Hon`ble Central Administrative Tribunal in Miscellaneous Application No: 420/10 in O.A. No.31/2010 filed by

Sri Paneendra Singh and others has ordered as under:

also in the list of eligible candidates to be prepared by the State Government provided they are eligible in all respects

except for the age restriction in Regulation 5(3) of the Regulations, and the UPSC shall also consider these candidates at

the time of making recommendations for promotion to IPS but in their case the sealed cover procedure shall be adopted.

It is also made clear that the adoption of sealed cover procedure in the case of such of the applicants who are eligible for

consideration but for the age restriction shall not come in the way of any of the persons from the list sent by the State

Government being selected or appointed….

Further, in application No: 41/2011 filed in C.A.T., by Sri K.M. Gangadharappa and 54/2011 filed by Sri

Krishnappa, Commandants, Hon’ble C.A.T., in its order dated: 28

Among the Officers figuring in the combined list, confirmation in respect of Sri Nazeer Ahmed and Sri

following rules further to amend the Karnataka Selection of Candidates for Admission to Government seats in Professional

Educational Institutions Rules, 2006, namely:-

1. Title and Commencement.- These rules may be called the Karnataka Selection of Candidates for Admission to

Government seats in Professional Educational Institutions (Third Amendment) Rules, 2011

(2) They shall come into force from the date of their publication in the official Gazette.

2. Amendment of rule 3.- In the Karnataka Selection of Candidates for Admission to Government seats in

Professional Educational Institutions Rules, 2006, in rule 3, in sub-rule (4), in the explanation, the second proviso shall

be omitted.

Whereas, the draft of the following rules further to amend the Karnataka Value Added Tax Rules, 2005 was

published as required by sub-Section (1) of Section 88 of Karnataka Value Added Tax Act, 2003 (Karnataka Act 32 of

2004) in Notification No. FD 39 CSL 2011, Bangalore, Dated 25.6.2011 in Part IV-A of Karnataka Gazette (Extraordinary)

No. 603, dated 25.6.2011 inviting objections or suggestions from all the persons likely to be affected thereby and notice

was given that the said draft will be taken into consideration after thirty days from the date of publication in the Official

Gazette.

And, whereas, the said Gazette was made available to the public on 25th June, 2011.

And, whereas, no objections and suggestions have been received in respect of the said draft rules by the

Government.

Now, therefore, in exercise of the powers conferred by section 88 of the Karnataka Value Added Tax Act, 2003

(Karnataka Act 32 of 2004), the Government of Karnataka hereby makes the following rules, namely,-

RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Value Added Tax (Second Amendment)

Rules, 2011.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 3.- In the Karnataka Value Added Tax Rules, 2005 (hereinafter referred to as the said

rules), in sub-rule (2), in clause (i-1), after the proviso the following proviso shall be inserted, namely:-

“Provided further that no such deduction shall be made where deduction of input tax is claimed in respect of tax

paid to any sub-contractor.”

3. Amendment of rule 161.- In Rule 161 of the said rules, in sub-rule (8), after the words “State limits”, the words

“along with a declaration duly signed and given by the consignee declaring receipt of the goods covered by the pass” shall

be inserted.

4. Amendment of rule 180.- In Rule 180 of the said rules, after sub-rule(1), the following shall be inserted,

namely:-

“(1-A)Where after making assessment or re-assessment for any tax period, the prescribed authority finds that the amount

due on assessment or re-assessment is lower than the amount already paid by the dealer, it shall issue a notice in Form

VAT 185 to such dealer.”

5. Amendment of Form VAT 100.- In Form VAT 100 of the said rules,

(1) after box 6.4, the following shall be inserted, namely:-

In exercise of the powers conferred by section 62 of the Building and Other Construction Workers (Regulation of

Employment and conditions of service) Act, 1996 (Central Act No. 27 of 1996), the Government of Karnataka, after

consultation with the Expert Committee, hereby makes the following rules to amend the Building and Other Construction

Workers (Regulation of Employment and Conditions of Service) Karnataka Rules, 2006, namely:-

RULES

1. Title and commencement.- (1) These rules may be called the Building and Other Construction Workers

(Regulation of Employment and Conditions of Service) Karnataka (Amendment) Rules, 2011.

(2) They shall come into force from the date of their publication in the official gazette.

2. Amendment of rule 39.- In rule 39 of the Building and Other Construction Workers (Regulation of Employment

and Conditions of Service) Karnataka Rules, 2006 (hereinafter referred to as the said rules), in sub-rule (3), for the

letters, figures and words "a sum of Rs.300/- per month", the letters, figures, brackets and words "a sum of Rs.500/-

(Rupees five hundred only) per month" shall be substituted.

3. Amendment of rule 45.- In rule 45 of the said rules, in sub-rule (1) ,-

(i) after the words “sanction” the words “every year” shall be inserted;

(ii) clause (a) shall be renumbered as clause (a1) and before the clause (a1) as so renumbered the following shall be

inserted, namely:-

“(a) If the son or daughter of the applicant who is studying in 8th standard, a sum of Rs.1,000/- (Rupees one

thousand only) and if the son or daughter of the applicant who is studying in 9th standard a sum of Rs. 1,000/- (Rupees

one thousand only) to the applicant.”

(iii) for clause (b), the following shall be substituted, namely:-

"(b) If the son or daughter of the applicant who has passed the 1st year PUC examination or equivalent examination,

a sum of Rs.2,000/- (Rupees two thousand only) to the applicant and if the son or daughter of the applicant who has

passed the 2nd year PUC examination or equivalent examination, a sum of Rs.2,000/- (Rupees two thousand only) to the

applicant.”

(iv) in clause (d), for the letters, figures, brackets and words "a sum of Rs.3,000/- (Rupees three thousand only) ",

the letters, figures, brackets and words "a sum of Rs.2,000/- (Rupees two thousand only) every year while studying” shall

be substituted.

(v) in clause (e), for the letters, figures, brackets and words "or Post Graduate Course, a sum of Rs.6,000/- (Rupees

six thousand only) ", the letters, figures, brackets and words "or studying in Post Graduate Course, a sum of Rs.10,000/-

(Rupees ten thousand only)" shall be substituted.

(vi) in clause (f), for the letters, figures, brackets and words "a sum of Rs.10,000/- (Rupees ten thousand only) ", the

letters, figures, brackets and words "a sum of Rs.5,000/- (Rupees five thousand only) for each Semester while studying”

shall be substituted.

4. Amendment of rule 47.- In rule 47 of the said rules,-

(i) in sub-rule (1), after the words and brackets "permanent disablement (incapacitation)", the comma and the

words and figures "permanent partial disablement as defined in the Employees Compensation Act, 1923" shall be

inserted.

(ii) in sub-rule (3), in clause (a), for the words and letters "Form XXI", the words and letters “Form XXI enclosing a

medical disability certificate issued by the doctor of the government hospital or of the recognized hospital who

has treated the applicant" showing clearly the percentage of permanent disablement (incapacitation) and

permanent partial disablement suffered by the applicant due to the accident occurred to him and also his age at

the time of accident” shall be substituted.

(ii) for sub-rule (4), the following shall be substituted, namely:-

4755 “(4) The Board shall grant an amount of Rs. One lakh in case of permanent disablement (incapacitation) or such

proportionate percentage of the compensation of Rs. One Lakh in case of permanent partial disablement suffered by the

applicant in proportion to the percentage of disability mentioned in the medical certificate.”

5. Amendment of rule 48.- In rule 48 of the said rules,-

(i) in sub-rule (1), for the word “and treatment for cancer” the comma and words, “eye operation, treatment of

paralysis, orthopaedics operation, uterus operation, treatment of asthama disease, maternity miscarriage cases,

treatment of gall bladder related ailments, removal of kidney stone, treatment of brain hemorrhage, treatment of

ulcer, cancer or such other ailments as in the opinion of the Board be considered as major ailments " shall be

substituted.

(ii) in sub-rule (4), after the word " application ” the words "or an estimate of treatment or operation ” shall be

inserted.

6. Amendment of rule 49.- In rule 49 of the said rules, in sub-rule (1), for the letters, figures, brackets and words

"Rs.5,000/- (Rupees five thousand only)” the letters, figures, brackets and words "Rs.10,000/- (Rupees ten thousand

only)" shall be substituted.

7. Amendment of Form XIX.- In Form XIX of the said rules,-

(i) for the words and figure "Rule 42", the words and figure "Rule 45" shall be substituted.

(ii) under the heading "SANCTION", for the letters, figures, brackets and words "Rs.3000/- (Rupees three thousand

only)" the letters “Rs.1000/- to 10000/-” shall be substituted.

8. Amendment of Form XXI.- In Form XXI of the said rules, after serial number 13 and entries relating thereto,

the following shall be inserted, namely:-

"14. (i) Age of the applicant at the time of accident.

(ii) Wage per month of the applicant at the time of accident.

(iii) The percentage of permanent partial disability suffered by the applicant as per the medical disability

certificate (original certificate to be enclosed)."

9. Amendment of Form XXII.- In Form XXII of the said rules, under the heading "SANCTION" for the letters,

figures, brackets and words "Rs. 5000/- (Rupees five thousand only)" the letters, figures and words “Rs. 10000 (Rupees

ten thousand only)” shall be substituted.

6. Probation: The applicant if appointed shall be initially on probation for a period of two years or for extended period if

necessary.

7. Age limit: Applicants must have attained the age of 18 years and must not exceed the age of:-

(a) 40 years in the case of a person belonging to Scheduled Caste or Scheduled Tribe or Category-I of

other Backward Classes.

(b) 38 years in the case of a person belonging to Category-II-A or II-B or III-A or III-B of Other

character.

(c) Persons claiming the benefit of reservations under SC/ST shall produce a certificate in the form

prescribed by the Government issued by the competent authority.

(d) SSLC or any other equivalent examination certificate showing the date of birth.

intake as applicable to the Academic year 2011-12. The A.I.C.T.E has also accorded approval to M.B.A & M.C.A courses

in certain colleges for the above academic year.

2. During the previous years while granting extension of approval to M.B.A & M.C.A courses conducted in the

universities and affiliated colleges, the A.I.C.T.E had granted extension of approval for the academic year 2010-11. Hence,

it is necessary to include such M.B.A & M.C.A courses which enjoy the currency of approval of the AICTE in the seat

matrix for the academic year 2011-12.

3. Determination of intake of M.B.A & M.C.A courses conducted in universities, affiliated colleges and also

Engineering colleges in terms of the approval of the AICTE under section 10(k) read with regulation 4 of the AICTE Act,

1987 and regulations 1994 as applicable to the academic year 2011-12 has been examined.

4. In exercise of powers conferred under rule 9(1) of the Karnataka Selection of Candidates for admission to Master

of Business Administration and Master of Computer Application courses, Rules 2007, the Government of Karnataka

hereby publishes the Seat matrix in respect of M.B.A and M.C.A courses conducted in the Universities and affiliated

colleges in Karnataka are indicated in Annexure-A and Annexure-C respectively. The break-up of Seats available to

4762 various categories in terms of Government Order No. SWL 251 BCA 94 dated: 31-01-95 in Government Seats are indicated

in Annexure-D.

5. The seats that are surrendered by the institutions are indicated in Annexure-S will be filled by the Karnataka

Examination Authority. This Seat matrix published shall be subject to the following conditions:-

(1) The colleges indicated in annexure-B shall continue to be subject to the condition of ‘no grant for ever’

basis in respect of the above Courses.

(2) The college shall abide by the norms and standards, general and specific conditions stipulated by the

AICTE while granting extension of approval and also the conditions of the LIC of the University.

(3) The admissions shall be made strictly in conformity with the regulation of the AICTE, and the

Karnataka Selection of Candidates for Admission to MBA & MCA Courses, Rules 2006 as amended

from time to time.

The draft of the following rules to amend the Karnataka State Police including ministerial Services (Recruitment) Rules-2004, which the Government of Karnataka

proposes to make in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990)

is hereby published as required by clause (a) of sub-section (2) of section 3 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby

given that the said draft will be taken into consideration after fifteen days from the date of its publication in the official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above

will be considered by the State Government. Objections and suggestions may be addressed to the Principal Secretary to Government, Home Department, Vidhana Soudha,

Bangalore-560 001.

DRAFT RULES

1. Title and commencement:- (1) These rules may be called the Karnataka State Police including ministerial Services (Recruitment) (Amendment) Rules, 2011.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of the Schedule:- In the schedule to the Karnataka State Police including ministerial Services (Recruitment) Rules, 2004, after the heading “IX

MINISTERIAL STAFF” and entries relating thereto, the following shall be inserted, namely:-

Government .

2) Must have put in a service of not less than five years in the cadre of

Foremen.

Provided that if officials who have put in not less than five years of

service are not available. officials who have put in a service of not less

than three years may be considered for promotion.
