Highlights of Dealer Conveyance Fee Report • Section 428 of PA 15-5 JSS required this report by the Legislative Program Review and

Investigations Committee (PRI), in addition to requiring new and used car dealers to submit dealer conveyance fee information to the legislature via PRI on a one-time basis by November 1, 2015.

• Most new and used license holders provided information for this survey. o The survey response rate for licensed new and used car dealers was 87% and 76%,

respectively, with an overall response rate of 78%.

• Dealers selling new cars charge a higher dealer conveyance fee than dealers selling used cars or other motor vehicles (e.g., motorcycles, RVs). The average dealer conveyance fee for dealers selling:

o new cars was $405 (range of $0 to $699);

o used cars was $131 (range of $0 to $695); and

o other motor vehicles, $119 (range of $0 to $499).

• Over 80% of new car dealers charge over $300, and over 70% of used car dealers charge under $199.

• No dealer conveyance fee is charged by 47% of used car dealers, 45% of other motor vehicles, and just 5% of new car dealers.

• For most dealers, there was little variability from month to month in the average dealer conveyance fee paid by customers from October 2014 through September 2015.

o Dealers who commented on reasons for month-to-month fee variability largely said it was because they: increased fees during the period (30%), discounted the fee when customers registered the vehicle (25%), or negotiated with customers (11%).

• When the average dealer conveyance fee was compared among dealers by county, the fees did not vary significantly by counties.

• The dealer conveyance fee law requires dealers who charge a fee to reduce that fee by a proportional amount when the buyer elects, “as appropriate,” to submit documentation to DMV to register and transfer ownership of a vehicle.

o The average amount deducted by new car dealers was $58 (average of 14% of dealer conveyance fee).

o The average amount for used car dealers was higher at $91 (average of 40% of dealer conveyance fee).

• When dealers were asked how the fee was calculated, the most frequent responses were: o an itemization of activities or supplies that were used to calculate the fee (36%), such

as, paperwork, wait in DMV line, gas, salaries, and emissions;

o costs divided by the number of vehicles sold (24%); and

o based on competitors’ prices (11%).

Dealer Conveyance Fees: PA 15-5 (JSS) Report

Introduction

The term “dealer conveyance or processing fee” refers to a fee that may be charged by new and used car dealers as part of the ultimate selling price of a motor vehicle, and is defined in Connecticut statute to mean:

“…a fee charged by a dealer to recover reasonable costs for processing all documentation and performing services related to the closing of a sale, including, but not limited to, the registration and transfer of ownership of the motor vehicle which is the subject of the sale.” 1

Interest was sparked in dealer conveyance fees during the 2015 regular session by legislation filed to establish a fee cap of $75. The cap concept did not survive, although other consumer-focused amendments to the dealer conveyance fee statutes were contemplated and passed the Senate. The House took no action before the regular session ended. During the June Special Session (JSS) held on June 29, 2015, the dealer conveyance fee topic arose again in Public Act 15-5 JSS, in Sections 426, 427, and 428 identical to what passed the Senate a few weeks earlier.

This report was required by Section 428, which mandated the collection and reporting of certain actual dealer conveyance fee information. Figure 1 summarizes the three subsections of Section 428.

It is important to be aware that while PA 15-5 sought actual dealer conveyance fee data at a point in time via Section 428, the two other fee-related sections made a number of substantive pro-consumer changes to the dealer conveyance fee law going forward, effective July 1, 2015. These changes include allowing the fee to be negotiable and requiring any dealer advertisement about the price of a car to include separately the amount of the dealer conveyance fee.

Report Content

The dealer conveyance fee data collection results are provided next in summary form, followed by five appendices. Appendix A contains the actual text of Section 428 of PA 15-5 JSS. Appendix B provides a legislative history of the dealer conveyance fee. Appendix C describes the report methodology used to collect and report fee information. Appendix D contains a copy of the dealer conveyance fee survey sent to all licensed new and used car dealers. Finally, Appendix E lists individual dealer conveyance fee information reported to be posted on September 1, 2015, by each responding dealer.

a. Car Dealer Reporting Requirement

− By November 1, 2015, each new and used car dealer licensed in Connecticut, continuously in business for the 12 month period between October 1, 2014 to September 30, 2015, was required to provide the Legislative Program Review and Investigations Committee the following information:

1. the average amount charged by each dealer as a dealer conveyance fee or processing fee in each month between October 1, 2014 to September 30, 2015;

2. a description of how such fee was calculated, and the reason for any month-to-month variations in such fee; and

3. the name and address of the dealer and whether such dealer is a new car dealer, a used car dealer or both.

b. Program Review Committee Facilitation

− The Legislative Program Review and Investigations Committee was required to facilitate the submission of information described above by:

1. publicizing the requirements of Section 428 of P.A. 15-5; 2. developing and distributing a form for such submission

(except there was no requirement for dealers to use the form, but if the form was not used, the dealer still had to submitted the required information above);

3. allowing such submission either by mail or electronic mail; and

4. taking any follow-up steps necessary to ensure complete and accurate reporting of such information.

c. Program Review Committee Report

− By January 15, 2016, the Legislative Program Review and Investigations Committee was required to report to the Transportation Committee.

− The report was required to be a compilation of the information submitted pursuant to Section 428 and to include a description of the methodology used to collect and report such information.

Dealer Conveyance Fee Results

The information provided by new and used car dealers to PRI in response to the form/survey sent to them in September 2015 is compiled here in summary form, including a comparison of the conveyance fees charged by different types of dealers, the reasons given for any monthly variability in the fees charged over a one-year time period, factors cited to develop conveyance fees, and descriptions of how dealers calculate the fee. Fee information by individual dealer license, town, and county is provided in Appendix E.

Dealers Included in Survey Analysis

A total of 2,474 licensed new and used car dealers3 received surveys, and 1,934 (78 percent) completed them. (The survey methodology is described in Appendix C). Each licensed dealer returning a completed survey had to meet two criteria for inclusion in the actual analysis:

1. sold motor vehicles (new or used of any type, e.g., cars or other (motorcyles, RVs)); and 2. continuously been in business during the period from October 1, 2014, to September 30,

2015. Table 1 shows the status of the surveys sent, completed, and included in the analysis. Two

hundred sixty-eight (268) of the 1,934 responding licensed dealers indicated they did not sell motor vehicles, and another 46 sold motor vehicles but had not continuously been in business during the period from October 1, 2014, to September 30, 2015. The resulting 1,620 dealer license holders met these requirements for inclusion in the analysis as shown in Table 1.

While actually selling motor vehicles was a threshold question to be included in the survey analysis, three categories of motor vehicle sales beyond just the license designation were created for more refined analysis purposes. The intent was to be able to distinguish between dealers who sold cars versus other types of motor vehicles, in case that made a difference in reporting the average dealer conveyance fee. Figures 2, 3, and 4 show the results of this categorization. Depending on which category they indicated on the dealer conveyance fee survey, dealers were classified as selling either: new cars (“Both new and used cars”) in Table 2; used cars (“Used cars only”) in Table 3, or other (“Other motor vehicles (for example, motorcycles, RVs)) in Table 4.

Range and Variability of Fees Posted on September 1, 20155

The figures above show that over 80 percent of the new car dealers charge over $300, with an average of $405. Conversely, over 70 percent of the used car dealers charged under $199, with nearly half charging $0 or no amount entered. Similarly, three-quarters of the motorcycle, RV, and other dealers charged under $199, with 45 percent not charging a dealer conveyance fee.

Monthly average variability. Dealers were asked to provide the monthly average dealer conveyance fee paid by customers for each of the 12 months from October 2014 through September 2015. Most of the new and used dealers (80 and 87 percent, respectively) reported the exact same average dealer conveyance fee paid by their customers for each of the 12 months.

Variability reasons. Dealers were asked to explain the reasons for any month-to-month

variability in the reported average fee. Of the 209 dealers (new and used) who commented on the variability, 30 percent of respondents said it was because they increased the fee over the time period (Figure 5). This included those who indicated it was because of the increased time it took to

process documents at DMV and a few who reported raising the fee when the legislature made it negotiable. Another 25 percent of dealers answering this question responded that it was due to discounts for the customer registering the vehicle, while 11 percent said it was because they negotiated the fee with customers.

A small number of dealers (1 percent) said they gave employee discounts. About 3 percent of respondents gave miscellaneous responses that included cost factors that went into the fee. A large number of responses (30 percent), mostly from used car dealers, stated the variability was due to the number of vehicles sold. Program review staff believes these responders misinterpreted the question. While the total fees collected could change from month to month based on the number of vehicles sold, the average, all other things being equal, should remain the same.

Amount Deducted for Customer Registration

The dealer conveyance fee law6 requires dealers who charge a fee to reduce that fee by a proportional amount when the buyer elects, “as appropriate,” to submit documentation to DMV to register and transfer ownership of a vehicle. As displayed in Table 6, the average amount for new car dealers who charged a dealer conveyance fee7 ranged from $50-$699 with an average of $425. The average amount deducted if the buyer chose to submit documentation to DMV was $58, or 14 percent of the dealer conveyance fee. Of the 265 new car dealers who charged a dealer conveyance fee, 33 dealers (12%) either did not fill in an amount or reported deducting $0 if a buyer chose to submit documentation to DMV.

The average amount for used car dealers who charged a dealer conveyance fee8 ranged from $10-$695 with an average of $246. The average amount deducted if the buyer chose to

submit documentation to DMV was $91, or 40 percent of the dealer conveyance fee. Of the 655 used car dealers who charged a dealer conveyance fee, 172 (26%) either did not fill in an amount or reported deducting $0 if a buyer chose to submit documentation to DMV. Conversely, of the 655 used dealers who charged a dealer conveyance fee, 135 (21%) reported deducting the entire amount of the dealer conveyance fee if the buyer chose to submit documentation to DMV, a deduction as high as $595.

Dealer Location Impact on Fee

When the average dealer conveyance fee was compared among dealer by county, the fees did not vary significantly across counties.

Factors Used in the Calculation of Dealer Conveyance Fee

Dealers were asked to choose from a list of 18 factors the ones that were included in the calculation of their dealer conveyance fee charged on September 1, 2015 (Table 2). Of those who responded to the question and charged a dealer conveyance fee, at least two-thirds of the new car dealers selected the following factors:

• Personnel costs to prepare and submit a vehicle registration to DMV; • Cost of office equipment needed to prepare and submit vehicle registration

to DMV; • Personnel costs to prepare and submit title documents to DMV; • Cost of office equipment needed to prepare and submit title documents to

DMV; • Personnel costs to prepare and submit finance and lease documents; • Personnel costs to file and release security liens on purchased and traded

vehicles; • Cost of office equipment needed to file and release security liens on

purchased and traded vehicles(for example, computers and printers); and • Training for sales associates in Dealer Conveyance Fee. Of the used car dealers responding to this question who charged a dealer conveyance fee, at

least 63 percent selected the following factors:

• Personnel costs to prepare and submit a vehicle registration to DMV; • Cost of office equipment needed to prepare and submit vehicle registration

to DMV; • Personnel costs to prepare and submit title documents to DMV; and • Cost of office equipment needed to prepare and submit title documents to DMV.

Other factors. Dealers also had the option of writing in additional factors used to calculate their dealer conveyance fees that were not included in the list of 18 factors. Some of the responses, though, cited a number of the same 18 factors.

Figure 7 shows that 23 percent of the 182 respondents (new and used dealers) indicated various types of paperwork duties went into the calculation, including title work, credit or vehicle

financing applications, the resolution of existing liens, “Car Fax” reports, warranty registration, and insurance forms. Other responses included the following:

• Twenty percent indicated DMV registration process related costs, such as training staff on the new computer system to register vehicles, standing in line at DMV, required safety inspections, and vehicle identification number verification.

• Fourteen percent indicated that they only charge for factors allowed by DMV. • Ten percent said they include various office supplies (toner, paper, forms) and

software fees, while 5 percent included fees related to delivery services (U.S. mail, Federal Express) and phone calls.

• Twenty-nine percent of those who responded offered miscellaneous comments that were not related to any specific factors. These respondents made comments regarding why they charged a fee, how they calculated a fee, critiques of DMV services, and how time consuming the whole registration process was.

Differences in Factors Selected by High and Low Charging Dealers

Factors selected by new car dealers charging relatively higher (top 25 percent) dealer conveyance fees ($499+) were compared with new dealers charging relatively lower (bottom 25 percent) dealer conveyance fees ($10-$387). There were virtually no differences in factors selected by the new dealers charging higher amounts versus those charging lower amounts.

However, differences were found in factors selected by used car dealers charging relatively

higher (top 25 percent) dealer conveyance fees ($299+) compared with dealers charging lower (bottom 25 percent) dealer conveyance fees ($10-$150). The dealers charging relatively higher amounts were significantly more likely to identify 15 of the 18 factors compared with dealers

charging lower amounts. (The three factors that were no more likely to be chosen by used car dealers charging higher dealer conveyance fees were: the type of car (make and/or model); the price of the car; and profit). For example, the used car dealers charging relatively higher amounts were more likely to select the following factors:

• Personnel costs to prepare and submit finance and lease documents (62% vs.

29%) • Cost of office equipment needed to file and release security liens on purchased

and traded vehicles (61% vs. 26%) • Detailing and other dealer preparations to get vehicle ready for buyer (for

example, gas for vehicle) (48% vs. 25%) • Cost of office equipment needed to store and retrieve information for audits and

government inspections (52% vs. 29%) How the Fee is Calculated

A total of 745 dealers who charge a conveyance fee provided responses to the open-ended question, “Based on these factors, how did you calculate the actual Dealer Conveyance Fee charged on September 1, 2015?” Figure 8 shows that 36 percent of the 745 responses provided an itemization of costs -- meaning a break out or at least a partial listing of costs that went into their dealer conveyance fees.

For example, some respondents listed the preparation of paperwork, time to actually go to DMV or payment to a company to help with on-line registration, office supplies, gas, salaries or hourly labor costs, emissions, information/paperwork storage, software, and maintenance of showroom.

Other respondents provided more specific breakdowns in percent or dollar terms. For example, one dealer said the costs were split between those associated with detailing and

preparation of a vehicle (approximately 75 percent of costs) and all other costs (25 percent). Another respondent provided the following dollar breakdown:

Another 24 percent of respondents said they divided the cost related to registering vehicles by the number of vehicles sold on a monthly or annual basis, while 11 percent said they established their fee by comparing what nearby competitors were charging.

The remaining respondents did not provide any description of a calculation but: said they charged a “fair” price, an “estimated” price, a price that had not changed in a long time, or “actual” price (11 percent); directly referred to survey question 11, which contained the list of 18 possible cost factors (9 percent); or made other miscellaneous comments (9 percent).

Other Comments

Over 300 survey respondents provided comments at the end of their surveys. As shown in Figure 9, most respondents (44 percent) reiterated that they did not charge a convenience fee. Nearly one in ten simply noted that they did not sell many (or any) vehicles during the survey time period.

Others (11 percent) provided additional explanation about the basis or administration of their fee, such as factors included in the fee, the fact the fee did not cover all of the dealer’s costs, the reduction in fee if customer registers the vehicle, or that their fee has not changed in years.

Several respondents (6 percent) provided negative comments about DMV services, especially related to the computer system, long lines at DMV offices, overall difficulty in working with DMV or getting answers from department employees, and pleas to privatize the registration function.

A number of respondents (5 percent) emphasized the fee was reasonable and needed, noting that it was “essential to dealers’ survival” or it “basically covered our costs.” Others said the fee was not needed (3 percent) or would be satisfied if the state established a cap or flat fee (2 percent). These respondents said the fee was “unfair to the consumer” and the “conveyance fee is offensive to buyers and not necessary.” Finally, 17 percent provided miscellaneous information relating to dealer contact information, the nature of their business (e.g., body shop, commercial vehicles), or questions and comments about the survey itself.

AN ACT IMPLEMENTING PROVISIONS OF THE STATE BUDGET FOR THE BIENNIUM ENDING JUNE 30, 2017, CONCERNING GENERAL GOVERNMENT, EDUCATION, HEALTH AND HUMAN SERVICES AND BONDS OF THE STATE. Sec. 428. (Effective July 1, 2015) (a) Not later than November 1, 2015, each new car dealer and used car dealer licensed under section 14-52 of the general statutes, and continuously in business during the period from October 1, 2014, to September 30, 2015, inclusive, shall provide to the Legislative Program Review and Investigations Committee the following information: (1) The average amount charged by each dealer as a dealer conveyance fee or processing fee in each month of the year commencing October 1, 2014, and ending September 30, 2015; (2) a description of how such fee was calculated, and the reason for any month-to-month variations in such fee; and (3) the name and address of the dealer and whether such dealer is a new car dealer, a used car dealer or both. For purposes of this section, "dealer conveyance fee" or "processing fee" has the same meaning as provided in section 14-62 of the general statutes, as amended by this act.

(b) The Legislative Program Review and Investigations Committee shall facilitate the submission of information described in subsection (a) of this section by (1) publicizing the requirements of this section, (2) developing and distributing a form for such submission, except there shall be no requirement that such form be used, provided, if such form is not used, the information is submitted in a manner and form that reasonably conforms to the requirements of subsection (a) of this section, (3) allowing such submission either by mail or electronic mail, and (4) taking any follow-up steps necessary to ensure complete and accurate reporting of such information.

(c) The Legislative Program Review and Investigations Committee shall, not later than January 15, 2016, report, in accordance with the provisions of section 11-4a of the general statutes, to the joint standing committee of the General Assembly having cognizance of matters relating to transportation. Such report shall be a compilation of the information submitted pursuant to this section and shall include a description of the methodology used to collect and report such information.

Appendix B: Background

Background

The dealer conveyance fee has been subject to legislative scrutiny on a couple of occasions over the last three decades. Below is an explanation of the legislative history of the fee, a discussion of a related Connecticut Supreme Court case, and a description of recent DMV guidelines involving the fee. At the end, the statutory definitions of new car dealer, used car dealer, and motor vehicle are provided for reference purposes.

1998 Legislation

Prior to 1998, at least some new car dealers in Connecticut charged their car-purchasing customers a “dealer conveyance or processing fee,” an item ungoverned by state statute in any way in contrast to many other aspects of motor vehicle sales by dealers. The fee apparently became the subject of complaints, including that consumers were confused about whether the dealer conveyance fee was a mandatory charge a dealer was required to collect and pass along to the state of Connecticut.

Public Act 98-182 addressed the dealer conveyance fee for the first time in state statute. The act among other items responded to concerns about consumer confusion by requiring a dealer, if such a fee was charged, to make clear on the sales order and invoice – in 10-point bold type - that the fee was not a state government charge.

Public Act 98-182 originated from a bill (HB 5997) raised by the Transportation Committee on behalf of the Connecticut Automotive Trades Association (CATA). The part of HB 5997 about dealer conveyance fees was described by CATA as providing “for the disclosure of the nature and amount of dealer processing fees. The disclosures would be made on contract documents, at the point of sale and in any advertisements.”1 Specifically, the PA 98-182 provisions about dealer conveyance fees did the following:

“…a fee charged by a dealer to recover reasonable costs for processing all documentation and performing services related to the closing of a sale, including, but not limited to, the registration and transfer of ownership of the motor vehicle which is the subject of the sale.”2

Amended a provision already requiring what must be included on an order and invoice for a motor vehicle sales by adding: “any dealer conveyance fee or

processing fee and a statement that such fee is not payable to the state of Connecticut printed in at least 10-point bold on the face of the order and invoice.

2007 Connecticut Supreme Court Decision on Meaning of “Reasonable” Costs

In 2007, the Connecticut Supreme Court was presented with determining the meaning of the word “reasonable” in the dealer conveyance fee definition established by PA 98-182, as in “a fee charged by dealer to recover reasonable costs…..”4 (see full definition in page above). In June 2002, a Connecticut resident entered into a contract with a licensed car dealer to purchase a 2001 Chrysler 300M. The purchase order, signed by both the resident and dealer, included a dealer conveyance fee of $299 along with the required statement that the dealer conveyance fee was not payable to the State of Connecticut.

After purchasing the car, the resident file a lawsuit against the dealer claiming the $299 fee violated C.G.S. Sec. 14-62(a) “because it exceeded the reasonable costs for processing all documentation and performing costs related to closing the sales of motor vehicles.”

The question was what the statute meant, i.e., “whether §14-62 of the General Statutes regulate[s] the amount that a motor vehicle dealer may charge as a dealer conveyance fee, such that a court may determine that the statute is violated if the amount charged is not reasonable in light of the dealer’s reasonable costs for processing all documentation and performing services related to the closing of the sale of the vehicle?”

The Supreme Court in a 5-2 decision upheld the appellate court’s earlier holding against the plaintiff that the statute “imposes disclosure obligations, but does not regulate the amount that a car dealer may charge as a conveyance fee.” This was because the word “reasonable” was part of the definition of “dealer conveyance fee” and meant to explain what is to be disclosed, and “there is no indication that it gives rise to a separate obligation.”

In contrast, the dissent argued that “it was obvious that the purpose of the statute is to require truth in price advertising for the benefit of the consumer. What the majority opinion fails to grasp is that the limitation of a dealer’s conveyance fee to the amount of the dealer’s reasonable costs in closing the sale of an automobile furthers the primary purpose of the statute by preventing a dealer from misleading consumers regarding the actual “price” of an automobile by manipulating the conveyance fee to hide profit.”

The Office of Attorney General filed an amicus brief for the state of Connecticut in this case on the side of the plaintiff. The attorney general’s concern about the appellate court’s holding that the word “reasonable” did not actually relate to the amount charged was in part that elsewhere the dealer conveyance fee was not required to be specifically provided in any price advertising—PA 98-182 had only added it to the list of items in C.G.S. Sec. 14-62a that were to be identified as not included in the price, like state or local taxes or registration fees.

Since this was a case of statutory interpretation, if the Connecticut General Assembly did not agree with the Supreme Court’s decision, it could amend the statute.

2015 Regular and June Special Legislative Sessions

Public Act 15-5 JSS amended the dealer conveyance fee laws for the first time since they were enacted in 1998. During the regular 2015 legislative session, Proposed Bill 503 was filed to amend state statutes to limit automobile dealer conveyance fees to $75. The Transportation Committee held a subject matter public hearing on the bill on February 9, 2015, and subsequently voted to draft the bill as a committee bill limiting the fee to be no more than $75. The committee bill was favorably reported by the Transportation Committee on March 18, 2015.

On May 27, 2015, the Senate took up SB 503 (File 3355), which still contained a $75 cap on dealer conveyance fees. A strike-all amendment was immediately called that eliminated the

$75 fee ceiling and instead provided a number of substantive pro-consumer changes to the dealer conveyance fee law. The amendment also required a one-time submission of dealer conveyance fee information by dealers to the legislature (through the program review committee).

During the debate, many speakers noted the amount of effort among a number of people that had gone into drafting the strike-all amendment. Regarding the report requirement, it was argued that the report would allow a “rational” collection of data to show what dealers were actually charging for dealer conveyance fees, as a way to protect consumers. Some legislators reported hearing from constituents about a wide range of fees charged.

After adopting the amendment (designated Senate A), the Senate passed SB 503 as amended by Senate A by a vote of 32-4. No action was taken in the House before the end of the regular session on June 3, 2015.

The Connecticut General Assembly held a special session on June 29, 2015. Public Act 15-5 included all the provisions that were in SB 503 as amended by Senate A.

PA 15-5. Figure 1 in the Introduction describes Sec. 428 of PA 145-5 regarding the one-time reporting requirement. Two other sections, 426 and 427, contained substantive changes. One key change was the provision that the dealer conveyance or processing fee was now negotiable (Secs. 426 and 427). The dealer conveyance law had been silent on that point until the change; the prevailing view among dealers appeared to be that if they decided to charge anyone a dealer conveyance fee, they had to charge everyone a dealer conveyance fee, and it had to be the same fee. (Some survey responses suggest this was an area of varied application.)

Other substantive changes included in P.A. 15-5 were the following:

Requires any advertised car price to state the amount of the dealer conveyance fee: 1.Now, in addition to the 1998 advertising requirements, any dealer advertising a motor vehicle price must “separately state, in at least eight-point bold type, immediately next to the phrase Dealer Conveyance Fee”, the amount of such dealer conveyance fee or process fee.” (Sec. 427)

Requires notice to potential buyers in two ways: Now, instead of the 1998 “either” option, 2.a dealer must both 1) provide a written statement to the buyer and 2) prominently display a sign in his place of business in which sales are negotiated , in order to specify the required information (e.g. fee amount and that it is not payable to the state of Connecticut), which now must include that the fee is negotiable. (Sec. 426)

Requires fee to be separately stated earlier than order signing: Now, there is a new 3.requirement that the “selling price quoted by any dealer to a prospective buyer must include, separately stated, the amount of the dealer conveyance fee and that such fee is negotiable.” Further, “[n]o dealer conveyance fee shall be added to the selling price at the time the order is signed by the buyer.” (Sec. 426)

DMV regulations or guidelines. There do not appear to be any DMV regulations promulgated in specific reference to the dealer conveyance provisions enacted in 1998.

During the summer of 2015, apparently prompted by the new requirement that dealers had to supply both a written statement and a sign related to dealer conveyance fees, DMV developed what might be called guidelines for dealers as to what services could be listed as covered by the conveyance or processing fee (each dealer has been required to specify the services performed by the dealer for such fee since 1998). The legal status of these guidelines is unclear, and DMV has not promulgated regulations in this area. The guidelines include the following as well as a space for a dealer to add other services:

(a) Processing and submission of credit applications to finance companies (b) Preparation of finance or lease documents (c) Preparation and submission of vehicle registrations both manually and

electronically with the Connecticut Department to Motor Vehicles (d) Filing and releasing security liens on purchased and traded vehicles as

contractually required by lending institutions (e) Processing applications for new or duplicate title documents with the Connecticut

Department of Motor Vehicles. (f) Processing the pay-off of an existing lien of any vehicle (g) Other (describe) _____________________

Further, the form makes a note that if a lienholder of record exists, the dealer must submit

the documentation to the Department of Motor Vehicles.

Definitions C.G.S. Sec. 14-51. Definitions. (a) As used in this subpart (D): (1) "New car dealer" includes any person, firm or corporation engaged in the business of merchandising new motor vehicles under a manufacturer's or importer's contract for each such make of vehicle who may, incidental to such business, sell used motor vehicles and repair motor vehicles. Such person shall be qualified to conduct such business in accordance with the requirements of section 14-52a. (2) "Used car dealer" includes any person, firm or corporation engaged in the business of merchandising motor vehicles other than new who may, incidental to such business, repair motor vehicles. A used car dealer does not include any person, firm or corporation engaged in the business of leasing or renting motor vehicles that offers for sale or sells used motor vehicles incidental to its primary business, if (A) such person, firm or corporation is licensed in accordance with the provisions of section 14-15, and (B) the motor vehicles that it offers for sale were formerly the subject of one or more lease agreements to which it was a party and the actual or prospective purchaser is the original lessee pursuant to a purchase option specified in a lease agreement. Such person shall be qualified to conduct such business in accordance with the requirements of section 14-52a. C.G.S. Sec. Sec. 14-1. Definitions. Terms used in this chapter shall be construed as follows, unless another construction is clearly apparent from the language or context in which the term is used or unless the construction is inconsistent with the manifest intention of the General Assembly: (53) "Motor vehicle" means any vehicle propelled or drawn by any nonmuscular power, except aircraft, motor boats, road rollers, baggage trucks used about railroad stations or other mass transit facilities, electric battery-operated wheel chairs when operated by physically handicapped persons at speeds not exceeding fifteen miles per hour, golf carts operated on highways solely for the purpose of crossing from one part of the golf course to another, golf-cart-type vehicles operated on roads or highways on the grounds of state institutions by state employees, agricultural tractors, farm implements, such vehicles as run only on rails or tracks, self-propelled snow plows, snow blowers and lawn mowers, when used for the purposes for which they were designed and operated at speeds not exceeding four miles per hour, whether or not the operator rides on or walks behind such equipment, motor-driven cycles as defined in section 14-286, special mobile equipment as defined in section 14-165, mini-motorcycles, as defined in section 14-289j, and any other vehicle not suitable for operation on a highway;

Appendix C: Methodology

Methodology

Methodology for Dealer Conveyance Fee Report

Public Act 15-5 (JSS) required this report to include a description of the methodology used to collect and report dealer conveyance fee information. The act itself set out broad methodological parameters that: 1) information was to be sought from all licensed new and used car dealers; 2) certain information was to be collected; and 3) a form/survey was to be used as a data collection tool.

To prepare to survey new and used car dealers, PRI staff talked with parties interested in or knowledgeable about dealer conveyance fees. These parties included: legislators and legislative staff; Department of Motor Vehicles (DMV) personnel; and representatives from the Connecticut Automotive Retailers Association (CARA)1 Through these discussions, PRI staff learned details about new and used car dealer licenses and activities that informed the final survey design. Both CARA and DMV personnel reviewed a survey draft for clarity, terminology, and length of time to complete.

This methodology section covers four areas: 1) identification of new and used car dealer license holders; 2) instrument development and description; 3) data collection; and 4) survey participant information.

Identification of New and Used Car Dealer License Holders

Any person or business wanting to sell motor vehicles in Connecticut, which includes motorcycles, campers, and RVs as well as automobiles, must be licensed as a “new car dealer” or “used car dealer.” New car dealers may sell new and used motor vehicles, while used car dealer may only sell used motor vehicles.

Department of Motor Vehicles staff directed PRI staff to an online, publicly available DMV spreadsheet containing a roster of licensed new and used car dealers.2 For this report, the roster on August 17, 2015 was used as the source of licensed dealers to survey. The DMV list contained information on 399 new car dealer license holders and 2,143 used car dealer license holders, for a total of 2,542 dealers.

Unique license numbers and DBAs. Each dealer license requires a legal name identified with it along with a specific location, as each dealer license is location-based. According to the DMV website, many dealer licenses are issued to a legal business name, but may operate under another name (called a “DBA” or Doing Business As).3

Because it was unclear if multiple DBAs operating under a single dealer license charged the same dealer conveyance fees, the survey asked dealer license holders to provide information for each DBA connected to the license number. Based on the survey responses to the question about the dealer conveyance fee posted on September 1, 2015, it appears that all DBAs connected to a unique dealer license number charge the same fee.

Non-car dealers. Seeking clearer information about which of the 2,542 dealers actually sold cars, as that term is commonly used, as opposed to other types of motor vehicles (e.g., motorcycles, RVs), the survey asked if the dealer sold: both new and used cars; used cars only; other motor vehicles (for example, motorcycles, RVs); or did not sell motor vehicles.

Survey Instrument Development and Description

The development of the form was a key part of the methodology, as its structure was critical to maximizing the usefulness of the information sought. (Throughout this project, the data collection “form” has been referred to interchangeably as the survey.)

The survey questions were divided into three parts, reflecting the information identified to be collected in Section 428:

• Part 1 asked for dealer license number, the legal business name for the license and address, and any DBAs operating under the license number.

• Part 2 asked for the average dealer conveyance fee charged for each of the 12 months between October 1, 2014 through September 30, 2015, along with a question about the reasons for any monthly variability in the average dealer conveyance fees. Also requested was the dealer conveyance fee posted at the dealership on September 1, 2015, and the amount deducted from the usual dealer conveyance fee for buyers who chose, where appropriate, to submit the documentation required for registration and transfer of ownership to DMV.

• Part 3 asked about how the dealer conveyance fee was calculated. Survey respondents chose from 18 factors listed and could specify any additional factors. Part 3 also included a question about how the actual dealer conveyance fee charge was calculated based on the factors. Respondents had the opportunity to add comments at the conclusion of the survey.

The 18 factors were developed by PRI staff based on a review of legislative hearings at

which dealer conveyance fees were discussed and a few visits to dealer showrooms, as well as outside input. While representatives from both CARA and DMV told PRI staff they thought some of the listed factors were not allowable under the dealer conveyance fee statute, each of the factors included was based on some public statement about what the fee covered.

Distribution of Notices and Survey

In the process of carrying out the requirements of PA 15-5, 6,169 pieces of mail were produced from the PRI staff office in three mailings.4 While every opportunity was given to the new and used car dealers to respond electronically to the survey if they so chose, there was no comprehensive dealer e-mail list for survey distribution. PRI staff prepared mailing labels for the new and used car dealers from the electronic roster posted on the DMV website on August 17, 2015.

Pre-survey postcard. On September 14, 2015, pre-survey postcards alerting dealers to expect a survey soon were distributed through U.S. mail to all 2,542 dealer names and addresses. (There were 71 postcards returned to sender, 68 Used and 3 New.) Below is a copy of the

postcard sent in advance of the survey.

Survey mailing. Approximately one week later, on September 23 and 24, 2015, the actual surveys were mailed to the 2,542 new and used car dealers. There were multiple ways the survey form could be completed by November 1, 2015, and returned to PRI:5

• fill out the enclosed paper survey and return it via regular mail (using the enclosed pre-paid envelope);

• scan the completed paper survey and email it to PRI ([email protected]); • fax the completed paper survey to PRI (860-240-0327); and • fill out the survey electronically using SurveyMonkey. A set of FAQs was developed to facilitate responses to telephone inquiries from dealers.

Staff was available to answer questions from dealers and assist in completing surveys.

Reminder postcards. By the survey return deadline of November 1, 2015, 1,085 dealers had not returned their surveys. Based on the Section 428 provision to take “any follow-up steps necessary to ensure complete and accurate reporting” of dealer conveyance fee data, 1,085 reminder postcards were mailed on November 5, 2015. (Fourteen postcards came back marked “returned to sender,” all intended for used car dealers.) Below is a copy of the reminder postcard.

The dealer conveyance fee information was provided to PRI in multiple ways. Table 2

shows over half of respondents filled out paper surveys and returned them via regular mail. Except for licensed dealers completing the survey electronically (28 percent), all other survey information was entered manually by PRI administrative staff.

In June 2015, the Connecticut General Assembly passed Section 428 of Public Act 15- 5. This law requires you and all other licensed new and used car dealers to give the Legislative Program Review Committee (PRI) --- on a one-time basis by November 1, 2015 --- certain information about the dealer conveyance or processing fees you charged between October 1, 2014 through September 30, 2015.

Survey Form and Return. The attached survey was developed to assist you in submitting the required information to the legislature. A blank survey is being mailed to each dealer license number. For your convenience, there are four options to complete and return the survey:

Survey Contents. You will see the survey has three parts, based on the requirements of the public act:

12 months between October 1, 2014 through September 30, 2015.

Part 3 asks about how you calculated your dealer conveyance fee.

Appendix E: Dealer Listings C.G.S. Sec. 14-62 (c) re: Conveyance or processing fee (as amended by PA 15-5 JSS Sec. 426 (Effective July 1, 2015):

(c) Each dealer shall provide a written statement to the buyer and prominently display a sign in the area of such dealer's place of business in which sales are negotiated which shall specify the amount of any conveyance or processing fee charged by such dealer, the services performed by the dealer for such fee, that such fee is negotiable, that such fee is not payable to the state of Connecticut and that the buyer may elect, where appropriate, to submit the documentation required for the registration and transfer of ownership of the motor vehicle which is the subject of the sale to the Commissioner of Motor Vehicles, in which case the dealer shall reduce such fee by a proportional amount. The Commissioner of Motor Vehicles shall determine the size, typeface and arrangement of such information.
