    performance in station by staff of CSN as follows:domestic ticket sales, ground handling and groundhandling agents, etc. Any department or staff in relationwithdomesticpassengerandbaggagedelivery,includingsales branch, department, office and ground handlingagentsshallfullyabidetheseConditions.

    REV 04Article1 Definitions1.1 ThefollowingtermsusedintheGeneralConditionsof

    InternationalCarriageforPassengerandBaggage(hereinafterreferredtoastheConditions)aredefinedasfollowsunlessotherwisespecified:

    1.1.1 CSNmeansChinaSouthernAirlinesCompanyLimited.1.1.2 Conventionmeanswhicheverofthefollowinginstruments

    thatisapplicable:TheConventionfortheUnificationofCertainRulesRelatingtoInternationalCarriagebyAir,signedatWarsaw,12October1929(hereinafterreferredtoastheWarsawConvention);TheWarsawConventionasamendedatTheHagueon28September

    1955

    (hereinafter

    referred

    to

    as

    the

    Hague

    Protocol);TheConventionfortheUnificationofCertainRulesforInternationalCarriagebyAir,doneatMontrealon28May1999(hereinafterreferredtoastheMontrealConvention).

    1.1.3 CSNsregulationsmeansrules,otherthantheConditions,published

    by

    CSN

    and

    in

    effect

    on

    date

    of

    publication,

    governingcarriageofpassengersand/orbaggageandshallincludeanyapplicabletariffsinforce.

    1.1.4 InternationalcarriagemeansaircarriageinaccordancewithaircarriagecontractbetweenCSNandthepassenger,whetherthereisabreakortransferinthetransportationor

    1.1.5 Carriermeansthepublicaircarriagecompanywhichissuesairtickets,carriesorundertakestocarrythe

    passengersandbaggagelistedinairtickets.Ticketingcarriermeansthecarrierwhosenumericcodeisindicatedincouponsofelectronicticketsales.Ticketingcarriershallbethecontrollerandauthorizerofelectronicticketsales.Marketingcarriermeansthecarrierwhoseairlinedesignatorcodeisrecordedincouponsasthecarrierthatoperates.OperatingCarriermeansthecarrierthatperformstheactualaircarriageandadditionalservices.Whentherearecertainbilateralagreements,suchascodesharingagreement,operatingcarrierandmarketingcarriermaynot

    bethesame.1.1.6 CSNauthorizedagentorauthorizedagentmeansa

    passengersalesagentwhohasbeenauthorizedbyCSNtorepresentCSNinthesalesofairpassengertransportationanditsrelevantservices.

    1.1.7 Passengermeansanyperson,exceptmembersofthecrew,carriedortobecarriedinanaircraftwiththeconsentofCSN.

    1.1.8 Childmeansanyperson2to11yearsoldonthedateofcommencementoftravel.

    REV 041.1.9 Unaccompaniedchildmeansanyperson5to11yearsold

    on the date of commencement of travel who travelswithout the company ofparents or any otherpassengerover18yearsold.

    1.1.10 Infantmeansanypersonwhoisundertheageof2onthedateofcommencementoftravel.

    1.1.11 Reservationmeansthereservationofseatandserviceclass,ortheweightandsizeofbaggageappointedbypassenger.

    1.1.12 Flightmeanstheflyingofaircraftaccordingtoscheduledroute,dateandtime.

    1.1.13 TicketmeanseitherthedocumententitledPassengerTicketandBaggageCheckortheElectronicTicketineachcaseissuedbyoronbehalfofCSNandincludestheconditionsofcontractandnoticesandtheflightand

    passengercouponscontainedtherein.1.1.14 ConjunctionticketmeansaticketissuedtoaPassengerin

    conjunctionwithanotherticketwhichtogetherconstituteasinglecontractofcarriage.

    1.1.15 Fixedticketmeansaticketwhosefilghtnumber,dateofflightarefixedandtheseatisreserved.

    1.1.16 Openticketmeansaticketwhosefilghtnumber,dateofflightarenotfixedandtheseatisnotreserved.

    REV 041.1.17 Flightcouponmeansthatportionoftheticketthatbears

    thenotation"goodforpassage",orinthecaseofanelectronicticket,theelectroniccoupon,andindicatesthe

    particularplacesbetweenwhichyouareentitledtobecarried.

    1.1.18 PassengercouponmeanstheportionofticketissuedbyoronbehalfofCSNandwhichissomarkedandultimatelytoberetainedbypassenger.

    1.1.19 Itineraryforaircarriageelectronicticket(hereinafterreferredtoasItinerary)meansthepaymentprooffor

    passengersprovidedbypublicaircarriagecompanyoritssalesagencyduringticketpurchasing.Oneitineraryis

    providedforeachelectronicticket,andcanbeprintedatlatestonemonthaftertheflightdeparture.Passengershall

    preserveitwellincaseofrefunds.1.1.20 Daymeanscalendardays,includingallsevendaysofthe

    week.Providedthat,forthepurposeofnotification,thedayuponwhichnoticeisdispatchedshallnotbecounted;andprovidedfurtherthatforthepurposesofdeterminingdurationofvalidity,thedayuponwhichtheticketisissued,orthedayuponwhichflightcommenced,shallnot

    becounted.1.1.21 Tariffsmeansthefares,chargesandrelevantrules

    publishedbycarriers.Whennecessary,tariffsmustbeapprovedbyrelevantdepartments.

    REV 04business/premiumeconomyclass/economyclassofvalidadultfare.Childrensfareandinfantsfarethatareestablishedasapercentageofanormalfarearealsoconsideredtobenormalfares.

    1.1.23 Specialfaremeansanyfareotherthananormalfare.1.1.24 Agreedtransitionpointmeansthepointofstay,other

    thantheoriginanddestination,stipulatedintheflightscheduleofticketofcarrier.

    1.1.25 Stopovermeansascheduledstopatacertainpointbetweenoriginanddestinationarrangedbypassengerandwiththeconsentofcarrier.

    1.1.26 Overbookingmeansthattheseatshavebeensoldexceedthebiggestallowanceoftheflight.

    1.1.27 Spillage means the spillage ofpassengers on a flightbecause of the aircraft type change or flight emergencecausedbymachineryoraircraftreadjustmentandetc.

    1.1.28 Codeshareflight means a carrier or several carriers usetheirownairlinedesignatorcoderespectivelyonanothercarriers operating flight in accordance with theiragreement.

    1.1.29 Deadlinetimeforcheck-inmeansthelatesttimestipulatedforpassengerby operating carrier to finish the check-informalities.

    1.1.30 Departuretimemeansthetimeofclosingcabindooraftertheboardingofpassengers.

    REV 04because they fail to finish check-in formalitiesbeforestipulated check-in deadline or because their traveldocumentsdontmeettherequirements.

    1.1.32 Mis-catchmeanspassengersfailuretoboardtheaircraftafterfinishingcheck-informalitiesattheoriginairportortransitairport.

    1.1.33 Wrong Boarding means passengers boarding a flightdifferentfromtheonelistedintheticket.

    1.1.34 Baggagemeanssucharticles,effectsandotherpersonalpropertyofthePassengerasarenecessaryorappropriateforwear,use,comfortorconvenienceinconnectionwiththetrip.Unlessotherwisespecified,itincludesbothcheckedanduncheckedbaggageofthePassenger.

    1.1.35 CheckedbaggagemeansbaggageofwhichCSNtakessolecustodyandforwhichCSNhasissuedabaggagetag.

    1.1.36 UncheckedBaggagemeansanybaggageofthePassengerotherthancheckedbaggage.

    1.1.37 Self-carebaggagemeansanybaggagewhich,withtheconsentofthecarrier,isweighedorcalculateditspieces

    bythecarrierandtakencareofbythepassengerthemselvesduringthejourneyincludingstayintransit

    points.1.1.38 Freehand-carryitemmeansanysmallitemwhich,with

    theconsentofthecarrier,istakenbypassengeronboardorduringthestayattransitpoints,withinthesortsandquantitylimitationofthecarrier.

    REV 041.1.39 Baggagecheckmeansthoseportionsoftheticket,

    whichrelatetothecarriageofthepassengerscheckedbaggage.

    1.1.40 BaggagetagmeansadocumentissuedbyCSNsolelyforidentificationofcheckedbaggage.

    1.1.41 Damageincludesdeath,injury,delay,loss,partiallossorotherdamageofwhatsoevernaturearisingoutoforinconnectionwithcarriageorotherservicesincidentaltheretoperformedbyCSN.

    1.1.42 Forcemajeuremeansanunusualandunforeseeablecircumstancebeyondcontrol,theconsequencesofwhichcouldnothavebeenavoidedevenifallduecarehadbeenexercised.

    1.1.43 Changefeemeansthechargeforpassengersvoluntaryrequestofchangingtheiroriginalflightreservation,includingflights,date,cabinandvalidity,etc.

    1.1.44 Endorsementmeanschangeofmarketingcarrier.

    Article2 Applicability2.1 Applicability2.1.1 GeneralRules2.1.1.1 Exceptasprovidedin2.1.2,2.1.3and2.1.4ofthischapter,

    theseconditionsapplytoallinternationalcarriagebyairofpassengersandbaggage,performedbyCSNforreward.

    2.1.1.2 TheseconditionsalsoapplytogratuitousandreducedfarecarriageexcepttotheextentthatCSNhasprovidedotherwiseinitsRegulationsorintherelevantcontracts,

    passesortickets.2.1.1.3 Theseconditionsalsoapplytothespecialinternational

    servicesexceptthatgovernmenthasprovidedapplicableregulations,

    or

    that

    CSN

    has

    provided

    otherwise

    in

    the

    relevantcontracts,passesortickets.

    2.1.2 Ifcarriageisperformedpursuanttoacharteragreement,theConditionsapplyonlytotheextenttheyareincorporatedbyreferencebythetermsofthecharteragreementandthecharterticketintothecontractofcarriage.

    2.1.3 Totheextentthatanyprovisioncontainedorreferredto

    hereiniscontrarytoanythingcontainedintheConvention,whereapplicableandanyapplicablelaws,governmentregulations,ordersorrequirementsthatcannotbewaived

    byagreementoftheparties,suchprovisionshallnotapply.The

    invalidity

    of

    any

    such

    provision

    shall

    not

    affect

    the

    2.1.4 Exceptforspecialagreementsasprovidedinspecificcontract,intheeventofinconsistencybetweentheseConditionsandCarriersregulations,theConditionsshall

    REV 04Article3 Tickets3.1 GeneralRules3.1.1 Theticketconstitutesprimafacieevidenceofthecontract

    ofcarriagebetweencarrierandthepassengernamedontheticket.CSNwillprovidecarriageonlytothepassengerholdingsuchticket,orholding,asproofofpaymentorpart

    payment,anyothercarrierdocumentissuedbyCSNoritsauthorizedagent.CSNticketisandremainsatalltimesthepropertyofCSN.TheconditionsofcontractcontainedintheticketareasummaryofsomeoftheprovisionsoftheseconditionsofCSN.

    3.1.2 Aticketisnottransferable.Ifaticketispresentedbysomeoneotherthanthepersonentitledtobecarriedthereunderortoarefundinconnectiontherewith,CSNshallnotbeliabletothepersonsoentitledifingoodfaithit

    providescarriageormakesarefundtothepersonpresentingtheticket.

    3.1.3 SometicketsaresoldatSpecialfareswhichmaybepartiallyorcompletelynon-refundable.Youshouldchoosethefarethatbestsuitstoyourneeds.

    3.1.4 RequirementsforTicketUsing3.1.4.1 Intheeventofusingapaperticket,apersonshallnotbe

    entitledtobecarriedonaflightunlessthatpersonpresentsaticketvalidanddulyissuedinaccordancewithCSNsRegulationsandcontainingtheflightcouponfortheflightandallotherunusedflightcouponsandthepassenger

    REV 04coupon.ApassengershallfurthermorenotbeentitledtobecarriediftheticketpresentedismutilatedorifithasbeenalteredotherwisethanbyCSNoritsauthorizedagents.

    3.1.4.2 Passengersnameontheticketmustbethesamewiththeidentityinformationprovidedbythepassenger;otherwiseCSNhastherighttorefusecarryingthepassenger.

    3.1.4.3 Forelectronictickets,ifthecouponofthesectorwhichpassengerrequeststocheckinisnotunusedandvalid,CSNhastherighttorefusecarryingthepassenger.

    3.1.4.4 CSNwillhonorflightcouponsonlyinsequencefromtheplaceofcommencementoftravelasshownontheticket.

    3.1.4.5 Eachflightcouponwillbeacceptedforcarriageintheclassofservicespecifiedthereinonthedateandflightforwhichaccommodationhasbeenreserved.Whenflightcouponsareissuedwithoutareservationbeingspecifiedthereon,spacewillbereservedonapplicationsubjecttotheconditionsoftherelevantfareandtheavailabilityofspaceontheflightappliedfor.

    3.2 PeriodofValidity3.2.1 GeneralRules3.2.1.1 Aticketisvalidforcarriageforoneyearfromthedateof

    commencementoftravel,orifnoportionoftheticketisusedortheticketisanopenticket,fromthedateofissuancethereof.

    3.2.1.2 Thevalidityofaticketiscountedfromthemidnightonthedateofcommencement,orifnoportionoftheticketisused,fromthemidnightonthedateofissuance,tillthe

    3.2.1.3 Thevalidityofaticket,whichisissuedinaccordancewithspecialfare,issubjecttotheapplicablerulesforthespecialfarebyCSN.Passengermustfinishallthesectorslistedintheticketwithintheperiodofvalidity.Ifthespecialfaretickethasspecialstipulationontraveldates,

    passengermustfinishallthesectorslistedwithintheperiodofvaliditystipulated.

    3.2.1.4 Period of validity of tickets with more than one sectorshallbecalculatedfromthedateofcommencementofthefirsttravelundertheticket.

    3.3 ExtensionofValidity3.3.1 GeneralRules3.3.1.1 Ifapassengerispreventedfromtravelingwithinthe

    periodofvalidityoftheticketbecauseofoneofthefollowingreasonbyCSN,thevalidityofsuchpassengerticketwillbeextendeduntilCSNsfirstflightonwhichspaceisavailableintheclassofserviceforwhichthefarehasbeenpaid.

    1 CSNcancelstheflightonwhichthepassengerholdsareservation;

    2 CSNomitsascheduledstop,beingthepassengersplaceofdeparture,placeofdestinationorastopover;

    3 CSNfailstooperateaflightreasonablyaccordingtoschedule;

    5 CSNchangestheclassofservice;6 CSNisunabletoprovidepreviousconfirmedspace.

    3.3.1.2 Whenapassengerafterhavingcommencedhisorherjourneyispreventedfromtravelingwithintheperiodofvalidityoftheticketbyreasonofillness,CSNwilldecidewhethertoextendtheperiodofvalidityofsuch

    passengersticketsinaccordancewithCSNsregulationsapplicabletothefarepaidandthemedicalcertificate.CSNwillextendsimilarlytheperiodofvalidityofticketsofothermembersofthepassengersimmediatefamilyaccompanyinganincapacitatedpassenger.

    3.3.1.3 Intheeventofdeathofapassengerenroute,theticketsofhisorherimmediatefamilyaccompanyingmembermay

    bemodifiedbyextendingthevalidity,orrefundedinaccordancewithinvoluntaryrefundsregulations.Anysuchmodificationandrefundshallbemadeuponreceiptofaproperdeathcertificateandanysuchextensionofvalidityshallnotbeforaperiodlongerthan45daysfromthedateofdeathshownonthedeathcertificate.

    3.4 LossofPaperTicket3.4.1 GeneralRules

    Passengershallbeliableforthelossofunusedtickets,flightcoupons,miscellaneouschargesordersorexchangecouponsofMCO,oranyotherdocumentsfortransportation.CSNwillnotberesponsibleforanyeffectonsuchpassengersitinerary.CSNwilldecidewhetheror

    REV 04nottorefund,replacesuchdocumentsinaccordancewithitsconcernedregulationsandcertaincondition.PassengerhasnorighttoclaimthatCSNmustrefundorreplacesuchticketsordocuments.

    3.4.2 ReportofLossofTicket3.4.2.1 Incaseoflossormutilationofaticket,orpartthereof,or

    non-presentation ofaticketcontainingthepassengercouponandallunusedflightcoupons,thepassengermustreportinwritingtoCSNoritsauthorizedagents.Such

    passengershallcompletetheformofApplicationandIndemnityAgreementforLostTicket.Formalitiesofreportingthelossofgroupticketsmustbedonebeforethedeadlinetimeofcheck-in.Reportoflosscannotbedoneonticketsofcharterflights.

    3.4.2.2 Whenreportingforlossofaticket,thepassengermustadvisethedateandplaceofissuanceandtheagentcouponoritscopyoftheoriginalticketandpresentproofoflosssatisfactorytoCSN.Ifthereporterisnotthe

    passenger,valididentitydocumentsofthereporterandthepassengermustbeproduced.

    3.4.2.3 Ifsomeoneotherthanthepersonentitledtobecarriedortoberefundedhastraveledwithorrefundedtheticket,CSNshallnotbeliabletothepersonsoentitled.

    3.4.3 Re-issuanceofLostTicket3.4.3.1 Onprinciple,afixedticket,oncelost,cannotbeallowed

    tobereissued.Butonspecialoccasions,afteritsapprovedbyCSNsdirectsalesdepartmentwhichdeals

    3.4.3.3 CSNhastherighttorefusetoreissuelostticketswhichhavenotbeenconfirmed.Inthatcaseifpassengerrequeststocontinuetotravel,passengershouldpurchaseanewticketatfaresapplicablethen.

    3.4.4 DeadlineforRefundingLostTicketsThedeadlineforrefundingticketspurelyoperatedbyCSNis60daysafter13monthsfromthedateofcommencementoftravel,orthedateofissuanceifno

    3.6 SequenceandUsageofCoupons3.6.1 Ticketpurchasedbypassengerisonlyapplicableforthe

    transportationfromtheorigintodestinationviatheanyagreedtransitionpointaslistedontheticket.Thefare

    paidbypassengerisbasedonCSNstariffrulesandthetransportationlistedontheticket.FareisthebasiccontentofthetransportationcontractbetweenCSNand

    passenger.3.6.2 Couponsofticketmustbeusedinthesequencelistedon

    theticket.Couponsthathavebeenusednotinsequenceshallberefundedaccordingtotherefundrestrictionsofcorrespondentclasswithintheperiodofvalidity.

    7.1.2 Ifthepassengerfailstoarriveintimeatthedesignatedcheck-inlocationorboardinggateorappearsimproperlydocumentedorfailstoprovideanacceptableticketandnotreadytotravel, CSNmaycancelthespacereservedforthepassengerandwillnotdelaytheflight.CSNisnotliabletothepassengerforlossorexpenseduetothe

    passengersfailuretocomplywiththeprovisionsofthisArticle.Ifthepassengerwishesarefund,theamountofsuchrefundshallbeprocessedinaccordancewiththevoluntaryrefundregulations.

    8.8.5 Ifapersonclaimingthebaggageisunabletoidentifythebaggagebythebaggageidentificationtag,CSNwilldeliverthebaggagetosuchpersononlyonconditionthatheorsheestablishestoCSNssatisfactionhisorherrightthereto.AndifrequiredbyCSN,suchpersonshallfurnishadequatesecuritytoindemnifyCSNforanyloss,damageorexpensewhichmaybeincurredbyCSNasaresultofsuchdelivery.

    8.8.6 Acceptanceofbaggagebythebearerofthebaggagecheck,withoutcomplaintatthetimeofdelivery,isprimafacieevidencethatthebaggagehasbeendeliveredingoodconditionandinaccordancewiththecontractofcarriage.

    8.9 Un-deliveredBaggageIfbaagageisnotcollectedafter90daysfromthenextdayofbaggagesarrival,CSNhastherighttoprocessitaccordingtotheregulationsonun-deliveredbaggage.

    8.10.2 IfthecheckedbaggagefailstoarriveinthesameflightwiththepassengerduetoCSNreasonsandtherebycauseinconvenienceforpassengerslife,CSNshouldgiveappropiatecompensationforpassengerstemporarylifeuse.

    8.11 Compensationforbaggage8.11.1 CompensationLimit8.11.1.1 AccordingtoMontrealConvention,intheeventof

    8.11.2 Timelimitationonclaimsandactions8.11.2.1 Noticeofclaims

    1 No action shall lie in the case of damage to checkedbaggageunlessthepersonentitledtodeliverycomplainstoCSNforthwithafterthediscoveryofthedamage,and,atthe latest, within seven working days from the date ofreceipt; and in the case of delay, unless the complaint ismade at the latest within twenty-one working days fromthedateonwhichthebaggagehasbeenplacedathisorherdisposal.Everycomplaintmustbemadeinwritinganddispatchedwithinthetimesaforesaid.

    2 Anyclaimsshouldberaisedinwrittenformwithintimelimit,ornocompensationshouldberaisedtowardsCSN.

    Article11 Refunds11.1 GeneralRules11.1.1 OnfailurebyCSNtoprovidecarriageinaccordancewith

    thecontractofcarriage,orwhereapassengerrequestsavoluntarychangeofhisorherarrangements,refundforanunusedticketorportionthereofshallbemadebyCSNaccordingtoCSNsRegulations.

    11.1.2 Exceptinthecaseoflosttickets,refundswillonlybemadeonsurrendertoCSNofthepassengercouponor

    passengerreceiptandsurrenderofallunusedflightcoupons,andtheconjunctionticketsifany.Forelectronictickets,refundmustbeappliednotlaterthan13monthsafterthedateofcommencementoftravelorthedateofissuance(forallfirstflightcouponunusedticket).ApplicationforrefundwillonlybeacceptedwhenthecouponsstatusisOPENFORUSE,andwithpayment

    proofprovidedbypassenger.11.2 Personreceivingrefundedfares11.2.1 CSNshallbeentitledtomakerefundtotheperson

    11.2.5 Whenrefundinganelectronicticket,passengerisrequiredtoprovideprinteditinerary.

    11.3 TimelimitforrefundRefundmustbeappliednotlaterthan13monthsafterthedateofcommencementoftravelorthedateofissuance(forallfirstflightcouponunusedticket).Applicationforrefundwillnotbeacceptedafterthetimelimit.

    11.4 Placeofrefund11.4.1 Onprinciple,refundofticketsandMCOshallbe

    processedintheoriginalplaceofpayment;exchangedticketscanalsoberefundedintheplaceofexchange.Intheeventofinvoluntaryrefund,refundcanbeprocessedinCSNssalesofficeintheplaceoforginalpurchase,commencementofjourney,stopover,orbreakpointoftravel,orinCSNsauthorizedsalesagenciesintheplacewherethecauseofinvoluntaryrefundhappens.

    11.4.3 Whenpassengerholdinganopenticketappliesforrefund,refundmustbeprocessedintheoriginalplaceofissuance.

    11.5 CurrencyAllrefundswillbesubjecttoGovernmentlaws,rulesandregulationsorordersofthecountryinwhichtheticketwasoriginallypurchasedandofthecountryinwhichtherefundisbeingmade.Refundswillnormallybemadeinthecurrencyinwhichtheticketwaspaidfor,orinanothercurrencyinaccordancewithCSNsregulations.

    11.6 InvoluntaryrefundsInvoluntaryrefundmeansanyrefundappliedforby

    passengerentitledtotravelonCSNsflightswhocannotbecarriedaccordingtocarriagecontractduetosuchuncontrollableorunpredictablereasonsasweather,airtrafficcontrol,aircraftmaintenance,flightreadjustment.InvoluntaryrefundcanbeprocessedatCSNssalesofficesintheplaceoforiginalpurchase,commencementof

    journey,stopover,breakpointoftravel,oratCSNsauthorizedagenciesintheplacewherethecauseofinvoluntaryrefundhappens.

    equaltothefarepaidincludingtaxesandchargesshallberefunded,withoutchargingrefundfee;

    11.6.1.2 Ifaportionofthetickethasbeenused,subtracttheamountofindividualorgroupfareontheusedsectorsandsubtracttheamountofusedtaxesandcharges,andrefundtheremainingamount.Therefundedamountshallnotbehigherthantheamountpaid.Norefundfeeshallbecharged.

    11.6.1.3 Iftheflightlandsatanairportotherthantheappointedstopoverandflightofthesamedayiscancelled,andifthe

    passengerdemandsforrefund,farefromthelandedairporttothedestinationatthesamediscountrateorsub-classwiththeoriginalpaidfareshallberefunded,buttherefundedamountshallnotbehigherthanthepaidamount;norefundfeeshallbecharged.Applicablecarrierfarefromlandedairporttodestinationshallbechosenon

    priority.Iftherearenopublishedfaresfromlandedairporttodestination,fareofothermeansoftransportationfromlandedairporttodestinationshallberefunded.Wheretherearemorethanoneapplicablefaresofasamemeansoftransportation,themediumoneshallbechosen.

    11.6.1.4 Changefeeshallbepaidbypassengerwhorequiresflightchangeofhis/herownwill.Whenthechangedflightisnot

    tothefarepaid,lessanyapplicableservicechargesorcancellationfees;

    11.7.1.2 Ifaportionofthetickethasbeenused,therefundwillbeanamountequaltothedifferencebetweenthefarepaidandtheapplicablefarefortravelbetweenthepointsforwhichthetickethasbeenused,andsubtractrefundfeesandnoshowfeesifany.

    11.7.1.3 Specialregulationswillbeappliedtotheticketwithaspecialfarepaid.

    11.8 RefundtoCreditCardorDebitCardAccountsRefundforTicketspaidwithcreditcardsordebitcardscanonlybecreditedtothecardaccountoriginallyusedfortheTicketpurchase.TherefundableamounttobepaidbyCSNwillbeinaccordancewiththeruleswithinthisarticleonly,onthebasisoftheamountoriginallypaidby

    passengerandthecurrencyenteredintheticket.Iftheresanydifferenceofamountcausedbycurrencyexchange,

    passengerisnotentitledtoclaimdamagestoCSN.

    11.10 RefusalofrefundExceptforinvoluntaryrefund,departmentsconcernedshallrefusetorefundinanyoneormoreofthefollowingsituations:

    11.10.1 Refundisappliedforafterthetimelimitofrefund;11.10.2 Passengerfailstopresentvalidcertificatesorticketsor

    proofsonapplyingforrefund;11.10.3 Whentheapplicablefareofusedsectorsisequaltoor

    higherthanthatofthewholejourney,theunusedsectorscannotberefunded;

    11.10.4 Ticketisannotatednon-refundable.11.11 Onrefunding,passengerspaidbutunusedtaxesand

    chargesshalberefundedtogether.Taxesandchargesofticketwhichisnon-refundableorhasnoapplicableremainingamountforrefundcanalsoberefundedalonewithoutextracharge,butmustberefundedbeforethetimelimitofrefund.

    11.12 Refundduetopassengersillnessshallbeprocessedasvoluntaryrefund.

    11.13 Unlessotherwisespecified,childrenshallbechargedthesamerefundfeeasadults,andinfantsareexemptfromrefundfee.

    Article12 ConductAboardAircraft12.1 Ifpassengerconductshimselforherselfaboardtheaircraft

    soastoendangertheaircraftoranypersonorpropertyonboard,orobstructsthecrewintheperformanceoftheirduties,orfailstocomplywithanyinstructionofthecrew,orbehavesinamannertowhichotherpassengersmayreasonablyobject,CSNmaytakesuchmeasuresasitdeemsnecessarytopreventcontinuationofsuchconduct,includingrestraintofthepassenger.Passengermaybedisembarkedandrefusedonwardcarriageatanypointand

    passengermaybeprosecutedforoffencescommittedonboardtheaircraft.

    12.2 Passengermaynotoperateaboardtheaircraftportableradios,electronicgames,laptopcomputer,digitalcameraortransmittingdevicesincludingradiocontrolledtoysandwalkie-talkies.ThepassengershallnotoperateanyotherelectronicdevicesonboardwithoutCSNspermission,exceptthatportablerecorders,hearingaidsandheart

    pacemakersmaybeused.12.3 Non-SmokingFlights

    AllCSNflightsarenon-smokingflights.Smokingisprohibitedinallareasoftheaircraft.

    12.4 RestrictiononAlcoholicDrinksWhileaboardaircraft,passengerisnotallowedtodrinkanyalcoholicdrinksotherthanthoseprovidedbyCSN.

    13.1.1 Thecarriageisprohibitedbyanyapplicablelaws,regulations,orordersoftheState;or,

    13.1.2 Passengerdoesnotabidebythelaws,regulations,orordersoftheState,ordoesnotabidebyCSNsregulations;or,

    13.1.3 Passengerrefusestosubmittosecuritycheckconductedbygovernment,airportorcarrier;or,

    13.1.4 Passengerfailstobeproperlydocumentedaccordingtoconcernedlaws,regulations,orders,requests,orrequirementsoftravelconditions;or,

    13.1.5 Passengerrefusestocomplybytheinstructionsonlimitationofexitseatsmadebycabincrewofstaffofauthorizedcompanyandformulatedbyoperatingcompany;or,

    13.1.6 Passengerdoesnotcomplybyinstructionsofcabincrew;or,

    13.1.7 Exitseatistheonlyseatsuitableforpassengerduetopassengersphysicaldisablity;or

    13.1.8 SuchactionisnecessaryduetoreasonsofweatherorotherreasonsuncontrollableforCSN;or,

    13.1.9 Theapplicablefareoranychargesortaxespayable

    13.1.11 Thepersonpresentingtheticketcannotprovethatheorsheisthepersonnamedintheticket;or,

    13.1.12 Passengerisover9months(36weeks)pregnant;or,13.1.13 Passengerislessthan14daysold;or,13.1.14 Theconduct,age,ormentalorphysicalstateofthe

    passengerissuchastounsuitableforairtravel,orcausediscomfortormakehimselforherselfobjectionabletootherpassengersorinvolveanyhazardorrisktohimselforherselfortootherpersonsortoproperty;or,

    13.1.15 Passengerhasbeendiagnosedwithseriousinfectiousdisease,andfailstopresentanymedicalproofthatnecessarymeasurehavebeentakentopreventinfectingothers;or,

    13.1.16 CSNdeterminesthatpassengermaybeunabletocomprehendoroperatesafetyinstructionsundertheir

    physicalormentalconditionswithoutassistancefromflightattendants;or,

    13.1.25 Passengersconduct,onpurposeornot,mayendagerthesafetyofaircraftorpassengersonboard.

    13.2 ArrangementforpassengerswhosecarriagehasbeenrefusedDuringCSNsrunningandoperation,whenrefusalof

    passengercarriagehappens,departmentsofcarriageserviceshalltreatthepassengerswhosecarriagehasbeenrefusedconsequentiallyaccordingtoCSNsPassengerSalesManualandGroundServiceandHandlingManual.

    Article14 ArrangementsforAdditionalServices14.1 If CSN makes arrangements forpassenger with any third

    partytoprovideanyservicesotherthancarriagebyair,orifCSNissuesaticketorvoucherrelatingtotransportationorservices (other than carriageby air)providedby a third

    party, such as ground transportation, hotel reservations orcarrental,CSNdoessoonlyaspassengersagentandCSNtakesnoresponsibilityfortheavailabilityorthequalityofsuchservices.Thetermsandconditionsofthethirdpartyserviceproviderwillapply.

    14.2 IfCSNprovidesgroundtransportationforpassenger,theseConditions of Carriage shall not apply to such groundtransportation.

    withalllaws,regulations,orders,demandsandtravelrequirementsofcountriestobeflownfrom,intoorover,andwithCSNsRegulationsandinstructions. CSNshallnotbeliableforanyaidorinformationgivenbyanyagentoremployeeofCSNtoanypassengerinconnectionwithobtainingnecessarydocumentsorvisasorcomplyingwithsuchlaws,regulations,orders,demands,andrequirements;orfortheconsequencestoanypassengerresultingfromhisorherfailuretoobtainsuchdocumentsorvisasortocomplywithsuchlaws,regulations,orders,demands,requirements,rulesorinstructions.

    15.2 Thepassengershallpresentallexits,entry,healthandotherdocumentsrequiredbylaws,regulations,orders,demandsorrequirementsofthecountriesconcerned,and

    permitCSNtotakeandretaincopiesthereof. CSNreservestherighttorefusecarriageofanypassengerwhohasnotcompliedwithapplicablelaws,regulations,orders,demandsorrequirementsorwhosedocumentsdonotappeartobeinorder,orwhodoesnotpermitCSNtotakeandretaincopiesthereof.

    15.3 ThepassengeragreestopaytheapplicablefarewheneverCSN,onGovernmentorder,isrequiredtoreturna

    passengertohisorherpointoforiginorelsewhere,owingtothepassengersinadmissibilityintoacountry,whether

    15.4 IfCSNisrequiredtopayordepositanyfineorpenaltyortoincuranyexpenditurebyreasonofthepassengersfailuretocomplywithlaws,regulations,orders,demandsandtravelrequirementsofthecountriesconcernedorto

    producetherequireddocuments,thepassengershallondemandreimbursetoCSNanyamountsopaidordepositedandanyexpendituresoincurred. CSNmayusetowardssuchexpenditureanyfundspaidtoCSNforunusedcarriage,oranyfundsofthepassengerinthe

    possessionofCSN.15.5 Ifrequired,thepassengershallattendinspectionofhisor

    herbaggage,checkedorunchecked,bycustomsorothergovernmentofficials.CSNisnotliabletopassengerforanylossordamagesufferedbythepassengerthroughfailuretocomplywiththisrequirement.

    15.6 Thepassenger shall submit to any security checksbygovernmentorairportofficialsorbyCSN.

    Article16 PassengerServices16.1 Unlessotherwisespecified,in-flightmealsshallbe

    providedbyCSNfreeofcharge.However,CSNmaychargeextrafeestoservicesbeyondthestipulatedvarietiesandquantityaccordingly.

    16.2 Exceptasotherwisespecified,CSNdoesnotprovidegroundtransferservicewithinairportareasorbetweenairportsorbetweenairportsandtownterminals.CSNisnotliablefortheactsoftheproviderofsuchgroundtransferservices. CSNwillnotbeliablefortheactsoromissionsofanythingdonebyanagentorrepresentativeofCSNinassistingthepassengertomakearrangementsforsuchtransferservice.

    16.3 Passenger shall pay for expenses of hotelaccommodationattheconnectionpoint.

    16.4 If illness happens topassenger during air carriage, CSNshall take active measures and do itsbest to save the

    passenger.16.5 Servicesforabnormalflights16.5.1 Iffightsaredelayedorcancelledatoriginduetosuch

    reasonsasaircraftmaintenance,flightreajustment,orflightcrew,CSNshallprovideaccommodationsto

    passengersaccordingtoregulationsconcerned.16.5.2 Ifflightsaredelayedorcancelledatorigindueto

    Article17 LiabilityforDamage17.1 CarriageconductedbyCSNissubjecttotherulesand

    limitationsrelatingtoliabilityestablishedbytheConventionunlesssuchcarriageisnotinternationalcarriagetowhichtheConventionapplies.

    17.2 IncarriagewhichisnotinternationalcarriagetowhichtheConventionapplies:

    17.2.1 CSNshallbeliablefordamagetoapassengerorhischeckedbaggageonlyifsuchdamagehasbeencausedbyCSNsactsoromissionsdonerecklesslywithintenttocausedamageandwithknowledgethatsuchdamagewouldprobablyresult.

    bodilyinjuryshallbelimitedtotheapplicablelaw.17.3 Totheextentnotinconflictwiththeforegoingand

    whetherornottheConventionapplies:17.3.1 CarriageconductedbyCSNandothercarriersaccording

    baggagecheck.17.3.2 CSNisnotliablefordamagetouncheckedbaggageunless

    suchdamageiscausedbyCSNsactsoromissionsdonerecklesslywithintenttocausedamageandwithknowledgethatsuchdamagewouldprobablyresult.

    17.3.3 CSNisnotliableforanydamagearisingfromitscompliancewithanylawsorGovernmentregulations,ordersorrequirements,orfromfailureofthepassengertocomplywiththesame.

    17.3.4 If the weight of thebaggage is not recorded on thebaggagecheck,itispresumedthatthetotalweightofthechecked baggage does not exceed the applicable free

    baggage allowance for the class of service concerned, asprovided in these Conditions. If in the case of checkedbaggage a higher value is declaredpursuant to 8.6.1, theliability of CSN shallbe limited to such higher declaredvalue.

    17.3.5 CSNsliabilityshallnotexceedtheamountofprovendamages.CSNshallfurthermorenotbeliableforindirectorconsequentialdamages.

    17.3.6 CSNisnotliableforinjurytoapassengerorfordamagetoapassengersbaggagecausedbypropertycontainedinsuchpassengersbaggage.AnypassengerwhosepropertycausesinjurytoanotherpersonordamagetoanotherpersonspropertyortothepropertyofCSNshall

    17.3.7 IfitemsattachedtoorwithincheckedbaggageaslistedinProvision8.1.2arelostordamaged,CSNisonlyliableaccordingtothelimitationofdamageforgeneralchecked

    baggage.17.3.8 Ifapassengeriscarriedwhoseageormentalorphysical

    conditionissuchastoinvolveanyhazardorrisktohimselforherself,CSNshallnotbeliableforanyillness,injuryordisability,includingdeath,attributabletosuchconditionorfortheaggravationofsuchcondition.

    17.4 InternationalcarriageasdefinedintheConvention,issubjecttotheliabilityrulesoftheConvention.WhereinternationalcarriageisnotsubjecttotheliabilityrulesoftheConvention,CSNsliabilityforanydamagewithrespecttothecarriageofpassengersandbaggage,shallbeassetforthintheMontrealConvention.
