AN ACT TO AUTHORIZE THE GUAM FIRE DEPARTMENT TO HIRE RETIRED FIREFIGHTERS WHENEVER A CRITICAL NEED ARISES AS A RESULT OF MILITARY ACTIVATION.

I BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section I. Temporary Employment of Retired Guam Fire Department

3 Firefighters. The Guam Fire Department may hire retired firefighters when a

4 critical need arises as a result of military activation of firefighters of the Guam

5 Fire Department. The retired firefighter shall fill such a vacated position and

6 shall be terminated when the incumbent returns to his/her duty from the military

7 service. Retired firefighters may be hired only in the ranks of Fire Service

8 Specialist and below, only at Step 1, and shall not be entitled to sick and annual

9 leave. Retired firefighters hired under this Section shall first meet requirements,

10 except for written examinations, for the position for which they are being

11 considered and the Fire Chief shall certify that every retiree hired is fit for duty.

12 Notwithstanding Title 4 G.C.A. 8121 (a), retired firefighters temporarily hired

13 pursuant to this Section may continue to receive their retirement benefits.

I. Overview

The Committee on General Governmental Operations and Reorganization convened for a public heaiing at 10:00 a.m. , Monday, April 30, 2007 to receive testimony on Bill no. 92 (LS) An act to authorize the Guam Fire Department to hire retired firefighters whenever a critical need arises as a result of military activation.

Notice of the hearing was disseminated throughout all local media for announcement on Thursday, April 19, 2007 and was posted on Franklshizaki.com. Notice was also posted in the Pacific Daily News Government Meetings Section on Friday, April 27, 2007.

II. Summary of Oral Testimony

No testimony, either oral or written, was submitted to the Committee.

III. Findings and Recommendations

The Committee on General Governmental Operations and Reorganization finds that Bill 92 (LS) was crafted in order to address possible shortages within the Guam Fire Department that will occur when local firefighters who serve in the United States Armed Forces are activated. The Committee believes that this matter should have more discussion and is open for comment on the session floor. No testimony from any of the bill 's stakeholders was submitted. Therefore, it is the recommendation of the Committee that Bill 92 (LS) be REPORTED OUT ONLY.
