A A Sellerrsquos Property Disclosure is required by Idaho statute to be given to any purchaser of 1 to 4 dwelling units within 10 days of acceptance of the purchaserrsquos offer While a limited number of sellers under specifically defined circumstances are exempt most sellers must complete and deliver a property disclosureWhy answer ALL those questions Particularly when the form used by the Idaho Association of Realtors goes into considerably more detail than required by Idaho statute There is one very good reason putting a buyer on notice of the existence or potential existence of an issue with the home transfers the responsibility of investigating that issue from the seller to the buyer If the buyer now has knowledge of the issue and if it is a concern the buyer has the responsibility to investigateFor example letrsquos say you had a sprinkler that popped off and water ran into the basement 3 years ago You fixed the sprinkler and never had any further problems Should you disclose this After all you had it fixed right Warning If you donrsquot disclose it to the buyer and the buyer subsequently discovers mold that resulted from water damage the buyer may have grounds to look to you for damages because you knew but did not disclose there had ever been water in the basement On the other hand if you explain on the property disclosure that a sprinkler popped off water entered the basement and you had it repaired you have protected yourself by fully disclosing the incident Now the buyer is responsible for determining whether there is an issue and whether they are comfortable moving forwardThe proper use of the Sellerrsquos Property Condition Disclosure Form can reduce a sellerrsquos liability and transfer responsibility to the buyer to inves-tigate the condition of the property to their satisfaction It would be pretty hard for the buyer in the above example to come back to the seller and claim the seller was responsible for any unknown damage when the buyer had been fully informed of the issueBe sure to talk to your Group One agent about how a Sellerrsquos Property Condition Disclosure Form can protect you the seller from liability

A A Sellerrsquos Property Disclosure is required by Idaho statute to be given to any purchaser of 1 to 4 dwelling units within 10 days of acceptance of the purchaserrsquos offer While a limited number of sellers under specifically defined circumstances are exempt most sellers must complete and deliver a property disclosureWhy answer ALL those questions Particularly when the form used by the Idaho Association of Realtors goes into considerably more detail than required by Idaho statute There is one very good reason putting a buyer on notice of the existence or potential existence of an issue with the home transfers the responsibility of investigating that issue from the seller to the buyer If the buyer now has knowledge of the issue and if it is a concern the buyer has the responsibility to investigateFor example letrsquos say you had a sprinkler that popped off and water ran into the basement 3 years ago You fixed the sprinkler and never had any further problems Should you disclose this After all you had it fixed right Warning If you donrsquot disclose it to the buyer and the buyer subsequently discovers mold that resulted from water damage the buyer may have grounds to look to you for damages because you knew but did not disclose there had ever been water in the basement On the other hand if you explain on the property disclosure that a sprinkler popped off water entered the basement and you had it repaired you have protected yourself by fully disclosing the incident Now the buyer is responsible for determining whether there is an issue and whether they are comfortable moving forwardThe proper use of the Sellerrsquos Property Condition Disclosure Form can reduce a sellerrsquos liability and transfer responsibility to the buyer to inves-tigate the condition of the property to their satisfaction It would be pretty hard for the buyer in the above example to come back to the seller and claim the seller was responsible for any unknown damage when the buyer had been fully informed of the issueBe sure to talk to your Group One agent about how a Sellerrsquos Property Condition Disclosure Form can protect you the seller from liability

A A Sellerrsquos Property Disclosure is required by Idaho statute to be given to any purchaser of 1 to 4 dwelling units within 10 days of acceptance of the purchaserrsquos offer While a limited number of sellers under specifically defined circumstances are exempt most sellers must complete and deliver a property disclosureWhy answer ALL those questions Particularly when the form used by the Idaho Association of Realtors goes into considerably more detail than required by Idaho statute There is one very good reason putting a buyer on notice of the existence or potential existence of an issue with the home transfers the responsibility of investigating that issue from the seller to the buyer If the buyer now has knowledge of the issue and if it is a concern the buyer has the responsibility to investigateFor example letrsquos say you had a sprinkler that popped off and water ran into the basement 3 years ago You fixed the sprinkler and never had any further problems Should you disclose this After all you had it fixed right Warning If you donrsquot disclose it to the buyer and the buyer subsequently discovers mold that resulted from water damage the buyer may have grounds to look to you for damages because you knew but did not disclose there had ever been water in the basement On the other hand if you explain on the property disclosure that a sprinkler popped off water entered the basement and you had it repaired you have protected yourself by fully disclosing the incident Now the buyer is responsible for determining whether there is an issue and whether they are comfortable moving forwardThe proper use of the Sellerrsquos Property Condition Disclosure Form can reduce a sellerrsquos liability and transfer responsibility to the buyer to inves-tigate the condition of the property to their satisfaction It would be pretty hard for the buyer in the above example to come back to the seller and claim the seller was responsible for any unknown damage when the buyer had been fully informed of the issueBe sure to talk to your Group One agent about how a Sellerrsquos Property Condition Disclosure Form can protect you the seller from liability

A A Sellerrsquos Property Disclosure is required by Idaho statute to be given to any purchaser of 1 to 4 dwelling units within 10 days of acceptance of the purchaserrsquos offer While a limited number of sellers under specifically defined circumstances are exempt most sellers must complete and deliver a property disclosureWhy answer ALL those questions Particularly when the form used by the Idaho Association of Realtors goes into considerably more detail than required by Idaho statute There is one very good reason putting a buyer on notice of the existence or potential existence of an issue with the home transfers the responsibility of investigating that issue from the seller to the buyer If the buyer now has knowledge of the issue and if it is a concern the buyer has the responsibility to investigateFor example letrsquos say you had a sprinkler that popped off and water ran into the basement 3 years ago You fixed the sprinkler and never had any further problems Should you disclose this After all you had it fixed right Warning If you donrsquot disclose it to the buyer and the buyer subsequently discovers mold that resulted from water damage the buyer may have grounds to look to you for damages because you knew but did not disclose there had ever been water in the basement On the other hand if you explain on the property disclosure that a sprinkler popped off water entered the basement and you had it repaired you have protected yourself by fully disclosing the incident Now the buyer is responsible for determining whether there is an issue and whether they are comfortable moving forwardThe proper use of the Sellerrsquos Property Condition Disclosure Form can reduce a sellerrsquos liability and transfer responsibility to the buyer to inves-tigate the condition of the property to their satisfaction It would be pretty hard for the buyer in the above example to come back to the seller and claim the seller was responsible for any unknown damage when the buyer had been fully informed of the issueBe sure to talk to your Group One agent about how a Sellerrsquos Property Condition Disclosure Form can protect you the seller from liability
