Terms and Conditions of Sale
Credit Terms: Cross Nurseries offers net 30 day credit terms. If you would wish to establish credit, please contact our office for a Credit Application.
Service Charge: A service charge of 1.5% per month (18% annual) is charged on past due accounts. We reserve the right to change this rate with 30 days written notice.
Credit Cards: We accept Visa, MasterCard, Discover and American Express. Due to the rise in credit card processing fees, we will now charge a 2% fee on credit card payments used to pay an Accounts Receivable balance held 30 days or more.
Sales Tax: Under the Minnesota Sales and Use Tax Law, we are required to collect 7.125% tax on all gross sales of tangible personal property made in Minnesota unless we are presented with a Certificate to the effect that the property purchased is for resale or that the sale is otherwise exempt from sales tax. The law requires us to presume all sales are taxable unless an exempt status is established. Sales to Out-of-State customers are exempt. If you are a Minnesota customer or picking up in MN, please furnish us with a signed Certificate of Exemption (ST3 Form) or we will be obliged to collect sales tax.
Prices: All prices in this catalog are F.O.B. Lakeville, MN and are subject to change without notice. Our prices do not include boxing and baling. There is no charge for loading. Our competitive prices are based on current conditions.
Shipping - Delivery: Cross Nurseries ships mainly by Motor Freight, FED-EX, SPEE-DEE or similar freight haulers. Local deliveries are made using Priority or OnTime Couriers. All shipments travel at the buyers risk and expense. Customer is responsible for supplying labor and equipment for unloading. Call for quotes on shipping or delivery pricing.
If plant material is shipped Motor Freight, then freight charges will be due within 10 days from invoice date.
All plant material shipped FED-EX or SPEE-DEE requires special packing. These charges will be added to your invoice at cost and not subject to any discounts.
Cancellation: Sometimes it becomes necessary to cancel an order. Please provide as much notice as possible, either in writing or by phone.
Restocking Fee: A restocking fee of 10% will be charged for returns and for cancellations made within 7 days of scheduled delivery.
Claims – Warranty: All orders are accepted subject to crop conditions, and we reserve the right to cancel any portion of any plant, should injury befall the plants from hail, wind, frost and any other condition. We are careful to keep our varieties true to name and will replace, at our option, any portion of the stock that may prove otherwise, or refund the price paid. We will not be responsible for any other expenses, losses or any inconvenience which the purchaser may sustain as a result thereof.
Will Call: All Will Call Orders are pre-pulled. Please phone at least two days in advance with desired pick up date. Sufficient time must be allowed to finish loading by the posted closing time, as stated below. When picking up an order, please bring a tarpaulin or suitable covering to protect your nursery stock.

Substitutions: Often orders are booked early before plants have been graded and tagged. If the size ordered is not available, a substitute size of the same variety will be made. Please inform us when ordering, if substitutions are not acceptable. If a major change is necessary, we will call to discuss.

Do not allow roots to dry out at any time when you are handling your plant material.
Keep out of the sun, wind and freezing temperatures.
If possible store bare root material in a refrigerated storage area or store plants in a cool, humid room.
Plants may be heeled in sand, sawdust or wood chips for a longer period of time.
If material has been frozen in transit, thaw out material very slowly. It should not be handled until thawed.
Sweating Bare Root Plants: To provide a warm, humid environment for bud break, lay down the plants to be sweated, in the shade. Cover with wet packing material, such as a rug. Be sure the plants are kept moist. Ideal temperatures should range between 45 and 70 degrees. When the buds begin to swell, the plants are ready to pot or line out. If after a week the buds have not begun to swell, do not become alarmed. In some instances, bud break can take several weeks.

Volume Discount: Our volume discount is based on the total purchases of nursery stock, at current catalog prices, from July 1st to June 30th. The amount used to determine your volume discount does not include sales tax or freight. We will issue a ‘Credit Memo’ in July after your account has been paid in full.
