Agenda Items No. 1 Confirmation of the minutes 158th

meeting of Executive Committee

held on 28.6.2010 .

It was noted that 158th meeting of Executive Committee was held on 28.6.2010 at New Delhi. The minutes of the same were placed before the

Central Council in its meeting held on 30.6.2010 for consideration and ratification. After considering the same, the minutes were ratified by the

CCIM.

Executive Committee confirmed the same.

Agenda Item No.2 Acquiring of Guest House.

It was noted that as per decision of Executive Committee in its meeting

held on 20.01.2010 regarding to hire the accommodation as Guest House

an advertisement was issued in the news paper namely Nav Bharat Times and Hindustan Time dated 3.4.2010. In response of the same 5

quotation were received. However, following two landlord mentioned the

rate.

As per instructions of President, CCIM the committee constituted by President, CCIM consisting of following members made a spot verification

for availability of furniture, fixture and other requirement of both the flats.

The committee verified the availability of the same in flat of Mr. Naresh Chand Meena and same has been hired from 1st August, 2010 for 05

years @ 32,000/- PM as rent in advance form alongwith charges of electricity and water charges etc. The same has been informed to all

the members of CCIM also

Agenda Item No.3 Engagement of Legal Consultant

It was noted that the Executive Committee in its 149th meeting held on decided to engage one Legal Consultant for the office of the Council.

In view of the above, an advertisement was issued to engage Legal

Consultant in newspaper and after receipt of the applications the interview was held on 28.6.10 and the Selection Committee consisting of

following members decided as under:-

“The Committee agreed to engage Sh. KN Subduhi temporarily for legal work on consolidated salary of Rs.20,000/- PM for a period of three

months initially.

Accordingly, Sh. KN Subduhi joined the office on 01.7.10.

Executive Committee noted the same.

Agenda Item No.4 Reporting of Consultant (R.T.I.)

It was noted that it was reported in the Executive Committee dated

28.6.10 that Mr. GP Chand was engaged as Consultant (R.T.I.). Accordingly, an offer of engagement was issued to Mr. GP Chand. He

joined the office w.e.f. 15.7.10 and tendered his resignation on 22.7.10 (forenoon). He was relieved and thereafter, the second choice Sh. Vijay

Kumar Joshi was asked to join the office. Accordingly, he has joined the office on 30.7.10.

Executive Committee noted the same.

Agenda Item No.5 Engagement of Sh. Lal Babu Mahto,

Ex-UDC It was noted that as per decision of 158th meeting of Executive

Committee dated 28.6.10, it was decided to engage Sh. Lal Babu Mahto, Ex-UDC for preparation and maintenance of Central Register of

Indian Medicine. Sh. Lal Babu Mahto, Ex-UDC has been engaged on consolidated salary of Rs.12,000/- PM for six months in the first instance.

In response of the same he has joined he service w.e.f. 05.7.10.

Executive Committee noted the same.

Agenda Item No.6 Ratification of the Action Taken by President, CCIM.

1. Om Ayurved College Betul

It was noted that after receipt of various complaints of students in respect of Om Ayurved College, Betul regarding non-availability of

teaching staff and infrastructure etc. to verify the same the visitation was conducted on 27.7.2010 by the visitors of the CCIM and the verification

report has been sent to Government of India for taking into consideration at the time of disposal of the case for the session 2010-11.

Executive Committee ratified the same.

2. Reporting regarding Ayurved Medical College & Hospital, Chalakari Village, Mahe, Pudduchery.

It was noted that after receipt of the proposal from the Government of India, the proposed college was visited on 12 & 13th July, 2010 by the

visitors of the CCIM for examination of the Scheme. After assessment of the visitation report in view of the criteria adopted by Executive

Committee in its meeting held on 28.6.2010 the recommendation to Government of India for granting permission for establishment an

Ayurved College as proposed by Government of Puducherry was sent.

Executive Committee agreed to the same.

3. Consideration of verification Report of Sri Sri College of

Ayurvedic Medicine & Research, Bangalore

It was noted that to verify the revised data of OPD and IPD and the physical

verification of newly appointed teachers as per the compliance received from Sri Sri College of Ayurvedic Science and Research, Bangalore, the college was

visited by the verification team consisting of following visitors on 05.07.2010.

i. Dr. PK Jain ii. Dr.KC Ballal

iii. Dr. Vaishali Mali, Ayurveda Expert

After assessment of the verification report the same observations were sent to Government of India with the relevant record.

Executive Committee ratified the same.

4. Consideration of verification Report of Sri Sai Ram Ayurved

College, Chennai.

It was noted that Government of India vide letter No. R.17011/189/2009-EP dated 28.07.2010 forwarded the documents

submitted by the college namely Shri Sai Ram Ayurved College, Chennai at the time of hearing for verification and genuineness of the records

received from Govt. of India regarding to the grant of permission to Sri Sairam Ayurved Medical College, Chennai

After examination of the record as provided by the college, the bed

occupancy has been informed to the Government of India.

Executive Committee ratified to the same.

Agenda Items No. 7 Special allowances to Expert of

Ayurved, Unani and Siddha.

It was noted that considering the observations of the President, CCIM that Experts of the Ayurved, Unani and Siddha have put their best effort

to complete the entrusted work of assessment of visitation report of 252 Ayuved, 41 Unani and 9 Siddha college to maintain the transparency and

considering that they have worked more than the Regular Employee of the CCIM by contributing a lot in respect of examination of teaching

experience, duplicity of teachers etc., therefore, special allowance to the experts may be paid on similarity to Regular Employees.

Executive Committee ratified to the same.

Agenda Items No. 8 Reporting of the decision in respect of

document forwarding by the Govt. of India submitted by the Unani College.

It was noted that Govt. of India has forwarded the document submitted

by the college at the time of hearing in respect of following Unani Colleges. The details are as under:-

years teaching gap since they last taught and as

per policy adopted by CCIM to assess the

eligibility of teacher, more than 3 years gap in teaching is not

acceptable. Therefore, all new appointed teachers

as Reader can not considered eligible for re-employment as teacher.

12 higher faculty in the college and submitted

documents (6 pages) in support of their claim in

regard to the higher faculty, and these papers are being sent to the

Council in original to examine and verify these

documents in original and return with Council’s views and comments within 07

days.

including 12 higher faculties, whereas, as per

visitation report of 2010-11, there were 31

teachers including 11 higher faculties and after further scrutiny, it was

observed that one Professor had submitted

fake experience certificate. Therefore he was not considered as

eligible teacher. 2. Regarding

promotion of one Lecturer to Reader, it has been observed that the

lecturer was appointed on 18.10.2005 and

promoted to the post of Reader on 2.1.2010

without completing 5 years teaching experience as per norms

of the CCIM. Therefore, teacher in question can

not be treated a reader. Therefore, the previous observations of 30

teachers including 10 higher faculty of CCIM

remain same.

3. Calcutta Unani

Medical College, Kolkata (WB)

To examine and verify the

documents of newly appointed teaching staff in regard to the eligibility of

teachers.

1. College has appointed

three higher faculties (one Professor-cum-Principal, one Professor

and one Reader). Out of three new higher

faculties, two Professors were found to be eligible as per norm of CCIM;

however, teaching eligibility of new

appointed Reader can not be considered due to three times break of

various duration (6 months to 3 years) from

continuous teaching, in previous three institutions where he

taught.

2. Four Lecturers have been promoted to the

Reader in concerned subjects as per CCIM

norms and hence may be treated eligible for the post of Reader.

In view of above, the college has a total 33

eligible teaching staff including 14 higher faculties.

4. Mohammadia Tibbia College.

Malegaon (MS)

The representative of the College submitted that they

have 41 teachers including 19 higher faculty and 180

beds are available in the college, they also informed that after CCIM visit they

have appointed 4 teachers and submitted documents

in support of their claim in regard to the teaching faculty and hospital, and

these papers (44 pages in original) are being sent to

you Council examine and verify the documents and

return in original with Council’s views and comments within 07 days.

1. College did not submit the affidavits and UG &

PG degrees of newly appointed teachers and

in absence of the same, the newly appointed teachers can not be

considered as eligible. Further, no copy of

promotion order enclosed for Dr. Alisha Ansari Mohd. Suleman (Sr. No.

21) which is shown as Reader since 01.12.2009

in new list of teaching staff submitted to the

Govt. of India by the college while she is a lecturer in visitation

report of 2010-11.

Therefore, the previous observation of CCIM about teaching staff

remains same i.e. 37 teaching staff including

18 higher faculty. 2. Sr. No. 14 (Dr.

Rahmani Shaheda) is MD Ilmul Advia (Jamia

Hamdard) as per copy of degree certificate not MD Amraz –e-Niswan (Jamia

Hamdard) which seems to be a typing error.

3. College claim of having 180 beds against

supported with the documents (letters of

University of Pune, Govt. of Maharashtra, previous visitation report of CCIM

etc.) can not be taken into consideration as

college itself has written 150 beds in the visitation report

which has been verified by the

visitors.

Agenda Item No.9 Consideration of visitation Report of H.A.H. Unani College, Dewas- Reg.

It was noted that H.A.H. Unani College was not permitted by the Govt. of

India for the session 2008-09 on the recommendation of the CCIM. The student admitted in the year 2008-09 filed the case in the Hon’ble Court

at Jabalpur. The Hon’ble Court stayed the order of Govt. of India for not granting permission for the session 2008-09 and asked the CCIM to

verify the fulfillment of shortcomings as per Regulations. Accordingly college was visited on 23rd January, 2010 and visitation report was

forwarded to Govt. of India. The Govt. of India did not grant the permission vide order No. 17012/19/2009-EP dated 15.6.2010,

Government of India did not grant permission for the session 2009-10 also vide letter No.17012/19/2009-EP dated 3.8.2009. To verify the

compliance of the shortcomings the college has been visited again on

17.7.2010. The visitation report is placed below for consideration.

Executive Committee decided that as college is not fulfilling the criteria as per decided policy of Government of India so the

college is not recommended. Accordingly the decision may be communicated to Government of India.

Agenda Item No.10 Reporting of decision in respect of

document forwarded by Govt. of India submitted by the college at the time of

hearing.

It was noted that Govt. of India has forwarded the document of the following Siddha Colleges submitted by the college at the time of

hearing. After examination following decisions have been taken.

is in the office within stipulated time, therefore, after examination the recommendations may be sent to Government of

India.

Executive Committee noted that Government of India has granted

permission to some colleges against the recommendations of the CCIM. Executive Committee decided to obtained the legal opinion

in the matter whether Government of India may grant the permission against the recommendations of the CCIM or not.

Agenda Item No.12 Revision of draft Proposed PG Regulations

It was noted that draft proposed Regulation namely “Indian Medicine

It was noted that it is understood from the media (printing and electronic) that some of the Ayurved and Unani colleges have been

raided at various places in the Country by CBI. Executive Committee decided to obtain the legal opinion of Senior Legal Counsel.

If necessary, President, CCIM is authorize to take legal action after

obtaining legal opinion of senior advocate initiate if any required to protect the interest of CCIM and clarify the position of the CCIM before

the appropriate authority.

President, CCIM adjorned the meeting for 18th August, 2010 for

same, it is not possible to furnish the recommendation to

the Government of India.

Therefore, it is not recommended to the

Government of India for granting permission for the

session 2010-11.

28. Bharti Veedyapeeth, Pune It was noted that 06 new teachers have been appointed

and 04 Lecturer have been promoted as Reader. But

after overall assessment of the teaching staff it has been

observed that even then college does not fulfill the

requirement of teaching staff

for the remaining subjects for which it was not recommended

earlier.

The recommendation of the CCIM remains same.

29. TMAE Society’s Ayurved Medical College, Nidgi

30. Amrita Ayurved Medical College,

Kollam

It was noted that college has

submitted the list of 39 teachers by adding 02 new

teachers and deleting 02 teachers alongwith with the

OPD record from 6th March 2010 to 15th June 2010. After

assessment it was observed

that there are 38 eligible teachers and 05 are ineligible.

However, as daily average attendance of patients in OPD

was 93.68 per day. On the basis of information from 1st

January, 2009 to December, 2009 whereas college has

submitted the information from 6th March, 2010 to 15th

June 2010, therefore, it is not possible to make the

recommendations in the matter.

31. SGV Ayurved College Bailhongal After going through the

recommendations of screening committee and other all the

relevant records, it was decided to not to

recommend to Government of India for issuing the Letter

of Permission for the year 2010-11.

UNANI

As per instructions of the President, CCIM, Dr. Rashidullah Khan, Member, EC was requested to visit the office on 17.8.2010 to examine

the documents forwarded by Government of India submitted by the

colleges at the time of hearing of same. The same has also been examined by Dr. Rashidullah Khan, Member, EC.

The supporting documents in favour of Professors at serial No. 1 & 2 (Prof. Ghulam Jeelani & Prof. Saad Usmani) are not enclosed, therefore, they will be treated as Reader as per information furnished by the college itself in the latest visitation report. Similarly, in absence of supporting documents, Sr. No. 7 Dr. Mohd. Hasan will be treated as lecturer (as per latest Visitation Report) not Reader.

2. Sr. No. 8-12 are Medical Officers and deputed in the College vide State Govt. order dated 03.11.2009 (for Sr. No. 8) and 16.12.2009 (Sr. No. 9-12). They have been deputed as lecturers around 7-8 months ago and now shown as Reader. These Medical Officers can not be treated as eligible teachers as reported earlier.

3. Similarly, Lecturers from Sr. No. 20-31 can not be treated as eligible lecturers as reported earlier because all of them are Medical Officers transferred to the college on various dates.

In view of above, there are only 14 teaching faculty including 6 higher faculty (Readers) in the college.

Further, OPD & IPD information of pervious 6 months submitted by the college can not be verified without supporting documents.

State Takmil-ut-Tib College, Lucknow (UP)

Govt. of India has forwarded the documents of State Takmil-ut-Tib College, Lucknow submitted by the college during hearing for examination and to furnish the opinion of CCIM in the matter related to grant permission to the college for admission to the BUMS course for 2010-11.

The documents have been examined and following observations have been made- 1- Regarding Eligible Teaching Staff: College has submitted department wise list of teaching staff of 34 including one Principal. Among them, 14 are Medical officers transferred to the college by Sate Govt. order on various dates. The Department of these Medical officers shown in new list is different from what has been furnished by the college during recent visitation report and which has duly been verified by the visitors also. Their designation has also been changed from lecturer to Reader or Professor in a short span (against the norms). The

Now College submit the sum of constructed area of two lands in the name of college and similarly the sum of constructed area of two lands in the name of Hospital and that comes at par with the norm. It has also been observed that college and Hospital are running at 4 places.

3. OPD and IPD: The record of 2009 for OPD and IPD was furnished by the college itself and which has been verified by the visitors also. However as per 5 months OPD and IPD record (Jan to

May 2010) submitted by the College, OPD is about 185/day and IPD is near about 50%. In view of the above, college may not be

recommend for granting permission for the session 2010-11.

SIDDHA

It was noted that documents submitted by the Sri Sairam Siddha Medical

College, Poonthandalam, West Tambaram, Chennai were examined and it has been observed that college has not submitted the desired documents

to examine the matter, therefore, it is not possible to arrived at suitable decision, therefore, it may not be recommended for the permission for

the session 2010-11.

After going through the recommendations of screening committee and other all the relevant records, Executive

Committee decided to recommend to Government of India for issuing the Letter of Permission for the year 2010-11.

Addl.Agenda Items No.5 Ratification of action taken by

President, CCIM

It was noted that WPNo.33/2009 was filed by KB Nagur V/s Government of India, the Government of India asked the CCIM to defend the case on

behalf of Government of India. Accordingly affidavit was filed.

It was further noted that Retainer of CCIM and Advocate of Supreme Court of India desired to engage the Senior Advocate for strengthening

our legal defense in the Court as writ petition was challenging certain statutory provisions of IMCC Act, 1970. Accordingly, Mr. Harish Salve

was appointed and Rs.3.20 lakh for the same has been paid to Shri Rakesh Upadhyaya for the same on account to engage the senior

advocate. The case was heard on 30.7.2010 and Hon’ble Court passed an order.

Executive Committee ratified the same.

Addl. Agenda Item No.7 Consideration of proposals received

from Government of India under section 13A of IMCC Act, 1970 in the

year 2010-11 for starting PG course and increasing intake capacity in UG &

PG Course.

It was noted that following proposals as per details given below have been received from the Government of India for recommendation to

issue the letter of Intent or not at first instance.

Executive Committee while considering the matter noted the following

points-

i. As per Regulations namely IMCC (Post-graduate Ayurved Education) Regulations, 2005 the Post Graduate Education Centre

shall satisfy the entire minimum requirements of UG training as prescribed by CCIM alongwith the other requirement.

ii. Government of India has conditionally permitted all colleges for the session 2010-11. CCIM itself has felt that if 100% norms are

followed 50-60% college will not be in position to get the permission.

iii. Applicant college should be recognised by CCIM for running UG or PG Course in Ayurveda, Unani and Unani Tibb at least 5-1/2 years

and 03 years respectively.

iv. Following colleges have applied last year also. The decision of the Government of India in the matter are still awaited.

Addl.Agenda Item No.7 Visitation report of Mohammadia Unani Medical College, Nanded.

It was noted that a proposal of Marathwada Education Society for establishment of new college namely Mohammadia Unani Medical

College, Nanded (MS) was received through Government of India. After going through the recommendations of screening committee and other

all the relevant records, it was decided not to recommend to Government of India for issuing the Letter of Intent for the year 2010-11.

Executive Committee disapproved the scheme.

Addl.Agenda Item No.8 Enhancement of consolidated salary of Ayurveda, Unani &

Siddha Experts working in CCIM

it was brought to the notice of Executive Committee that Ayurveda,

Unani and Siddha Experts engaged under the scheme of TKDL are getting more consolidated salary from the CCIM.

However, Executive Committee decided that on the tuning of TKDL the

consolidated salary paid to Ayurveda, Unani and Siddha Experts be

enhanced as follows:-

a. Experts who join the CCIM with one year experience 35,000/- pm b. Experts who join the CCIM without any experience 30,000/- pm

Addl.Agenda Item No.9 Regarding fake documents.

It was noted that as per observations of Hearing Committee held on 22nd,

23rd and 24th July, 2009 the letters in respect of 39 colleges submitted the false affidavit in respect of 57 teachers and 18 teachers were working

in the two or three places among the 18 colleges were asked for

clarifications vice-versa.

The comments received from the colleges and teachers were tabulated. After going through the same only 26 colleges have responded but

except seven teachers have not submitted their comments.

However, the matter was placed before the Executive Committee in its

meeting held on 17-18.5.2010 and further Executive Committee discussed the issue and decided to prepare the details regarding duplicity

and false Experience/ Affidavit of last year and of this year and the same be placed before Executive Committee for consideration.

Executive Committee constituted a sub committee consisting of following

members to finalized the matter of fake documents submitted by the college or false affidavit submitted by the teacher. It was decided that

after scrutinize the documents, if Committee feels necessary, the hearing may be called of College as well as teachers as the case may be.

i. If any college found guilty, FIR for submission of fake information may be lodged against the institution.

against the teacher and he will not treated as Teacher. iv. The list of Black Listed teacher should be circulated among the

college for non-appointment of blacklisted teachers. v. If any college appoints such teacher will not be considered as

teacher and list of Black Listed teaching staff will be displayed on the web site

It was further decided that the Sub Committee should chalk out the matter within 15 days and submit the action taken report to the ensuing

meeting Executive Committee.

It was noted that agency is not providing the emoluments like bonus

etc., uniform and other benefits etc., as per settle terms and conditions therefore, Executive Committee decided to enquire the matter.
