In 2005, the Michigan Supreme Court determined that the general public has the right to walk along the lakeshore on land below the ordinary high water mark. The "ordinary high water mark" is defined as being the point on the shore where the water presence is continuous as to leave a distinct mark on the land. It is also important to know that the court did not address the public's right to use a private beach for activities other than walking, running, etc. It is implicit that the public cannot use private property for any activity outside of those outlined. In Illinois and Wisconsin, walkers along private beaches are not trespassing as long as they keep their feet wet. Indiana allows public access up to the ordinary high‐water mark of Lake Michigan.
