Report”. Chapter 91, HRS, Chairperson Arita called for a recess from the Board’s meeting at Adjudicatory 8:36 a.m. to discuss and deliberate on the following adjudicatory matters Matters: pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractors Licenses of Hirayama Brothers Electric, Inc., and Melva S. Hirayama and James W. Hirayama; CLB 2009-298-L and CLB 2009-333-L

RICO received a complaint alleging that Hirayama Brothers Electric, Inc., Melva Hirayama, and James Hirayama (“Respondents”) failed to comply with the one-to-one ratio of licensed electricians to non-licensed electrical workers on a project.

The Board discussed the settlement agreement in which Respondents,

who do not admit to violating any law or rule, agree to pay, jointly and severally, a fine in the amount of $5,000.00

After discussion, it was moved by Mr. Lee, seconded by Mr. Akasaki, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Board’s Final Orders

a. In the Matter of the Contractor’s Licenses of Three Point

Restoration, Inc., doing business as 3 Point Restoration Hawaii, Inc., also doing business as 3 Point Restoration Hawaii; Edward J. DeMattos; CLB 2007-210-L

An administrative hearing was held for the above case with Mr. DeMattos, RME of Three Point Restoration, Inc. (“3 Point”) appearing pro se. 3 Point failed to appear. The Hearings Officer found that 3 Point and the RME violated the Board’s laws and rules, among them non-disclosure of lien rights, not providing a written contract, RME failing to supervise and be on the job site, failing to comply with trade standards, and unlicensed activity. The Hearings Officer recommended that Respondent 3 Point’s license be revoked and Respondent DeMattos be required to pay a $2,000.00 fine.

and unanimously carried to approve the Hearings Officer’s recommended order as the Board’s Final Order in the above case.

b. In the Matter of the Contractor’s Licenses of Tevita S. Lauaki

aka Joe Lauaki and Uilani’s Custom Masonry & Design aka Stonecrete Hawaii Contractors LLC; CLB 2009-385-L

An administrative hearing was held for the above case and the hearings officer found that Tevita S. Lauaki, RME of Uilani’s Custom Masonry & Design LLC aka Stonecrete Hawaii Contractors LLC (“Respondents”), violated the Board’s laws and rules, among them failing to disclose and provide written notice to the Board of default judgments obtained against them, failure to disclose lien rights, and failure to comply with the terms of the contract with the homeowner. The Hearings Officer recommended that Respondents’ licenses be revoked, that Respondents pay restitution to the homeowner in the amount of $5,750.00, and pay a fine in the amount of $5,000.00 within 60 days of the Board’s Final Order. After discussion, it was moved by Mr. Akasaki, seconded by Mr. Mochida, and unanimously carried to approve the Hearings Officer’s recommended order as the Board’s Final Order in the above case.

Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Chairperson Arita announced that the Board was reconvening to its open meeting at 8:40 a.m.

At 8:48 a.m., it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Mochida, seconded by Mr. Dill, and

unanimously carried to defer Mr. Bresslauer’s application for licensure in the C-21 and C-51 classifications pending submittal of separate lists of additional projects.

unanimously carried to approve Mr. Aguirre’s application for licensure in the “B” classification.

unanimously carried to deny Mr. Qu’s application for licensure in the C-37 classification. Mr. Qu was informed that he can hire someone licensed

in the C-37 classification to be his RME and gain experience while working under him or her.

Executive Officer Tamanaha explained that the contractor’s license allows him

to contract or bid for work and if his employees will be performing the actual wiring work, they will need to be licensed in the electrical journey workers specialty classification (“EJS”) under HRS chapter 448E. Mr. Harmer stated that he is in the process of applying for the EJS.

k. Fu Xiang Wang (Individual) C-13 Electrical Executive At 11:15 a.m., it was moved by Mr. Sadowski, seconded by Mr. Kamai, and Session: unanimously carried to enter into Executive Session pursuant to HRS section

b. Tyrone J. Takahashi, RME (Reactivate) Solarcity Corporation C-13 Electrical Executive At 12:11 p.m., it was moved by Mr. Mochida, seconded by Mr. Kamai, and Session: unanimously carried to enter into Executive Session pursuant to HRS section

92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. At 12:14 p.m., it was moved by Mr. Dill, seconded by Mr. Akasaki, and

After discussion, it was moved by Mr. Dill, seconded by Mr. Akasaki, and

carried to approve Mr. Takahashi’s request for a conditional license, subject to the submittal of semi-annual updates on the Bank of America account and an annual credit report.

The agenda was taken out of order and continued with “Committee Reports”. Committee Reports: 1. Examination Committee: Guy Akasaki, Chairperson The Examination Summary for January 2012 was distributed in the Board’s

packet.

3. Legislation Committee: Denny Sadowski, Chairperson

Mr. Sadowski and Executive Officer Oda presented a summary of the

following bills: HB No. 1897 - This bill limits incidental work to one-half percent of the

contract value and has not been scheduled for a hearing. HB No. 1898/SB No. 236 – These bills change the composition of the

Board to six contractors, four non-contractors, and three “exclusive representatives of collective bargaining units”. Senate Bill 236 is scheduled for a hearing on February 28, 2012, and the Board will be submitting testimony in opposition to this bill.

HB No. 1969, HD1 – This bill creates a new section in the Board’s

laws regarding performance bonds and retainage on all projects. It

also amends HRS chapters 103 and 507. This bill was heard by CPC/JUD on February 22, 2012, and passed unamended.

HB No. 2748 – This bill licenses AC pipefitters, fire sprinkler

technicians, and solar technicians under the Board of Electricians and Plumbers. It prohibits owner-builders from doing this work and requires the one-to-one ratio of licensed workers. This bill was referred to the Finance Committee.

HB No. 1295 – This is the task force bill which was heard on February

22, 2012, and passed with amendments. 4. Rules Committee:
