Due to the suspension of the project constructionactivities by the Ministry of Environment, Forestsand Climate Change (MoEF&CC) on 01.03.2011,the construction activities at the project site weresuspended. Even though, the suspension wasfinally withdrawn by MoEF&CC on 02.04.2012, theconstruction activities could however resumed bythe project proponent only from March, 2013.

The construction activities are going now in fullswing for commissioning of the Unit # 1 (660MW)by March, 2016 and Unit # 2 (660MW) bySeptember, 2016. The activities for Unit # 3 (660MW) and Unit # 4 (660 MW) are likely to be takenup by the project proponent parallely and expectedto be commissioned by the first quarter of 2019.

PRESENT STATUS OF THE PROJECT

Ministry of Environment, Forests and Climate Change (MoEF&CC) vide letter No. J-13011/36/2008-1A.II(T)dated 9.4.2009 accorded Environmental Clearance (EC) to MIs EastCoast Energy Private Limited (ECEPL) for setting up of 2640 MW (4 x 660 MW)Bhavanapadu Thermal Power Project near Kakrapalli village, Srikakulum District, AndhraPradesh. As per the EC, the total land requirement for the project is 1995 acres.Subsequently, MOEF&CC vide letter dated 22.9.2011 amended the EC dated 9.4.2009 bystipulating additional conditions for compliance by the project proponent. PP informed thatMoEF&CC vide letters dated 01.03.2011 and 5.10.2011, suspended the constructionactivities at the project site. Finally, MoEF&CC vide letter dated 02.04.2012 rescinded itssuspension order dated 5.10.2011. The Project Proponent (PP) informed that vide theirletters dated 18.1.2014 and 14.2.2014 approached MoEF&CC, New Delhi for extension ofvalidity of the EC dated 9.4.2009. Thereafter, in acceptance of the recommendation of theEAC (Thermal Power), MoEF&CC vide its letter dated 21.08.2014 has extended the validityof EC for a period of five years i.e. till 08.04.2019 to start the production operations by thePower Plant. Additional conditions were also stipulated by MoEF&CC for compliance by thePP.

During the site visit, it was informed by the PP that the power project will beimplemented in two phases i.e. Phase I: 2x660 MW and Phase II: 2x660 MW. Presently,only the phase I (2x660 MW) is under development and the details of the constructionactivities being carried out at the project site in respect of phase I of the power project aresummarized as below. As per the PP, the phase I is expected to be commissioned by March2016 (Unit #1: 660 MW) and September, 2016 (Unit #2: 660 MW). The activities for Unit # 3(660 MW) and Unit # 4 (660 MW) are likely to be taken up by the project proponent parallelyand expected to be commissioned by the first quarter of 2019.MNR OF ECEPLPOWER PLANT EC2009 VISIT 12.2.2015 Page3 of 21

As per the EC dated 9.4.2009, the totalland requirement for all the activities ofthe project is 1995 acres. The break upfor the 1995 acres is furnished under:-• Plant & other facilities - 1800 acres• Colony• Pipeline corridor

- 35 acres- 160 acres

PP informed that the entire land of 1995acres has been acquired from AndhraPradesh Industrial and InfrastructureCorporation (APIIC), Govt. of AndhraPradesh and it's under the possession ofPP.

Subsequently, MoEF&CC vide letterdated 22.9.2011 amended the EC dated9.4.2009, wherein it has been stipulatedthat against 1800 acres of plant area, nofilling and raising of land beyond 1317acres (constituting 150 acres of greenbelt) is permitted and an area of 483acres (425 acres + 8 acres + 50 acres)shall be left untouched.

PP informed that the construction isbeing carried out as stipulated above andthe project layout has been revised. Acopy of the layout as provided by the PPis enclosed as Annexure - II.

During the site visit, it was observedthat the PP had acquired an additionalland of 250acres beyond the total areaspecified in the EC condition(condition no.ii) and constructed 14km garland drain (Width varies from20-BOm)in 173 acres and earmarked77 acres for CSR activities withoutprior permission from the MoEF&CC.A copy of the layout incorporating 250acres additional land as provided bythe PP is enclosed as Annexure - II. Aphotograph indicating garland drainsis enclosed as Annexure -III.

Further, PP informed that additional landof 250 acres acquired (173 acres forgarland drain and 77 acres for CSRactivities) is a part of fulfillment towardsthe commitment made during the PublicHearing.

i. Project proponent has acquired an additional land of 250 acres beyond thetotal area specified in the EC condition and constructed 14 km garland drainin 173 acres and earmarked 77 acres for CSR activities without priorpermission from the MoEF&CC.

ii. Project proponent has not created the common Green Endowment Fund asstipulated in the EC condition.

Whereas, the Ministry has received several representations regardingthe location of the project being in wetland area as well as regarding non­compliance with the order of Hon'ble National Environment AppellateAuthority(NEAA) dated so" August, 2010, which order is in the knowledge ofthe project proponents as Q Respondent and is a publiC document; and

Whereas, in view of the nature and the seriousness of the matter, it hadbeen decided that the Expert Appraispl Committee (EAC) dealing With ThermalPower Projects should consider these. and the issue of compliance with theconditions stipulated in the aforest:lid environmental clearance in Its meetingscheduled to be held on -r» March, 2011: and

2. The Ministry vide letter of ·even no. dated 1st March, 2011 directed to stop theconstruction work at the site' in view of unfortunate incident of Police firing in the proximity of theproject site resulting in death and iinjury to local people. Thereafter based on therecommendation of the. Expert Appraisal Committee (Thermal). the 'stop I.A!!Xk'0rd8r 0f1.03.2011 was withdrawn by letter dated 22.09.201,.

3. However, after issuance of the withdrawal order dated 22.09.2011, fresh complaints ofserious nature have been received. These complaints are under examination.

4. In view of the above, the Ministry has' decided that, pending examination of thecomplaints, the earlier order of even no. dated 22.092011 to rescind the stop work at theproject site is kept in abeyance and the Ministry of Environment and Forests directs that theongoing construction activity at the project site shall be stopped until further orders.
