Whereas the draft of the Karnataka (Prevention of Illegal Mining, Transportation and Storage of Minerals)
(Amendment) Rules, 2011, was published as required by sub-section (1) of Section 23(C) of Mines and Minerals
(Development and Regulation) Act, 1957 (Central Act 67 of 1957) in Notification No. CI.327:MMM.2010, dated: 16.7.2011
in Part IV-A of the Karnataka Gazette Extraordinary dated: 19.7.2011 inviting objections and suggestions from all persons
likely to be affected thereby within thirty days from the date of its publication in the official Gazette.
And whereas the said Gazette was made available to the public on 19th July, 2011.
And, whereas no objections and suggestions have been received by the State Government, in respect of the said
draft:
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 23(C) of Mines and Minerals
(Development and Regulation) Act, 1957 (Central Act 67 of 1957), the Government of Karnataka hereby makes the
following rules, namely:-
RULES
1. Title and Commencement:- (1) These rules may be called "The Karnataka (Prevention of Illegal Mining,
Transportation and Storage of Minerals) (Amendment) Rules, 2011.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Amendment of rule 4:- In the Karnataka (Prevention of Illegal Mining, Transportation and Storage of Minerals)
Rules, 2011 in rule 4, sub-rules (3) and (7) shall be omitted.

Whereas in the Notification No.SARIE 300 SAEPA 2007, dated:18.03.2008, issued under sub-section (1)(i) of
section 67 of the Motor Vehicle Act 1988 (Central Act 59/of 1988), the Government of Karnataka issued direction to the
Karnataka State Transport Authority and Regional Transport Authorities regarding the fixing of fares and freights
(including maximum and minimum) in respect of Air conditioned city taxies.
Whereas the Government of India have increased the prices of fuel from time to time and the cost of the vehicles
and maintenance cost has increased considerably and also at present, there are many motor cabs of different models
operating as Taxis (with air condition and without air condition) and keeping in view, the maximum number of taxis that
are operating, the Government has considered it necessary to issue the following directions to the Karnataka State
Transport Authority and Regional Transport Authorities to revise the fares and freights of taxis.
In exercise of the powers conferred under sub-section(1)(i) of section 67 of Motor Vehicles Act 1988 (Central Act
59 of 1988), the Government of Karnataka in partial modifications of all directions issued in this behalf in the Notification
dated: 18-03-2008, issue the following directions to the Karnataka State Transport Authority and Regional Transport
Authorities namely:-

The Karnataka State Transport Authority and Regional Transport Authorities are hereby directed to fix the
following fares and freights for the Air conditioned City Taxies with engine capacity not less than 1200 CC and operating
within 25 Kms radius from City limits of all the cities in Karnataka State for Transportation of Passengers and their
luggages with immediate effect.

Hire Charges for Air Conditioned
Taxies Rs. 70.00 (4km) Rs.17.50
Waiting Charges Free for the first 20 minutes and thereafter Rs.10/- per 15 minutes or part thereof
Luggage Charges No charges for the first 120 Kgs. (Suitcase, Bedding etc.,) and Rs.5/- for every
additional 20 Kgs. or part thereof
Night Charges From midnight 12 O’ clock to morning 6. A.M ten percent extra on the above fare

Whereas the draft of the Karnataka General Service (Pre-University Education Department) (Recruitment to the
cadre of Lecturers of Government Pre-University Colleges) (Special) Rules, 2011 was published as required by sub-section
(1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in
Notification No.ED 60 TPU 2010 dated 16th September 2011 in part-IV-A of the Karnataka Gazette dated 16th September
2011 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from the date of
its publication in the official Gazette.
And whereas said Gazette was made available to the public on 16th September 2011.
And whereas the objections and suggestions received within the period specified above, have been considered by
the Government.
Now therefore in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the
Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the
following rules, namely:-
RULES
1. Title and commencement.- (1) These rules may be called the Karnataka General Service (Pre-University
Education Department) (Recruitment to the cadre of Lecturers of Government Pre-University Colleges) (Special) Rules,
2011.
(2) They shall come into force from the date of their publication in the official Gazette
(3) Notwithstanding anything contained in the Karnataka Civil Services (General Recruitment) Rules, 1977 or in the
Karnataka General Service (Pre-University Education Department) (Recruitment) Rules, 1996 or in any other rules of
recruitment relating to the categories of posts specified in the schedule made or deemed to have been made under the
Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the provisions of these rules, shall apply to the 1765
direct recruitment vacancies for the category of posts of Lecturers in the Government Pre-University Colleges as specified
in the said schedule:
Provided that nothing in these rules shall apply to more than one recruitment.
2. Definitions.- (1) In these rules, unless the context otherwise requires,-
(a) “Appointing Authority” means the Director, Department of Pre-university Education;
(b) “CAC” means Centralised Admission Cell , functioning under the Department of Public Instruction;
(c) "Schedule" means the schedule appended to these rules;
(d) “Special Recruitment Committee” means Recruitment Committee constituted under rule 3.
(2) Other words and expressions used but not defined in these rules shall have the same meaning assigned to them
in the Karnataka Civil Services (General Recruitment) Rules, 1977.
3. Constitution of special recruitment committee.- The State Government shall, by notification, constitute a
special recruitment committee at the state level consisting of the following members namely:-

(i) The Director, Department of Pre-university Education – Chairman.
(ii) The Director, Social Welfare Department or his representative
not below the cadre of Joint Director - Member
(iii) The Director, Backward Classes and Minorities or his representative
not below the cadre of Joint Director - Member
(iv) The Joint Director (Administration),
Department of Pre-university Education – Member
(v) The Special Officer, Centralized Admission Cell,
Department of Public Instruction – Member - Secretary
4. Qualification and age.- No person shall be eligible for direct recruitment under these rules unless he has,-
(a) passed Master Degree at least in Second Class in a subject specified in corresponding entries in column (3) of the
Schedule with a Bachelor Degree of Education (B.Ed.)or its equivalent;
and
(b) has attained the age of eighteen years but has not attained the age of,-
(i) forty five years in case of the Scheduled Castes, the Scheduled Tribes and Category – I of other Backward
Classes;
(ii) forty three years in case of Category II(a), Category II(b), Category III(a), Category III(b) of other Backward
Classes; and
(iii) forty years in case of others.
Provided that the persons having Master Degree at least in Second Class in Economics, Commerce and Statistics
subjects shall pass Bachelor Degree of Education (B.Ed.) or its equivalent; subject to the norms to be prescribed by the
NCTE in future within four years from such prescription.
5. Application for recruitment.- The special recruitment committee shall take necessary steps to invite
applications from eligible candidates by advertising in the Karnataka Gazette, specifying the conditions of eligibility,
method of recruitment, provisional number of vacancies subject wise to be filled and their classification. An abstract of
such advertisement shall be published at least in two leading newspapers having wide circulation in the state of which
one shall be in Kannada.
6. Competitive examination for selection.- (1) The special recruitment committee shall make necessary
arrangements to conduct a competitive examination through Centralised Admission Cell in the form of an objective
multiple choice examinations.
(2) The special recruitment committee shall constitute an expert committee which shall consist of,-
(a) Director of Pre-University Education - Chairman
(b) Joint Director (Administration and Examination), Pre-University Education - Member
(c) Experts in the concerned subject - Members
(3) The expert committee shall prepare question papers and evaluate the papers.
(4) The paper shall be set by the expert committee in Kannada and English medium. A candidate may answer the
papers either wholly in Kannada or wholly in English but not in both.
(5) The Kannada Language paper shall carry 150 marks and shall be of 3 hours duration. The paper shall be of the
standard equivalent to that of first language Kannada at S.S.L.C level. The questions shall be of multiple choice type. The
candidate shall secure a minimum of 50 marks in order to get eligibility for selection. However the marks secured in the
Language paper shall not be considered for the preparation of the merit list.
6240 (6) The specific papers shall consist of the paper 1 and 2 which shall be in the concerned subject in which the
candidate has passed the qualifying post graduate examination. Each paper shall carry 150 marks and shall be of 3 hours
duration. The expert committee shall prepare question paper in both Kannada and English versions. The candidate may
answer the paper either in Kannada or in English. The visually impaired (Blind) candidates certified by the expert
committee shall be provided the scribe facility by the expert committee as per rules. The valuation of Multiple Choice
questions shall be done on the basis of negative marks valuation in case of wrong answers. Quarter mark shall be
deducted for each wrong answer. The syllabus for these papers shall be the same as prescribed for main examination
specified in the Karnataka Recruitment of Gazetted Probationer’s (Appointment by Competitive Examination) Rules, 1997.
The marks secured in specific papers shall be reckoned for the preparation of the merit list.
7. List of selected candidates.- (1) The special recruitment committee shall from among the candidates who have
applied in pursuance to the advertisements under rule 5 and on the basis of marks obtained in the specific papers of the
competitive examination and subject to the conditions specified in rule 6 and subject to the orders in force from time to
time relating to reservation in appointments or posts, prepare the merit list of candidates equal to the number of
vacancies notified.
(2) If two or more candidates have secured equal percentage of marks in the qualifying examination, the order of
merit in respect of such candidates shall be fixed on the basis of their age, the elder in age being placed above the younger
in the order of merit. The special recruitment committee shall prepare a final selection list of candidates in respect of each
category of post accordingly.
(3) The special recruitment committee shall also prepare an additional list of such of the candidates not included in
the main list prepared under sub-rule (1). The number of candidates to be included in the additional list shall be as far as
possible 10% of the number of candidates in each of the reservation categories (horizontal and vertical) in the list under
sub-rule (1). There shall atleast be one candidate in the additional list belonging to each of the reservation categories
(horizontal and vertical) represented in the list under sub-rule (1). If a candidate whose name is included in the list under
sub-rule (1) fails to report for duty within the prescribed period, then a candidate belonging to the same reservation
category as of the candidate who failed to report for duty shall be appointed from the additional list.
(4) The select list prepared under sub-rule (1), shall be published in the official Gazette and shall be valid till all the
vacancies specified under these rules are filled up or until the expiry of the period of six months from the date of
publication of the list prepared under sub-rule (3) whichever is earlier.
8. Appointment of candidates.- (1) The special recruitment committee shall send the list of the candidates
selected under rule 7 to the Appointing Authority. The candidates whose names are included in the main list sent by the
special recruitment committee shall be appointed by the Appointing Authority in the vacancies in the order in which the
names are found in the main list after satisfying itself, after such enquiry as may be considered necessary that each
candidate is suitable in all respects for such appointment.
(2) The inclusion of the name of the candidates in the list published under rule 7, shall not confer any right of
appointment. The candidates in the additional list may be appointed in the post, not exceeding the extent of unfilled
vacancies in the main list.
9. Application of other rules.- The Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957, the
Karnataka Civil Services (Conduct) Rules, 1966, the Karnataka Civil Services (Probation) Rules, 1977 and all other rules
for the time being in force regulating the recruitment and conditions of services of Government servants made or deemed
to have made under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in so far as such rules are
not inconsistent with the provisions of these rules shall be applicable to the selection made and to the persons appointed
under these rules.

Whereas the draft of the following rules further to amend the Karnataka Civil Services (Direct Recruitment by
Competitive Examinations and Selection) (General) Rules, 2006, was published as required by clause (a) of sub-section (2)
6244 of section 3 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notification No. DPAR 26 SCR
2011 dated: 21.09.2011 in part IV A (P.R.No. 845) of the Karnataka Gazette dated: 21.09.2011 inviting objections and
suggestions from all persons likely to be affected thereby within fifteen days from the date of its publication in the Official
Gazette.
Whereas, the said Gazette was made available to the public on 21.09.2011.
And whereas, no objections and suggestions have been received in this behalf by the State Government.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the
Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) the Government of Karnataka hereby makes the
following rules, namely:-
R U L E S
1. Title and Commencement:- (1) These rules may be called the Karnataka Civil Services (Direct Recruitment by
Competitive Examinations and Selection) (General) (Fifth Amendment) Rules, 2011.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Amendment of rule 8.- In the Karnataka Civil Services (Direct Recruitment by Competitive Examinations and
Selection) (General) Rules, 2006 (hereafter referred to as the said rules) in rule 8, after sub-rule (3) the following shall be
inserted namely:-
“(4) The Commission shall in accordance with the provisions of sub-rule (1) or (2) as the case may be, also prepare an
Additional List of candidates not included in the list prepared under sub rule (1) or (2) in which the number of
candidates to be included shall as far as possible not exceeding fifty percent of the vacancies in respect of
technical posts and ten percent of the vacancies in respect of non-technical posts notified by taking into
consideration the policy of reservation in direct recruitment (both vertical & horizontal reservation) and the same
shall be inforce for a period of one year from the date of publication”.
3. Amendment of rule 9.- In rule 9 0f the said rules, for sub-rule (3), the following shall be substituted, namely:-
“(3) The candidates whose names are included in the additional list prepared under sub-rule (4) of rule 8 may be
similarly appointed only in case and to the extent of candidates whose names are included in the list prepared
under sub-rule (1) or (2) of rule 8 and to whom order of appointment has been issued do not assume charge of
the post to which they are appointed by the appointing authority within the joining time prescribed”.
4. Amendment of rule 10.- In rule 10 of the said rules, after sub-rule (3), the following shall be inserted, namely:-
“(4) The Appointing Authority shall in accordance with the provisions of these rules, also prepare an Additional List
of candidates not included in the final list in which the number of candidates to be included shall as far as
possible not exceeding ten percent of the vacancies notified by taking into consideration the policy of reservation
in direct recruitment (both vertical & horizontal reservation).
(5) The candidates whose names are included in the additional list prepared under sub-rule (4) may be similarly
appointed only in case and to the extent of candidates whose names are included in the final list and to whom
order of appointment has been issued do not assume charge of the post to which they are appointed by the
appointing authority within the joining time prescribed.”

Subject: Devolution of funds to the Panchayat Raj Institutions and Urban Local Bodies on
the recommendations of the Third State Finance Commission

PREAMBLE:
In the Government Notification read at (1) above, Government had constituted the Third State Finance
Commission (TSFC) as required under Article 243-I and 243-Y of the Constitution of India to review financial position of
the Panchayats (PRIs) and Municipalities/Urban Local Bodies (ULBs) and make recommendations to the Governor
regarding matters affecting their finances. The terms of reference of this Commission are detailed in the said notification.
The TSFC has submitted its final report to the Government in December 2009. As the recommendations of the Second
State Finance Commission (SSFC) were implemented from 2006-07 to 2010-11, the recommendations of the TSFC have to
be implemented from financial year 2011-12 until 2015-16.
On devolution of finances, the main recommendations of TSFC are as follows:
a. 33% of the Net Own Revenue Receipts (NORR) of the State Government should be distributed to
the PRIs and ULBs, out of which 23% should be provided to PRIs over and above salary
expenditure of PRI officials and remaining 10% should be provided to ULBs.
b. Grants to Gram Panchayats (GPs) should increase from existing Rs.338 crore to Rs.804.50 crore
per year.
c. Grants amounting to Rs.600.50 crore per annum should be given to Zilla Panchayats (ZPs) and
Taluka Panchayats (TPs). Out of this untied grants ranging from Rs.5 to 10 crore per annum
should be given to ZP based on rural population and untied grants ranging from Rs.1 to 4 crore
per annum to Taluk Panchayats based on their backwardness.
Subsequently the Government analysed the report of the TSFC and examined in detail the implementabilty of the
recommendations with regard to devolutions and its overall implications on the available resources of the State if the
recommendations are accepted in full. If the recommendations on devolution are accepted fully, then the total devolution
to the local bodies will increase from existing 40% to 52.3%. The increase in devolution to local bodies would be 76% in
2011-12 as compared to 2009-10, with a corresponding increase of only 40% in Non Loan Net Own Revenue Receipts
(NLNORR) over the same period. Funds left with the State Government for its overall responsibilities would be limited
to the balance 47.7% of NLNORR, devolution of central taxes and borrowings limited by the fiscal deficit. Only Rs.2671
crore out of the total incremental growth of NLNORR would be available with the State Government for the entire increase
in its expenditure over two years.
A clear inference from this analysis is that the responsibilities of the State Government (both development and
regulatory) have not been considered appropriately in the recommendations even though the terms of reference of the
TSFC had mandated it to do so. In view of the above, the Government is of the view that the implementation of the
6246 recommendations of TSFC in to will have severe adverse impact on financial ability of the Government to shoulder its
overall responsibilities and hence the following order:

After having studied the recommendations of TSFC on devolution, the Government in partial modification of
these recommendations, is pleased to order the following:-
1. The recommendations of the TSFC as modified by this Government Order would be applicable from FY
2011-12 to FY 2015-16.
2. Total funds to be devolved to local bodies is increased from the current 40% to 42% of the Non Loan Net
Own Revenue Receipts (NLNORR) of the State;
3. Out of this 42%, 32% of NLNORR would be assigned to PRIs. This would be inclusive of their salary
expenditure;
4. In the case of ULBs, their share would be increased from the current 8% to 10% of NLNORR (including their
salary expenditure), over a four year period by increasing the share by 0.5% every year as shown below:

5. During the TSFC implementation period, devolution to ULBs would be under the categories of Entry Tax
Devolution and Other Devolution. Since the entry taxes are largely collected in the urban areas, the entire
entry tax proceeds would be assigned to the ULBs. The entry tax collection in 2011-12 is estimated to be
around Rs.1510 crore, which will be around 3.3% of the NLNORR. This amount would be devolved directly.
The balance required share to ULBs would be met under ‘Other Devolution’. Hence the devolution under
the heads Entry Tax Devolution and Other Devolution would be as follows:

6. To ensure that the overall mandated devolution to ULBs is achieved annually as per the targets fixed at
para 4 above, any shortfall in actual collection and transfer of Entry Tax (i.e. below 3.3% of NLNORR),
would be made good by transfer of equivalent additional funds under ‘Other Devolution’ to the ULBs.
7. It is desirable to have a system where all components being earmarked under Global Protection and Global
Provision, attributable to a particular ULB, are earmarked in the same ULB’s SFC allocation after applying
the devolution formula on the entire SFC allocation. For a start, from F.Y 2012-13 onwards salaries,
pension contribution and power sector dues would be clubbed together and earmarked in the individual
ULB’s allocation as per devolution formula. However over the implementation period of TSFC, efforts would
be made to earmark debt servicing also from individual ULB allocation. Urban Development Department
would separately issue a G.O indicating the devolution formula to be used for inter-se allocation of TSFC
funds among ULBs.

8. For the Panchayat Raj Institutions, following annual grants would be provided:
a. Rs. 8 lakh per Gram Panchayat (G.P)
b. Rs. 1 crore per Taluka Panchayat (T.P)
c. Rs. 2 crore per Zilla Panchayat (Z.P)

the Distillery as he deems fit. The distiller shall provide suitable office accommodation and furniture for the use of the
staff”.

Distillery Licence", serial number 8 and the entries relating thereto shall be omitted.

No. 100/KT-LA/5/2011: - Whereas, the seat of Shri B. Sreeramulu in the Legislative Assembly of the Karnataka
State, elected from 93-Bellary (ST) Assembly Constituency, has become vacant on 13-10-2011, by reason of his
resignation; and
2. Whereas, a bye-election is to be held for the purpose of filling the vacancy so caused;
3. Now, therefore, in pursuance of sub-section (2) of Section 150, and Sections 30 and 56 of the Representation of
the People Act, 1951 (43 of 1951), the Election Commission of India hereby:-
(A) Calls upon the said 93-Bellary (ST) Assembly Constituency in the State of Karnataka to elect, before the 07-12-
2011 (Wednesday) and in accordance with the provisions of the said Act and of the rules and orders made there
under, a person of the Schedule Tribe of the State, for the purpose of filling the said vacancy in the Legislative
Assembly of the State; and
6254 (B) Appoints, with respect to the said election:-
(a) the 11.11.2011 (Friday), as the last date for making nominations;
(b) the 12.11.2011 (Saturday), as the date for the scrutiny of nominations;
(c) the 15.11.2011 (Tuesday), as the last date for the withdrawal of candidatures;
(d) the 30.11.2011 (Wednesday), as the date, on which a poll shall, if necessary, be taken;
(e) the 07.12.2011 (Wednesday), as the date before which the election shall be completed, and
(C) Fixes the hours from 8.00 A.M to 5.00 P.M, as the hours during which the poll shall, if necessary, be taken on
the date specified above for the election.

Whereas the draft of the following rules further to amend the Karnataka grant of land in case of construction of
dwelling houses in occupied land rules, 1999 which the Government of Karnataka proposes to make in exercise of the
powers conferred by section 197 of the Karnataka Land Revenue Act, 1964 (Karnataka Act 12 of 1964) is hereby
published as required by sub-section (1) of section 197 in Notification No. RD 111 LGP 2011, dated 08.09.2011 published
in part IV-A of the Karnataka Gazette (Extraordinary) dated 20.10.2011 inviting objections from all the persons likely to
affect thereby fifteen days from the date of its publication in the official Gazette.
Whereas the said Gazette was made available to the public on 20.10.2011.
And whereas no objection and suggestion have been received by the State Government.
Now, therefore in exercise of the powers conferred by section 197 of the Karnataka Land Revenue Act, 1964
(Karnataka Act No. 12 of 1964). The Government of Karnataka hereby makes the following rules namely:-
RULES
1. Title and Commencement.- (1) These rules may be called the Karnataka Grant of Land in case of constructions
of dwelling houses in occupied land (Amendment) Rules, 2011.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Amendment of the rule 3.- In the Karnataka grant of land in case of construction of dwelling houses in
occupied land rules 1999, in rule 3, in sub rule (2), for the words, brackets and figures “within 31st day of July 2009” the
words and figures “within 31st day of January 2012” shall be and shall always be deemed to have been substituted.
