order at 8:34 a.m. Agenda: The agenda for this meeting was filed with the Office of the Lieutenant

Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

and unanimously carried to approve the April 19, 2013 minutes with amendments as follows, and executive session minutes as circulated.

Contractors License Board Minutes of the May 17, 2013 Meeting Page 3 Chapter 91, HRS, Chairperson Lau called for a recess from the Board’s meeting at 8:35 Adjudicatory a.m. to discuss and deliberate on the following adjudicatory Matters: matters pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractors License of John J. Richard, dba Jack Richard Construction; CLB 2009-178-L

RICO received a complaint alleging that John J. Richard, dba Jack Richard Construction (“Respondent”) failed to make certain disclosures and that some required information was missing from the contract.

The Board discussed the settlement agreement in which

Respondent, who does not admit to violating any law or rule, agrees to pay an administrative fine of $1,000.00.

After discussion, it was moved by Mr. Yamada, seconded by Mr. Lee, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Petition for Declaratory Relief a. In the Matter of the Petition for Declaratory Relief of District

Council 50 of the International Union of Painters and Allied Trades and Aloha Glass Sales & Service, Inc.; CLB-DR-2006-2

Deputy Attorney General (“DAG”) Tam summarized the above

case which went to the Hawaii Supreme Court which remanded to the Board to reconsider whether the jalousie window work qualified as “incidental and supplemental” to the Project in light of the cost and extent of work involved.

The Board had a lengthy discussion on the court’s opinion and deferred the matter to its July 2013 meeting to reconsider the matter in light of the Court’s decision. In addition to the specific Project in the case, the Board also has to decide how to implement the Court’s decision when making future scope determinations. DAG Tam also recommended that the Board consider amending the C-5 scope and removing “incidental and supplemental” in its definition, as “incidental and supplemental” already applies to all of the “C” specialty classifications.

pursuant to HRS chapter 91, Chairperson Lau announced that the Board was reconvening to its open meeting at 9:59 a.m.

Executive At 10:00 a.m., it was moved by Mr. Lee, seconded by Mr. Polischeck, Session: and unanimously carried to enter into executive session to consult with

Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:06 a.m., it was moved by Mr. Lee, seconded by Mr. Mochida, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Chairperson Lau asked if anyone had any comments on the DC 50 case,

to which no one replied. It was moved by Mr. Lee, seconded by Mr. Mochida, and unanimously

carried to defer further discussion on the DC 50 case to the Board’s July 19, 2013 meeting.

The agenda was taken out of order and continued with “Committee

Reports, 6. Scope of Activity Committee.” Committee Reports: 6. Scope of Activity Committee: Gerald Yamada, Chairperson Dept. of Land and Natural Resources The Dept. of Land and Natural Resources (“DLNR”) requests

reconsideration of the Board’s September 23, 2011 informal interpretation that a C-32 Ornamental, guardrail and fencing license is required to bid and install a DLNR fencing project on the slopes of Mauna Kea, and clarification as to when a license may be required for the installation of DLNR ungulate control fences.

Esther Kia’aina, Deputy Director of DLNR, Emma Yuen, NARS

Coordinator, and Cindy Young, Deputy Attorney General representing DLNR, were in attendance.

Ms. Kia’aina stated that DLNR is requesting clear guidance from the

Board so they can continue on their watershed fencing initiatives as projects are being postponed due to challenges during the bidding process. They recently received increased funding for the watershed initiative and the State will be matching the federal funds. She also stated that they will abide by the Board’s decision as to whether a contractor’s license is required to move forward.

Contractors License Board Minutes of the May 17, 2013 Meeting Page 5 Deputy Attorney General Cindy Young stated that the fences are in

different locations, such as remote areas with steep terrain and vegetation, pedestrian access areas, and vehicular access areas. The fences are made of mesh and wire with no gates, but sometimes there are step-overs. Some step-overs are for management access only and some are for management and public access.

Mr. Yamada asked if this project was right next to Saddle Road. He

noticed there is a new fence line that is 18-1/2 miles long. Ms. Yuen stated that the Mauna Kea project was not the real issue and

they were requesting more of a policy clarification based on prior Board determinations to avoid being challenged in future contracts.

Ms. Yuen explained that some areas are accessible and open to the

public but because there are no trails for people to use, they are accessible only by helicopter. They will use a helicopter to scope the location first and then clear the area for the contractor to install the fence. The sole purpose of these fences is to keep out feral goats, pigs, and other animals.

Ms. Yuen also stated that when they hire people to install the fences they

usually look for people with past experience in this type of fence construction and those who are familiar with helicopter safety. Usually, if the fence will cross a road, then they install a gate.

At 10:45 a.m., it was moved by Mr. Mochida, seconded by Mr. Suehiro,

and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

DLNR Chairperson Aila’s memo stated that the fences are located in

three types of areas: (1) helicopter access only (wilderness areas without vehicular access or public trails); (2) pedestrian access (wilderness areas without vehicular access but with public trails that intersect or follow the fence line); and (3) vehicular access (areas with public or management-only vehicular access to certain sections of the fence line).

The Board discussed these issues and noted that fencing work on federal

property performed by DLNR employees does not require a contractor’s license. In addition, HRS section 444-2(1) exempts officers and employees of the United States, the State, or any County from the requirements of HRS chapter 444 while those individuals are performing their governmental duties. Thus, if DLNR used its own employees to perform the fencing work and such work fell within the scope of those

employees’ governmental duties, a contractor’s license would not be required.

The Board also felt that, consistent with its prior determinations, portions of the fencing work without public access would not require a contractor’s license.

The Board stated that the primary factor in these fencing cases is how

accessible the fence is by the public. This is decided on a case-by-case basis and depends on the specific facts of each case. The Board discussed whether the C-32 license is required when there is minimal access to the area. They also discussed whether inaccessible portions of a fencing project may be performed by an unlicensed contractor. Just because there is a remote possibility that a hiker or member of the public may come across a fence that is located in a remote area or an area that has minimal access does not make the fence “accessible by the public”.

Recommendation: Based on what was presented, the Board determined that: (1) Helicopter access only – no license required;(2) Pedestrian access – C-32 license is required; and (3) Vehicular access – C-32 license is required. The Board suggested that DLNR could always break the project up and issue separate RFPs/IFBs based on the portions that are or are not accessible by the public. Thus, one RFP/IFB would require a C-32 license, and one RFP/IFB would not. Finally, the Board clarified that the decision in the Hinton v. Young case (PCH 2005-3) was made by the DCCA Administrative Hearings Officer and not the Board. The Hinton case was a procurement protest case that involved fencing at the Kokee State Park on Kauai. In that case, DLNR estimated that approximately 225,000 people visited the Park each year. Because the project area may have been accessible to the public, the Board stated that it may not have concluded that a C-32 license was not required. Ms. Kia’aina thanked the Board for their decision. It was moved by Mr. Yamada, seconded by Mr. Suehiro (with Mr. Lee recusing himself) and carried to approve the above scope recommendation. Board of Water Supply The Board of Water Supply (“BWS”) requests determination on the classification required for the application of an interior coating system for a reservoir. The project calls for the removal of the existing reservoir interior lining and the application of a new coating system. The performance requirements state that the interior coating system is to bond

with the concrete surface and prevent the passage of water resulting in a watertight structure. Felix Agraan, project manager for this Board of Water Supply project, stated that there have been challenges in awarding this contract. The reservoir lasted 19 years before having repairs done, including the installation of a liner system and application of interior coatings. Leaks have again appeared and the repair work includes removal of the existing interior lining and applying a new coating system to waterproof the interior reservoir wall. Mr. Agraan stated that they normally do not coat the interior of reservoirs other than for leak repair. A bid was opened in April and Ralph S. Inouye Co., Ltd. was the low bidder. They had listed a C-33 Painting and decorating contractor as their sub to do the interior coating and BWS requests the Board’s determination if the C-33 contractor can do this work. Mr. Agraan also stated that they usually don’t indicate which license is required for a project and leave it up to the contractor to list its subs. Mark Stiglmeier of Coating Works Hawaii, Inc., the C-33 contractor, stated that he believes the specifications allow him to bid for the project because it referred to “emulsion cementitious material”, which is a protective coating and which he is allowed to apply. He stated that he has done this type of work on 11 tanks within a 6-year period. The coating protects the concrete and also protects the water from the concrete, and acts as a moisture barrier. The coating can be applied by sprayer or slurry mortar. He only bid on applying the coating but not the waterproofing. Mr. Stiglmeier is also approved by the manufacturer to apply this type of coating. Aaron Ho of DC 50 stated that he represents the Glaziers union which has signatory C-33 and C-55 contractors bidding on the project. Mr. Stiglmeier stated that the plans had mentioned interior and roof coating, so he believed it meant interior coating and not waterproofing. Mr. Agraan confirmed that the interior coating work is for the purpose of waterproofing.

performed by a contractor holding the C-55 Waterproofing classification. It was moved by Mr. Mochida, seconded by Mr. Polischeck, and

unanimously carried to approve the above scope recommendation. Crown Castle Crown Castle requests determination on whether the C-68TN

Communication tower license is required to perform the following work on communication towers:

1. Replacing corroded tower components and/or painting tower

components. Does climbing the tower require the C-68TN license?

2. Adding appurtenances to existing mounts, such as changing

antennas and coax or fiber cables. Does it matter if work is performed by climbing the tower or from a man lift?

3. Adding new antenna mount structures, antennas, and coax or

fiber cables to an existing tower structure. 4. Building a new tower and adding new appurtenances and mounts. Arnold Wong of the Ironworkers Local 1186 stated that the C-48

Structural steel classification should be required for the work as stated above and not the C-68TN.

Recommendation: Scenario 1: Replacing corroded tower components

may be performed under the C-68TN or C-48 Structural steel classification. Painting tower components may be performed under the C-68TN or C-33 Painting and decorating classification. The act of climbing a tower does not necessarily require a contractor’s license.

Scenario 2: Adding or replacing antennas, coax cables, or fiber cables on

existing mounts and towers may be performed under the C-68TN, C-13 Electrical, or C-15 Electronic systems classifications. Whether work is performed by climbing the tower or from a man lift is not relevant.

Scenario 3: Adding new mount structures to an existing steel tower

structure may be performed under the C-68TN or C-48 classification. Adding new antennas, coax cables, or fiber cables to an existing tower structure may be performed under the C-68TN, C-13, or C-15 classification.

Scenario 4: Building a new tower and adding new appurtenances and

mounts may be performed under the C-68TN classification. The C-48 may build a new steel tower and add mounts.

carried to approve the above scope recommendation. Aubrey Silvey Enterprises, Inc. Aubrey Silvey Enterprises, Inc. requests clarification on the scope of the

C-63 High voltage electrical classification, and whether it includes installing substations and transformers, pouring piers, erecting steel, grounding, etc.

Mr. Wong of the Ironworkers Local 1186 testified that the C-48 Structural

steel classification should be required for the structural steel portion of the work.

Recommendation: Generally, the C-31 Masonry or C-31a Cement

concrete contractor classification is required to pour foundations, and the C-41 Reinforcing steel or C-48 Structural steel license may be required to erect steel. The C-13 Electrical or C-63 High voltage electrical license is required for running conduit, and installing transformers, breakers and equipment stands, depending on whether or not the work involves electrical energy of more than 600 volts.

Mr. Lee briefly summarized the following bills affecting the Board: SB No. 1077 – This bill restricts owner-builders to residential and farm structures and clarifies the owner-builder’s responsibilities. This bill has been enrolled to the Governor. SB No. 512 – This bill exempts qualified out-of-state persons employed by contractors retained by a public utility from HRS chapter 448E (Electricians and Plumbers) license requirements and provisions of HRS

section 444-9.5 (one-to-one ratio). This became Act 65, effective April 30, 2013 and is to be repealed on June 30, 2018. SCR 84 – This Resolution requests that the Board assess and review all license classifications, licensing requirements, automatically granted licenses to general contractors, and compare our State’s licensing scheme with other states’ licensing schemes. It also requests the Board to evaluate the C-5 Cabinet, millwork, and carpentry remodeling and repairs classification, determine whether the rules appropriately reflect the Legislature’s intent regarding the scope of each classification, and suggest modifications to the licensing process. The draft report is due to the Legislative Reference Bureau by November 1, 2013. This Resolution was adopted by the House and Senate. DAG Tam stated that the entire Board should be involved in to reviewing the classifications and engage interested stakeholder in discussing the matter. If interested stakeholders have any comments or if they think the scope of the classifications should be changed, they should provide their comments and changes in writing, with justifications, to Executive Officer Oda by the end of June 2013. The Board will then provide a draft for the review by the interested stakeholders and public, and hopes to place the matter on the Board’s July 2013 agenda.

DAG Tam also suggested that requests for comments should be put on

the website and he also asked the General Contractors Association for their help in getting the word out.
