    Gabriel; JOHN JANO SIK, individually and in hisofficial capacity as the T reasurer of the City ofSan Gabriel; and DOE S 1 through 50, Inclusive,Defendants.

    1. Plaintiff SAN GA BRIEL POL ICE OFFICERS' ASSOCIATION ("SGPO A") isthe recognized exclusive bargaining representative for those em ployees of the City of SanGabriel ("the City") with the job classification of Police Officer. The SGPO A can sue an d besued in its name and on behalf of its members.

    2. Plaintiff MA RIAN A LVA REZ brings this claim on behalf of herself and all othersimilarly situated residents and taxpayers of the City of S an Gabriel. She is a resident of the C ityof San G abriel who is liable or has been liable within one year of the filing of this complaint forthe payment of taxes, assessmen ts and fees imposed and collected by the City.

    3. Defe ndant CITY OF S AN G ABR IEL ("the City") is a duly constituted municipalcorporation operating under the laws of the State of C alifornia, wholly situated in the County ofLos Angeles.

    4. Defendant CITY COU NCIL OF THE CITY OF SAN GAB RIEL ("CityCouncil"), the elected governing body of De fendant City, is responsible for establishing laws andpolicies in the condu ct of City business.

    5. Defendant DAV ID R GUTIERREZ is the Mayor and a Councilperson for the Cityof San Gabriel. Defendant G utierrez is named in both his official and individual capacities.

    6. Defendant KEVIN B. SAW KINS is the Vice-Mayor and a Councilperson for theCity of San Gabriel. Defendant Sawkins is nam ed in both his official and individual capacities.

    7. Defe ndant JULI COST ANZ O is a Councilperson for the City of San Gabriel.Defe ndant Costanzo is name d in both her official and individual capacities.

    17.egarding the special tax, Ordinance No. 540 of 194 8 authorized the City to:"...levy and collect annually...a special tax sufficient to raise the amountestimated...to be required to provide sufficient revenues to meet the obligationsof said City to said retirement system..." (See "Exhibit A" attached hereto.Emphasis added.)18. Based on information and belief, since the adoption of this special tax, the City

    has updated the tax by enacting annual rate-setting Resolutions.19. According to docum ents obtained by P laintiffs, every rate-setting Resolution

    enacted for the past eleven y ears, from fiscal year 2000-2001 through 2010-2011 , specificallyreferences the purpose of the tax as the "C ity's indebtedness to Public Employees' RetirementSystem as set forth in Ordinance N o. 540..." (See "Exhibit B" attached hereto.)

    20. Since at least fiscal year 2000-2001, and most likely beginning before that year,the revenue from this special tax has been p laced outside the City's general fund and into theCity's designated "Retirement Fund."

    21. Despite the enume rated specified purpose for the revenues generated from thisspecial tax, documents obtained by Plaintiffs show that the funds instead are being, and havebeen, diverted towards and use d for purposes other than the C ity's indebtedness and contractualobligations to PE RS for the benefit of its em ployees, and attracting and retaining qualifiedemployees f or the benefit of the C ity, and ultimately its residents, businesses and otherconstituents.

    22. Specifically, docum ents show that at least $5,714,280 from the C ity's RetirementFund has been diverted by D efendants to fund nume rous benefits for City staff personnel,including deferred co mpensation accounts and retiree m edical accounts. (See Exhibit C attachedhereto.)

    23. In addition, based on information and be lief, interest received from the special taxrevenue w as diverted to the City's General Fund by D efendants to assist in paying for City Staffcompensation increases.

    24. Based on information and belief, defendants MARSTON and PRESTONpersonally received these benefits, and thus personally benefit from the diversions from the C ityRetirement Fund.

    25. Upon inform ation and belief, Plaintiffs estimate that more than $5,714,280 hasbeen imperm issibly diverted from the City's Retirement Fund; the documents obtained byPlaintiffs only extend back to fiscal year 2000-2001.

    26. As a result of these diversions, the Retirement Fu nd has been de pleted to a pointwhere its continued solvency is in jeopardy, and as such the City's responsibility to fund itsPERS obligations is creating a fiscal crisis endangering the we ll-being of the City as a w hole.
