The application was published in the PT Board Bulletin on July 14, 2010. The Board made a decision on this application on August 5, 2010. The Board amended its decision on August 10, 2010. The amendment related to the effective date of the new rates (September 1, 2010). The decision and amendment decision were published August 11, 2011.
Board Review Decision:
Amend boundary definitions of zones used to calculate rates.
The effective date is effective January 9, 2012
Legislation and Policy:
Section 7 of the Passenger Transportation Act states that the Board may approve, or set, for the purpose of establishing just and uniform charges, rates to be charged by a licensee in respect of passenger directed vehicles and approve any rule, practice or tariff of the licensee relating to those rates.
Background:
632226 BC Ltd. dba “Aerocar” provides a limousine service in the Lower Mainland. Its passenger transportation licence, 70821, allows Aerocar to pick up passengers at the Vancouver International Airport. The Board has approved zone rates for the airport service.
This review stemmed from an inquiry from the Passenger Transportation Branch on May 9, 2011. The Branch asked the Board to interpret zone rates for Aerocar. The rates and zone

descriptions were set in application T183-10. The zones were defined by a descriptive title and a low resolution map of the Lower Mainland.
The Branch asked which zone rate applies to a trip from Vancouver International Airport to the Fairmont Waterfront Hotel: Zone 201 (Canada Place) or Zone 200 (Downtown/Kits)?
In reviewing the Branch’s request, the Board found the definitions of zones were ambiguous. The zone descriptions were brief and the zone map did not provide the clarity needed to answer the question. It was not clear whether “Canada Place” includes the Canada Place facility or facilities adjacent to Canada Place Way. The Board decided to look at all Aerocar zone definitions to check whether they were clear.
On June 23, 2011, the Chair of the Board asked me to review this matter. This review relates to zone definitions, not the rates themselves.
On July 15, 2011, the Board wrote to the licensee to request more details about various zone boundaries. On August 3, 2011, Aerocar provided a written description for these zones. The Board reviewed this information. The descriptions were consistent with what the Board approved in application T183-10. However, greater detail was provided.
The Board consolidated the approved rates and zones with the more detailed maps and written descriptions. It created a new document that sets out the boundaries and rates for Service 4 of Passenger Transportation Licence 70821. Aerocar reviewed the Board document and accepted the changes.
Review Outcome: The Board is replacing the Aerocar’s rates and rules for Service 4 with a new document: Limousine Zone Rates & Boundaries under Passenger Transportation Licence 70821 (Service 4).
Definitions of the zones must be clear for people to understand them. Zone boundaries approved by the Board in application T183-10 are, in many cases, not sufficiently clear. This causes questions about what rate must be charged in a particular zone. The Board produced a replacement document to clarify zone boundaries. It does not create substantial changes to zone boundaries.
Zone 200 (Downtown/Kits) and 201 (Canada Place) merit special comment. Aerocar has been charging the higher of the two rates (Zone 201) for trips into the Canada Place parking levels, particularly the cruise ship terminal. This is below street level and may involve longer times for waiting and disembarking. This appears to be a reasonable basis for a separate zone and rate that is more than the rate for trips to the downtown Vancouver and Kitsilano areas.
The Board has renamed Zone 201 to “Canada Place Lower Level.”
As a result of this review, the answer to the Branch’s inquiry is that rates for Zone 200 (Downtown/Kits) apply to a trip from the Vancouver International Airport to the Fairmont Waterfront Hotel.

The Board is aware that the rates for Zone 200 are at the low end of the spectrum for passenger directed transportation in Vancouver. However, no changes are being considered or made to the rates themselves as such matters are not within the scope of this review.
The Board notes that Aerocar has authority to take passengers to locations that are outside of a defined area. These appear to be areas with little population or uncommon destinations. To prevent ambiguity in such cases, the Board is establishing the following rule governing zone rates charged for transportation under Service 4:
If a passenger is picked up or dropped off at a location outside of any Service 4 zone, the applicable rate is the rate for the zone after the last zone the vehicle travels through to pick up or drop off the passenger.

The Board approves the rates and rules set out in the document Limousine Zone Rates & Boundaries under Passenger Transportation Licence 70821 (Service 4). These rates and rules are approved by the Passenger Transportation Board and effective as of January 9, 2012.

2. Rules Governing Limousine Zone Rates
a. Taxes are not included in the rates.
b. Zone rates for Service 4 may only be advertised, charged or collected by 632226 BC Ltd., when it is performing a service pursuant to its contract with YVR.
c. If a passenger is picked up or dropped off at a location outside of any Service 4 zone, the applicable rate is the rate for the zone after the last zone the vehicle travels through to pick up or drop off the passenger.

3a. Zone Boundary Definitions – Overview
Zone rates apply to zones with specific boundaries. Each zone is identified by a number.
The numbers start at 100. The highest number is 955.
The boundary of each zone is defined either by a written zone description (3b) or an
illustrated zone map (3c). The exceptions are zones 200, 201 and 202. Information about
these zones is contained with the written descriptions (3b) and the zone map (3c).
