ARTICLEI:OWNERSHIP,USE&OCCUPANCY
1.PursuanttoChapter718oftheFloridaStatute,alsoknownastheCondominiumAct,andthegoverningdocumentsoftheCoveCayVillageIAssociation,Inc.,(hereinafterreferredtoasthe“Association”),theBoardofDirectorshasthepowertoadoptreasonableRulesandRegulationsrelatingtotheuseofboththecommonelementsandtheunits.Theserulesandregulationsshallapplytoallunitowners,Lessee’s,visitorsandanyoccupantofthisunitwiththeultimateresponsibilityforcompliancerestingwiththeowners.Unitownersareresponsibleforassuringthatalltheoccupantsaregivenacopyoftheserulesandregulationsandthatallguestsandvisitorsobservethemaswell.FailuretodosowillmaketheOwnersresponsibleforanyinfractionsalongwithwhatevercostsandlegalactionsarenecessarytoensurethecomplianceoftheseRules.
2.Kitchendisposalisforfoodwasteandliquidsonly.Nogreaseshallbedisposedofdownthesinkasitmayclogthedrainlines,causingabackupandfloodingofthelowerfloors.
3.Noownershallflushanythingdownthetoiletexceptenvironmentallyfriendlytoiletpaper.DONOTFLUSHi.e.depends,disposablediapers,pads,etc.
4.EachUnitshallbeusedforthepurposeofasinglefamilyresidenceasdefinedintheAssociationsDeclarationandBy-Laws,andfornootherpurpose.
5.CommercialUse:Industries,businesses,tradeorcommercialactivitiesmaynotbeconductedinanyunit.
6.AllwindowdressingsMUSTshowawhitecolortowardstheoutsideofthewindow.Unitownersarenotpermittedtohanganythingotherthancurtains,conventionaldraperiesorblindsinthewindowsoftheirunit.
7.Cleanliness:Unitownersmustkeeptheirunitsinagoodstateofpreservationandcleanlinessandwillpreventtheaccumulationofmaterialsthatwillconstituteadanger,permit,orpromotethespreadofvermin,odorsorconditionsconstitutingadangerornuisancetothecommonelementsorotherunits.

8.Voting:Thereisonlyonevoteperunitandthatappliesonlytoowners.Itistheresponsibilityofeachownertoregisterthevotermemberatthemanagementoffice.Undermostsituations,ownershavetheright(withcertainexceptionssuchaselections)toappointaproxyforspecificpurposes,andtoinstructtheproxyholderhowtovoteonissuesbeingvotedonbythemembership.
9.Allunitownersmustsupplythemanagementofficewithanextrasetofkeysintheeventofanemergency.Iftheofficedoesnothaveakeyalocksmithmaybecalledandordamagetoyourdoorlockmayoccurandtheexpensewillbedeferredtotheowner.FloridaStatute718.givesthemanagementofficeRightofEntryintheeventofmaintenanceoranemergencytoentertheunit.Theofficewillmakeeveryefforttonotifytheownerswithin48-hoursbyphone,emailormail.
ARTICLEII:USEOFTHECOMMONELEMENTS-BUILDINGANDOTHERAREAS
1.PursuanttothegoverningdocumentsoftheAssociation,theCommonElementsarecontrolledandmaintainedbytheAssociation,andwillbeusedonlyforthepurposesforwhichtheyweredesignated.
2.PursuanttoSectionIVoftheDeclaration,thefollowingtermsaredefinedas:
a.CommonElementsincludeallareasandimprovementsoutsideoftheunitboundariesexceptasotherwisespecificallyprovidedintheDeclaration,easementsthroughunitsforallconduits,pipes,ducts,plumbing,wiringandallotherfacilitiesforthefurnishingofutilityservicestomultipleUnitsandCommonElements,andshallfurtherincludeallpersonalpropertyheldandmaintainedforthejointuseandenjoymentofalloftheownersofallUnits(i.e.walkways,elevators,driveways,landscaping,meterroom,trashchuteroomsanddumpsterareas)
b.LimitedCommonElements:parkingspaces,balconies,andStorageSpaces.
3.Nopersonshallconductanyactivitythatwill,ormay,permanentlydestroyordamageassociationproperty,orinterferewiththeproperusebyothers,orcommitanyvandalismorimproperbehavioronthecommonelements,whichinterfereswithorlimitstheenjoymentofthecommonelementsbyallothersinthecommunity.

4.Obstructions:Therewillbenoobstructionofthecommonelements,norwillanythingbestoredoutsidetheunitswithoutthepriorconsentoftheboardexceptashereinafterexpresslyprovided.Including,butnotlimitedto,WalkwaysandTrashRooms.
5.NopersonalpropertyoftheunitownersoroccupantsispermittedinanyoftheAssociationcommonareas,includingtrashroomandWalkways.
a.Thisincludesplants,chairsandotherpersonalitemsonthewalkwayarea.AllwalkwaysmustbefreeandcleartoallowforasafeentranceandexitincaseofanemergencypursuanttotheNationalFireProtectionAssociationCodes.
b.AllpersonalpropertyleftinacommonareaorwalkwayshallimmediatelyberemovedbymanagementandanycostsforremovalshallbeassessedtotheunitownerwithafineforviolationofthisRule.
6.SmokingisprohibitedinanyindoorareasasdefinedintheFloridaCleanIndoorAirAct.Thisincludestherecreationbuilding,andsmokingisalsoprohibitedintheswimmingpoolareawiththeexceptionofthedesignatedareaforthispurpose.Smokingisprohibitedinwalkwaystopreventsmoketothosepassingbyorsmokeenteringopenwindows.Thisincludeswalkway,elevatorsandstairways.
7.Trash
a.TrashContainment.Trashmaynotbestoredoutsideanyunitinsuchamannerastopermitthespreadorencouragementoffireorvermin.
b.Rugsormopsmaynotbeshakenorhungfromwalkwaysoronanycommonarea.
c.Alltrashandgarbagemustbedisposedofinthetrashchutesbetweenthehoursof
7:00A.M.and10:00P.M.only.
d.Itemstoolargeforthechutemustbehandcarriedtothedumpsters,locatedonthegroundfloor.Theseitemsarenottobeleftinthetrashchuteroom.DoorMUSTbeclosedontrashchuteroom.

e.TheAssociationhasrecyclecontainerslocatedinthegroundfloortrashroom.Allboxesandothercardboardmaterialsmustbebrokendownfordisposal.
f.Petlitter,diapersandothersimilarwastemattermustbedoublebagged,withtiesandcarriedtothedumpster.Undernocircumstancesarethesewasteitemstobethrowndownthetrashchute,asthebagscantearandbreak.
g.Nofurniture,appliances,oranyotherhouseholdfurnishingsmaybeleftordisposedofinthetrashormeterroom.Allunitownersshallberesponsibleforreimbursingtheassociationthecostofremovalandafinemaybeimposedof$100perdayupto$1000.00.
8.Useofbalcony,porches,walkwaysandotherlimitedcommonelements.
a.Theunitowneroroccupantshallkeepbalconyandporchesorderlyandclean.
b.AnymodificationstothelimitedcommonelementsmustbeapprovedbytheBoardofDirectors.
c.Thereshallbeneithergasnorcharcoalgrillingonthebalconies.Onlyelectricalgrillsshallbepermittedonthebalconies.
d.Cookingisstrictlyprohibitedonwalkwaysoranycommonareasoftheassociation.
Thisincludeselectricalgrills,whicharepermissibleonporchesandbalconies
e.Allbalconyfurnitureandanyotheritemswhichmaybeblownawaybyhighwindsmustberemovedinperiodsofexpectedseverestorms,includingallhurricaneandtropicalstormwatchesandwarnings.
f.Thereshallbenostackingofanyitemsortossingofanytypeofmaterialsfrombalconiesorwalkways.
g.Nothingmaybehungoverthebalconyrailings.
9.Intheeventanowner,oritstenants,guests,orotherpersonswhomtheyareresponsiblefor,causesdamagetoassociationpropertyduetotheirwillfulorunwillfulnegligentacts,those

unitownersshallberesponsibletorepair,andreplacesaidpropertyattheirownexpense.TheRules&RegulationsaretheresponsibilityofUNITOwnerstoassuretenants,guests&visitorsareincompliance.
ARTICLEIII:ENFORCEMENT&FINING
1.Theboardwillmanagethedaytodayaffairsoftheassociationandhastherighttolevyassessments,andmaintainrepairsandreplacethecommonelementsorassociationproperty.
2.AllviolationoftheserulesandregulationsshallbereportedimmediatelytotheAssociationofficeand/orthemanagementcompany.Disagreementsconcerningviolationsincluding,withoutlimitations,disagreementsregardingtheproperinterpretationandeffectoftheserulesandregulations,shallbepresentedtoanddeterminedbytheBoardofDirectorsoftheAssociation,legalauthorityorassignedcommittee,whoseinterpretationoftheserulesand/orremedialactionsshallberelatingto.Intheeventthatanyperson,firmorentitysubjecttotheserulesandregulations,failstoabidebythem,astheyareinterpretedbytheBoardofDirectorsoftheAssociation,theyshallbesubjecttolegalactionafterwrittennoticefromtheBoardofDirectors.IftheBoardofDirectorsoftheAssociationdeemsitnecessary,itmaybringactionatlaworinequity,inthenameoftheAssociationtoenforcetheserulesandregulations.Intheeventanysuchactionisinstituted,andtheAssociationprevailsinanysuchaction,theAssociationshallinadditionbeentitledtorecoveritscostsandattorney’sfeesincurredinenforcingtheserulesandregulations.
3.FININGPOLICY:InaccordancewithFloridastatutesection718.303,theAssociationhastherighttolevyfinesagainstunitowners,andtheirtenants,foractionsbyowners,tenantsandguestswhichfailtocomplywiththegoverningdocumentsoftheAssociation.Theunitownerisresponsiblefortheactionsofallpersonsoccupyingorvisitingtheunit.Finesmaybeimposeduptoamaximumof$100.00perdayperviolation,nottoexceed$1,000.00foronecontinuingviolation.Owners,occupantsandtenantsaresubjecttotheassessmentsoffines.

4.ThisfiningpolicyispartoftheRulesandRegulationsoftheAssociation,andaddressestheprocedureforfiningowners,tenants,andotherpersonswhoviolatetheDeclarationofCondominium,Bylaws,orRulesandRegulationsoftheAssociation.
5.Finesareanalternativetoothermeansofenforcement:
a.TheBoardofDirectorsoritsappointedagentsarechargedwithdeterminingwhetherthereisprobablecausethatanyoftheprovisionsoftheDeclarationofCondominium,theBylaws,ortheunit,commonelements,orAssociationpropertyarebeingorhavebeenviolated.
b.TheBoardofDirectorsshallappointaFiningReviewCommittee(the“Committee”)offive(5)persons,whichshallconsistentirelyofunitownersotherthanmembersoftheBoardofDirectors,orpersonsrelatedtoBoardmembers,andwhichshallbechargedwithconductingthehearingandrenderingthedecisionwithregardtothelevyoffinesashereinprovided.AlternatemembersoftheCommitteemaybeappointed,tobeavailabletoserveshouldaCommitteememberresignsorisunavailableforahearing.
c.IntheeventthatacomplaintisreceivedbytheAssociation,oraviolationisotherwisedeterminedtohaveoccurred,theBoardofDirectors(the“Board”)oritsagentswillnotifytheviolator(s),andinappropriatecases,willprovideanopportunityforsuchviolationtobecorrectedwithinareasonabletime(atleast5daysexceptinthecaseofanemergency).
d.Iftheviolationhasnotbeencorrected,orinthecaseofarepeatedviolation,oraviolationofaseriousnaturethattheBoarddeterminesdoesnotwarrantanopportunityfortheviolatortocorrectit,theBoardmayadoptaproposedfine,uptothemaximumamountallowedbylaw.Afinemaybeimposedbaseduponeachdaythatacontinuingviolationcontinues.Thefinewillnotbecomefinaluntilahearinghasbeenheld,orwaivedbytheallegedviolator.
e.Followingtheadoptionofaproposedfine,theviolatorshallbenotifiedbycertifiedmail,andacopyoftheserulesshallbeprovided,alongwithanoticethattheviolatormayrequestahearingbeforetheCommitteewithinfourteen(14)daysofthedateof

theviolationletter.Alternatively,theAssociationortheCommitteemaysetthedateandtimeoftheproposedhearingpriortosendingthelettertotheallegedviolator,providedthatthehearingisatleastfourteen(14)daysfromthedateofthenotice.ThenoticetotheallegedviolatorshallalsoincludeashortandplainstatementofthemattersassertedbytheAssociation,aswellasastatementoftheprovisionsoftheDeclaration,Bylaws,orRules,whichhaveallegedlybeenviolated.Failuretorequestahearingwithinthisfourteen(14)days’timeframeshallconstituteawaiveroftherighttoahearing.
f.TheCommitteeshallholdahearingifrequested,aftergivingtheoccupantatleastfourteen(14)dayswrittennoticeofthedate,timeandplaceofthehearing,unlesstheallegedviolatorwaivesthisfourteen(14)daynoticerequirement.TheCommitteemayoverruleormodifythefinefollowingthehearing.
g.TheBoardwillappointedaChairman,oriftheChairmanisabsent,theCommitteeshallappointasubstituteChairmanoftheFiningCommitteewhoshallconducthearingsinaccordancewiththefollowingrulestohearanychargesanddefenses.Thehearingmaybeaudioorvideo-recordedinthesamemannerandunderthesamerulesthatunitownersarepermittedtoaudioorvideo-recordmeetingsoftheBoardofDirectors.
I.ArepresentativeoftheAssociationshallbeheardfirst,inordertosummarizethebasisfortheproposedfine,andtopresentanywitnessesordocumentsinsupportoftheproposedfine.Writtenaffidavitsarepermitted.Theuseoftechnicalrulesrelatingtoevidenceandwitnessesarenotnecessaryorpermitted.Apartyorwitnessmayalsobeallowedtoappearbytelephoneconference,providedthatthecostinvolvedispaidbythepartyofferingsuchevidence.
ii.Eachpartyshallhavetheserights:
1.Toberepresentedbycounsel;
2.Tocallandexaminewitnesses;
3.Tointroduceexhibits;
4.Tocross-examineopposingwitnessesonanymatterrelevanttotheissueseventhoughthatmatterwasnotcoveredinthedirectexamination;

5.Toimpeachanywitness;
6.Torebuttheevidenceagainsthim.
iii.Theaccusingpersonand/ortheallegedlydefaultingunitownermustbeinattendanceatthehearing.Thehearingshallbeopentoattendancebyallunitowners.Inrenderingadecision,officialnoticemaybetakenatanytimeofanygenerallyacceptedmatterwithintheDeclaration,theArticles,theBylaws,theRulesandRegulations,ortheworkingsoftheAssociation.
iv.Withinten(10)days,theCommitteeshallrenderadecisiononthematter.IfthedecisionoftheCommitteeistoupholdthefine,ortoimposeareducedfine,thefineshallbepayabletotheAssociationwithinTwenty(20)daysfromthedatethatwrittennoticeofthedecisionissenttotheallegedviolator(s).
h.Subsequenttothehearingorifnohearingisrequestedwithinfourteen(14)daysfromthedateoftheletternotifyingtheviolatorofthefine,anyfurtherenforcementactionwillbetakenbytheBoardofDirectors.
I.Anyviolator(s)willberesponsibleforinterest,costsandattorneys’feesincurredintheenforcementofthefine,includingcostsandattorney’sfeesinconnectionwithanycorrespondenceorhearings,providedthattheCommitteeupholdsthefine,inwholeorinpart.Ifanyfineisfinalandthatpaymentisdue,theAssociationwillbeentitledtoproceedwithfurtherenforcementaction,asitdeemsappropriate.
ARTICLEIV:SALESANDLEASING
1.TheAssociationiscomprisedofallunitowners.UnitOwnersshallensurefollowingapprovalofanylease,therentermeetswiththeboard’sdesignatedrepresentativeandcompleteanorientationandindoctrinationaswellasnecessarydocumentation.ThenecessaryformsaretobeprovidedtotheAssociationwithaminimumof20daysofbeginningresidency.TheAssociationistonotifytheunitownerofapprovalordisapprovalofsuchproposedleasewithin14daysafterreceiptoftheapplication.Thisorientationmustbecompletedbeforethetenantbeginsoccupyingtheunit.Lessthan20daysisconsidereda“Rush”andthereisanadditionalcharge.

2.ForanysaleorrentalyoumusthavetheAssociation’spriorapprovalforoccupancy.Thefollowingdirectivesmustbemetpriortoclosingorleasing:
a.Youmustobtainanapplicationfromthemanagementofficewhichistobecompletedandreturnedtotheoffice.
b.Withtheapplication,a$90non-refundableapplicationfee,perapplicant,mustbepaidatthetimeofsubmissionwithacopyoftheproposedleaseagreement.(FeesetbyBoardaction)
c.AlltenantsshallexecuteaLeaseAddendumapprovedbytheBoardofDirectors,andalltenantsshallberesponsibleforcomplyingwithallrulesandrestrictionsoftheAssociation.
d.TheBoardofDirectorshas14businessdaystoreviewandapprovetheleaseapplication.Allleaseapplicationsmustbehanddeliveredtothemanagementoffice.
e.Alltenantsmustundergoanationalcriminalbackgroundcheck.Allcostsassociatedwiththisbackgroundcheckshallbepaidbytheunitowneraspartoftheapplicationfee.TheBoard,withinitssolediscretion,maydenyanapplicationbasedontheresultsofthecriminalbackgroundcheck,ifitdeterminesthatacriminalrecordexistswhichposesapotentialthreattothehealth,safetyorwelfareofotherresidents.
f.AllleaserenewalsmustbeapprovedbytheBoardofDirectors.
g.ArefundableSecurityDepositequalto1monthrentwillbecollectedbytheAssociation.
h.Two(2)leasesperyearwithaminimumof91dayseach.
i.NOperperson,corporations,orotherlegalentitiesmayacquiretitletomorethantwo(2)unitsandtheownermustliveinone(1)oftheunits.
j.Newbuyerofaunitcannotleasetheunitfor24monthsfromthedateofclosing.

3.FailurebyanyownertocomplywiththeseRulesandRegulationsregardingleasingprovisionsshallbesubjecttoa$100fineperday,nottoexceed$1,000.00foracontinuingviolations.IntheeventtheownerfailstocureanybreachoftheseRulesandRegulations,Boardshallhavetherighttofilelegalactionagainsttheunitownertoenforcetheserules.
4.Allownersshallberesponsiblefortheirtenants’actions,orinactions.
5.Tenantshavetherighttouseallcommonfacilitieswhenaunitisleased,andownersgiveupthatrightunlessthetenantwaivesthisrightinwriting.Thisistopreventdualusageofthefacilities.
6.Bylaw,thereisonlyonevoteperunitandthatappliesonlytoowners.
7.AllUnitOwnersshallberesponsibleformaintenanceissuesrelatingtotheirunitasprovidedforintheDeclarationandothergoverningdocuments.ThisincludesallissuesrelatingtotheUnitownerstenantsandguests.
ARTICLEV:GUESTS
1.“Guests”shallbedefinedasanypersonwhoisnotamemberoftheOwner’sfamilyandoccupiestheUnitattheinvitationoftheOwnerorotherlegallypermittedoccupant,withoutanyrequirementtocontributemoney,servicesorothertypesofconsiderationfortheoccupancy.
2.“Tenant,”“Lessee”or“Renter,”shallbedefinedasanyoccupantofaunitwhopaystheowner,orprovidesotherconsiderationforleasingtheunit.Unitsmustbeleasedintheirentirety(leasingofpartoftheunitisnotpermitted)throughanapprovedapplication.
3.“ImmediateFamilyMembers”shallmeanspouses,children,siblings,grandchildren,parentsandgrandparents.AllImmediateFamilyMembersmustshowtheirrelationshiptothemanagementofficetoavoidtheapplicationprocessdescribedinArticleIV,2above.
4.Agueststayingmorethan72hoursmustpickupaguestparkingpassattheoffice.
5.“PermanentOccupant”Anypersonotherthantheownerorhis/herimmediatefamilymember,ifstayingover30-daysinanyconsecutive12monthperiodisconsideredtobea

PermanentOccupantforpurposesoftheserules,andmustbeapprovedbytheBoardofDirectorsinthesamemannerastenantsunderArticleIIoftheseRulesforpurposesofmaintainingthesafetyandsecurityinthecommunity.
6.AnyunitownerortenantthatwillbeabsentduringaGuestvisitation,shallnotifythemanagementofficeinwritingusingour“GuestRegistrationForm”.Acceptablenotificationmaybesubmittedthroughfax,email,orpostalmail.Thefollowingmustbecompliedwithifovernightguestsarestayingandtheowner/tenantisabsent:
a.AllOwnersandTenantsmustprovidethemanagementofficethenameofeachguestwhowillbeoccupyingtheunit,andthedurationoftheGuests’stay.
b.Whenaunitownerisnotpresent,Guestvisitationsshallbelimitedto15dayspervisit,andlimitedto2visitsinanygivencalendaryear.
c.TheOwnerand/orTenantmuststipulateinwriting,thattheGuestisnotpayinganyremunerationforrentorutilities.
d.AllUnitowners,lesseesandGuestsmustbeadmittedthroughsecurity.Unauthorizedpersonswillbedeniedentry.
e.uponarrivalofadayGuests,securityshallissueadaypass.
f.Uponarrival,allGuestsmustvisittheManagementofficetoregisterandobtainavisitorspassandsigntherequiredGuestFormfilledoutbytheownerpriortothevisit.
g.UnitownersandortenantsshallprovidetheirGuestswithasetofkeystotheunit.UndernocircumstancesisthemanagementofficetoopenadoorforaGuest.
h.IntheOwners’absence,approvedGuestsmaynotentertainovernightGuestsoftheirownwithoutwrittenpermissionfromtheOwner,andacopyofsuchwrittenpermissionshallbefurnishedtothemanagementoffice.
NUMBEROFOCCUPANTS:
Onlythenumberofguestsauthorizedmayoccupytheunitintheabsenceoftheunitowner.

Innoeventshallthenumberofpersonsinresidenceexceedthefollowing:

7.AguestorlesseeshallbegivenacopyofthegoverningrulesandregulationsbytheownerandmustacknowledgethattheywillcomplywithalloftherulesandregulationsoftheCondominium.
8.ViolationsofGuestProcedureanddamages.AnyunauthorizedGuestscannotbeadmittedandshallsubjecttheUnitOwnertoafineperArticleIIabove.
ARTICLEVI:ALTERATIONSANDREMODELINGBYUNITOWNERS
1.Noalterations,additions,orimprovementsmaybemadetothecommonelementsunlessinaccordancewiththeAssociation’sDeclaration.Theboardshallhavetherighttotakeanyandalllegalactionandremediesnecessaryunderthelaw,includingfilinglegalactionforaninjunctiontopreventorundueanyalterationstothecommonelementscontrarytothegoverningdocumentsoftheassociationandunderFloridalaw.
2.ItistheAssociation’sresponsibilitytomaintainandrepairthecommonelementsofthe
Association.Thisprovisionincludes,butisnotlimitedto
a.Alterationstotheexteriortothebuilding
3.FlooringandotherAlterationsorremodelinginsidetheunits.
a.Anychangestotheunits’floorcovering,mustbeapprovedinwritingbytheBoardofDirectorstoensurethepropermaterialsareusedforsoundproofing,inaccordancewiththeAssociations’specifications.Allfloormodificationsmustbeapprovedafter

completinganapplicationformandprovidingdetailsregardingsoundproofingmeasures.Theboard’sdesignatedrepresentativeshallhave15daystoreviewtheapplicationfortherequestedwork,andmayimposeconditionsorinspectionrequirementspriortothealterationsbeingmade.

5.EmployeesandManagement:
a.Nounitowner,tenant,guest,occupant,orcontractor,agentoftheassociationshallsendanyemployeeofthemanager,oremployeesoftheAssociation,outofthepropertyonanyprivatebusinessoftheunitowner,norwillanyemployeebeusedfortheindividualbenefitoftheunitowner,unlessinthepursuitofthemutualbenefitofallunitowners,orpursuanttoafeetobepaidtotheAssociationforspecialservicesrequired,afterapprovalbytheAssociation.
b.Nounitowner,tenant,guest,occupant,orcontractor,(includingofficersanddirectorsoftheboard),shallreprimand,givedirectionorinterferewiththeworkofanemployee,agentorcontractoroftheAssociation,unlesssafetyisanissue.ThisresponsibilityisdelegatedsolelytotheAssociation’smanagerorBoarddesignatedrepresentative.

d.Anyunitownersortenantswhoaregoneformorethan7daysshalldesignateanindividual,orarepresentativeoftheAssociationifagreedto,andsuchpersonmustchecktheirunitweeklywhiletheyaregone,andimmediatelyreportanyleaksorotherproblemstomanagement.

ARTICLEVIII:VEHICLESANDPARKING:
1.Compliancewiththelaw:AllpersonswillcomplywithstatelawsandDepartmentofMotorVehiclesregulationsontheAssociationroads,drives,andproperty.Failuretokeepalltagsandregistrationcurrentshallresultinthetowingofthevehiclefollowinganattempttoprovidepriorwrittennoticetotheowner.
2.Registration:Allvehiclesofemployees,agents,owners,andoccupantsregularlyusingthepremisesmustberegisteredwiththemanagerandallguestvehiclesmustdisplayavehiclestickeroraguestpasstobeobtainedfromSecurityormanagementofficeuponenteringthecommunityofCoveCayVillage.
3.CoveredparkingspaceswithcarportsareassignedattheVillageOnemanagementoffice.Thesecarportsarerestrictedforthespecificuseoftheassignedunitownerorlessee.Onlypassengermotorvehiclesarepermittedtoparkinanyassignedparkingspace.Failuretocomplywiththisprovisionshallresultinawrittenreprimand,thenafine.
4.LimitationonUse:Onlyonecarportwillbeassignedperunit.Vehiclesmustberegisteredinordertopermanentlyparkonthepremises.Parkingareaswillbeusedfornopurposeotherthantoparkpassengermotorvehicles,loading,orunloading.Ifanownerrequirestheuseofanadditionalparkingspace,orrequestspecialhandicappedparkingduetoamedicalcondition,anapplicationmustbefilledoutandapprovedbytheboardofdirectors.Undernocircumstanceswillasingleunitbepermittedtohavemorethan2vehiclesonsite.Anyvehicleparkedinaspaceassignedtoanotherunit,withoutfirstprovidingwrittenpermissionfromtheowneroftheunittowhichthisspaceisassigned,maybetowedwithoutpriornotice.
5.Alloversizedtrucksorcommercialvehicles,includingtrucks,displayingtradesignage(excludinglawenforcementandgovernmentalvehicles);commercialvehicleswhichhave

commercialequipmentinstalledontheexteriorofthevehicle;andtrailers,boats,recreationalvehiclesandmotorhomesmaynotbeparkedonthecommonelements,andtheyareprohibitedinthegeneralparkingareas,exceptfortemporaryloadingandunloading.Specialpermissionmaybeobtainedfromtheboardforsmalltypesofsuchvehiclestobeparkedinadesignatedarea.
6.Motorcycles,scooters,golfcartsetc.areprohibited.ONLYexceptionisSecurityonagolfcart.
7.Visitorparkingspacesareavailableateachbuildingandthoseareasarerestrictedtopassengermotorvehiclesonly.
8.Residentsareprohibitedfromparkinginthesevisitorparkingspaces,exceptforloadingandunloading.Violatorsareatriskofbeingtowedattheirownexpense.

17.Handicappedparking:UnderFloridaLaw,anyonewithahandicappermitisentitledtoparkinadesignatedhandicapspace(owner/tenantorguest).However,thereisalimitedamountofhandicappedparkingspacesinthecommunityandallunitownersareassignedaparkingspace.Duetothesefacts,theboardisrequestingthatunitownernotparktheirvehiclesinahandicappedparkingspaceforanextendedperiodoftime.Anextendedperiodoftimemeansmorethan1hour.Thefollowingrulesrelatetohandicappedparkingspaces:
a.Owners/tenantsusinghandicappedparkingspacesshouldbeusedforloadingandunloadingpurposesonly.
b.Ifaunitownerhasadisabilityrequiringacloserspacetothebuilding,thatunitownermustrequestaparkingspacereassignmentforacloserparkingspacetothebuilding.Theboardwillattempttoreassignaspaceforthedisabledunitownereithertemporarilyorpermanentlydependingonthedurationofthedisability.Theunitownermustthenallowhisassignedspacetobeusedasanopenparkingspace.Supportingdocumentationshouldbeprovidedwiththeowners’requestforareassignment.

b.Nofurnishingsaretoberemovedfromtheseareas.Theonlyexceptionistohavemaintenanceworkonthatitem.
