Our senior management team has just returned from an intensive 3-day principals’ summit in Queensland.

The event is completely unique, as it brings together directors from the leading real estate businesses across Australia and New Zealand in a non-competitive environment - no two companies from the same region are represented. Needless to say, collaboration and innovation thrive.

A highlight of this year’s agenda was leadership speaker Rachael Robertson, who shared insights of her time leading teams in one of Earth’s most challenging environments: Antarctica.

In summer, Rachael’s role was to keep a hectic research programme moving forward. During the boring winter months, her main role was to keep 18 strangers from killing each other who were confined in small spaces with total darkness outside for 6 months! Without a hint of irony,

she revealed that a $20million science program almost derailed over whether bacon should be soft or crispy!

Rachael spoke of the importance of collaborative environments, where leadership attributes are not confined to those ‘in charge’.

She’s also a big believer in the idea that ‘Respect Trumps Harmony’ - a philosophy very close to the heart of what Caporn Young is about. If you focus on harmony in an organisation, you stifle innovation and push any grievances underground.

Respect is much more important in the success of a team. For example, we are adopting the no ‘triangles’ at Caporn Young, meaning no one speaks to a third party about someone else, unless it’s something you would say if they were standing by your side. Man up, go direct and have an open and honest conversation.

Plenty of new learnings came out of the summit too - we’re feeling full of energy and fresh ideas to make your experience with Caporn Young even better.

A new property law that has been hyped in the media as “bizarre” and “shocking” is set to take effect on July 1 – but for the vast majority of buyers, it simply means obtaining one extra piece of paperwork.

The new law, which is aimed at reducing tax avoidance amongst foreign residents, will require all sellers of homes sold for $2million or more to produce a ‘Tax Clearance Certificate’, which will verify they are not a foreign resident for the purpose of the new measures.

Without this certificate, the seller will be treated as a foreign resident, regardless of their citizenship or the length of time they have lived in Australia. In this case, a 10 percent non-final withholding tax will be paid directly to the Commissioner following the sale of the property.

The tough new measure is a bid by the government to overcome low

levels of voluntary compliance of Capital Gains Tax amongst foreign residents who sell property in Australia. The amount paid to the Commissioner is not a final tax, and it will be credited against a person’s Australian tax liability once a tax return has been lodged.

Caporn Young chief executive Richard Young says the good news is that the necessary paperwork can be obtained easily, and without hassle. The Australian Taxation Office is implementing an automated process for issuing clearance certificates, which can be applied for by the seller, or the seller’s agent, online. The certificates can be applied for at any time, without cost, and are expected to be valid for 12 months.

“For Australian residents who are selling property in this price bracket, the most important fact to remember is that so long as you obtain your Tax Clearance Certificate, you will have

absolutely no problems,” Richard explains.

“You simply need to take the appropriate steps and to ensure compliance with the law. The ATO has indicated that, in straightforward cases, the clearance certificates are expected to be provided within days of the application being made. High risk and unusual cases may take longer than 28 days, so I encourage you to be proactive and get your Tax Clearance Certificate early in the process. This will minimise any risk of delays in the property settlement process.”

For buyers purchasing a property for $2million or more, your settlement agent will need to obtain a clearance certificate from the seller, or pay the prescribed amount to the Commissioner. The relevant amounts must be paid on or before the day the purchaser becomes the owner of the property.

“Whether you are a buyer, an Australian seller or a foreign resident seller, a good conveyancer will be able to guide you through this process and ensure you are abiding by the new laws. If in doubt, reach out to your local Caporn Young representative,” Richard adds.

“While we’re not tax lawyers, we are up-to-speed with the new requirements and we can point you in the direction of the appropriate experts and provide assistance where possible.”

Real estate changing hands for less than $2million is exempt from these new requirements. Detailed information on the new regulations is available on the Australian Taxation Office website www.ato.gov.au. Search term: ‘Foreign resident capital gains withholding payments’.
