Cox Communications, Inc. (“Cox”), by its attorneys, hereby submits its response to the

Commission’s public notice seeking comment on the proposed list of unserved census blocks.1

As shown below and in the attached materials, the Commission should revise the list to remove

census blocks that are served or serviceable by Cox and should reject Windstream’s analysis that

adds certain census blocks that Cox also can serve. As shown below, Cox has identified 531

census blocks that should be removed from the unserved areas list.

Introduction

Cox is a broadband, communications and entertainment company providing advanced

digital video, Internet, telephone and home security services over its network. Cox serves over

6.2 million subscribers and operates in hundreds of communities in 18 states.

Since 1996, Cox has invested more than $24 billion through infrastructure upgrades to

deliver video, phone and high-speed Internet service to homes and businesses in its service

areas. More than 99.5 percent of the households in Cox service areas have access to Cox high-

speed Internet, at some of the fastest broadband speeds available in the nation. Throughout all

Cox service areas, Cox offers broadband service with speeds that well exceed 3 Mbps/1 Mbps,

the minimum threshold to be deemed “served” for purposes of the Connect America Fund (CAF)

Phase I, round 2 review of carrier funding elections.

Cox supports CAF’s goal of extending broadband to parts of the country that are

unserved. Cox appreciates the efforts of the Commission to ensure that the Universal Service

funds available under the CAF are targeted toward those communities with the greatest need,

rather than to areas that already have access to broadband service.

Information on Served and Serviceable Areas on Initial Unserved Area List

To assist the Commission in ensuring that CAF funds are directed to truly unserved areas,

Cox is providing the information included herein in response to the elections of AT&T,

CenturyLink and Windstream for funding in areas already served or serviceable by

Cox. Consistent with the statutory requirement to expend funds only for projects in eligible

areas and the Commission’s rules requiring that CAF funding be made available only in areas

that do not have broadband service, this information should be used – along with information

from other broadband providers – to obtain a clear picture of service availability in the area

covered by carrier elections and to remove census blocks with available broadband service from

the unserved area list. The list of the census blocks (along with additional information

concerning the speed of available broadband services) is attached as Exhibit 1.

The first step in Cox’s analysis was to narrow the census block list provided in the

Bureau’s August 28 Excel spreadsheet to focus only on states in which Cox provides service and

only on those price cap carriers with which Cox potentially has overlapping service areas.

Focusing on the elections of AT&T, CenturyLink and Windstream, this initial step yielded

14,867 census blocks in Cox-served states where potential overlap with Cox service areas could

exist.

The next step in the process was to determine actual census block overlap. Cox’s node

boundary maps were used to identify overlapping census blocks. These maps depict the

coverage area of specific optical nodes and collectively define the geographic footprint where

Cox offers its services. Further, these maps are updated when capacity constraints or other

upgrades to Cox services require node splits and as Cox deploys additional nodes to expand its

geographic reach. These maps also are critical to Cox’s network and business operations and

consequently provide an accurate portrayal of Cox’s service area.

The process used to identify overlap involved layering census block and node boundaries

on top of each other in a GIS program, in this case, MapInfo Professional v12. Node boundaries

and census blocks are both closed polygon boundaries with unique IDs assigned to them. After

layering, a query is performed to identify where the two layers intersect and the corresponding

IDs from both layers where intersections occur are identified.

Using this process, Cox initially identified 587 census blocks where a Cox node boundary

intersected with the boundary of a census block included in the initial price cap carriers’

elections. These census blocks were then subject to further analysis. That analysis began by

identifying serviceable addresses within each census block at issue. A serviceable address

represents a location where Cox can, in general, immediately provide service without the

construction of significant physical plant. The determination is driven by guidelines relating to

proximity to existing network and by the type of construction involved (e.g., aerial or buried).

The process again involves layering as described above. In this case, census blocks represent a

boundary layer and addresses represent a point layer. A query then identifies all the address

points that fall within each census block.

The focused analysis yielded results that indicated that 468 census blocks included

addresses that are currently serviceable by Cox. These census blocks are being challenged by

Cox and are included in Exhibit 1.

The remaining 119 census blocks yielded no Cox serviceable addresses but did have

overlap with Cox node boundaries. For each of these census blocks, Cox performed an in depth

analysis to determine if the census blocks were actually served by Cox. This involved first

creating maps with layers that depicted the census blocks in question along with the intersecting

Cox node boundaries and other pertinent information such as major highways, address points,

physical plant facilities (fiber and coax), and satellite imagery. These maps were then shared

with local engineers and regulatory personnel in the appropriate state to confirm the physical

presence or adjacent proximity of Cox’s facilities in each census block. As a result of this

process, each of the 119 census blocks was categorized as either serviceable or unserved by Cox.

Cox’s analysis of the census blocks where no serviceable addresses were on record

revealed two primary situations. First, many census blocks are quite small in square mileage and

were found to be completely encompassed by Cox nodes and close enough to those nodes that

Cox would extend service to a customer in those areas upon request. Thus, although Cox may

have no current record of a serviceable address within that census block, Cox service is available

within these areas. A total of 72 census blocks fell into this category, of which 51 are included

in Cox’s challenge. The other situation involves census blocks on the edges of Cox’s current

footprint. As noted above, these census blocks were analyzed by local personnel and categorized

as either served or unserved by Cox. This categorization was driven by the presence, or lack of,

physical network plant located in the census block and the likelihood that Cox would provide

service in response to a request from a potential customer in the census block. A total of 47

census blocks fell into this category, of which only 12 are being included in Cox’s challenge.

Thus, Cox was conservative in its approach to challenging these types of census blocks. This

additional analysis added a total of 63 census blocks to the original group of 468 blocks with

Cox-served or -serviceable addresses.

Based on the analysis described above Cox has identified 531 census blocks depicted by

electing carriers as unserved that it is challenging. As noted above, all of these census blocks are

identified in Exhibit 1.

As described above, Cox’s process to identify census blocks to be challenged relied upon

current network node maps and real time analysis by local engineers. Consequently, this process

did not directly rely upon any particular version of the National Broadband Map. As part of its

regular process of updating its systems and network data to ensure ongoing accuracy, Cox has

made significant improvements in data it has provided for map updates since the June 2012

version of the map that price cap carriers relied upon in making their CAF elections. As a result,

some of Cox’s CAF challenges reflect the use of more current network deployment data than

would have been reflected on the 2012 version of the map.

There is additional commercially sensitive and proprietary data relating to this showing,

such as specific subscriber serviceable addresses in the census blocks and node boundaries that

Cox maintains. This data has been analyzed for additional corroboration of the information

contained in the attestations provided by senior management in the various Cox

markets. Because this information is commercially sensitive and not routinely disclosed by Cox,

it has not been included with this submission. Upon Commission request, however, Cox will

provide supplemental information to the Commission subject to confidential treatment.2

The information provided in this submission relates only to areas served or serviceable by

Cox, but it is apparent from Cox’s analysis that there are likely to be other areas outside the Cox

footprint that appear on the initial list but actually have broadband service available.

Consequently, Cox encourages the Commission to use independent due diligence to determine

the extent of other broadband service offerings in the proposed funded service area covered by

this submission if other providers fail to submit information prior to the submission deadline.

Response to Windstream Submission

Cox’s basic analysis, as described above, is sufficient to demonstrate that Cox offers

service in the challenged census blocks and effectively rebuts any unserved areas proposed by

Windstream for those blocks. Nevertheless, because Windstream’s submission includes 317

census blocks based on a porting analysis that were within the scope of Cox’s initial analysis,

and because Windstream generally proposes to use porting data as a proxy for determining

whether broadband service is available, Cox is providing additional comments on the

Windstream analysis.

Windstream’s challenges were based upon a porting analysis described in the declaration

of Christopher Raper in Windstream’s August 20, 2013, submission.3 As a threshold matter, the

analysis in this docket pertains exclusively to available competition for providing broadband

Internet services, not telephone services, while porting activity relates exclusively to telephone

services. Therefore, use of porting activity as a basis for Windstream’s submission is

fundamentally flawed.

Further, while ILECs and competitive providers can offer bundle packages that include

telephone services, in practice customers are not required to buy the whole bundle; indeed, Cox

customers often purchase broadband and video but keep their telephone service with the ILEC or

a wireless provider. Therefore, as the Commission itself has noted, Windstream’s analysis,

while of some interest, is by no means determinative of whether a particular census block is

served by a competitor.4

In addition, the Windstream analysis does not incorporate several important factors,

including the size and geography of the census block. Census blocks vary significantly in size,

with some blocks encompassing areas smaller than a city block. Others may include large areas,

such as city parks, where no potential customers are located. Given these factors, it is not

surprising that some, or many, census blocks may show no porting activity but yet are served by

competitors.

To illustrate this, a few data points provide some perspective. Of the 317 census blocks

resulting from Windstream challenges, 223 or approximately 70.6 % have areas of less than one-

tenth of a square mile. Further, 299 or approximately 94.6 % have areas less than 1 square mile.

In terms of serviceable addresses, 247 or approximately 78% are census blocks containing less

than 20 serviceable addresses. Even if one assumes that Windstream’s porting analysis is

accurate, these data points demonstrate that for the vast majority of Windstream’s challenged

census blocks it is entirely plausible that no ports may have occurred, even though the area is

indeed served by Cox.

Finally, Cox examined its porting data to evaluate the accuracy of Windstream’s claims

regarding the lack of porting data in specific census blocks. This process began with the creation

of an electronic file of all Windstream ports for the previous 18 months, which contained, among

other items, customer account number and zip code. Cox’s analysis focused on the Perry

exchange in Georgia, as Windstream challenged a number of census blocks in this area where

Cox currently has a significant number of serviceable addresses. Cox first identified specific zip

codes in the Perry area where Cox has significant coverage. Within these zip codes, Cox then

selected a random sample of 20 customer accounts for further analysis. Cox’s billing system was

then used to associate these customer accounts with a specific address. These addresses were

then “geo-coded” to identify the census block in which the address was located. These census

blocks were then compared to the census blocks included in Windstream’s submission to identify

any intersections. Of the 20 accounts examined, Cox’s data indicates that six were associated

with customer accounts in census blocks where Windstream indicated no porting had occurred.

This analysis demonstrates that the porting analysis conducted by Windstream is not a

reliable indicator of whether there is competition in a specific census block. There could be

many reasons why the Windstream analysis is unreliable, including that it considers only

customers who ported their number (and therefore excludes new customers who do not port their

numbers). Regardless of the reason, Cox’s analysis shows that Windstream’s approach failed to

recognize that broadband service was available from Cox in 30 percent of the census blocks

included in a random sample. Thus, the Windstream analysis cannot be used to determine

whether an area is unserved.

Conclusion

Cox appreciates this opportunity and, based on information provided herein, the census

blocks subject to this challenge should be deemed ineligible for CAF Phase I incremental

support.
