(Information freedom law - IFG)

Article 1

§ 1 law purpose

Purpose of this law is it, the free entrance too that nearthe public places of the Federal Government availableinformation as well as to guarantee the circulation ofthese information and to define the basic prerequisitesunder which such information are supposed to bemade accessible.

§ of 2 definitions

1. Information -

a) all authorities of the immediate and indirect mana-gement including the special capabilities of the Fede-ral Government;

b) all devices which are responsible with the percepti-on of public tasks, and succumb to the control or a

comparable influence of authorities;

6. Perception of public tasks -

also the fiscal activity as well as the deliberation ofpublic places and other services for public places.

§ 3 field of application

(1) The rules about the entrance to information are va-lid for the public places of the Federal Government.

(2) also unions of public places of the Federal Go-vernment as well as the supervision of the FederalGovernment are Public places in the sense of this re-gulation subjecting legal persons of the public right.

(3) Public places in the sense of this regulation are not

1. the Bundestag within the framework of his activitynot public;

2. Courts, courts of auditors and other places, as far asthey become active due to special rules in judicial in-dependence;

3. Radio stations within the framework of their journa-listisch-editorial activity.

(4) a natural or legal person as well as a union of theprivate right are a match for A public place in thesense of this regulation, so far

§ 4 information freedom

§ 6 lodging an application

(4) 1 The Application is supposed to be made near theresponsible place. 2 Responsible Place is the place nearwhich the sought after information are available. 3 pa-ragraph 6 stays unchanged. 4 Ist the asked place notthe responsible place, so the asked place investigatedthat one to heel 2 responsible place and the proposerto appoint. 5 The Proposer can demand that the askedplace transmits his application to the responsible placeand informs him of that.

§ 7 decision on the application

(3) 1 As Far As extent and complexity of the sought af-ter information justify this, the period of time of theAbsatzes 1 can be prolonged to six weeks. 2 As Far Asthe complexity of the sought after information justifiesthis, sentence 1 can be extended to six weeks the peri-od of time of the Absatzes 2. 3 The Proposer is to be in-formed of the extension of deadline and their reasonsin writing. 4 paragraph 2 sentence 3 is valid accordingto.

(4) A further extension of deadline needs the authori-zation of the proposer.

Not granted (5) 1 Wird the application within the pe-riod of time mentioned in paragraph 1, this is re-garded as refusal. 2 This is valid at according to exten-sion of deadline, if in the periods of time of the Absat-zes 3 the application is not determined. 3 The claim toperiod of time protection can be gained stand-aloneon the legal procedure being valid.





§ of 8 costs

§ 10 protection of the official decision formationprocess

§ 11 protection of personal information

2. as far as their knowledge is necessary for the defini-tion, distinction, allocation or the Nachvollzug of offi-cial action or

3. when the data subjects as analysts, experts or to ha-ve produced a comment in comparable manner in apublic procedure

(4) Not for the business and business secrets in thesense these law's appertain in particular:

1. Information about ejections;

2. Information about health dangers;

3. Information above

a) Products in the sense of the food hygiene and re-quirement subject law, the meat hygiene law, thepoultry meat hygiene law and the wine law, if at theproduction, the processing or the introduction of aproduct in measure not unimportant against legal ru-les to the protection of health and security or econo-mical interests by consumers has been offended;

b) an in particular disgusting food taken into the traf-fic in numbers not unimportant, health damaging, butsuitable not for the consumption;

4. Information about recipients and height of publicpromotion means;

5. Information about bidders and the height of thecommandments at advertisements through publicplaces, as far as the inauguration date is closed;

6. Information about job receivers and agreed priceswith free hand awarded jobs of public places.

(5) § of 11 Abs. 1 finds corresponding application.

§ 13 authorization of the data subjects

(1) In the cases of the § 11 and 12 the responsible placerequests approval for the release of the sought afterinformation of that one or the data subject on requestsof the applicant or the proposer.

(3) Special categories of dates in the sense of the § of 3Abs. 9 of the German privacy act, when the data sub-ject agrees explicitly, may become only apparent.

§ 14 Restricted Information Entrance

The Federal Minister for interior issues a legal regula-tion for the nearer arranging of the requirements up tothe 31.12.2004 according to the § 15 and 16.

§ 18 invocation of the federal agent for the data pro-tection

(1) 1 A person that thinks that their information call zuUnrecht was refused or attention was not paid to theirinformation call zu Unrecht or for her receiving an in-sufficient answer from an authority can appeal, thefederal agent for the data protection. 2 The rules aboutthe legal legal protection stay unchanged.

"(4) For the enforcement of the claim to entrance to in-formation near the justice and execution authoritiesthe management legal procedure is reveals."

Article 4 change of the Administrative court order

(2) 1 As Far As extent or complexity of the sought afterinformation justify this, the period of time of the Ab-satzes 1 can be prolonged to six weeks. 2 The Contra-diction Leader is to be informed of the extension ofdeadline and their reasons within the period of timeof the Absatzes 1 in writing.

(3) 1 After transgression of the period of time mentio-ned in paragraph 1 or, if the contradiction leader ac-cording to paragraph 2 sentence 2 was informed, aftertransgression of the period of time mentioned senten-ce 1 in paragraph 2, the proposer can apply for legallegal protection. 2 it can demand the payment of necessary expenditures

4. In § following paragraph 3 is added to 99 VwGO:

5. § 152 of the Administrative court order is changedas follows:

a) Following paragraph 2 is fit:

"If quarrel subject of the procedure is the entrance toinformation, decisions of the Higher AdministrativeCourt with the complaint to the Federal Administrati-ve Court can be appealed against so. The rules of the13th section of the Administrative court order aboutthe revision find corresponding application."

b) The previous paragraph 2 becomes paragraph 3.

Article 5Change of the court costs law

§ 13 of the court costs law in the composure of the an-nouncement of the 15.12.1975 (BGBl I, p. 3047), at lastchanged through law by the 14.3.2003 (BGBl I, p. 345),is changed as follows:

"DTX" - PROJECT CONSULTDocument Technology Index

DTXThe DTX hunts the goal to document the market trendof the DRT-rung of the information technology sector.To that selected stock exchange noted providers areput together. In order to facilitate an appraisal of theDRT sector evolution, the DTX is opposed to that DAXand a reference index DTV. The DTV is based on theshare prices of the keyplayers from the informationtechnology sector. In addition single enterprises chang-ing regularly and their trends are included into theshare price arrangement. The DTX appears once perquarter.

The stock exchange quotations are understood in spiteof that for every month and expressed in the DTX. Inthis way can in particular stock exchange activities asfor example splits are pursued better.

The evolutions of DTX, DTV and DAX as well as theenterprises listed in the DTX and DTV are given to ef-fective immediately also in percent in order to be ableto express the value evolution more precisely. DTX andDTV reflect in future the average prozentualen modifi-cations of the enterprises again. Besides also theprozentualen modifications of the individual enter-prises are indicated. All prozentualen values alwaysrefer in this case to the values of the former quarter.
