Subject: RULES AND REGULATIONS ON ANIMAL AIR TRANSPORT

Pursuant to Section of !epublic Act ""#, ot$er%ise &no%n as Animal 'elfare Act

of 199", t$e follo%ing re(uirements for animal transport are $ereb) promulgated for t$e

information, guidance and compliance of all concerned.

Section 1. BASIC POLIC AND OB!ECTI"ES

*t s$all be t$e dut) of t$e o%ner and operator of an) air public utilit) and air

transport aut$orit) transporting pet, %ildlife and all ot$er animals to provide in all

cases ade(uate, clean and sanitar) facilities for t$e safe conve)ance and deliver) ofsuc$ animals to t$eir consignee at t$e place of consignment. +es$e s$all ensure t$at

sufficient food and %ater for suc$ animals be made available %$enever necessar)

%$ile in carriage for more t$an t%elve -1/ $ours.

 

Section #. DE$INITION O$ TERMS

or t$e purpose of t$ese rules and regulations t$e follo%ing definitions are

adopted

.1  Animal Transport   refers to t$e mode of transport t$at %ould bring t$e

animal from t$e place of origin to t$e place of destination.

.  Air Transport refers to t$e transfer of animal from place of origin to

 place of destination b) air.

.2 Carriage refers to t$e process of conve)ing or transporting animals

from one place to anot$er. 3$is e4tends from t$e time t$e animals are

c$ec&ed5in to t$e time t$e) are released.

Section 3. CODE O$ PRACTICE ON ANIMAL AIR TRANSPORT

2.1 Animals t$at are transported b) air s$all conform %it$ t$e e4isting

rules, principles and regulations of t$e *nternational Air 3ransport

Association -*A3A/.

2.  Last In – First Out Concept   s$all be observed %$en loading and

unloading live animals.

2.2 aged animals s$all be placed in %ell ventilated room %it$ appropriate

temperature as indicated in t$e Appendi4 -Optimum 3emperature

2. Small domestic fo%ls s$all be transported in proper cages %it$

sufficient ventilation.

2.# *n case carriage e4ceeds 1 $ours, t$e s$ipper s$all provide food and

%ater %$enever necessar).

2.6 Airport aut$orities s$all provide a $olding area in t$eir respective

airports for animal sunder carriage. Provided, $o%ever, t$at in case of

emergenc), t$e) s$all also e4tend t$e necessar) assistance to t$eanimals.

2.; 3$e carrier or airport aut$orities s$all e4tend all t$e necessar)

assistance for t$e safet) and comfort of t$e animals %$ile in $oldingarea.

2." *n international and ma<or domestic airports, airport veterinar) officerss$all be available for acceptance and release of all incoming and

outgoing animals. ompetent officials suc$ as, but not limited to,

uarantine =eterinar), 'ildlife and ustoms aut$orities s$all beavailable at all times for t$e immediate release of t$e animals from t$e

$olding area.

 

Section 4. PENALT

An) person %$o violates an) provision of t$is Administrative Order s$all,

upon conviction of final <udgement, be punis$ed b) imprisonment of not less t$an si4

-6/ nor more t$an t%o -/ )ears or a fine of not less t$an One 3$ousand pesos-P1,000/ nor more t$an ive 3$ousand pesos -P#,000/ or bot$ at t$e discretion of t$e

court. *f t$e violation is committed b) an alien, $e or s$e s$all be immediatel)

deported after service of sentence %it$out an) furt$er proceedings.

Section %. SEPARABILIT CLAUSE

*n case an) provision of t$is rules and regulation is declared contrar) to la% or

unconstitutional, ot$er provisions %$ic$ are not affected t$ereb) s$all continue to be

in force and effect.

Section &. REPEALING CLAUSE

All Administrative Orders, rules and regulation and ot$er administrative

issuance>s or parts t$ereof, inconsistent %it$ t$e provision of t$is regulation are

$ereb) repealed or modified accordingl).

Section '. E$$ECTI"IT

3$is !egulation s$all ta&e effect fifteen -1#/ da)s after its publication in a

ne%spaper of general circulation.
