Permit Descriptions CAFRA - A Coastal Area Facility Act permit is required to construct residential, commercial, public, transportation, utility and energy-related facilities in the coastal area as defined by the Act. Federal Consistency Activity: Certain federal permits, not limited to the U.S. Army Corps of Engineers Dredge and Fill Permits, require certification by the DEP prior to the issuance of the permit by the federal agency. Freshwater Wetlands: A Permit (Letters of Exemption, Letters of Interpretation, Statewide General Permit, Open Water Fill, Individual, Transition Area Waiver, Water Quality Certificate) is needed prior to engaging in a regulated activity in or around freshwater wetlands and associated transition areas. A Flood Hazard Area Permit, an U.S. Army Corps of Engineers Dredge and Fill Permit, and a Water Quality Certification may also be required. General Groundwater Petroleum Products Cleanup: This general permit authorizes the surface water discharge of treated groundwater previously contaminated with petroleum products. NJPDES permits: A permit is required for the discharge of pollutants to surface and groundwater, a discharge from an indirect user or the land application of municipal and/or industrial residuals. (A more comprehensive definition of activities, which require a permit, may be found at N.J.A.C. 7:14A-2.4) Solid Waste Facility: A permit is required to conduct or operate any solid waste facility as defined under the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq., and N.J.A.C. 7:26-1 et seq. Tidal Wetlands: A Coastal Wetlands Permit is needed to excavate, dredge, fill or erect structures on coastal wetlands. Treatment Works Approval: A TWA permit is required for the construction, modification or operation of a treatment works, including sanitary/industrial sewage pretreatment or treatment systems, sewage conveyance systems, sewer extensions and subsurface sewage disposal systems. Waterfront Development: A permit is required for any project involving the development of waterfront near or upon any tidal or navigable waterway in the State. Coastal Wetlands: A permit authorizing disturbances to Mapped Tidal Wetlands under the Wetlands Act of 1970, N.J.S.A. 13:9A”

General Information
The DEP Bulletin is an information service provided by the New Jersey Department of Environmental Protection. In compliance with the Rules and Regulations Governing 90 Day Construction Permits (NJAC 7:1C-1.1 et seq.) this semi-monthly publication contains a list of construction permit applications recently filed or acted upon by the DEP. Using the Application Milestone Codes located on the inside front cover, interested persons can determine the status of Coastal Area Facility Review Act (CAFRA) permits, Federal Consistency Activity permits, Freshwater Wetlands Individual and Statewide General permits, General Groundwater Petroleum Products Cleanup permits, Open Water Fill permits, Solid Waste Facility permits (SWF), Flood Hazard Area (FHA) permits, Tidal Wetlands permits, Waterfront Development permits and Treatment Works Approvals (TWA). In addition, a calendar of Events of Interest and a Schedule of Public Hearings is provided. The public hearings listed do not, however, constitute an official notice. Environmental Impact Statements acted upon during the period are also shown. Additional information concerning the permit applications can be obtained by calling the project manager at the appropriate office listed on the inside back cover. Public Hearings are held for the purpose of obtaining input and reaction to a proposed rule, regulation, or new program. Some hearings may be mandated by law. Generally their scope of impact is statewide or of broad general interest and open to the public. Contested Case Hearings are held between the State and a particular party involving an application, enforcement violation or an appeal. Interest in these hearings is generally limited to those directly involved. DEP Events of Public Interest include public hearings, council meetings, workshops, public information meetings, and exams.

Our Lady of the Magnificat Church is applying for a Revoke Reissue NJPDES-DGW Permit. This facility has an existing on-site waste water treatment plant. Currently the on-site treatment plant is malfunctioning and must be periodically pumped to remove sanitary waste and hauled away to be treated at another location. This treatment plant services effluent from a 600 seat church and a 195 student school. Neither school or church are occupied simultaneously. Once the NJPDES-DGW permit is final, OLM’s current NJPDES Discharge to Surface Water permit will be revoked. Our Lady of the Magnificat is proposing at this time to remove the malfunctioning on-site waste water treatment plant and replace it with a septic system. The septic system will include three (3) 1,500 gallon septic tanks and a 3,159 square feet of subsurface disposal bed. Flow will not exceed 1,950 gallons per day (gpd) as stated in Our Lady of the Magnificat NJPDES-DGW application. Effluent flow was calculated based on past discharge meter readings from the current waste water treatment plant. Residuals generated will be pumped from the septic tanks and hauled offsite to be managed at an approved residuals management site.

This is a renewal permit action for Tall Pines Day Camp. This facility is utilized as a children’s day camp on weekdays during the months of June, July, and August, a family/company picnic area on weekends from July to September, and a children's pre-school on weekdays from September through early June. Facilities include bathhouses, offices, recreation centers, and a dining hall. The maximum discharge of sanitary wastewater at any time is 10,000 gallons per day (gpd). Two disposal fields discharge sanitary wastewater, providing a total of 16,000 ft2 of disposal area. To maintain a maximum hydraulic loading rate of 0.64 gpd/ft2 to each disposal field, adjustable gates within the weir chamber facilitate a distribution of flow between the smaller (2,820 ft2) and larger (13,380 ft2) disposal fields. Residuals generated will be pumped from the septic tanks and hauled offsite to be managed at an approved residuals management site.

This action is for the renewal of a NJPDES-DGW permit for a discharge of primary treated wastewater to subsurface disposal fields. The facility, located on an 11.48-acre site, is an elementary school with a maximum population of 600 persons. The discharge consists of sanitary wastewater at a design flow of 9,000 gallons per day (gpd). Primary treated wastewater is discharged to a 16,000 square foot disposal field at a loading rate not to exceed 0.56 gpd/square foot. The discharge is monitored through wastewater sampling and the monitoring of 4 ground water monitoring wells and 2 piezometer wells.

This is a renewal NJPDES-DGW permit for Cape May National Golf Club. Cape May National Golf Club is an existing 18 hole golf club occupying 83 acres in Lower Township, Cape May County. The golf club currently consists of an 18 hole golf course; clubhouse with a proshop, 100 seat restaurant and 85 patron bar; cart storage building and a maintenance shop. The existing clubhouse is served by an onsite subsurface sewage disposal system. As previously identified and approved in the expired permit and this renewal permit, the golf club proposes to expand and construct a locker room facility to accommodate up to 60 members and 25 nonmembers. Final build out will result in a maximum daily design volume of 11,150 gpd during peak months (April through September, inclusive). The wastewater generated by the golf club, both the existing facilities and future expansion, is treated and disposed through a subsurface disposal system consisting of grease traps, septic tanks, pump station and disposal field. The existing clubhouse is served by one (1) 6,120 ft2 disposal field. The disposal area shall not be loaded at a rate greater than 0.89 gpd/ft2. The maintenance building is served by an existing septic system with a daily design volume less than 2,000 gpd.

The facility is an existing 27 hole golf course with a 200 seat restaurant and clubhouse with showers, maintenance building, driving range and comfort station/halfway house. Sanitary wastewater generated by the facility will be treated and discharged into the ground water of the state via an onsite subsurface sewage disposal system. The proposed onsite subsurface sewage disposal system design consists of three (3) septic tanks in series, pump chamber and two (2) 8,700 ft2 disposal fields and will serve the clubhouse, proshop and restaurant for a total daily design volume of 10,250 gallons per day. The existing 1,500 gallon per day onsite subsurface sewage disposal system will remain to serve the shower facilities within the clubhouse. The total sanitary sewage design flow from the facility will be a maximum of 12,250 gallons per day.

The Upper Township Elementary School is an existing elementary school with a maximum population of 565 students and staff and a daily design volume of sanitary sewage of 8,475 gdp. The wastewater from the elementary school is treated by a conventional septic system and discharged to the ground via 4 subsurface disposal beds and 2 seepage pits. The Upper Township Primary School is an existing primary school with a maximum population of 555 students and staff and a daily design volume of sanitary sewage of 8,325 gpd. The wastewater from the primary school is treatment via an onsite wastewater treatment plant and discharged to the ground via a subsurface disposal field.

The Beacon Hill WTP serves the Beacon Hill residential Development which consists of 473 total units. The development has 174 three (3) bedroom age rstricted units, 213 two (2)bedroom age restricted units, 86 four (4) bedroom single family units and an recreational complex. Total flow from the facilty shall not exceed 103,660 gpd. The wastewater is treated by an advanced wastewater treatment plant, with disinfection, and discharged to four (4) 13,110 square foot disposal fields.

This is a renewal permit action for Schering Corporation. The facility performs pre-clinical safety evaluations of potential pharmaceuticals. The facility consists of seven main buildings (office, laboratory, and utilities), storage buildings and a wastewater treatment plant. The total size of the facility in gross square feet is approximately 171,000. An on-site infiltration/percolation lagoon (fire suppression pond) is utilized to discharge wastewater from air conditioning condensate, well water, cooling tower blowdown, surface runoff, and a water bleed line for the research laboratory. Discharge to the pond has averaged approximately 17,500 gallons per day. Overflow from the lagoon, which discharges to an unnamed tributary of the Paulins Kill, is regulated under NJPDES-DSW permit NJ0005711. An on-site wastewater treatment plant handles all other facility wastewater generated, including sanitary wastewater and boiler blowdown. The treatment plant also discharges to the unnamed tributary of Paulins Kill, and is also regulated under the aforementioned DSW permit.

This is a major modification permit action. The existing buildings presently on the school site include a library, an arts / sciences building and a monastery. In 2007, a field house and chapel buildings occupying 65,418 sq. ft. and 11,699 sq. ft, respectively, were constructed to meet the needs of current students/staff, as well as, an increase up to 635 students total. A new wastewater treatment system and subsurface disposal system were constructed to serve the existing library, the arts/science building, the proposed chapel and the proposed field house. The monastery remained on it’s own separate subsurface disposal system. On July 2006, historical flow data from the facility indicated that a maximum of 2,600 gpd of wastewater would be generated and a NJPDES-DGW permit, effective January 1, 2007, was issued with a 2,600 gpd wastewater flow limit. Unexpected higher flow volumes and effluent of increased concentrations, resulted in a 10,000 gallon equalization tank being installed upgradient of the treatment system. This permit action is to modify the wastewater flow limit to 7,350 gpd while treating the effluent to 10 mg/l total nitrogen prior to disposal in two subsurface disposal fields totaling 15,570 square feet. The facility is capable of generating 7,350 gpd of sanitary wastewater, which will be processed by a wastewater treatment plant to meet a limit of 10 mg/l total nitrogen. The treated sanitary wastewater will be discharged to ground waters of the State via two subsurface disposal beds totaling 15,570 square feet. Four groundwater monitor wells will be sampled at the downgradient property boundary to monitor compliance with the GWQS. Pursuant to SQAR, N.J.A.C. 7:14C - 1.8, category 1 domestic treatment works are required to do annual monitoring of their sludge. It appears, based on the design of this system, that the quantity of sludge removed will be minimal and low in percent total solids. Therefore, a Residuals Waste Characterization Report (WCR) and Residuals Discharge Monitoring Report (DMR), which is normally required for a category 1 facility, will not be required at this time. These reports may be required at some point in the future should the quantity and total solids of the sludge be greater than anticipated. However, a Residuals Transfer Report (RTR) is required and has been established at Part III, Limits and Monitoring Requirements, at monitoring location SL1A.

Notice of Public Comment Period Regarding Requests for Highlands Applicability and Water Quality Management Plan Consistency Determinations
Notice is hereby given that the New Jersey Department of Environmental Protection (NJDEP), Bureau of Watershed Regulation, has received the following Highlands Applicability and Water Quality Management Plan Consistency Determination application(s) requesting the issuance of determinations in accordance with N.J.S.A. 13:20-1 et seq. Each application is described in the accompanying table. All applications, prior to submittal for public notice, have been deemed administratively complete in accordance with N.J.A.C. 7:38-11.2(c)3 and the following agencies/persons have been notified by the applicant in accordance with the requirements under N.J.A.C. 7:38-9.2(b).

iii. The Municipal Environmental Commission (if one exists); iv. The Municipal Planning Board v. The Municipal Construction Official
vi. The County Planning Board; and vii. The County Environmental Commission (if one exists) Applications will be reviewed to determine whether the project proposal qualifies for the selected exemption and whether it is consistent with the applicable Water Quality Management Plan. Be advised, however, that the proposal will also be reviewed to determine whether it qualifies for an exemption other than the one specifically applied for. The public notice has been prepared for these applications as part of the administrative record to be filed at NJDEP, 401 East State Street, Trenton. An appointment to review the file pertinent to the listed proposals may be requested through the Open Public Records Act.
