It is with great concern that i write to you today regarding the US . Department of Justice Office of Inspector General reports reviewing the Federal Bureau of Investigations (FBI) use of National Security Letters and Section 215 orders for business records. The reports, required by the USA Patriot Act, are a perfect example of the import cnce of independent oversight of the Administration and its programs. As the Ranking Member of the principal oversight committee of the House of Representative^ F believe shining a light qn deficiencies is ultimately t i e most effective way to strengthen a program

As you know, the House Oversight and Government Reform Committee pays particular attention to government management and information technology issues. My staff has regularly scheduled briefings on Sentinel. You and I have met personally to discuss FBI's IT systems and how best to bolster current and future projects. We both know that no system can be succcssfiil without proper internal management While I am encouraged by your public statements of accountability, I remain cautiously optimistic until FBI implements its plans to remedy the proccss errors and management weaknesses that occurred in utilizing national security letters, as well as Section 215 orders.

I ask that the FBI continue to keep my staff abreast of changes to the system and how corrective protocols are being implemented. Can you please send an email that says something like the attached to all the SACs. While normally SACs readily accept our offers for training, every once and a while we get some push back. I think an email from you would insure that doesn't happen.

To ensure that all agents and analysts who deal with national security letters understand fully the statutory limits and FBI policies on their use, OGC is developing a training module that will be loaded onto the virtual academy. They have also developed in service training on this subject. Any time an OGC attorney from the National Security Law Branch is in a field office for any reason, they will be providing an in-service training module on NSLs until all field offices have received the training. Please make this training mandatory for all employees who deal with national security letters.

The two promised get backs by the end of the week from the Director's hearing are (1) how many NSLs have been served on libraries or educational institutions, including the Connecticut letters; and (2)| | (actual exchange is below).

In 2005, the FBI issued national security letters to four Windsor, Connecticut librarians. Here's what they asked them to do: surrender all subscriber informal ion, biiling information and access logs of any person related to a specific library computer during a specific time period, according to press reports. But then the NISI, also prohibited the librarians from disclosing the tact that they received the NSL or its contents; a so-called gag order, under the Patriot Act So what you have is, if somebody sees area! abuse of an NSL (inaudible). 1 mean, that's like saying, "Let's check the records of everybody who showed up in this hearing today, every citizen who showed up, every member of the press or anybody else who came to this, but let's not tell anybody we've done it." If there's abuses, the very people who could uncover those abuses have been gagged, told they cant say what's going on. This is Kafka at the extreme. Did the FBI abuse its - two questions: Did the FBI abuse its authority in this Connecticut case? And how many times has the FBI issued NSLs to libraries or educational institutions to date?

There has been much confusion about the notion of filling the signed copy of the NSL in the investigative file and in a "control file". Per email from AD Hooton below, the second copy should NOT be put into a control file. DD Pistole is in agreement that the SAC should retain it in a drop file.

NSLs are generated in support of an investigative case and should therefore be filed with the investigative file.

Any office, including OGC may maintain a "convenience copy" for their counting or statistical purposes. This can be maintained as an electronic drop file or a paper drop file which can be destroyed when the owner of the drop file no longer needs or wants it.

Control Files are permanent files according to the FBI's records retention schedule and may never be destroyed. Control files also get transferred to the National Archives and Records Administration (NARA) at some point and because they are designated as permanent files will be maintained by NARA forever.

Classification 319 is for FBI administrative matters not investigative matters.

The guidance given in the below email to the SACs and CDCs to open control files to maintain these copies needs to be rescinded.

Let me clarify something. A copy of the signed NSL should be kept in the investigative file to which the request relates. In addition, a copy should be kept in a field-office wide control file so that all NSLs from a given office can be found in one place.

Details: ^4//OC/NF) The following telephone numbers were submitted to CAU under exigent circumstances by FBI field offices and headquarters operational personnel. Each target number was part of an existing FBI case, and at the time of request, the circumstances were considered exigent because of a threat to national security or harm to a U.S. citizen. For that reason, the search was done in advance of the issuance of an NSL, based upon the issuance of an exigent letter:

Talking Points for DD Pistole regarding DOJ/OIG findings

Use of Exigent Letters:

The DOJ/OIG found numerous instances of CAU obtaining telephone records from carriers by promising forthcoming legal process in the form of an NSL or a grand jury subpoena via an "exigent letter". CAU and NSLB are working to document that valid legal process issued with respect to all numbers so reguested. Further, NSLB informed CAU that it must file a notice of a potential IOB violation with respect to the "exigent letters" which issued as identified by DOJ/OIG.

OGC will issue guidance during the week of February 20, 2 007 proscribing the practice of obtaining telephone records with the promise of forthcoming legal process. In future, all FBI Divisions will be required to either issue NSLs, grand jury subpoenas, or obtain information under 18 U.S.C. 2702(c). Additionally, CAU has not utilized the old form of the Exigent Letter since May 2006 and unless the circumstances are genuinely exigent, CAU has required a National Security Letter (NSL) prior to obtaining telephone records from the telecommunications Companies.
