As the Santa Barbara County Board ofSupervisors pondered letting an environ-mental review of the Eastern Goleta ValleyCommunity Plan go forward, dozens ofresidents came to give their opinions.Sometimes dubbed “Noleta” as it’s

outside both the Goleta and SantaBarbara city limits, the Eastern GoletaValley is one of the most populated unin-corporated areas of the county at 36,000people. It hasn’t had a new communityplan since 1993, well before the city ofGoleta incorporated.While speakers had a wide variety of

concerns, the sticking point seemed to bethe rezoning of eight properties to allowfor more housing. The rezoning wouldnet the area another 626 units of housing.But residents worried it could be the

first step towards overdevelopment andthe loss of the valley’s semi-rural feel.Donald Stern said Los Angeles hadlooked very much like Santa Barbara in1949. But he claimed zoning changeslike the ones being proposed is whatturned it into the urban jungle it is today.“What you’re doing is the beginning

of what happened in Los Angeles andyou can’t go back on it,” Stern said.Other residents understood the need

for more housing, but felt more commu-nity input and oversight would be need-ed. Barbara Kloos, a member of theEastern Goleta Valley Coalition, said shecould approve of the plan as offered pro-vided the supervisors reinsert languageprotecting agricultural land.

“The 36,000 residents don’t want rede-velopment to be the dominant character-istic of Eastern Goleta Valley,” Kloossaid. But Kloos had some harsher lan-guage aimed at prospective developers. “For those that don’t live in our com-

munity and are looking to extract our lastavailable resources of land, we suggestyou look elsewhere for your insatiableneed for urban development,” Kloos said.But developers argued that the plan

did not seek to overdevelop the area.Craig Minus, a project manager at theTowbes Group, a major developer in thearea, said there is a balance between get-

ting more affordable housing in the areaand keeping the Valley’s character, andthat the Towbes Group has always beenconscious of that balance.He said Towbes has never built sky-

scrapers in Santa Barbara, but has pro-vided plenty of affordable housing proj-ects, public improvements, and support-ed the arts, jobs, and non-profits.“Now that is the type of ‘developer’

standing in my living room gazing out tothe sidewalk where neighbors passed bywhile my 3 year old watched some morn-ing program before we went outside toplay. I watched curiously as a transientcouple walked past my driveway andpaused. The woman was stumbling and strug-

gling to take a swig out of her 40 oz. beercan, so she had to stop walking for amoment. The man waited for her to finish her

drink and took the can from her for him-self. They continued on, stumblingdown the sidewalk of this residentialneighborhood. It was 9:00 a.m. If this neighborhood were anywhere

other than on the east side, near Milpas,it would not be tolerated and policewould be called promptly to deal withthese pedestrians. However, sadly, thisoccurs regularly on my street, and there'snothing I can do. I often chase away transients who sit

in front of my house between the parkedcars in the morning hours drinking theirbeers or smoking pot. I hate that my son is becoming old

enough to recognize the aberrant behav-iors, and we may be forced to move awayfrom our house, which was built by mygreat grandfather, because of the deterio-ration of our neighborhood.

It's not right. Casa Esperanza has donea disservice to this community by itsrepeated failures to protect the residentsand neighborhoods surrounding the shel-ter. Now can I say "Not In MyBackyard"?

Das wants to ban sugarydrinks on school campuses

California Assemblyman DasWilliams wants to ban the sale of sugary

sports drinks such asGatorade and Poweradeat middle and highschool campusesthroughout the state.Williams introduced

AB 1746 late last week.Sodas are already

banned on the campus-es, but AB 1746 would

make the energy and electrolyte replace-ment drinks also illegal.. Sodas and other beverages high in

sugar are among the most prominent fac-tors contributing to our nation’s obesityepidemic.

“This bill aims to set the example ofmaking healthful choices in life,” saidWilliams, D-Santa Barbara. “Researchshows that these sugary drinks directlyrelate to higher incidents of obesity andmany youth – and adults – are still con-suming them unnecessarily. These drinksshould not be a replacement for water.Williams said teachers shouldn’t have

to compete with sugary drinks to get stu-dents’ attention.“Teachers have a tough enough job as

it and I believe this will give a littlehelp,” said Williams, a two-term SantaBarbara City Councilman who grew upin Isla Vista. “A 32-ounce sports drinkhas 14 teaspoons of sugar. Kids jackedup on that much sugar have a harder timelearning.” Sports drinks or electrolyte replace-

ment beverages are designed to replacefluids after vigorous exercise of morethan hour straight. Research, Williamssaid, shows that sports drinks serve noadded benefit over water.The California Center for Public

Health and the California MedicalAssociation are sponsors of the bill.“Sports drinks are an inappropriate

option for California students,” said Dr.Harold Goldstein, executive director ofthe California Center for Public Health.“They were designed for athletes whohave been sweating for an hour or more,not for children as they walk across cam-pus or eat their lunch. In a blow to the oil and gas industry, a judge has ruled smalltowns in New York have the authority to ban drilling -- includ-ing the controversial method known as fracking -- within theirborders.In a ruling released late Tuesday, state Supreme Court Justice

Phillip Rumsey of Tompkins County held that the Ithaca suburbof Dryden's recent ban on gas drilling falls within the authorityof local governments to regulate local land use.Anschutz Exploration Corporation, which owns leases on

more than 22,000 acres in the town and has invested $5.1 mil-lion in drilling operations there, argued the ban violated a statelaw designed to create uniform regulations for oil and gasdrilling and encourage the extraction of those resources.Rumsey disagreed, holding the law was not written to favor

the industry, but to regulate it in such a way that “prevents waste... and protects the rights of all persons.”

Court upholds oil fracking ban

A woman pushing her child in a stroller in downtown ElPaso, Texas, was struck by an assault rifle bullet fired fromacross the border in Ciudad Juarez, Mexico, yesterday, mayorJohn Cook said.After Juarez police responded to a carjacking about half a

mile from the border, a gunfight broke out between police andthe carjackers, Cook said. A bullet -- a type used in assaultweapons such as M16s -- penetrated and exited the woman'scalf, he said.The unidentified woman, 48, who was shopping, was treated

at a hospital and released with minor injuries, and her child --whose age Cook did not know -- was not hurt, he said. Themother, a Mexican citizen, is a legal U.S. resident living in ElPaso, Cook said.“I don't think there's any reason for El Pasoans to panic or for

anyone else to panic,” Cook said. “El Paso still remains a verysafe large city.”

NEWSConsumer agency to examine overdraft feesWASHINGTON (Reuters) - The new

U.S. Consumer Financial ProtectionBureau is weighing a crackdown onchecking account overdraft fees chargedby banks, saying the charges can "inflictserious economic harm" on consumers.The agency said on Wednesday that it

will begin collecting information todetermine if banks are manipulating the

system to goose fees and whether theyare making it clear to customers howthey can incur overdraft charges.Consumer advocate groups have com-

plained that bank customers can get hitwith multiple $35 charges because theyaccidentally overdrew their account withsmall purchases such as a cup of coffee.The fees have brought in about $30

billion in annual revenue for the bankingindustry over the past few years.Overdraft fees have been a source of

tension between regulators and banks inrecent years, and the CFPB's announce-ment follows steps taken by other regula-tors, including the Federal Reserve andFederal Deposit Insurance Corp, inresponse to complaints.

With worries about cherished farm-land being lost to development, theGoodland Coalition announced it wouldbe seeking signatures for an initiative toprotect certain agricultural plots.At a Goleta City Council meeting

Coalition chairman Bob Wignot said thatthe initiative would require voterapproval to rezone Bishop Ranch, a par-cel in Ellwood Canyon, FairviewGardens, and a parcel west of GlenAnnie.While the council unanimously

stopped a developer from working on

Bishop Ranch last year, Wignot said itwould just take is three different citycouncil members to undo that decision.“Rezoning of our heritage farmlands

is too important to leave to the sole dis-cretion of a city council majority subjectto change every two years,” Wignot said.

Unified School District, spoke in supportof the plan. The district has the Tatumproperty which is not zoned for agricul-ture but would be rezoned to supporthigher density. Deacon said the district has no plans

to develop the property but with a $6million deficit, the district needs to keepits options open for potential fundingsources. “Because of the state budget crisis we

need to look at our assets, such as the

Tatum property, as possible revenuestreams so that we can support our stu-dents,” Deacon said.The supervisors tried to alleviate some

of the public’s worries. Second districtsupervisor Janet Wolf, who representsthe Eastern Goleta Valley, headed offsome fears by noting the parcel by Vonsis not affected by the general plan.First district supervisor Salud

Carbajal noted the board had to maintaina sense of balance between providingnew housing opportunities and keepingthe valley’s character. He felt the currentplan struck that balance.

“I know not everybody’s happy, but Ithink this is a good product,” Carbajalsaid.Wolf also supported the measure.

She thanked the community for comingin and noted to people who still hadconcerns that this would not be the lastword the Eastern Goleta Valley—shemade a point of not using the term“Noleta”—would have on the commu-nity plan.“While there’s going to be disagree-

ment, I think at the end we are going tobe a stronger community because of thisprocess,” Wolf said.

KITTY LITTER.How can these twoitty bitty words be

such a giant pain in the pos-terior for some cats and thepeople who love them? Ifyour finicky feline turns upher nose at her bathroomaccommodations, is pid-dling over the side of thebox or avoiding it altogeth-er, you’re not alone. Catsand their litter box habitshave left many of us befud-dled, but instead of just burying ourheads in the proverbial sand andignoring the situation, or worse, get-ting rid of our cats, let’s see if wecan, um, eliminate the problem.Two of the most important issues

for cats are the type of litter beingprovided and the placement and num-ber of litter boxes in the house. Let’stake a look at litter first. There aretwo main types: clumping and non-clumping. Clumping litter is sandyclay with small granules that forms aball around the urine for easy scoop-ing (making for a cleaner box, whichcats appreciate). Clumping litter con-trols odors better than the non-clump-ing variety, but it can be dustier,which can cause respiratory problemsin both people and pets. Non-clump-ing litter is coarse clay with large

granules so it produces lessdust and tracking. Thedownside is that it must becompletely dumped andreplaced on a regular basis(not fun for those of us withbad backs!). Studies showthat 9 out of 10 cats preferclumping (sandy) litter, inpart because the litter boxsmells better and the small-er granules are gentler ontender toes. This is especial-ly important if a cat has

been declawed (which I am vehe-mently opposed to, but that’s anothertopic for another column...).Now that we’ve talked about dif-

ferent types of litter, let’s address thescent issue. Scented litter is great forthe person and not so great for thecat. A certain area of the felinebrain—called the Rhinencephalon or“nose brain”—makes the catextremely sensitive to various odorsand it is this acute sense of smell thatcan cause a cat to avoid a box withscented litter. (Imagine yourselftrapped in an elevator with someonewearing a sickeningly sweet perfumeor overpowering cologne and you getthe idea.) Simply switching to anunscented brand of litter will oftensolve any litter box avoidance prob-lems.

Aside from scented litter, if yournormally fastidious feline suddenlytakes a detour around the litter box,chances are: 1) the box is not cleanenough (scoop out waste every day ifyou’re using clumping litter andcompletely change the litter everyweek), 2) the box is not positioned ina favorable location (put it in a low-traffic, yet easily accessible area ofyour home), 3) the box has a hood(most cats don’t like a covered box),or 4) your cat is ill. A cat with a uri-nary tract infection or diabetes maynot be able to hold their urine longenough to get to the box or they mayassociate the box with their painfulurination. A cat with arthritis mayfind it difficult to climb into the box(one with lower edges can help). Ifyour cat abruptly becomes pickyabout her potty, it’s time for a trip tothe veterinarian for a check-up.Here’s a tip: if you’re thinking of

switching to a new type of cat litter,it’s important to slowly make thetransition by putting an inch or so ofthe new product at the bottom of thelitter box and then pouring the oldbrand on top. Don’t mix it together;let your cat do the mixing (digging)herself. Gradually, over a 2-3 weekperiod, keep adding more of the newlitter and less of the old until the boxis completely filled with the new lit-

ter. Another helpful hint: be sure youhave enough litter boxes in yourhouse—the general rule is to haveone box per cat plus one. In otherwords, if you have two cats, youshould have three litter boxes; if youhave three cats, four litter boxes, andso on.By following these simple sugges-

tions, your cat will start peeing andpooping in the proper place in notime. Can you dig it?

After so many years in themortgage industry, I am sur-prised that so few people areaware of a financing optioncalled a "no-cost mortgage."You may also hear the term"reduced-cost mortgage,"which is a related mortgagestrategy. First, what IS a no-cost

mortgage? A no-cost mortgage is a

home loan for which the mort-gage lender pays all of the bor-rower's closing costs. The no-cost loan may be used either for pur-chase or for a refinance. With areduced-cost loan, most of the costs toobtain the loan are paid by the lender.In both cases, the lender may pay theescrow and title fees as well as thelender fees. Typically on no-cost loans, the bor-

rower pays the prepaid items and anyreserve accounts themselves, includingimpound accounts and reserves for taxesand insurance. (If the borrower choosesto pay impounds and reserves monthly,then these expenses are paid as part ofthe monthly mortgage obligation.)Be aware that a no-cost mortgage

generally includes a higher interest rate– in order for the no-cost loan to makesense, the overall financial 'snapshot' forthe borrower needs to be considered. Your mortgage lender can calculate

whether a no-cost loan is right for yoursituation. By taking a slightly higherrate for a loan, you may immediatelystart saving on your monthly payment.With a no-cost loan, you will not needto factor in the costs of the loan todetermine a break-even point, whereas,typically, you will need five to six yearsto break even when factoring in thecosts of a refinance. A properly struc-tured no-cost loan allows immediatesavings. If interest rates drop, a borrower may

then refinance again without losing the

money they paid on the previ-ous loan. The "catch" is thatyou'll take a higher interestrate – but you don't pay apenny to refinance. With a no-cost loan the bor-

rower is refinancing the cur-rent principal balance only.Nothing is added to the loanbalance. Be certain when com-paring loans to include settle-ment costs as well as rate andpoints.

Reduced-Cost Loan OptionThe total amount of the mortgage

may factor into the lender's decision ofwhether to offer a no-cost loan. For example, my colleague, Helene

Keddington, veteran Realtor in Oxnard,recently guided her client to inquireabout the no-cost loan. Helene has beenin the real estate business for over 28-years."Because the overall amount of the

loan was under $150,000, we were notfinally able to eliminate all the costsassociated with the financing of thehome - but my client, a first-time home-buyer, and had never heard of the terms'no-cost' or 'reduced-cost loans' at all.He was completely delighted to learn ofthe option." When you call your lender to ask

about these loan options, remember thata lender can guarantee only their ownfees; a lender cannot guarantee thirdparty fees. Third party fees are esti-mates, and a reputable lender will quotehonest estimates. Always insist on receiving estimates

in writing, as a verbal quote has novalue. If a lender cannot put an esti-mate with every closing cost itemized inwriting, then I recommend being verycautious about working with such alender. When you ask for a quote, ask to see

a comparison between the following: 1) paying standard closing costs; 2) a

reduced-cost loan option; and 3) a no-cost loan option. This way you are ableconsider the pros and cons of each strat-egy. Clients have asked, what is the disad-

vantage to a no-cost loan? Remember,the only disadvantage to a no-cost loanis that you will agree to a loan with ahigher interest rate, though it may beonly slightly higher, depending on cur-rent rates. Be certain to factor in any past refi-

nances and how much you've paid forthose loans. If you have just purchased aproperty, and paid your standard closingcosts, a no-cost loan might be a greatchoice.

No-Cost Loan May Protect AgainstBeing OverchargedFor this article, I interviewed a long-

time client I have dubbed The King ofthe No-Cost Loan: he has been able tobenefit from the logic of a no-cost loanstrategy several times over the years. He reported to me that he believes

the no-cost loan can actually be easierfor the consumer to understand. Whilethe interest rate might be slightly higherthan the lowest market rate available atthe time, the overall cost of the loan isless, which can be seen when comparingestimates from a reputable lender.

New Jersey Governor Christierecently made news by making a notso cogent comment concerningsocial change. Even though the twochambers of government in his statepassed a law (by a wide margin) tolegalize gay marriage, he decided toveto the proposal. A better idea, heclaimed, is to have a state-wide ref-erendum to determine what the"people" really want. (I thoughtthat's what our elected "representa-tives" were for.)Then he really stepped in it. Christie, a

well-educated lawyer, evidently let his con-servative ideology override his supposedintelligence. He claimed that the civil rights movement

of the 1950-60's would have preferred a refer-endum in the South instead of exposing them-selves to violent retribution at the hands ofblood-thirsty racists. Huh? Yeah...I bet thoseopen-minded segregationists were just dyingto make black folks feel more comfortable.Maybe let em walk on the same sidewalk inabout twenty years.Responding to a firestorm of indignation,

Christy expanded (a few days later) that "Thepolitical climate in the South didn't give themthe option to have a referendum backthen...meaning they would not win." Goodcatch there, Attorney Christie.

These political shenanigans havebeen going on forever and they justconfirm for me that society cannever legislate true tolerance, com-passion, and understanding. Yes, wecan create laws which prohibitunfairness and inequalities but thereal work of lasting social justicehas to take place in the human heart.And that starts with me. Have I

found the kindness and the claritywhich is being bestowed on meevery day? Have I eliminated blind

prejudice in my life?Can I see a fellow human being without

layers of preconceived judgement? Do I har-bor any arrogant desire to make everyonethink exactly the same way I do?Have I closed my mind and heart to the

possibility that I can learn something of valuefrom a stranger or a different culture?The answers to these questions are the true

building blocks to cultivate a kind and justsociety. The seeds of peace that need tosprout live in our own hearts. The sunshine ofour self-awakening and the rain from ourinherent goodness are all that's needed tomake this planet start to bloom with the mag-nificent colors that so many yearn to see.
