SUBJECT: ACCEPT BID AND AWARD CONTRACT NO. 6929 BETWEEN ALAMEDA COUNTY PUBLIC WORKS AGENCY AND ROSAS BROTHERS CONSTRUCTION FOR THE REPAIR OF DAMAGED AND DISPLACED SECTIONS OF CURBS, GUTTERS AND SIDEWALKS TN EDEN TOWNSHIP, ALAMEDA COUNTY, CALIFORNIA, SPECIFICATION NO. 2\81; IN THE AMOUNT OF $76,564.50

RECOMMENDATION:

That your Honorable Board:

I. Accept the bid and award Contract No. 6929 between Alameda County Public Works Agency and Rosas Brothers Construction, (Principal: Victor M. Rosas, President; Location: Oakland, CA), in the amount of $76,564.50, based on the unit prices stated in its bid proposal for the project, the Repair of Damaged and Displaced Sections of Curbs, Gutters and Sidewalks in Eden Township, Alameda County, California; Specification No. 2181;

2. Authorize the President of the Board to sign said contract upon review by County Counsel, said work to be completed within forty five (45) working days from the date of receipt of Notice to Proceed; and

3. Approve the encumbrance of an additional $7,656 as a Supplemental Work Allowance (SWA) for a total encumbered amount of $84,220.50 for the project, and authorize the Director of Public Works to approve contract changes as necessary against the SWA.

SUM MARYfD ISCUSSION:

The project consists, in general, of removing and replacing of damaged curbs and gutters, driveways and sidewalks, removal of tree roots and installation of root contra I barrier, and cleaning of the site at the end of the job. The Engineer's Estimate for this work is $99,500.

SELECTION CRITERIA AND PROCESS:

The project was advertised in accordance with established Construction Outreach Program procedures, which include:

• Advertisement in seven (7) general publications and eight (8) trade or minority publication; • Posting ofcontract documents in 23 Plan Rooms and/or trade organizations; • A pre-bid conference for interested contractors, with attendance at the conferences required

for all general contractors, and encouraged for subcontractors. The conference was attended by eight (8) contractors;

On August 9, 201 J, six (6) bids were received and opened. Table / shows an abstract of the bids received in response to the authorized advertisement. 17le bids will be forwarded to you under separate cover.

The bids were reviewed by Public Works staffand found to be in order. As the lowest bid is under SJOO,OOO, it is not suhject to the County M/WBE reqUirements. It is recommended that the contract be awarded to Rosas Brothers Construction, Q local finn.

Rosas Brothers Construction and their subcontractors are required to utilize the County's Compliance system to ensure labor and business utilization compliance.

FfNANCING:

The funds for this project are budgeted and available in the Road Department Budget, ORG No. 27040 I, Account 610261, (Professional & Specialized Services). There will be no impact on the General Fund.
