For a measure that hassome of the simplest languageon the June ballot, Measure Yhas stoked some of the heavi-est fighting for a city ballotinitiative since the battle overbuilding heights almost threeyears ago.Its advocates say the meas-

ure restores creek habitat,provides a safe route to thebeach, and creates six acres ofparkland all without any

expense to the taxpayers.Its opponents say it’s just a

giveaway to the developerthat actual hurts the creek,doesn’t address major safetyissues, and accuse the “Yes”crowd of misleading the pub-lic into thinking the measure’sabout creek restoration.At its core, Measure Y is

about a bridge over ArroyoBurro Creek. This bridge isspecial because it’s part of aprivate development thatcrosses over public land des-ignated as “undeveloped

parkland,” hence only the cit-izens can allow the city coun-cil to permit its construction.Unlike some ballot measures,Measure Y’ is concise, onlyasking if the city councilshould permit the construc-tion, as many of the develop-ment details have alreadybeen settled in the normalplanning process.If constructed, the bridge

would allow vehicle access toa 25-unit housing projectknown as VeronicaMeadows. Without it,

the only other access pointwould be through Alan Road,and protests from residents ofthat street almost killed theproject when a bridgelessalternative had been pro-posed. The project is the brain-

child of developer Mark Lee,who’s been dragging the proj-ect through a landmine of citypermits, opposition from resi-dents, and the courtrooms.Lee said the Veronica

Civil Grand Jury findsproblems with how jail

staff handled 2011 suicideThe Santa Barbara Civil

Grand Jury found that jailstaff could have done a betterjob to prevent the suicide of a29-year-old man who died in2011.The inmate was found in

his bunk with a plastic bagover his head, with his leftfoot on the floor and his armover the bed. He was lying onhis back facing the front ofthe cell and his head behindan alcove wall.Although jail staff checked

on the inmate, who was in anisolation cell, throughout the

day, the civil grand jury deter-mined that staff did not doenough to make sure the manwas breathing or that theycould see his head to evenmake that determination.When the deputy noticed

that the man had a clear plas-tic bag over his head hequickly entered the cell. A deputy also found a

piece of vinyl fabric wrappedaround the dead man’s mouthand tied together at the backof his head.The inmate apparently tore

the cloth from his mattress.

He got the plastic bag fromstaff, which the food comesin. They are also handed outfor trash pickup.The grand jury determined

that there was no accountabil-ity for who is given a trashbag and how it is picked up.Video cameras in the hall-

ways also were not filmingthe day of the man’s death sothe grand jury could not see ifdeputies attempted to com-municate with the man beforehe died. The grand jury rec-ommended that the jail do abetter job to track the distri-

bution of plastic bags; thatthere be an attempt to imme-diately awaken an inmate if adeputy cannot tell if he isbreathing; that inmates’ headsare always in plain view andnot hidden behind walls; thatthe jail include 24/7 videomonitoring; and that mentalhealth staff review inmates’history and background todetermine if there is a needfor a suicide intervention.From 2009 through 2011

14 people had attempted sui-cide. The only death was inJuly of 2011.

OAK BROOK, Ill., May 24 - McDonald's Corp investorssoundly rejected a shareholder proposal that would have requiredthe world's biggest fast-food chain to assess its impact on child-hood obesity.The subject was a major topic of discussion at Thursday's annu-

al shareholder meeting, which also served as a send-off for retir-ing Chief Executive Jim Skinner - whose nearly eight years at thehelm will be remembered as a time when the price of McDonald'sstock tripled.The shareholder proposal, which also failed last year, returned

amid growing concern over the social and financial costs of obe-sity in the United States and around the world - not only in termsof healthcare-related expenses but also lower worker productivityand diminished quality of life.Nearly one-third of U.S. children are overweight or obese.

America is one of the fattest nations on earth, and the Institute ofMedicine, in a 2006 report requested by Congress, said junk foodmarketing contributes to an epidemic of childhood obesity thatcontinues to rise. U.S. Senate passes big FDA billThe U.S. Senate on Thursday showed near-unanimous sup-

port for a bill that helps fund the U.S. Food and DrugAdministration, a regulatory powerhouse with sweeping influ-ence over the foods Americans eat and the medicines they take.The bill, which passed by a vote of 96 to 1, aims to speed

approval of new drugs and devices and ensure food safety. Itreauthorizes fees from companies like Johnson & Johnson,Medtronic Inc and Roche Holding AG that help speed FDAevaluation of new medical products prior to approval. These so-called user fees could provide almost half of the FDA's pro-posed $4.5 billion budget for next year. The FDA regulatesproducts that make up about a quarter of the U.S. economy.

An obese person isn't inevitably at increased risk of cardio-vascular disease and death, a new U.K. study finds."The people really at risk are the ones who have obesity in

combination with other metabolic health risk factors," saidMark Hamer, a principal research associate at UniversityCollege London who worked on the study.The results are in line with most previous research that

defined metabolic health as having normal levels of markerslike blood pressure, blood sugar, HDL, or "good" cholesterol,and C-reactive protein, which is a measure of inflammation inthe body."People with good metabolic health are not at risk of future

Sometimes I feel likeI am bologna on wryI had one of those “aha”

moments the other day when Ifound mold in a piece offrozen bread. Isn’t that whywe freeze bread in the firstplace? To keep those grossgreen spores from invadingour otherwise pristine bakedgoods?It’s a metaphor, I realized.

My life is sandwichedbetween the beginning andthe end. I’m somewherebetween that fresh, hot-out-of-the-oven, mouth-watering,buttery baguette, and a dried-up end of old pumpernickelthat you’ve been saving in theback of the freezer for a sci-ence experiment. And themold is … ignore the mold. Itdoesn’t work in my metaphor,but it was gross and I thoughtI’d share.How did this happen? It

seems just a minute ago that Iwas in the middle of elemen-tary school, and now my sonis half-way through juniorhigh. Wasn’t it just yesterdaythat my mom was the onerunning errands for her par-ents and schlepping the kids

around town? Whyam I driving car-pool? Where are allthe adults?Shouldn’t there be agrownup here topass my overflowingplate of stresses andr e s p o n s i b i l i t i e salong to? I read a study

recently that says theaverage person willspend 17 years tak-ing care of a childand 18 years taking care of aparent. But my parents havebeen taking care of me formore than 40 years now andI’ve been “helping out” withthem for, well, I’m planningto start next week. Whichmeans they’ve got to live agood long time if we’re evergoing to even things up statis-tically.Again, I’m the grown-up?

When did I make the switchfrom having mom to cut thecrusts off my bread to beingthe one making sure we hadpeanut butter in the cabinetand cheese in the fridge?

like to keep, who shall there-fore remain nameless—thatthis kind of “whoops, I forgotJohnny” incident happens topeople with lots of kids all thetime. But, let’s face it, theyhave extra children, so leav-ing one of them behind byaccident is only a minor dis-aster. As an only child, Koss is

our not just our only contribu-tion to the future of the plan-et, he’s also our great whitehope for the future (a.k.a. our

retirement plan), so if some-thing were to happen to him,well, let’s just say that would-n’t be chopped liver. Although I think he’s

caviar, or whatever that reallyrare and precious Japanesefish is that people pay mil-lions of dollars for--he’s anopen-faced sandwich, with nosiblings to keep the ingredi-ents together. When eventual-ly it’s his turn to juggle thatmassive Dagwood sandwichmade up of his kids on oneside, us (his parents) on theother and him jammed in themiddle, he’ll have no one tohelp him. This does not bode well for

me, ‘cause he’s already killeda fish and lost a dog. Another “aha” moment:

development,” Lee said.But critics say it’s not responsible develop-

ment. Santa Barbara City Council memberCathy Murillo said the city shouldn’t handover public space for this kind of housing proj-ect.“I don’t think that the city should allow the

use of public parkland for private develop-ments, especially not luxury homes,” Murillosaid.Critics of the measure claim that the bridge

would be a disaster for the creek. They havesome potent ammunition according to the CityAttorney’s analysis which notes the project’sEnvironmental Impact Report for the projecthas listed the bridge as a Class 1 Impact, mean-ing significant and unavoidable impacts. Dan McCarter, a retired firefighter and Alan

Road resident, said that particular section ofcreek is better off than most other creeks in thecity. He points out that the environmentalimpact report says the very constructionprocess could cause irreparable harm to the

creek habitat.“You can’t call something restoration when

you’re permanently damaging it,” McCartersaid.Y proponents say there’s never been any

misrepresentation with regards to the VeronicaMeadows development. Lee said the develop-ment hasn’t been played up in campaign mate-rials because the initiative is approving thebridge, not housing.“The election’s not about the homes,

they’ve been approved,” Lee said.Steven Amerikaner, a land use attorney for

Lee, agreed, saying that the campaign hasspelled out what the initiative does.“We think our description of the project is

fair and accurate,” Amerikaner said. “And thevoters have a good, clean sense of what theissue is all about.”The “Yes” camp counters that the restora-

tion will more than make up for any damagedone by the bridge. Amerikaner said that thebridge takes up 30 feet, but the restoration cov-ers 1,800 square-feet.He also pointed to the six-acre park. The

project will clear out invasive species andrestore native vegetation. Trails, open spaces,and eating areas are options that the developerwill leave up to the city departments. “This is not going to be our decision, it will

be the city’s decision,” Amerikaner said.

Child smoking in Indonesiacould force class action suit(Reuters) - Anti-tobacco

advocates in Indonesia plan tofile a class action lawsuit thismonth using cases of childaddicts in the hope of forcingtougher regulations on a soci-ety where one in three peoplesmokes.It is a rare attempt of its

kind to constrain a tobaccoindustry which looks to theworld's fourth most populouscountry and its growingappetite for cigarettes toreplace dwindling sales else-where.The suit against tobacco

companies and the Indonesiangovernment argues that feebleregulation has left childrendangerously exposed to therisks of smoking."There are ... kids who

have fallen victim to theimpact of cigarette companiesand smoking. They areaddicted. In the context ofpeople's rights, the societyhas been disadvantaged bythe tobacco industry," head ofthe National Commission forChild Protection, AristMerdeka Sirait, said.Indonesia is something of a

paradise for both smokers andtobacco companies, with theworld's fifth largest popula-

tion of smokers. It is a widelytolerated habit and one whicheven in this relatively poorarchipelago most can affordto feed.And it is getting more pop-

ular as the economy grows. In1995, one in four Indonesianssmoked.Fifteen years later it had

risen to one in three.That in turn has tempted

international tobacco firms tojoin the hugely profitablehome-grown ones such asGudang Garam, P T Djarumand Hanjaya MandalaSampoerna, which is nowpart of Philip MorrisInternational.The government even

gives tax incentives for the

manufacture of hand-rolledcigarettes because it providessuch a major source ofemployment in east Javawhere the local firms congre-gate.Sampoerna said it had only

seen reports of the plannedlawsuit and could not com-ment. Other producers alsohad no immediate comment.A spokesman for the

Federation of IndonesianCigarette Manufacturers saidhe had heard of the suit butdeclined comment because itwas not aimed at the federa-tion."If a child is smoking is

Ilham Hadi has becomesomething of a poster childfor the anti-smoking cam-paign.He began smoking aged

four when his mother Nenahsaid she gave him 3,000 rupi-ah ($0.32) to buy snacks atschool. He bought a cigaretteinstead.The addiction has since

blackened his teeth, damagedhis skin and, his friends say,made the now nine-year old auseless soccer player andslow, wheezy runner."He sometimes bangs on

the window at 4 a.m. in themorning to buy a cigarette,"said Iin Indriyani, who runs atiny store from the front roomof her home around 100 yards(meters) up a winding pathfrom the two-room housewhere Hadi's family lives."Whenever he wants a cig-

arette he looks like he is in atrance," she told Reuters, say-ing that he sometimes hit herand her daughters to demandcigarettes.Hadi smokes two packs a

day, adding to the financialstress on his parents giventhat his father earns only $5-6per day as a laborer and part-time motor bike taxi driver.
