NOTICE TO APPLICANTS

1. A special exception is a use that would not be appropriate or without restriction throughout a zoning division or district but which, if controlled as to number, area, location, or relation to the neighborhood, would promote the public health, safety, welfare, morals, order, comfort, convenience, appearance, prosperity, or the general welfare. Such uses may be permissible in a zoning classification or district as a special exception if specific provision for such a special exception is made in the Zoning Regulations.

2. The following is required to be submitted along with the, appeal for a Special Exception:

a. site plans at an appropriate scale showing proposed placement of structures on the prope.._rty;provisions for ingress and egress, off street parking and off street loading areas, and refuse and service areas; and required yards and other open spaces;

b. plans showing proposed locations for utility. hook-up;

regulations place additional regulations on specific special exceptions, the petition should

demonstrate that such requirements are met.

3. Any person or persons, jointly or severally, aggrieved by any <iee*sron-·or- action of the Board of Adjustment may apply to the Board of County Commissioners for review of such decision within thirty (30) days after the rendition of the decision by the Board of Adjustment.

A Variance is a zoning adjustment which permits .minor changes or dimensional requirements where individual properties are both harshly and uniquely burdened by the strict application of the Zoning Regulations. The power to vary is restricted and degree of Variance is limited to the minimum change necessary to overcome the inetiuality inherent in the property. Use Variance are specifically prohibited. "Variance" means the modification of the dimensional requirements of a zoning district and does not include the substitution of uses assigned to other districts.

SIGNS POSTED FOR BOARD HEARINGS.

The Columbia County Zoning Regulations require that properties for which a Land Use Change, Zoning Change, Special Exception, or Variance is requested' must be posted by the Building and Zoning Department for a minimum period of one week prior to the Planning and Zoning Board's hearing. Once the property is posted, it is the property owner's responsibility to keep the property posted until after the final hearing of the Planning and Zoning Board. If the request .is one that must also be heard by the Board of County Commissioners, then it continues to be the property owner's responsibility to keep the property posted until after the final hearing of that Board.

In the event the signs are moved, removed from the property, torn down, defaced, or otherwise disturbed, the applicant/property owner must immediately notify the Building and Zoning Department so that the property can be reposted. If the property is not properly posted until all hearings of the Planning and Zoning Board and/or the Board of County Commissioners are completed, both Boards reserve the right to table a discussion on the request or continue the hearing until such time as the property is properly posted for the required period.

1. A Variance recognizes that the same district requirements do not affect all properties equally; it was invented to permit minor changes to allow hardship properties to enjoy equal opportunities with properties similarly zoned. You must prove that your land is affected by special circumstances or unusual conditions. These must result in uncommon hardship and unequal treatment under the. strict application of the Zoning Regulations. Where hardship conditions extend to other properties a Variance cannot be granted. The remedy for general hardship is a change of the map or the text of the Zoning Regulations.

2. You must prove that the combination of the Zoning Regulations and the uncommon conditions of your property prevents you from making any reasonable use of your land as permitted by your present zoning district. Since zoning regulates land and not people, the following conditions cannot be considered pertinent to the application for a Variance: (1) Proof that a Variance would increase the financial return from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last case, the recognition of conditions created after the enactment of the Zoning Regulations would encourage and condone violation of the law.

3. No Variance may be granted which adversely affect surrounding property or the general neighborhood. All Variances must be in harmony with the intent and purposes of the Zoning Regulations.

4. An appeal from a decision of the Board of Adjustment may be taken to the circuit court having jurisdiction in the County for judicial relief within thirty (30) days after the rendition of the decision by the Board of Adjustment.

1. A Variance recognizes that the same district requirements do not affect all properties equally; it was invented to permit minor changes to allow hardship properties to enjoy equal opportunities with properties similarly zoned. You must prove that your land is affected by special circumstances or unusual conditions. These must result in uncommon hardship and unequal treatment under the. strict application of the Zoning Regulations. Where hardship conditions extend to other properties a Variance cannot be granted. The remedy for general hardship is a change of the map or the text of the Zoning Regulations.

2. You must prove that the combination of the Zoning Regulations and the uncommon conditions of your property prevents you from making any reasonable use of your land as permitted by your present zoning district. Since zoning regulates land and not people, the following conditions cannot be considered pertinent to the application for a Variance: (1) Proof that a Variance would increase the financial return from the land, (2) Personal hardship, (3) Self-imposed hardship. In the last case, the recognition of conditions created after the enactment of the Zoning Regulations would encourage and condone violation of the law.

3. No Variance may be granted which adversely affect surrounding property or the general neighborhood. All Variances must be in harmony with the intent and purposes of the Zoning Regulations.

4. An appeal from a decision of the Board of Adjustment may be taken to the circuit court having jurisdiction in the County for judicial relief within thirty (30) days after the rendition of the decision by the Board of Adjustment

In April 2010, myself, C&G Homes salesman Kevin Jones, customers Charles Brown and Dean Jarvenpaa, contractors Brian Timmerman and Larry Parrish met at the above mentioned property for the laying and stacking out preparation for placement ofa mobile home. The customers were informed from the entity (bank or realtor) that they purchased the property from where the approximate property boundaries were. There was no boundary survey required by First Federal Bank, who holds the new mortgage note. The only documentation I had to confirm the approximate location of property boundaries was the recorded plat and property appraiser aerial. I used the measurements from the plat on the property to the north to locate the whereabouts of the north (side) property line to the best of my ability. The site was stacked out accordingly with the attached measurements to the " assumed property lines" . All required permits were obtained through the county. The home was set according to all USDA Requirements; to include concrete foundation, concrete stem wall, concrete driveway and concrete side walk. The county and city utility inspections were completed, passed and Certificate of Occupancy was issued. First Federal Savings Bank then completed their final survey for closing purposes. At this time it was discovered that the concrete driveway was sitting on the property to the north, owned by Freedom Homes/Steve Smith and also that the front comer of the home was 3.9' into the required building setback. .

I personally went to Steve Smith of Freedom homes to ask if we could do some property swapping, maintaining the same acreage, just skewing the line. He asked me to get a drawing showing the proposed property lines. I hired Daniel & Gore to show us how we could skew the line maintaining same acreage and getting our customers driveway and home to meet all requirements. He was not interested in assisting us with the issues at hand. C&G Homes then offered Freedom Homes $5,000 to skew the line for an even property exchange. He still did not accept our offer. Steve Smith then 2 weeks later approaches C&G Homes with a counter offer of $15,000 for the same proposal. We could not justify $15,000 for an even exchange of property. At this time, we took up the concrete driveway and moved it to the other side of the home at my expense. We now are in need of satisfying the bank on the building set back issue. The costs ofmoving a mobile home on concrete footers with a concrete stem wall are extremely high and I thank you for your sincere consideration on a variance for the building setback.

NOTICE TO APPLICANTS

A Variance is a zoning adjustment which permits .minor changes or dimensional requirements where individual properties are both harshly and uniquely burdened by the strict application of the Zoning Regulations. The power to vary is restricted and degree of Variance is limited to the minimum change necessary to overcome the inequality inherent in the property. Use Variance are specifically prohibited. "Variance" means the modification of the dimensional requirements ofa zoning district and does not include the substitution of uses assigned to other districts.

1. A Variance recognizes that the same district requirements do not affect all properties equally; it was invented to permit minor changes to allow hardship properties to enjoy equal opportunities with properties similarly zoned. You must prove that your land is affected by special circumstances or unusual conditions. These must result in uncommon hardship and unequal treatment under the. strict application of the Zoning Regulations. Where hardship conditions extend to other properties a Variance cannot be granted. The remedy for general hardship is a change of the map or the text of the Zoning Regulations.

2. You must prove that the combination of the Zoning Regulations and the uncommon conditions of your property prevents you from making any reasonable use of your land as permitted by your present zoning district. Since zoning regulates land and not people, the following conditions cannot be considered pertinent to the application for a Variance: (I) Proof that a Variance would increase the financial return from the land, (2) Personal hardship, (3) Seli.imposed hardship. In the last case, the recognition of conditions created after the enactment of the Zoning Regulations would encourage and condone ,iolation of the law.

3. No Variance may be granted which adversely affect surrounding property or the general neighborhood. AJI Variances must be in harmony with the intent and purposes of the Zoning Regulations.

3. An appeal from a decisim of the Board of Adjustment may be taken to the circuit court having jurisdiction in the County for judicial relief within thirty (30) days after the rendition of the decision by the Board of Adjustment.

SIGNS POSTED FOR BOARD HEARINGS .

The Columbia County Zoning Regulations require that properties for which a Land Use Change, Zoning Change, Special Exception, or Variance is requested' must be posted by the Building and Zoning Department for a minimum period of one week prior to the Planning and Zoning Board's hearing. Once the property is posted, it is the property owner's responsibility to keep the property posted until after the final hearing of the Planning and Zoning Board. If the request .is one that must also be beard by the Board of County Commissioners, then it continues to be the property owner's responsibility to keep the property posted until after the final hearing of that Board.

NOTICE TO APPLICANT The Board of Adjustment shall have power to authorize upon appeal such variance from the terms of these land development regulations as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of these land development regulations will result in unnecessary and undue hardship.

In granting any variance to the provisions of Article 4 of these land development regulations, the Board of Adjustment may prescribe appropriate conditions and safeguards in conformity with such regulations, including but not limited to, reasonable time limits within which the action for which variance is requested shall be begun or completed, or both. Violation of such conditions and safeguards, when made a part of the terms under which the variance is granted, shall be deemed a violation of these land development regulations.

Under no circumstances shall the Board of Adjustment grant a variance to permit a use not permitted under the terms of these land development regulations in the zoning district involved, or any use expressly or by implication prohibited by the terms of these land development regulations in the zoning district. No nonconforming use of neighboring lands, structures, or buildings in the same zoning district and no permitted use of lands, structures, or buildings in other zoning districts shall be considered grounds for the authorization of a variance.

The Board of Adjustment requires that the applicant or representative be present at the public hearing to address and answer any questions the Board may have during the public hearing. The application may be continued to future dates if the applicant or representative is not present at the hearing.

Fourteen (14) copies of a site plan must accompany an application for a Variance.

The Columbia County Land Development regulations require that a sign must be posted on the property ten (10) days prior to the Board to Adjustment hearing date. Once a sign has been posted, it is the property owner's responsibility to notify the Planning and Zoning Depa1tment if the sign has been moved, removed from the property, torn down, defaced or otherwise disturbed so the property can be reposted. If the property is not properly posted until all public hearings before the Board of Adjustment are completed, the Board reserves the right to continue such public hearing until such time as the property can be property posted for the required period of time.

There is a thirty (30) day appeal period after the date of the decision. No additional permitting will be issued until that thirty (30) day period has expired.

GENERAL NOTES 19. The constru~tion plans m.ust be reviewed and approved by Columbia County prior1. The contractor shall verify all existing conditions and dimensions at the job to commencing construction.site to insure that all new work will fit in the manner intended on the plans.

Should any conditions exist that are contrary to those shown on the plans 20. All materials and construction shall conform to the requirements of the FOOT Standardthe contractor shall notify the engineer and Columbia County, Florida ' Specifications for Road and Bridge Construction . (Department of Growth ~ anagement) of such differences immediately & prior to proceeding with the work. 21 . The materials and construction shall be certified by a testing laboratory retained by the

contractor. Copies of all test results shall be proviaed prior to acceptance.2. The contractor shall maintain the construction site at all times in a secure manner. All open trenches and excavated areas shall be protected from access 22. All traffic control and safety items (striping, stop bars, regulatory signs, etc .) shall beby the general public. in place before final Certificate of Occupancy.

3. Boundary and topographical information shown was obtained from a survey 23. The temporary grass shall be sufficient to control erosion during periods of constructionperformed by Donafd F. Lee & Associates, Inc., P.S.M. Florida Certificate when earth work areas are left for more than 7 calendar days. #7042. 24. Final inspection for acceptance to be performed by GTC Design Group and Public 4. Any public land corner within the limits of construction is to be protected. Works Director. 5. Contractor shall contact GTC Design Group, LLC and Department of Public Works for Columiba County to preform site inspections. No Certificate of Occupancy will be issued for any developments that do not receive the following inspections.

A. Erosion & sediment control inspection (prior to commencin9 construction) B. Completion of clearing and grubbing (GTC visual site visit)(no test requirements)C. Rough Grading and Drainage Structures and pipes in place (Density and LBR

6. Contractors shall adhere to the Erosion Control Plan. All erosion control measures shall be implemented prior to construction and be continued until construction is complete. Any failure of erosion measures must be corrected immediately per SWPPP.

7. All disturbed areas not sodded shall be seeded with a mixture of long-termvegetation and quick-growing short-term vegetation for the following conditions. For the months from September through March, the mix shall consist of 70 pounds per acre of long-term seed and 20 pounds per ncrc of winter rye. For the months of April through August. the mix shall consist of 70 pounds per acre of long-term seed and 20 pounds per acre of millet.

8. A pad of rubble riprap shall be placed at the bottom of all collection flumes and collection pipe outlets.

9. Existing drainage structures within the construction limits shall be removed (1) #f> CONT. W/ ~.. unless otherwise specified in the plans. ' CL!:.ARANCE FROM

11 . All site construction shall be in accordance with the Columbia County Land Development Regulations.

12. Contractor shall provide an as-built survey meeting the requirements of Chapter61G17 F.A.C. for the stormwater management systems. Include horizontal and vertical dimensional data so that Improvements are located and delineated relative lo the boundary. Provide sufficient detailed data to determine whether the improvements were constructed in accordance with the plans. Submit the survey 4" THICK 3000 PSI CONCRETE to the engineer on reproducible 20 lb. Vellum. WI 6X6 W1 .4 X W1 .4 WWM

OVER COMAPCTED FILL13. Contractor shall review and become familiar with all required utility connections

prior_ to bidding and determine exact location during construction . Contractor shall provide all work and materials required to complete connection to the existing utilities. VAPOR BARRIER

The location of the utilities shown in the plans is approximate only. The exact location shall be determined by the contractor during construction. This includes, but is not limited to, manhole coring, wet taps, pavement repairs and directional boring . SIDEWALK TYPICAL SECTION

NTS 14. Contractor shall coordinate all work with other contractors within project limits.

15. Contractor shall seed and mulch all disturbed areas, and shall sod all slopes of 5' horizontal to 1' vertical to 3' horit:ontal lo 1' vertical and shall staple sod all slopes steeper than 3' horizontal to 1' vertical.

16. All swales, depression areas and retention ponds shall be inspected monthly for sinkhole occurrence. Should a sinkhole occur, the area should be repaired as soon as possible. If a solution pipe sinkhole does form in the stormwater system, then the sinkhole shall be repaired by backfilling with a lower permeability material. A 2-foot cap that extends 2 feet beyond the perimeter of the sinkhole shall be constructed with clayey so.ils . The clayey soil should have at least 20% passing the number 200 sieve, compacted to 95% of Standard Proctor, and compacted in a wet condition with moisture 2%-4% above optimum. The claysoil cap shall be re-graded lo prevent ponding and re-vegetated.

17. All stormwater pipes shall have a minimum cover of 6". Use Limerock backfill if pipeunder pavement has less than 12" cover.

18. Potable water will be supplied by an existing on site well and sanitary sewer will be supplied by on-site septic system.

EROSION CONTROL NOTES

DIVERSION RIDGE REQUIRED WHERE GRADE EXCEEDS 2%

1. Contractor shall adhere to Columbia County, SRWMD and other governing authorities for erosion and sediment contror regulations. Contractor shall use BMP's from "The Florida Development Manuar.

2. Sediment and erosion control facilities, storm drainage facilities and detention basins shall be installed prior to any other construction.

3. Erosion control measures shall be inspected weekly and after each rainfall and replaced as necessary.

4. Sediment and erosion control measures shall not be removed until all construction is complete and until a permanent ground cover has been estahlisherl .

5. All open drainage swales shall be grassed and riprap shall be placed as required to control erosion.

6. Silt fences shall be located on site to prevent sediment and erosion from leaving right-of-way limits.

7. Additional erosion control devices shall be used as required.

8. Silt fence shall be cleaned or replaced when silt builds up to within one foot of top of silt fence.

9. During construction and after construction is complete, all structures shall be cleaned of all debris and excess sediment.

10. All grades areas shall be stabilized immediately with a temporary fast-growing cover and/or mulch.

11. Apad of rubble riprap shall be placed at the bottom of all collection numes and collection pipe outlets.

12. All disturbed areas not sodded shall be seeded with a mixture of long-termvegetation and quick-growing short-term vegetation for the followin_gconditions. 13. Staked silt fences shall be placed near all box culvert extensions in accordance with FOOT Standard Index 102.

14. Disturbed areas with shall be stabilized by sodding, grassing, and mulc~ing. All side slopes steeper than 4:1 shall be adequately protected from erosion through the use of hay bales or sodding.

15. All stabil1zation practices shall be Initiated as soon as practlcable In areas of the job where construction activities have temporarily or permanentlystopped. but in no case shall the disturbed area be left unprotected for more than seven (7) days.

16. If the prorosed erosion control plan does not work, the contractor should use the BMP sin the Florida Erosion and Sediment Control lm~pecor's manual lo implement a plan that will work and meet actual field conditions.

17. All waste generated on the project shall be disposed of by the contractor in areas provided by contractor.

18. Loaded haul trucks shall be covered with tarps.

19. Excess dirt shall be removed daily.

20. Fertilizer shall be applied as specified in the plans and specifications.

21. This project shall comply with all water quality standards. Permit required rrom SRWMD has been obtained.

22. All pollution controls shall be maintained at all times.

23. Type IV silt fence shall be placed to prevent sediment. Slit fence shall be replaced after three (3) months or when sediment reaches one-half (1/2) the height of the fence.

24. Qualified personnel shall inspect th~ area used fo_r storage of sto~kpiles,. the silt fence and straw bales. the location where vehicles enter or exit the site, and the disturbed areas that have not been finally stabilized, at least once every seven (7) calendar days and within 24 hours of the end of a storm of 0.2 inches or greater.

25. Sites that have been finally stabilized with sod or grassing shall be inspected at least once every week.

26. Contractor ls responsible for the construction and maintenance of all erosion and sedimentation controls during proposed construction.

The meeting opened at 7:00 P.M. with prayer and the pledge of Allegiance to the Flag of the United States of America.

Jordan: Removed himself from the voting on the matter as he believes that he has a potential conflict concerning this application and the proposed location of the telecommunications tower.

Gerald Muldowney: Civil engineer representing Towercom on behave of Charles Graham. Identify that

the carrier for this tower is AT&T. Also present tonight is Dave Beoff CEO of Towercom and he has a brief presentation for you tonight. The tower is a co-location tower and is designed to hold a total of 6 carries. We believe that we have meet the County's codes concerning this tower and are not asking for any types of variances. Our main concern tonight is the report from the County tower consultant recommending denial of the application as there is an existing tower to the south that they could co-locate on and pretty much achieve the required coverage needed. Our concern is that this location would cut down on the performance of the network that AT&T is trying to achieve. It will follow all of the FF A regulations including the duel lighting of the tower, white during the day turning to red at dusk. We would like to you at least consider what we have to present here tonight.

Dave Beoff: CEO of Towercom, we are a co-location developer out of Jacksonville. Has built and constructed approximately 300 types of cell, wireless and broadcast type towers. have handed out to you a map that shows the 1-10/1-75 area with a SAR. An SAR is basically a site area request. The AT&T engineers look at their complete network and adjacent site and try to determine the optimal location for a tower where the network will perform best. Often time it is not possible to be at that location. Sometimes

those points are in lakes, middle of a building, they don't take into account any existing geographic features. In a rural area they like to find a location within a % mile of that SAR point and this location is within that radius and the closest we can get to that point the more optimal the network will perform. AS you can see our proposed location is within that% mile ring. If you look at the map you will see the American Tower Com. (ATC) location which is located right off of 1-75. This site was considered but because it was located outside of the ring they were hoping to find a site within the ring. Mr. Peters and I have known Art for a very very long time way before cellular hit the area before 1987. He is a very very good engineer, nationally renound and an expert in his field. What I would like to point out is that whenever you are doing range propagation usually definition of propagation is probable it is not exact. Until the system actually goes operation it is hard to determine just how well it will work. Sometimes it exceeds expectations sometimes it does not. All you can do is get a probable high percentage of probability. Because of this inexactness, it is very important to get as close to that main SAR point as possible. It is real logical. Our site is close to the SAR and within the % mile search ring while ate American tower site is not. Mr. Peters report states that that the ATC site would work. Working with AT&T and speaking on behalf of AT&T, yes the ATC tower will work but define work. Our site will provide the absolute best possible coverage for AT&T along this corridor. If you drive to Jacksonville on 1-10 you may notice that the placement of towers are usually within 1500 feet of the interstate the nobody tries to cover it from l.3miles away which is where the A TC tower is in relationship to 1-10. Many times we have to go to a site that may not be optimal. There are a lot of different criteria that has to be considered. This situation is not the case there is an optimum site and the AT&T engineers who designed the system believe this to be the best site. While Mr. Peters is an excellent engineer and I would never doubt his abilities but, he is not AT&T's engineer and AT&T engineers state that this site will work optimally. In summary the American tower will work but will not work optimally for what the AT&T engineers have designed to accomplish their objectives. All we ask is that you consider letting us build this site so we can provide the optimal coverage. Are there any questions I may be able to answer? Thank you very much.

Huey Hawkins: Civil Engineer representing Richardson Site Prep for a site located just west of Ft.

White on U.S. Highway27. About 4 years ago a permit was received for the north side of US. Highway 27. Several 100 of years they dug phosphate mines dug and they

piled up sand around so they could get down to where the phosphate was at. The permit was issued 4 years ago was to basically level the hill down. This is essentially the same thing we are requesting here tonight except for the south side of U.S. Highway 27. We have answered all the questions on the application the other question that Brian has brought up is if we have a water management permit for this. I spoke this afternoon with Mr. Leroy Marshall with the Water Management District and conveyed to him exactly what I just told you, we would not be digging a whole we will simply taking the sand out we will not be digging it below the w natural grade. In the application we gave an elevation the southwest corner which approximately the natural ground elevation we would not go below that elevation. I'll be happy to answer any questions the board may have.

Jordan: How much of the property are you going to be digging?

Hawkins: If you look at the northwest corner of the property there is a hole about 80 feet deep. We would be removing the dirt from the area around there approximately 10 acres or so.

Jordan: I'm a lawyer and I was look at the regulations and they require signed and sealed borings for this application?

Hawkins: What we provided to Brian was a topographic map showing the hole location and the area with the elevation of the southwest corner. Did not include any as we are not going below the existing grade of the southwest corner with a 92 foot elevation benchmark.

Jordan: How much of the property of the property were you planning on digging?

Hawkins: The old mine is in the northwest corner taking up approximately 6 acres of the property. We would have to stop at our property line.

Jordan: What type of slope would you leaving?

Hawkins: It would be a very gradual slope like a 4 to 1.

Kepner: May I interject. That would all be part of the restoration once they were completed with the digging. The regulations spell out the requirement for the restoration of the property.

Jordan: What type of vegetation will you used?

Hawkins: It will be put back in a natural grass.

vertical and in a way to minimize erosion due to rainfall, break up long uninterrupted slopes and make the surface suitable for vegetation. Vegetation shall be appropriately planted to prevent erosion."

Jordan: How long do you do you think this will be in operation?

Hawkins: It will probably be over the next 2 years depending upon business.

Jordan: Does DEP get involved?

Hawkins: No sir.

Jordan: Brian made some recommendations from the County Planner concerning the operation of the borrow pit. Have you seen them? They recommend that hours of operation be limited to and that there be a 25 foot buffer along the west side of the property.

Hawkins: We would be willing to meet any other County requirements.

Feagle: Any other question from the Board. Open up for the public hearing.

Todd Jenkins: I have a few questions. The back side of the property is an easement SW Angel Glen. Will this impact the easement? Was wondering how we can be assured that there would be no dumping?

Jordan: Is that a county maintained road?

Jenkins: No, it is private.

Pete Richardson: Angel Glen turns off U.S 27 as soon as you tum of you tum into the pretty and I try and

help keep that portion of the road graded for access. As far as dumping of course I am regulated by code enforcement, DEP and everybody else. I get called and complained on all the time so there is always somebody there checking on me.

Jordan: Would you mine so close to the road that it would undermine the road?

Richardson: No I won't if the elevation provides that I can go to the property line it will have the 4 to 1 slope and the If anything it will be deeper on my side than on the roadside.

Jenkins: Pete has been a good neighbor.

Ramsey Kassess: I own property just to the west of the site. I was concerned with a buff er on that side,

which the County may have already addressed. Was that to be 25 feet?

Jordan: This is a good place for a borrow pit. I will try and make the motion that will address the concerns that we have been talking about. Motion to approve BPSP 10-01 with the following conditions; ( 1) placement of planted 25 foot buffer on the west side of the property, (20 limit hours of operation from sunup to sun rise, (3) subject to a bond approved by the County Attorney and to stay in effect for 1 year after restoration and (4) subject all conditions of restoration as listed in the LDR' s.
