Powertrain LimitedWarranty if you are a second owner and a transfer ofcoverage was not made; if you are the third (orsubsequent) owner of the vehicle; or if the vehiclewas used as a police vehicle, taxi, limousine, postaldelivery vehicle, ambulance or rental vehicle.

WHAT'S NOT COVERED

3.8 Other ExclusionsYour warranties don’t cover the costs of repairingdamage or conditions caused by any of the following:

• fire or accident;• abuse or negligence;• misuse — for example, driving over curbs or

overloading;• tampering with the emission systems, or with a part

that could affect the emission systems;• use of used parts, even if they were originally

supplied by DaimlerChrysler (however, authorizedDaimlerChrysler or MOPAR remanufactured partsare covered);

• windshield or rear window damage fromexternalobjects;

• any changes made to your vehicle that don’tcomply with DaimlerChrysler Corporation specifica-tions; or

• using any fluid that doesn't meet the minimumrecommendations in your Owner's Manual.

3.9 Total Loss, Salvage, Junk, or ScrapVehicles Not CoveredA vehicle has no warranty coverage of any kind if:

• the vehicle is declared to be a total loss by aninsurance company;

• the vehicle is rebuilt after being declared to be atotal loss by an insurance company; or

• the vehicle is issued a certificate of title indicat-ing that it is designated as “salvage,” “junk,”“rebuilt,” “scrap,” or some similar word.

DaimlerChrysler will deny warranty coverage withoutnotice if it learns that a vehicle is ineligible for cover-age for any of these reasons.

3.10 Restricted WarrantyYour warranties can also be restricted byDaimlerChrysler. DaimlerChrysler may restrict thewarranty on your vehicle if the vehicle is notproperly maintained, or if the vehicle is abused orneglected, and the abuse or neglect interferes withthe proper functioning of the vehicle. If the warrantyis restricted, coverage may be denied or subject toapproval by DaimlerChrysler before covered repairsare performed.

4. Other Terms of YourWarranties

4.1 Exchanged Parts May Be Used inWarranty RepairsIn the interest of customer satisfaction,DaimlerChrysler Motors Company LLC("DaimlerChrysler") may offer exchange service onsome vehicle parts. This service is intended to reducethe amount of time your vehicle is not available foryour use because of repairs. Parts used in exchangeservice may be new, remanufactured, reconditioned,or repaired, depending on the part involved.

All exchange parts that might be used meet Daimler-Chrysler Corporation standards, and have the samewarranties as new parts.

OTHER TERMS OF YOUR WARRANTIES

Examples of the kinds of parts that might beserviced in this way are:

• engine assemblies;• transmission assemblies;• instrument cluster assemblies;• radios, tape and CD players;• speedometers; and• powertrain control modules.

To help control suspected ozone-depletingagents, the EPA requires the capture, purifica-tion, and reuse of automotive air-conditioningrefrigerant gases. As a result, a repair to thesealed portion of your air-conditioning systemmay involve the installation of purified reclaimedrefrigerant.

4.2 Pre-Delivery ServiceA defect in or damage to the mechanical, electrical,sheet-metal, paint, trim, and other components of yourvehicle may have occurred at the factory or while it wasbeing shipped to the dealer.

Such a defect or damage is usually detected andcorrected at the factory. In addition, dealers mustinspect each vehicle before delivery. They repair anydefects or damage detected before the vehicle isdelivered to you.

4.3 Production ChangesDaimlerChrysler Corporation, DaimlerChrysler and itsdealers reserve the right to make changes in vehiclesbuilt or sold by them at any time without incurring anyobligation to make the same or similar changes onvehicles previously built or sold.

4.4 Governing Law and Other TermsAll of the warranties, except for the Federal Emis-sions and noise warranty and the CaliforniaEmissions warranties, are made under Michigan law,and Michigan law will be used to interpret them.Punitive, exemplary or multiple damages may not berecovered unless applicable state or local lawprohibits their disclaimer. No person, includingDaimlerChrysler employees or dealers may modifyor waive any part of these warranties.

5. Emission Warranties RequiredBy Law

5.1 Federal Emission Warranty

A. Parts Covered for 2 Years or 24,000 MilesFederal law requires DaimlerChrysler MotorsCompany LLC ("DaimlerChrysler") to warrant thefollowing emissions parts for 2 years or 24,000miles, whichever occurs first. DaimlerChryslercovers all of these parts under the Basic LimitedWarranty for 3 years or 36,000 miles, whicheveroccurs first.

• Air system controls;• distributor and its components;

• electronic fuel injection system, includinginjector;

• evaporative-emission canister and controls;• exhaust manifold;• exhaust gas recirculation valve and control

system;• exhaust pipes (between exhaust manifold and

catalyst);• fuel cap and tank assembly, pump, and fuel

lines;• ignition coil and ignition module;• intake manifold;• on-board diagnostic-system components;• oxygen sensors;• positive crankcase-ventilation (PCV) valve or orifice;• secondary ignition wires;• spark plugs;

• throttle body;• transmission-control module;• vacuum hoses, clamps, and fittings, as well as

tubing used for these components;• vacuum, temperature, altitude, speed, timesensitive

valves, sensors, and switches used in thesecomponents and systems.

B. Parts Covered for 8 years or 80,000 milesIf your vehicle has one of the following parts, thisFederal Emission Warranty covers that part for aperiod of 8 years or 80,000 miles, whichever occursfirst.

These limits are counted from the time when yourBasic Limited Warranty begins under 2.1(E). Thecovered parts are:

• catalytic converter; and• powertrain control module.

C. Additional Emission WarrantiesIf your vehicle is equipped with a CaliforniaCertified Emission Control System and is registeredin California, Massachusetts, Maine or Vermont, theCalifornia Emission Warranty — described inSection 5.3 — also applies.

5.2 Emission Performance WarrantyThis warranty supplements the federal warrantyunder 5.1. It lasts for 2 years or 24,000 miles on theodometer, whichever occurs first. If your vehicle hasone of the following parts, catalytic converter andpowertrain control module, this Federal EmissionWarranty covers that part for a period of 8 years or80,000 miles, whichever occurs first. These limits arecounted from the time when your Basic LimitedWarranty begins under 2.1(E). The Emission Perfor-mance Warranty covers the cost of repairing oradjusting any components or parts that might beneeded for your vehicle to pass Federal EmissionStandards for a federally approved state or localemissions test, but only if:

• your vehicle has failed a federally approved stateor local emissions test;

• your vehicle has been maintained and operatedproperly up until it fails such a test; and

• you face a real penalty — for example, a fine orthe loss of the use of your vehicle — because thevehicle has failed the test.

Section 6.3 explains how to get service under this war-ranty.

Where a warrantable condition exists, DaimlerChryslerwill repair your vehicle at no cost to you, includingdiagnosis, parts and labor.

1. If an emission-related part listed in this warrantybooklet specially noted with coverage for 7 yearsor 70,000 miles is defective, the part will berepaired or replaced by DaimlerChrysler. This is yourlong-term emission control system DEFECTSWARRANTY.

5.3 California Emission Warranty Contd.

Owner's Warranty Responsibilities:

-- As the vehicle owner, you are responsible for theperformance of the required maintenance listedin your owner's manual. DaimlerChrysler recom-mends that you retain all receipts covering mainte-nance on your vehicle, but DaimlerChrysler cannotdeny warranty solely for the lack of receipts or foryour failure to ensure the performance of all sched-uled maintenance.

-- You are responsible for presenting your vehicle to aChrysler, Dodge or Jeep dealer as soon as a problemexists. The warranty repairs should be completed in areasonable amount of time, not to exceed 30 days.

The repair or replacement will be made at nocharge to you for diagnosis, parts or labor. Any otherparts damaged by the failure of a defective part will also berepaired or replaced.

In addition, if your vehicle fails a smog check inspection,DaimlerChrysler will make all necessary repairs andadjustments to ensure that your vehicle passes theinspection. Your emission control system may include parts such asthe fuel injection system, ignition system, catalytic con-verter and powertrain control module. 6. How to Get Warranty Service

6.1 Where to Take Your Vehicle

A. In the United States (We Include U.S.Possessions and Territories as Part of theUnited States for Warranty Purposes):Warranty service must be done by an authorizedChrysler, Dodge or Jeep dealer. We stronglyrecommend that you take your vehicle to yourSelling Dealer. They know you and your vehiclebest, and are most concerned that you getprompt and high quality service. If you movewithin the United States, warranty service maybe requested from any authorized Chrysler,Dodge or Jeep dealer.

B. In Canada and Mexico:If you are traveling temporarily in Canada orMexico, and your vehicle remains registered inthe United States, your DaimlerChrysler warrantystill applies. Service may be requested at anyauthorized Chrysler, Dodge or Jeep dealership.

C. In a Foreign Country Outside of NorthAmerica:If you are traveling temporarily outside of NorthAmerica, and your vehicle remains registered inthe United States:

• You should take your vehicle to an authorizedChrysler, Dodge or Jeep dealer. They shouldgive you the same warranty service youreceive in the United States.

• Reimbursement will not be considered if thevehicle does not return to the United States.

D. If You Move:If you move to another country, be sure to contactthe DaimlerChrysler Customer Assistance Center(section 7.2) and the customs department of thedestination country before you move. Vehicleimportation rules vary considerably from country tocountry. You may be required to present documen-tation of your move to DaimlerChrysler in order tocontinue your warranty coverage. You may also berequired to obtain documentation fromDaimlerChrysler in order to register your vehicle inyour new country.


• If the authorized dealership charges you forrepairs which you feel should be coveredunder your warranty, please get a detailedreceipt for the work done. Make sure that thisreceipt lists all warranty repairs and parts thatwere involved. (This receipt will be similar tothe one used by the dealer who normallyservices your vehicle.)

• When your vehicle returns to the UnitedStates, contact the DaimlerChrysler CustomerAssistance Center (section 7.2) for reimburse-ment consideration.You will normally need toprovide a copy of the receipt, your vehicleregistration and any other relevant documents.

E. Notice:If your vehicles is registered outside of the UnitedStates, and you have not followed the procedureset out above, your vehicle will no longer beeligible for warranty coverage of any kind.(Vehicles registered to United States governmentofficials or military personnel on assignmentoutside of the U.S. will continue to be covered.)

6.2 Emergency Warranty RepairsIf you have an emergency and have to get a warrantyrepair made by someone other than an authorizedChrysler, Dodge or Jeep dealer, follow the reimburse-ment procedure in 6.1(C).

6.3 Getting Service Under the FederalEmission Performance Warranties

A. What to DoIf your vehicle has failed an emissions testdescribed in 5.2:

• Take it to an authorized Chrysler, Dodge or Jeepdealer as soon as possible.

• Give the service representative the printoutshowing that your vehicle failed the test.

• If possible, bring all service receipts,maintenance logs, and records proving thatyour vehicle has been properly maintained,since you may be required to show them.

B. Further Steps You Can Take, and How toGet More InformationIf you think your dealer has wrongly denied youemission-warranty coverage, follow the stepsdescribed in 7.1. If the owner is not notified within 30 days thata performance warranty claim is denied, the manufac-turer must repair the vehicle free of charge.

6.4 Getting Service Under the CaliforniaEmission Warranty

A. What to Do If You Fail a Smog CheckIf a vehicle fails a state Smog Check test duringthe coverage period, DaimlerChrysler will repairthe vehicle so that it will pass a State Smog Checkre-test. The owner should take the vehicle to anyauthorized Chrysler, Dodge or Jeep dealer forwarranty repairs and give a copy of the failedSmog Check test report to the dealer. If the owneris not notified within 30 days that a performancewarranty claim is denied, the manufacturer mustrepair the vehicle free of charge.

B. What to Do to Get Warranty ServiceTo get warranty service -- even if you're traveling --take your vehicle to any Chrysler, Dodge or Jeepdealer. (DaimlerChrysler recommends that you takeyour vehicle to a dealer who sells the same make ofvehicle as yours.) That dealer will perform anywarranty service without charging you for diagnosis,parts or labor.

C. Emergency Emission Warranty ServiceIf you need emergency service under this warrantyand a Chrysler, Dodge or Jeep dealer is not readilyavailable, you may have your vehicle repaired byanyone using any brand of repair parts. However,DaimlerChrysler Corporation recommends that youdo the following before having repairs made:

• Contact the DaimlerChrysler Customer Center andask for help with emission warranty service.(You'll find the address and telephone number ofthe Customer Center at 7.2.)

• The Customer Center will recommend anauthorized servicing dealer or help you find aqualified independent servicing dealer.


• If you are going to have to use an independentservicing dealer, make arrangements during yourfirst contact with the Customer Center for gettingreimbursed for emergency repairs (includinglabor and diagnosis). You will need to get and keepthe replaced parts, as well as the original invoicemarked "paid".

• You should review with the Customer Center anyquestions you have about the emission warranty.

Reimbursement for parts will be based onDaimlerChrysler's suggested retail price. Reimburse-ment for labor will be based on DaimlerChrysler'srecommended time allowance for the repair and onthe appropriate hourly labor rate in the geographicarea where you had the work done.

Before DaimlerChrysler will reimburse you foremergency repairs under this warranty, you will haveto provide DaimlerChrysler with details on why thesituation was an emergency and why dealer servicewas unavailable. Under this warranty, an emergencyoccurs if a part will not be available within 30 days or ifa repair can't be completed within 30 days.

7. How to Deal with WarrantyProblems

7.1 Steps to Take

A. In GeneralNormally, warranty problems can be resolved byyour dealer’s sales or service departments. That’swhy you should always talk to your dealer’s servicemanager or sales manager first. But if you’re notsatisfied with your dealer’s response to yourproblem, DaimlerChrysler Motors Company LLC("DaimlerChrysler") recommends that you do thefollowing:


Step 1: Discuss your problem with the owner orgeneral manager of the dealership.

Step 2: If your dealership still can’t resolve theproblem, contact the DaimlerChrysler CustomerCenter. You’ll find the address at 7.2.

B. What DaimlerChrysler Corporation Will DoOnce you have followed the two steps described in7.1(A), a DaimlerChrysler representative atDaimlerChrysler headquarters will review yoursituation. If it’s something that DaimlerChrysler canhelp you with, DaimlerChrysler will provide yourdealer with all the information and assistancenecessary to resolve the problem. Even ifDaimlerChrysler can’t help you, DaimlerChrysler willacknowledge your contact and explainDaimlerChrysler's position.

The CAP will need the following information from you:1) Legible copies of all documents and repair ordersrelevant to your case, 2) Vehicle identification number ofyour vehicle, 3) A brief description of your unresolvedconcern, 4) The identity of your servicing/selling dealer,5) The date(s) of repair(s) and mileage at the time, 6)Current mileage, and 7) A description of the action youexpect to resolve your concern.

Upon receipt of your request:• The National Center for Dispute Settlement(NCDS) will acknowledge receipt of your request,by mail, within ten (10) days, and advise youwhether or not your dispute is within the jurisdic-tion of the Process.• When your request is within jurisdiction NCDSwill request DaimlerChrysler and the dealer topresent their side of the dispute. You will receivecopies of their responses.• While your dispute is pending NCDS orDaimlerChrysler may contact you to see if yourcase can be settled by agreement. If a settlement isoffered to you, DaimlerChrysler will ask you to signa form that contains that settlement. Your case willthen be closed. There is no requirement for you toparticipate in this settlement process.

• The entire dispute settlement process will normallytake no longer than 40 days.• The CAP dispute settlement procedure does not takethe place of any state or Federal legal remediesavailable to you. D. Notice Under State Lemon LawsSome states have laws allowing you to get a replace-ment vehicle or a refund of the vehicle’s purchase priceunder certain circumstances. These laws vary fromstate to state. If your state law allows, DaimlerChryslerrequires that you first notify us in writing of anyservice difficulty that you may have experienced so

• If you requested an oral hearing, a decision-maker willcontact you to arrange a convenient time and place for ahearing. Usually, this will be at a dealership near you.• If you request a documents-only review, an NCDS panelwill review and decide your case. Neither you, the dealernor DaimlerChrysler need be present.• NCDS will send you a written Statement of Decision.This statement will include the decision, any action to betaken by the dealer or DaimlerChrysler and the time bywhich the action must be taken. The decision will bebinding on the dealer and DaimlerChrysler but not on youunless you accept the decision.• If any action is required on the part of the dealer orDaimlerChrysler you will be contacted within ten (10) daysafter the date by which the dealer or DaimlerChrysler mustact to determine whether performance has been rendered.

9.Maintenance9.1 General Information

It’s your responsibility to properly maintain andoperate your new vehicle. Follow the instructionscontained in the General and Scheduled MaintenanceService guidelines in your Owner’s Manual. Regular,scheduled maintenance is essential to trouble-freeoperation. If there is a dispute between you andDaimlerChrysler Motors Company LLC("DaimlerChrysler") concerning your maintenance ofyour vehicle, DaimlerChrysler will require you toprovide proof that your vehicle was properly main-tained.

For your convenience, DaimlerChrysler hasprepared a Maintenance Logbook which isincluded in your Owner's Literature Package. Youshould use this Maintenance Logbook to keeptrack of scheduled maintenance, either by routinelyhaving the repairs entered in your MaintenanceLogbook, or by keeping receipts or otherdocumentation of work you’ve had done on yourvehicle in your Maintenance Logbook.
