OnWednesday,May12th,themorningandnoonisatyourowndisposalwhereyoucandowhateveryouliketodo.At2PMwewillmeet at theVIP catering tent of Villa Cortine PalaceHotel at theMilleMiglia pit stop area (bigparkinglot)infrontoftheCastelloScaglierowherewewillhaveawonderfullunchtogetherwhilewewatchtheracefromthebestavailableandmostcomfortableseats.Ataround2.30PMthefirstcarswillappearinSirmioneandwewill bepart of theexciting spectacleofmore than400historical race cars from1927 to1957. If youhaveneverexperienced this before, you can not imagine the atmosphere that comes from this race. The last carwill leaveSirmioneataround6PM.

1.Services/Performance

Palm Island Car Tours (hereinafter referred to as PICT) organizes guidedadventure tours and road trips for self-drivers with rented sports cars -mostlyof theChevroletCorvettebrand - aswell as for travelerswith theirown vehicle. The scope of the services is described in detail in the offerbrochure. PICT reserves the right of changes to individual travel services,whichbecomenecessaryafterconclusionof thetravelcontractanddonotquestion the overall character of the trip. PICT endeavors to allocate theprovidedvehiclesaccordingtothewishesofthetraveler,howeveraclaimtoacertainvehicledoesnotexist.2.Minimum/maximumagerequirement

Participants driving a highly motorized rental vehicle - provided by PICT -themselves must be at least 30 years of age and in possession of an EUrecognizedcardriverslicenseforatleasttenyearswhenthetourstarts.IDPisrequiredinmostEUcountries.Iftheparticipantisolderthan75years,heneedsamedicalcertificatethatheishealthyenoughtoundertakethetour.3.Registration/Payment

Byregistering,thetravelparticipantconcludesatravelcontractwithPICTforhimselfaswell asall listed fellow travelers.Thecontract is concludedwiththeacceptancebyPICT.UponconclusionofthecontractPICThandsoutthetravelconfirmationtothetravelparticipant.Uponregistration,adepositofUSD1,500.00pertravelermustbepaid,theremainingtravelpricemustbereceivedbyPICTno later than fourweeksprior todeparture.Thetermsofpaymentaregiventothetravelparticipantatregistration.4.Liabilityofthetouroperator

PICT is liable for the correctness of the stated travel services as well as aconscientioustravelhandling.Transportationwithexternalserviceproviders(e.g.,bus,train,taxi)issubjecttotheconditionsoftherespectivecarrier.IntheeventofcancellationofajourneyduetoForceMajeure,PICTretainstherighttoappropriatecompensationforservicesalreadyprovidedornecessaryforthetravelconditions.ThecontractualliabilityofPICTfordamages,whicharenotpersonalinjury, is limitedtothreetimesthetravelprice,asfarasadamageofthetravelerisneitherintentionallynorgrosslynegligentlycausedorasfarasPICTisresponsibleforadamagetothetraveleralonebecauseofafaultofaserviceprovider.Thismaximumliability isvalidpertravelerandjourney. PICT is not liable for damages caused intentionally or grosslynegligently by the travel participant. PICT is also not liable for anyperformance disturbances in connection with services that are merelyprovidedasthird-partyservicesandthatareexpresslyindicatedinthetraveladvertisementas a third-party service.A claim fordamagesagainstPICT isexcluded. IfPICT is a serviceprovider inother cases,PICT shallbe liable inaccordancewiththeprovisionsapplicabletoit.Theparticipantisobligedtoassistintheeventofperformancedisruptionsinordertoavoidorminimizeany possible damage. In particular, the traveler is obliged to report hiscomplaintsimmediatelytotheorganizer.Heisobligedtoprovideremedies,if possible. If the traveler culpably fails to report a deficiency, the right toreductiondoesnotapply.5.Liabilityofthetourparticipant

The travelerparticipateson the journeyathisown risk.He is instructed inthe handling of the vehicles and is responsible for compliance with theHighway Code and all legal requirements. The traveler is liable for self-inflicted accident and other damage to PICT mediated vehicles up to theamountofexcessEURO5,000 (ca.USD6,000)per claim.Theparticipant isliable without limitation if he caused the damage by intent or grossnegligence or if the damage was caused by alcohol or drug-related unfitdriving,incaseofaccidentorprovenimproperhandlingofthemediatedbyPICTvehicle.6.Cancellation/rebookingoftheclient

PICT recommends the conclusion of a travel cancellation insurance. Thecancellationfeesvarydependingonthelength,typeanddestination/routeof the trip, so please refer to the respective offer brochure. The resignedparticipant is at liberty to prove that PICT did not incur any damage or asignificantlylowerdamagethanthelumpsumdemandedbyhim.Thetravelparticipantmayrequestthatathirdparty(substitute)enter intotherightsandobligationsofthetravelcontract.PICTcanonlyobjecttothechangeinthepersonifthereareimportantreasons(forexample,lackofavailabilityoftwosingleroomsinsteadofadoubleroom).Arefundforunusedservicesisnot provided, this applies in particular to the non-timely arrival at thebeginningofthetriporforearlierdeparture.Arefundforunusedservicesis

notmade,thisappliesinparticulartotheuntimelyarrivalatthestartofthejourneyorforearlydeparture.Inthiscase,PICTreservestherighttochargeseparately for any additional expenses (for example, for an additionallodgingortransfer).7.Cancellationofthetourorganizer

PICT may terminate the travel contract without notice, if the journey ispermanentlydisturbedbythetravelparticipantorifapermanentimpropertreatmentofthevehiclesbrokeredbyPICTisdetected.Anyadditionalcostsfor thereturn journeyshallbebornebytheexcludedtraveler.PICTretainsthe right to the travel pricewith deduction of saved travel expenses. PICTshall be entitled to terminate a travel contract up to four weeks prior todeparture, if its execution is unreasonable for PICT after exhausting allpossibilities,becausethecostsincurredintheeventofexecutionexceedtheeconomic limitof thevictim's travel costs ifPICT isnot responsible for thecircumstances leading to the cancellation and proves the circumstances. Ifthe trip is canceled for this reason, without the traveler claiming thealternativeservice,hewillreceivethepaidtravelpricebackimmediately.8.Safety

ThePICTroutesarecarefullyselectedroutesthatusuallytakeplaceonminorroads. Sections with higher traffic such as highways are possible anddepending on travel route also necessary. The vehicles used by PICT areregularlymaintainedandare inexcellenttechnicalconditions.Theycomplywithalllegalregulationsinallaspects.ThetouroperatorstrivestocarryoutthePICTtourstothecompletesatisfactionoftheparticipants.Thepresenceattheinstructionfortheuseofthevehiclesisobligatoryforallparticipants,whodriveonethruPICTprovidedvehicle.All Instructionsgivenbythetourmanagementtotheparticipantsarebinding.

9.Insurance

Included in the travelpriceare themotorvehicle liability insurance,a fullycomprehensive insurancewith a deductible of € 5,000 (ca. $ 6,000) and apassenger accident insurance. In case of damage, the tour guidemust beinformed immediately. The conditions of the insurance contract can beviewedbythetravelparticipantatPICT.Thetravelpricedoesnotincludethebaggage and travel cancellation insurance. PICT recommends that youconcludeatravelinsurance,especiallyonewithrentalcardamageprotector.10.Generalprovisions

ClaimsagainstPICTmustbemadeinwritingno laterthanonemonthaftertheendof the tripat the registeredofficeof theorganizer.Afterexpiryoftheperiod,theparticipantmayonlyassertclaimsifhehasbeenpreventedfromobserving thedeadlinewithout fault. Contractual claims for damagesbecometime-barredaftertwoyears.PICTinformsthenationalsofthestatein which the travel is offered about travel, passport, visa and healthregulations as well as their possible changes before departure. Theparticipantisresponsiblefortheobservanceofallimportantregulationsfortherealizationofthejourney.Alldisadvantages,inparticularthepaymentofcancellationfees,resultingfromthenon-compliancewiththeseregulationsare at the expense of the customer, unless they are caused by culpablemisinformationornon-informationofPICT.Allcostsnotincludedinthetourprice,suchaswarnings(fines),areindicatedseparatelyintheofferbrochure.Verbal agreements require the written confirmation to be effective. TheparticipantcansuePICTonlyat itsseat.PICT'sclaimagainstthetraveler isgoverned by the latter' s domicile, unless the action is directed againstregistered traders or persons who have moved their domicile or habitualresidenceabroadaftertheconclusionofthecontractorwhosedomicileorhabitualresidenceisatthetimeofActionisnotknown.Inthesecases,theseatofPICTisauthoritative.11.Ineffectiveness
