Consider the following statements regarding AFSPA : 1. The AFSPA gives powers to the Army and Central forces deployed

in “disturbed areas” to kill anyone acting in contravention of law, arrest and search any premises without a warrant and provides cover to forces from prosecution and legal suits without the Centre’s sanction.

2. AFSPA is effective in the whole of Nagaland, Assam, Manipur (excluding the seven Assembly constituencies of Imphal).

3. In Arunachal Pradesh, it is in force in 16 police stations and in Tirap, Longding and Changlang districts bordering Assam.

4. Tripura withdrew AFSPA in 2015. 5. AFSPA is in force in whole of Meghalaya and Mizoram.

AFSPA, 1958 • Armed Forces (Special Powers) Act was passed in

1958. • It is a law with just six sections granting special

powers to the Indian Armed Forces in "disturbed areas" to bring back order in the disturbed areas.

• Any area which is declared ‘Disturbed’ under Disturbed Areas Act enables armed forces to resort to the provisions of AFSPA.

• The most controversial sections of AFSPA are:

o Section 4 : Enables security forces to “fire upon or otherwise use force, even to the causing of death” where laws are being violated( the assembly of five or more persons; or carrying of weapons)

o Section 6 : No criminal prosecution will lie against any person who has taken action under this act.

It is not in force in Meghalaya (except 20 kilometre area along Assam border) and Mizoram.

How is a region declared ‘disturbed’? Section (3) of the AFSPA empowers the governor of the state or Union territory to issue an official notification in The Gazette of India, following which the Centre has the authority to send in armed forces for civilian aid. Once declared ‘disturbed’, the region has to maintain status quo for a minimum of three months, according to The Disturbed Areas (Special Courts) Act, 1976. What is state government’s role? The state governments can suggest whether the act is required to be enforced or not. But under Section (3) of the act, their opinion can be overruled by the governor or the Centre.
