BE IT KNOWN, That on this . f\ ,-} W BEFORE ME, KarenT. Carlin, A Notary Public duly commissioned, qualified and sworn, within and forthe Parish of Iberia, State of Louisiana, therein residing, and in the presence of thewitnesses hereinafter undersigned,

PERSONALLY CAME AND APPEARED:

Jeanerette, Louisiana and Jeanne B. Roane, whose permanent mailing address is

207 Canaan Lane Jeanerette, Louisiana 70544 both single and of full age,

hereinafter designated as "Appearers", and who further declared unto me, Notary,

that Appearers are the owners of the following described property, herein

designated as "Danielle Place Subdivision - Phase II" more particularly described

as follows:

DANIELLE PLACE SUBDIVISION - PHASE II, ACCORDINGTO A PLAT OF SURVEY PREPARED BY CHARLES D.

MOO~~1L.S., dated March 24, 2009 filed for record atCOB , under Entry No. ~, records ofIberia Parish, Louisiana.

Being that certain tract of land situated in Section 57, T12S, R7E,Iberia Parish, LA, consisting of Lots 1 through 4, all fronting onVida Shaw Road, all as is shown and depicted on the abovereferenced plat of survey.

Being a portion of the same property acquired by Robert LeeRoane, Jr. et al from Albert Eldridge et al by act of cash sale datedDecember 16, 1963 filed for record at COB 444 Folio 38 Entry No.128174 of the Public Records of Iberia Parish, Louisiana.

And said Appearers further declared to me, Notary, that being desirous of

establishing certain restrictive covenants applicable to the hereinabove described

property, which shall be binding on all purchasers of lots therein, their successors

and assigns, and to make any subsequent sale or transfer of said property subject

thereto, although not set forth therein, Appearer does now and herewith designate,

impose and adopt the following restrictive covenants which shall bear against the

above described property:

1. No lot in this subdivision shall be used for any purpose other than singlefamily residential. No mpre than one residence shall be constructed on anysubdivision lot. No commercial activities of any kind shall be conducted inthis subdivision.

2. No lot in this subdivision shall be resubdivided except where two or more

owners desire to purchase a common lot between them to be further

subdivided in order to increase the width of their respective properties. This

shall not prevent the owner of two or more adjacent lots from combining

them; altering their interlinear drainage, and constructing thereon a single

dwelling, provided those changes do not affect the drainage of adjacent

properties.

3. No building shall be erected, altered, placed or permitted to remain on any

lot in this subdivision other than one detached single-family dwelling.

Detached buildings shall be allowed for playhouses, RV/boat storage,

barbecue houses, workshops, etc.,provided that any such detached buildings

shall be of good quality and constructed on a concrete slab.

4. No dwelling shall be permitted on any lot in this subdivision unless said

dwelling contains at a minimum, 1,500 square feet of livingarea, exclusiveof

porches, carports or garages, in the case of a single story dwelling, or less

than 1000 square feet exclusive of porches, carports, and garages, on theground floor, in the case of two-story dwellings. Dwellings or appurtantstructures may not exceeded two stories in height.

5. All dwellings shall be constructed on a concrete foundation. No piers will beallowed. Each dwelling shall have a primary roof pitch of no less than 6 on12. Metal chimneys shall be enclosed by brick, dryvit, or their equal on theexterior. Driveways extending from Vida Shaw Road may be gravel,limestone or other similar material. Parking areas immediately adjoining thedwelling shall be constructed of concrete or asphalt.

6. The roof of any building shall be constructed or covered with asphalt orcomposition shingles, or factory baked enamel corrugated ribbed panel metalroofing, or modern pre-finished metal roofing of good quality.

7. No dwelling previously constructed shall be moved in whole or in part on anylot in this subdivision.

8. No house trailer, mobile home, manufactured home, recreation vehicle, etc.shall be used as a dwelling in this subdivision.

9. No building shall be located on any lot in this subdivision nearer to the frontlot line than 75' (seventy five feet) measured from the roof edge. No dwelling,building or auxiliary building in this subdivision shall be located nearer to aninterior or side lot line than 5' (five feet) measured from the roof edge of thebuilding and no nearer to the rear lot line than 20' (twenty feet) measuredfrom the roof edge. No fence, wall or other similar structure shan be erectednearer to the front lot line than the front wall of the dwelling.Servitudes/easements for the installation and maintenance of utilities anddrainage facilities are reserved as shown on the recorded plat.NOTWITHSTANDING THE FOREGOING SETBACK LINES, no buildingshall be located on any lot within the area reserved for utility and/ordrainage easements as shown on the above reference£! subdivision plat.

10. Fences shall be permitted, however no fence, wall or other similar structureshall be erected nearer to the front lot line than the front wall of the dwelling.Barbed wire or similar type wire material shall under no circumstance beused for fencing. Hurricane fencing is permissible.

11. Natural gas storage tanks (butane) shall be allowed provided that, (a) alltanks shall be completely shielded from view of the neighborhood usingmaterials suitable for fencing as described in paragraph #10. (b) All tanksshall be located to !he rear of the main dwelling and their location shallcomply with side and rear lot line setbacks as described in paragraph #9.

12.No privyor outdoor toiletshall be allowed in this subdivision except for theuse of a builder or his employees during the period of construction of abuilding in this subdivision.

13. The lots in this subdivision shall not be filled by the owners or anyone else,above the grade set for the entire subdivision by the developer. The drainageon anyone lot shall under no circumstance be altered or restricted in anymanner that could in any way affect the drainage of any adjacent propertiesor drainage of the subdivision as a whole. This does not prohibit terracingaround the main dwelling a reasonable distance, or terracing for flowerbedsprovided that the drainage for the subdivision and the adjacent properties isnot, in any way, adversely affected.

14. No vacant lot in this subdivision shall be allowed to grow up in weeds andshall be maintained in accordance with applicable parish regulations.

15. No noxious or offensive activity shall be carried on upon any lot, nor shallanything be done thereon, which may be or may become an annoyance ornuisance to the neighborhood.

16. No structure of a temporary character, or basement, tent, shack, garage,barn or other out building shall be used on any lot at any time as a residence,either temporarily or permanently.

17. The keeping of animals, other than those generally recognized as householdpets is prohibited within this subdivision.

18. No signs shall be permitted in this subdivision except:

a. Such signs as the developer shall deem necessary to promote the salesof his lots.

b. One sign of not more than five (5) square feet advertising any houseor lot for sale.

c. Contractors' signs of not more that five (5) square feet during theperiod of construction only.

19. There shall be no dumping of any garbage or trash of any kind on any streetor lot in this subdivision, except for the collection of garbage, trash, etc. insanitary containers pending collection of garbage.

20. No trucks, vans, trailers, boats or any vehicle other than passenger cars willbe permitted to park on streets or on drives or yards in front of anyresidence for longer than a 12 (twelve) hour period. No vehicle shall beabandoned or junked in this subdivision by any lot owner nor shall he/shepermit others to do so.

21. Servitudes for installation and maintenance of utilities and drainage facilitiesare reserved as shown on the recorded plat; no structure may be constructedwithin said servitude area except fences. No planting or fences of any kindshall be allowed within such easement areas which will in any way interferewith, damage, or obstruct the installation or maintenance of any utilities insuch area, nor change or retard the flow of water through any drainagechannels in the area. Fences complying with Paragraph #9 and Paragraph#10 will be allowed along the side and rear boundaries of the lots providedthat no portion of the fence shall in any way interfere with, damage, orobstruct the installation or maintenance of any utilities and drainage.

22. Except for those improvements placed thereon by public authority or privateutility company, each lot owner shall maintain the easement areas of hisproperty continuously. The lot owner may enjoy full use of such area orareas, with the exclusions noted herein. However, he/she shall at all timesallow ingress and egress by properly constituted agents of such utility to theeasement area. .,.

23.Provision has been made by the developer for the installation of all utilitiesunderground, and no lot owner may erect above ground any extension ofsaid utilities. All electrical services to houses erected in the subdivision shallbe placed underground, and that portion from the terminals of the powerline to the residence shall be installed, underground, by the lot owner at hisexpense. All primaries and secondary shall also be placed underground.

24. No oil drilling, oil development operations, or mining operations of any kindshall be permitted upon or in any lot, nor shall tanks, tunnels, mineralexcavations, or shafts be permitted upon or in any lot. No derrick or anyother structure designed for use in boring oil or natural gas shall be erectedor permitted within this subdivision. This does not prohibit the development,outside of this subdivision area, of mineral production by directional drillingfrom adjacent properties. Appearer (Seller) reserves an oil, gas and otherminerals in, or under all of the property described herein.

25.These covenants are to run with the land, and shall be binding on all partiesfor a period of 20 (twenty) years from date of recordation hereof. Thesecovenants shall then be automatically extended for successive ten-yearperiods.

26. Invalidation of anyone of these covenants by judgment or court order shallin no way affect any of the other covenants, which shall remain in full forceand effect.

27. Enforcement of the covenants shall be by proceedings at law, or in equity,against any person or persons violating or attempting to violate anycovenant, either to restrain violation or to recover damages.

28. These restrictions may be amended by agreement of the owners of a majorityof the lots in Danielle Place Subdivision - Phase I and by agreement of theowners of a majority of the lots in Danielle Place Subdivision -Phase II.

THlJS DONE, SIGNED AND PASSED in the City of New Iberia, Parish of Iberia,

State of Louisiana, in the presence of the two undersigned competent witnesses who

have signed as such, together with the said Appearers and me, Notary, on the day
